Few studies exist which look at psychological factors associated with physician sexual misconduct. In this study, we explore family dysfunction as a possible risk factor associated with physician sexual misconduct. Six hundred thirteen physicians referred to a continuing medical education (CME) course for sexual misconduct were administered the FACES-II survey, a validated and reliable measure of family dynamics. The survey was part of a self-learning activity. We collected data from February 2000 to February 2009. Participants were predominantly white, middle-aged males (...) who represented the full range of medical specialties. Their results were compared against a sample of 177 physicians. The FACES-II is a self-report test that measures family of origin (the family in which one was raised) dynamics on two dimensions (1) flexibility, ranging from too flexible (chaotic) to not flexible enough (rigid) and (2) cohesion ranging from too close (enmeshed) to not close enough (disengaged). The most common family pattern observed among physicians accused of sexual misconduct was rigid flexibility paired with disengaged cohesion, indicative of unhealthy family functioning. This pattern was significantly different than the pattern observed in the comparison group. Physicians who engage in sexual misconduct are more likely to have family of origin dysfunction. Ethics is developmental and learned in one’s family of origin. Family of origin dynamics may be one risk factor predisposing one to ethical violations. These findings have important implications for screening, education, and treatment across the medical education continuum. (shrink)

Although there is much discussion in scientific and law journals regarding direct-to-consumer genetic testing (DTCGT), there is a paucity of philosophical-ethical examination of how such services threaten to repeat the essentialist, racial-projects of the past. On the one hand, testing for ancestry can be cathartic: for those lacking familial history as to when and how they came to be where they are, DTCGT can offer powerful access to their lineage and identity-formation. On the other hand, DTCGT inevitably reinscribes problematic epistemologies (...) of race—even when the companies claim that their tests can be tools to combat white supremacy. Tracing the roots of biological essentialism back to Aristotle, through the invention of raza as cocreator of modernity, and up to critical race theories today, provides a strong foundation to examine the nascent race-thinking underlying DTCGT. Borrowing heavily from Paul Taylor and Charles Mills, but also enlisting scholars from other disciplines, such as Ifeoma Ajunwa (law), Alondra Nelson (sociology), and Troy Duster (genetics), provides the broad scope necessary for thoughtful, agile engagement of that which is ameliorative, unethical, and even dangerous—for all of us—in the age of 23andMe. Is the history of philosophy primarily a contribution to PHILOSOPHY or primarily a contribution to HISTORY? This paper is primarily contribution to history (specifically the history of New Zealand) but although the history of philosophy has been big in New Zealand, most NZ philosophers with a historical bent are primarily interested in the history of philosophy as a contribution to philosophy. My essay focuses on two questions: 1) How did New Zealand philosophy get to be so good? And why, given (...) that is so good (a point I am at pains to establish), has it apparently had so slight a cultural impact within New Zealand itself? Did we get the wrong Anderson – the uninspiring William, who was Professor at Auckland, rather than his talented younger brother John, who had such a huge cultural influence as Professor of Philosophy at Sydney? Perhaps but that can only be part of the story since we managed to attract even bigger stars, (notably Karl Popper) as well as breeding bigger talents of our own (Prior, Baier, Bennett, Mulgan, Hursthouse, Waldron and many more). Do we export our best talent? Sometimes – but the stars that stay and the stars who arrive don’t seem to have much impact in New Zealand itself however brightly they shine in the international philosophical firmament. Is it too esoteric? Perhaps, but esoteric philosophy can still have a cultural impact, witness, Moore, Popper and the younger Anderson. Is it, like many of New Zealand’s cultural products (from romance novels to movies), primarily intended for an international audience? That’s a large part of the answer but only a part. Another part of the answer is that philosophy HAS had a cultural impact but that impact is not readily apparent. For NZ philosophers have been less keen to push their ideological barrows and more keen to produce critical thinkers, and critical thinkers don’t all think alike. The logician George Hughes was apparently a life-changing teacher not because he had a nostrum but because he taught people to think. As one of his students said ‘the only ism you believe in is the syllogism’. On the whole the history of New Zealand Philosphy is a ‘From Log Cabin to White House’ tale, ‘From colonial obscurity through struggle and adversity to philosophical excellence’. But there are shadows in the picture. Some departments have nearly come to grief through bureaucratic and political misadventures, and it is hard to resist the suspicion that there is often an element of hostility to philosophers on the part of both university bureaucrats and fellow-academics. I speculate as to why this is the case (we are too argumentative and don’t confine our argumentative tendencies to the cloister) but conclude with some upbeat reflections. on the future of New Zealand Philosophy. American democracy faces severe challenges today, as everyday life gathers pace, national borders become increasingly porous, and commodity culture becomes more dominant. Democracy and Vision assembles a cast of prominent political theorists to consider the problems confronting political life by reviewing, assessing, and expanding on the ideas of one of the most influential political thinkers of the past forty years, Sheldon Wolin. The book consists of three sections linked by the underlying theme of Wolin's monumental effort to define ''the political'' (...) and the conditions of democratic life. In the first, Nicholas Xenos, George Kateb, Fred Dallmayr, and Charles Taylor focus, in particular, on whether mass political participation, sustainable in times of upheaval as what Wolin aptly termed ''fugitive democracy,'' can be buoyed by political institutions during periods of stability. In the second section, Wendy Brown, Aryeh Botwinick, Melissa A. Orlie, and Anne Norton examine the relevance of Wolin's ideas to current debates about, for example, social diversity and the commercialization of culture. In the last, Stephen K. White, Kirstie M. McClure, Michael J. Shapiro, and J. Peter Euben address globalization and temporality in relation to Wolin's narrative of decline, asking, among other things, whether citizenship today must incorporate a cosmopolitan dimension. _The Hidden God_ revisits the origins of American pragmatism and finds a nascent "posthumanist" critique shaping early modern thought. By reaching as far back as the Calvinist arguments of the American Puritans and their struggle to know a "hidden God," this book brings American pragmatism closer to contemporary critical theory. Ryan White reads the writings of key American philosophers, including Jonathan Edwards, Ralph Waldo Emerson, William James, and Charles Sanders Peirce, against modern theoretical works by Niklas Luhmann, Richard (...) Rorty, Jacques Derrida, Sharon Cameron, Cary Wolfe, and Gregory Bateson. This juxtaposition isolates the distinctly posthumanist form of pragmatism that began to arise in these early texts, challenging the accepted genealogy of pragmatic discourse and common definitions of posthumanist critique. Is the critique of modern, liberal subjectivity warranted, and, if so, how do we proceed in its aftermath? This article clarifies the ways in which such a critique is valid, as well as the ways in which it both misses its mark and gives us little in the way of resources for thinking further about subjectivity. I argue that thinking in the aftermath must articulate a weak ontological portrait of subjectivity that vivifies the value of both political generosity (emphasized by (...) critics like William Connolly) and equal respect (as emphasized by the defenders of liberalism like Charles Larmore). The corporatization of U.S. health care has directed cost containment efforts toward scrutinizing the clinical decisions of physicians. This stimulated a variety of new utilization management interventions, particularly in hospital and managed care settings. Recent changes in fee-for-service medicine and physicians' traditional agency relationships with patients, purchasers, and insurers are examined here. New information systems monitoring of physician ordering behavior has already begun to impact on physician autonomy and the relationship of physicians to provider organizations in both for-profit and not-for-profit (...) sectors. As managed care practice settings proliferate, serious ethical questions will be raised about agency relationships with patients.This article examines health system dynamics altering the historical agency relationship between the physician and patient and eroding the traditional autonomy of the medical profession in the United States. The corporatization of medicine and the accompanying information systems monitoring of physician productivity is seen to account of such change, now posing serious ethical dilemmas. (shrink)

A patient is not always told when a student is performing a procedure for the first time. Withholding this information is a form of deception. It is justified on paternalistic grounds (it is in the patient's interest not to know), or on public policy grounds (given the choice, patients would refuse, thus compromising the training of future physicians). Using the spinal tap procedure (lumbar puncture) as a paradigm, 173 patients were surveyed to determine how they felt about first time procedures (...) by medical students, interns, and residents. The patients indicated that they would be willing to be the subject for a student's (52%), intern's (62%), or resident's (66%) first spinal tap. This paper reassesses the ethics of consent for first time procedures based on responses to this survey. (shrink)

The idea of role‐playing makes some people nervous – even some people who play role‐playing games (RPGs). So the idea of immersion is central to understanding how Dungeons Dragons and other aspects of participatory culture work. Phenomenology is a kind of “philosophy of mind” associated with the works of twentieth‐century philosophers Edmund Husserl, Martin Heidegger, Jean‐Paul Sartre, and Maurice Merleau‐Ponty, among others. The domain of phenomenology encompasses the entire range of experiences in the world, paying attention to what Husserl called (...) “intentionality,” or how our consciousness is directed toward particular objects in the world. The fact that this is presented as an atypical approach to play, or at least one that requires some effort, invites us to ask about typical modes of play if visualization of in‐game events is not that mode. This chapter concluded by scratch the surface of a complete phenomenological description of role‐playing. (shrink)

This dissertation elaborates and defends a certain broad orientation in the philosophy of mind---the inferentialism of Sellars and Brandom---and explores the striking consequences of that orientation for the field of practical reason. Inferentialism aims to understand the significance of various philosophically important concepts in terms of their role in inference. In the first part of the dissertation, I use an analysis of inference to draw a distinction between two types of practical reasoning: reasoning that takes facts as reasons for acting, (...) and reasoning that takes practical attitudes as reasons for acting. I argue that once we take a contextualist, non-foundationalist approach to practical reasoning---and we should---we realize that neither form of reasoning is more fundamental or primary than the other. This leaves behind a number of current debates between Humeans and their opponents. In the second part, I examine three important, practically-oriented mental states: intentions, evaluative beliefs, and desires. Using their role in practical reasoning as a guiding thread in my analysis, I arrive at novel accounts of each. I analyze intentions as practical commitments, the linchpin of practical reasoning, and reveal their deep connection with beliefs. Desires are understood in terms of intentions, reversing the usual direction of analysis, while evaluative beliefs are approached via a distinction between acknowledging and attributing practical states. Theological determinism can make good sense of petitionary prayer. Answered prayers are a good thing, so God has reasons to create them. Thus, when a supplicant prays, she gives God a reason to create an answer to her prayer. When he does answer a prayer, he creates the prayed-for results as a means to the fulfillment of the petition. In this way, the prayed-for results are genuinely answers to prayer, even as God has also determined the supplicant to make the (...) request. This result holds whether or not God would have had sufficient reason to bring about the prayed-for result, had the petition not occurred. Thus, the theological determinist can hold all of: a) when a prayer is answered, it is always at least partly answered because of the prayer, b) God would have brought about some prayed-for results whether or not anyone prayed for them, and c) God would not have brought about some prayed-for results, if someone had not prayed for them. Charles Avison's Essay on Musical Expression, first published in 1752, is a major contribution to the debate on musical aesthetics which developed in the course of the 18th century. Considered by Charles Burney as the first essay devoted to 'musical criticism' proper, it established the primary importance of 'expression' and reconsidered the relative importance of harmony and melody. Immediately after its publication it was followed by William Hayes's Remarks (1753), to which Avison himself retorted in his Reply. (...) Taken together these three texts offer a fascinating insight into the debate that raged in the 18th century between the promoters of the so-called 'ancient music' (such as Hayes) and the more 'modern' musicians. Beyond matters of taste, what was at stake in Avison's theoretical contribution was the assertion that the individual's response to music ultimately mattered more than the dry rules established by professional musicians. Avison also wrote several prefaces to the published editions of his own musical compositions. This volume reprints these prefaces and advertisements together with his Essay to provide an interesting view of eighteenth-century conceptions of composition and performance, and a complete survey of Avison's theory of music. The last two decades have seen two significant trends emerging within the philosophy of science: the rapid development and focus on the philosophy of the specialised sciences, and a resurgence of Aristotelian metaphysics, much of which is concerned with the possibility of emergence, as well as the ontological status and indispensability of dispositions and powers in science. Despite these recent trends, few Aristotelian metaphysicians have engaged directly with the philosophy of the specialised sciences.
