Over the past three decades, the Precautionary Principle has become popular in discussions of public policy, especially in relation to health and environmental policy. Though there are a number of different versions of the principle, the genesis of the idea is that it is better to be safe than sorry. In terms of public policy, proponents of the PP argue that being safe means that, if there is a possibility of harm from a new activity or novel technology, even if (...) the scientific evidence concerning the harm is absent or uncertain, precautionary actions should be taken. In one version or another, the PP has been incorporated into a number of laws and treaties. Yet arguments for the PP are unconvincing, the PP itself is vague and when enacted in law, results in arbitrary regulations that pose a threat to human welfare. There has been much first-rate work done in recent years both by way of criticizing Humean assumptions and explicating alter native concepts of causal explanation and non-logical necessity. Roderick Chisholm early showed the inadequacies of neo-Humean views of explanation in his articles on counterfactual inference, and C. J. Ducasse, Sterling Lamprecht, William Kneale, Nicholas Maxwell, Richard Taylor, G. E. M. Anscombe, P. T. Geach, Milton Fisk, Baruch Brody, Peter Alexander, R. Harré, and William Wallace, among others, have articulated interesting (...) alternative views to the Humean ones they have so trenchantly criticized. We will be concerned with the recent work of Harré and Wallace in this study. Harré has not only launched a fresh attack but has also presented what is probably the most fully developed neorealistic [[sic]] alternative. This note analyses the decision of the House of Lords in Fitzpatrick, which held that gay partners could fall within the legal definition of ‘family’ for some purposes. The note argues that despite the real (if overstated) benefits that this case bestows on gay partners in the form of legal rights, under analysis, the decision self-deconstructs to reveal that it is grounded on the principle of discrimination on the basis of sexuality. However, it is also suggested that the encounter between (...) discursive legal reasoning (underpinned by normative heterosexuality), and aversion of the family which is ‘other’ to this discourse, is one which leaves its mark on law, as the potential undermining or deconstruction of law’s normative assumptions. The note further argues that although this decision is properly seen as a moment in the struggle for gay rights, it also serves as a reminder that the fortunes of critical theories and political movements that seek to challenge the legal paradigm of the white, heterosexual male are inextricably linked. Fitzpatrick, whatever else it is, is also an object lesson in the debt that current campaigns for gay legal rights owe to feminist critiques of, and campaigns that have successfully challenged, the role of this norm in legal discourse. Contemporary society involves a number of different persons, groups, and ways of life that are deeply divided and very often opposed on fundamental matters of deep concern. Today, many contemporary philosophers regard this 'fact of diversity' as a problem that needs to be addressed when assessing the principles employed to organize society. In this paper, I discuss the fact of diversity, as it is understood by the notion of reasonable pluralism, and explain why it is thought by some to challenge (...) the stability of a society's political morality. I examine the leading attempt to offer an account of the stability of a political morality and I argue that John Rawls's attempt to account for the stability of Justice as Fairness fails for reasons applicable to all political moralities because the very notion of a stable political morality is implausible. Diversity, as reasonable pluralism understands it, is not a problem that can be solved either by identifying a stable political morality or by modifying a political morality in some way that will make it more stable. Instead, the fact of diversity indicates only that disagreements on all aspects of society's organization, including its organizing principles and matters of value, is a permanent feature of social life that cannot be ignored, wished away, or solved. Democracy has been a flawed hegemony since the fall of communism. Its flexibility, its commitment to equality of representation, and its recognition of the legitimacy of opposition politics are all positive features for political institutions. But democracy has many deficiencies: it is all too easily held hostage by powerful interests; it often fails to advance social justice; and it does not cope well with a number of features of the political landscape, such as political identities, boundary disputes, and environmental crises. (...) Although democracy is valuable it fits uneasily with other political values and is in many respects less than equal to the demands it confronts. In this volume prominent political theorists and social scientists present original discussions of such central issues. From birth to 15 months infants and caregivers form a fundamentally intersubjective, dyadic unit within which the infant’s ability to recognize gender/sex in the world develops. Between about 18 and 36 months the infant accumulates an increasingly clear and subjective sense of self as female or male. We know little about how the precursors to gender/sex identity form during the intersubjective period, nor how they transform into an independent sense of self by 3 years of age. In this Theory and (...) Hypothesis article I offer a general framework for thinking about this problem. I propose that through repetition and patterning, the dyadic interactions in which infants and caregivers engage imbue the infant with an embodied, i.e., sensori-motor understanding of gender/sex. During this developmental period (which I label Phase 1) gender/sex is primarily an intersubjective project. From 15 to 18 months (which I label Phase 2) there are few reports of newly appearing gender/sex behavioral differences, and I hypothesize that this absence reflects a period of developmental instability during which there is a transition from gender/sex as primarily inter-subjective to gender/sex as primarily subjective. Beginning at 18 months (i.e., the start of Phase 3), a toddler’s subjective sense of self as having a gender/sex emerges, and it solidifies by 3 years of age. I propose a dynamic systems perspective to track how infants first assimilate gender/sex information during the intersubjective period (birth to 15 months); then explore what changes might occur during a hypothesized phase transition (15 to 18 months), and finally, review the emergence and initial stabilization of individual subjectivity-the period from 18 to 36 months. The critical questions explored focus on how to model and translate data from very different experimental disciplines, especially neuroscience, physiology, developmental psychology and cognitive development. I close by proposing the formation of a research consortium on gender/sex development during the first 3 years after birth. (shrink)
