De maneira reconhecida ou não, a presença de Górgias, e suas teses, no corpus platônico transcende os limites da presença da personagem Górgias nos sete diálogos em que este é mencionado por Platão. Diante de uma influência multifacetada – que abarca desde questões relativas à linguagem, passando pela metafísica, política e estatuto da arte – faz-se necessário um recorte para melhor evidenciar a apropriação e reelaboração platônica do quadro conceitual gorgiano. A pretensão é fazer uma releitura de alguns momentos do (...) texto platônico por meio de um destaque às referências, diretas e indiretas, que nele estão contidas, tanto da sofística de um modo geral, como de Górgias de Leontinos de modo específico. A tese que se pretende defender é a de que as principais hipóteses teóricas apresentadas pelos sofistas, e por Górgias de modo proeminente, devem ser consideradas imprescindíveis para a construção da filosofia platônica – ainda que esta constitua-se como reação ou apropriação seletiva daquelas. Assim, a indústria platônica não se constitui apenas em desqualificar o edifício filosófico gorgiano, a fim de erguer suas teses sobre as ruínas deste, mas também utilizar alguns conceitos da empresa filosófica de Górgias como vigas-mestras da nova perspectiva reflexiva que o discípulo de Sócrates comprometeu-se a desenvolver. A proposta é repensar o famoso conceito de Nietzsche, vontade de poder. Procurou-se fazer isto de três maneiras: primeiro o conceito é visado a partir da etimologia da palavra. Depois algumas interpretações são expostas e então se procura, por fim, pensar o conceito a partir de seu texto de origem, a passagem “Do Superar a si mesmo” e outras que lhe precedem, na obra Assim Falou Zaratustra.

Neste artigo estudo uma disposição afetiva abordada por Walter Benjamin nas _Teses sobre o conceito de história_, mais precisamente, estudo a empatia (_Einfühlung_). Este afeto estaria presente no tipo de historiografia rejeitada pelo autor, uma vez que ela seria a “empatia pelos vencedores”. Trabalho no presente estudo com uma hipótese “ou-ou”. Benjamin diferencia dois tipos de escrita da história, a inautêntica e a autêntica: ou bem o historiógrafo parte do horror (_Grauen_) inerente aos acontecimentos históricos, ou bem ele elege certos (...) passados e sente empatia (_Einfühlung_) pelos espólios da transmissão cultural. Também em outros escritos de Benjamin encontramos uma atribuição pejorativa à empatia, e a razão para tal, sugerimos, é a de que o historiador deve “fazer explodir” a linha de continuidade da história, enfatizando, em vez de um afeto conciliador ou mesmo apaziguador e conformista, o afeto colérico com relação aos acontecimentos opressores e, portanto, um aspecto “destrutivo”, “disruptivo” da história. Effective and specifically targeted social and therapeutic responses for antisocial personality disorders and psychopathy are scarce. Some authors maintain that this scarcity should be overcome by revising current syndrome - based classifications of these conditions and devising better biocognitive classifications of antisocial individuals. The inspiration for the latter classifications has been embedded in the Research domain criteria approach (RDoC). RDoC - type approaches to psychiatric research aim at transforming diagnosis, provide valid measures of disorders, aid clinical practice, and improve health (...) outcomes by integrating the data on the genetic, neural, cognitive, and affective systems underlying psychiatric conditions. In the first part of the paper, we discuss the benefits of such approaches in comparison to the dominant syndrome-based ones and review recent attempts at building biocognitive classifications of antisocial individuals. Other researchers, how ever, have objected that biocognitive approaches in psychiatry are committed to an untenable form of explanatory. (shrink)

It has been argued that a biomarker-informed classification system for antisocial individuals has the potential to overcome many obstacles in current conceptualizations of forensic and psychiatric constructs and promises better targeted treatments. However, some have expressed ethical worries about the social impact of the use of biological information for classification. Many have discussed the ethical and legal issues related to possibilities of using biomarkers for predicting antisocial behaviour. We argue that prediction should not raise the most pressing ethical worries. Instead, (...) issues connected with ‘biologisation’, such as stigmatization and negative effects on self-image, need more consideration. However, we conclude that also in this respect there are no principled ethical objections against the use of biomarkers to guide classification and treatment of adult antisocial individuals. More specifically, words denoting actions are postulated to make use of neural motor areas, while words denoting visual properties draw on the resources of visual brain areas. Therefore, there is a direct correspondence between word meaning and the experience a listener has had with a word's referent on the brain level. Behavioral and neuroimaging studies have provided (...) evidence in favor of ETLs; however, recent studies have also shown that sensorimotor information is recruited in a flexible manner during language comprehension (e.g., Raposo et al. ; Van Dam et al., ), leaving open the question as to what level of language processing sensorimotor activations contribute. In this study, we investigated the time course of modality‐specific contributions (i.e., the contribution of action information) as to word processing by manipulating both (a) the linguistic and (b) the action context in which target words were presented. Our results demonstrate that processes reflecting sensorimotor information play a role early in word processing (i.e., within 200 ms of word presentation), but that they are sensitive to the linguistic context in which a word is presented. Background:Ethical issues are increasingly being reported by care-providers; however, little is known about the nature of these issues within the nursing home. Ethical issues are unavoidable in healthcare and can result in opportunities for improving work and care conditions; however, they are also associated with detrimental outcomes including staff burnout and moral distress.Objectives:The purpose of this review was to identify prior research which focuses on ethical issues in the nursing home and to explore staffs’ experiences of ethical issues.Methods:Using a systematic (...) approach based on Aveyard (2014), a literature review was conducted which focused on ethical and moral issues, nurses and nursing assistants, and the nursing home.Findings:The most salient themes identified in the review included clashing ethical principles, issues related to communication, lack of resources and quality of care provision. The review also identified solutions for overcoming the ethical issues that were identified and revealed the definitional challenges that permeate this area of work.Conclusions:The review highlighted a need for improved ethics education for care-providers. The harm usually associated with psychopathy requires therapeutically, legally, and ethically satisfactory solutions. Scholars from different fields have, thus, examined whether empirical evidence shows that individuals with psychopathic traits satisfy concepts, such as responsibility, mental disorder, or disability, that have specific legal or ethical implications. The present paper considers the less discussed issue of whether psychopathy is a disability. As it has been shown for the cases of the responsibility and mental disorder status of psychopathic individuals, we argue that it (...) is undecided whether psychopathy is a disability. Nonetheless, based on insights from disability studies and legislations, we propose that interventions to directly modify the propensities of individuals with psychopathic tendencies should be balanced with modifications of the social and physical environments to accommodate their peculiarities. We also suggest how this social approach in some practical contexts that involve non-offender populations might be effective in addressing some of the negative effects of psychopathy. (shrink)

Should offenders with psychopathy or those exhibiting extreme forms of antisocial behav- iour be considered criminally responsible? The current debate seems to have reached a stalemate. Several scholars have argued that neuropsychologi- cal data on individuals with psychopathy might be relevant for determining their criminal responsibil- ity. However, relying on such data has not produced a consensus among legal scholars and philosophers on whether individuals with psychopathy should be excused from responsibility. We offer a diagnosis about why this debate has (...) reached a standoff. We argue that part of the problem is that psychopathy, being a syndrome-based category, is too heterogeneous and thus offers low prospects for being integrated with neuropsychological data that might support significant conclusions about the criminal responsibility of individuals with psychopathy. Moreover, the construct of psychopathy was not originally devised to discriminate criminally accountable from unac- countable antisocial individuals. To overcome these difficulties and advance the debate, we extend a currently less discussed theoretical framework for bridging biopsychology and the law that focuses on neuropsychological constructs, domains, and processes that directly measure capacities of offenders that are relevant for criminal responsibility, without necessarily relying on mediating syndrome-based constructs. The novelty of our contribution is that the biopsy- chological bases of exculpation can be further devel- oped and used for determining more fine-grained cat- egorisations of antisocial personality types. We show how this framework provides guidelines for inter- disciplinary research that can significantly advance our understanding of the preconditions for criminal responsibility and help the legal practice of ascribing or withholding it. BackgroundThe amount of research utilizing health information has increased dramatically over the last ten years. Many institutions have extensive biobank holdings collected over a number of years for clinical and teaching purposes, but are uncertain as to the proper circumstances in which to permit research uses of these samples. Research Ethics Boards (REBs) in Canada and elsewhere in the world are grappling with these issues, but lack clear guidance regarding their role in the creation of and access to registries and (...) biobanks.MethodsChairs of 34 REBS and/or REB Administrators affiliated with Faculties of Medicine in Canadian universities were interviewed. Interviews consisted of structured questions dealing with diabetes-related scenarios, with open-ended responses and probing for rationales. The two scenarios involved the development of a diabetes registry using clinical encounter data across several physicians' practices, and the addition of biological samples to the registry to create a biobank.ResultsThere was a wide range of responses given for the questions raised in the scenarios, indicating a lack of clarity about the role of REBs in registries and biobanks. With respect to the creation of a registry, a minority of sites felt that consent was not required for the information to be entered into the registry. Whether patient consent was required for information to be entered into the registry and the duration for which the consent would be operative differed across sites. With respect to the creation of a biobank linked to the registry, a majority of sites viewed biobank information as qualitatively different from other types of personal health information. All respondents agreed that patient consent was needed for blood samples to be placed in the biobank but the duration of consent again varied.ConclusionParticipants were more attuned to issues surrounding biobanks as compared to registries and demonstrated a higher level of concern regarding biobanks. As registries and biobanks expand, there is a need for critical analysis of suitable roles for REBs and subsequent guidance on these topics. The authors conclude by recommending REB participation in the creation of registries and biobanks and the eventual drafting of comprehensive legislation. (shrink)

In their daily practices, can doctors be both patient advocates and society's agents in rationing costly care? Doctors disagree among themselves. Some argue that patients stand to benefit if doctors lead the movement for cost‐effective care in hospitals, nursing homes, and patients' homes. For others cost‐cutting at the bedside erodes the foundations of the doctor‐patient relationship and compromises the quality of care.

The history of the Euclidean Steiner tree problem, which is the problem of constructing a shortest possible network interconnecting a set of given points in the Euclidean plane, goes back to Gergonne in the early nineteenth century. We present a detailed account of the mathematical contributions of some of the earliest papers on the Euclidean Steiner tree problem. Furthermore, we link these initial contributions with results from the recent literature on the problem.

Background:Palliative care is acknowledged as an appropriate approach to support older people in nursing homes. Ethical issues arise from many aspects of palliative care provision in nursing homes; however, they have not been investigated in this context.Aim:To explore the ethical issues associated with palliative care in nursing homes in the United Kingdom.Design:Exploratory, sequential, mixed-methods design.Methods:Semi-structured interviews with 13 registered nurses and 10 healthcare assistants (HCAs) working in 13 nursing homes in the United Kingdom were used to explore ethical issues in (...) palliative care. The ‘Ethical Issues in Palliative Care for Nursing Homes’ instrument was used to measure the frequency and level of distress arising from ethical issues through a cross-sectional survey with 69 registered nurses and 129 healthcare assistants. Data collection occurred between December 2014 and November 2015.Ethical considerations:Ethical approval was granted by Queen’s University’s School of Nursing and Midwifery Research Ethics Committee and governance sought from each nursing home’s manager.Findings:The interviews revealed three themes: ethical issues in practice; relational issues; and organisational issues. No significant differences between registered nurses and healthcare assistants were evident, confirming the patterns emerging from the interviews. Relational issues, primarily issues with residents and families, occurred most frequently and caused greater distress.Conclusion:The shared environment is key in the experience of ethical issues; therefore, multidisciplinary education is needed for ethical decision making in palliative care. Addressing staff knowledge and service organisation may reduce ethical issues locally and provide a benchmark for global change. (shrink)

Introduction: Variation across research ethics boards in conditions placed on access to medical records for research purposes raises concerns around negative impacts on research quality and on human subject protection, including privacy.Aim: To study variation in REB consent requirements for retrospective chart review and who may have access to the medical record for data abstraction.Methods: Thirty 90-min face-to-face interviews were conducted with REB chairs and administrators affiliated with faculties of medicine in Canadian universities, using structured questions around a case study (...) with open-ended responses. Interviews were recorded, transcribed and coded manually.Results: Fourteen sites required individual patient consent for the study to proceed as proposed. Three indicated that their response would depend on how potentially identifying variables would be managed. Eleven sites did not require consent. Two suggested a notification and opt-out process. Most stated that consent would be required if identifiable information was being abstracted from the record. Among those not requiring consent, there was substantial variation in recognising that the abstracted information could potentially indirectly re-identify individuals. Concern over access to medical records by an outside individual was also associated with requirement for consent. Eighteen sites required full committee review. Sixteen allowed an external research assistant to abstract information from the health record.Conclusions: Large variation was found across sites in the requirement for consent for research involving access to medical records. REBs need training in best practices for protecting privacy and confidentiality in health research. A forum for REB chairs to confidentially share concerns and decisions about specific studies could also reduce variation in decisions. (shrink)

The aim of this paper is to present a revision of international versions of the Utrecht Work Engagement Scale and to describe the psychometric properties of a Portuguese version of the UWES-9 developed simultaneously for Brazil and Portugal, the validity evidence related with the internal structure, namely, Dimensionality, measurement invariance between Brazil and Portugal, and Reliability of the scores. This is the first UWES version developed simultaneously for both countries, and it is an important instrument for understanding employees' work engagement (...) in the organizations, allowing human resources departments to better use workforces, especially when they are migrants. A total of 524 Brazilian workers and 522 Portuguese workers participated in the study. Confirmatory Factor Analysis, group comparisons, and Reliability estimates were used. The use of workers who were primarily professionals or administrative support, according to ISCO-08, reinforced the need to collect data on other professional occupations. Confirmatory factor analysis showed acceptable fit for the UWES-9 original three-factor solution, and a second-order factor structure has been proposed that presented an acceptable fit. Full-scale invariance was obtained between the Portuguese and Brazilian samples, both for the original three-factor first-order and second-order models. Data revealed that Portuguese and Brazilian workers didn't show statistically significant differences in the work engagement dimensions. This version allows for direct comparisons of means and, consequently, for performance of comparative and cross-cultural studies between these two countries. (shrink)

The style of thinking is “postphilosophical” in the sense developed in Part II of the author's Negative Dialectics and the End of (...) Pedro Alvares Cabral's ships left Portugal on 9 March 1500 en route for the territory that he first named Terra de Vera Cruz and that later came to be known as Brazil. On the 22 March they called at the island of São Nicolau [Caminha, 1500], one of the northernmost islands of the Cape Verde group; this was about forty years after the discovery of the archipelago in 1460-62 [Albuquerque, 1991]. It is known that Vasco da Gama had stopped at (...) the island of Santiago in 1498 on his voyage to India, and also in 1499 on the return journey. Straight after the discovery of Brazil Cabral sailed for India and on the way back also dropped anchor at Santiago. Indeed, our archipelago, which is situated off Cape Verde in Senegal (the place from which it appears to take its name), was to become an important stopover point for maritime traffic between Europe, Asia and the Americas in the fifteenth and sixteenth centuries, both to allow crews to rest and to take on water, wood and some food supplies. It also became important as a holding point for slaves (a large number of whom came from around thirty Guinean ethnic groups and subgroups). They were dispatched from Santiago, known then as Cape Verde island, to territories such as Brazil from the early sixteenth century onwards, since these territories, which had only recently been discovered and were little known, needed people to work and populate them. This chapter focuses on Brazil and Colombia in the context of the official multiculturalism adopted by both countries. It looks primarily at ‘blackness’, but necessarily also makes reference to the category ‘indigenous’, as this is an inherent part of the processes by which identities come to be defined, claimed and contested. The text shows how blackness in each country oscillated between ‘ethnic’ and ‘racialised’ definitions, both from an official and from a social movement point of view, and how oscillation was (...) related to different contexts and political conjunctures. In Colombia, there was a move between 1991 and 2009 from a very ‘ethnic’ definition towards a more explicitly ‘racialised’ one; while in Brazil, we can see a move from a pre-1988 racial definition towards a more ethnic one, which however coexists with the more racial emphasis. These are not opposed trajectories, but variations on a theme of changing, overlapping and often conflicting definitions. (shrink)

This article focuses on scientific integrity and the identification of predisposing factors to scientific misconduct in Brazil. Brazilian scientific production has increased in the last ten years, but the quality of the articles has decreased. Pressure on researchers and students for increasing scientific production may contribute to scientific misconduct. Cases of misconduct in science have been recently denounced in the country. Brazil has important institutions for controlling ethical and safety aspects of human research, but there is a lack of specific (...) offices to investigate suspected cases of misconduct and policies to deal with scientific dishonesty. Corporate governance is an issue of growing importance in developing economies, as many firms pass through significant transformations due to the combined forces of sociopolitical changes, technological progress and economic trends toward globalization. These elements, along with the structural characteristics of developing economies such as less developed capital markets and governmental interventionism, draw a picture for corporate governance practices that may, in some aspects, be fundamentally different from the practices found in European or North American contexts. Precision medicine is emerging as a scientific bandwagon within the contemporary biomedical sciences in the United States. PM brings together concepts and tools from genomics and bioinformatics to develop better diagnostics and therapies based on individualized information. Developing countries like China and Brazil have also begun pursuing PM projects, motivated by a desire to claim genomic sovereignty over its population. In spite of commonalities, institutional arrangements produced by the history of genomics research in China and Brazil are ushering PM along (...) different trajectories. In the Chinese case, we identify a strong state-backed push for PM combined with a dynamic network of international academic and private actors along the lines of networked technonationalism that has made large-scale, speculative PM projects possible. The Brazilian case is characterized by an institutional void at the federal level in which PM is driven by domestic academic actors in universities in the regional level, resulting in smaller scale, needs-driven PM projects. Through these cases, this paper shows how a scientific bandwagon adapts to national histories and institutions. Through this peripheral translation of the scientific bandwagon, the global infrastructure of biomedical knowledge has the potential to be transformed. (shrink)

Recent trends in academic and professional legal communication worldwide have promoted significant changes to aim at operating successfully under current multilingual and multilegal contexts. The aim is to consider a kind of supranational legal discourse so as to minimize socio-cultural variants and to promote the pragmatic conditions for harmonized and ‘common sense’ legal practices without excluding potential reciprocal influences of or resistance to one hegemonic legal system upon others. In Brazil, the traditional ‘thinking like a civil lawyer’ culture still prevails (...) against a more global approach constraining the consolidation of the country’s role of major player in most global legal areas. In addition, the key tool required for achieving some sort of global legal status—Brazilian legal operators’ proficiency in legal English—has been barely considered in both academic and professional settings, particularly in legal translation. This study resorts to the linguistic anthropology concept of ‘entextualization’ to discuss the process of official translation in Brazil to render global legal genres. The comparative analysis between the original text in English and its official version in English focus on drafting consistency, the translator’s choice of some formal entextualization elements used in the process of translation and his/her authority as the entextualizing agent to legitimate text. This article proposes an exposition and analysis of perceptions intrinsic to rituals carried out with the use of the jurema plant, especially when mixed with Syrian rue (juremahuasca) in contexts of contemporary esoteric re-actualizations in Brazil. These rituals are conducted by people who look at jurema as a spiritual path, once acquainted with its psychedelic properties. We highlight the mystical attributes and the cultural bricolage elaborated by these individuals, who conduct ceremonies in ritual spaces in which participants experience altered states (...) of perception and consciousness. Considered as an entheogen, jurema leads to states of mystical transformation in people. Such personal changes are often considered by users as the rhetoric of healing. Life stories and ethnographic contexts form the background of the article, which seeks to advance understandings about jurema based on speculations around the intertwining of the themes of consciousness, mysticism, and healing.
