Cet article examine les formes de justice islamique pratiquées dans un pays où l’islam est pluriel. Il montre que les autorités islamiques en charge de la résolution des conflits de famille font preuve d’une grande capacité à conjuguer les normes islamiques avec les pratiques locales et les demandes des justiciables. En ville, cette importance donnée à l’ « arrangement » constitue un frein pour les couples souhaitant divorcer. En effet, les élites islamiques s’accordent pour reconnaître que le droit islamique autorise le divorce, tant pour les hommes que pour les femmes, mais dans les faits, elles se refusent à le cautionner. Context In France, a new payment for performance (P4P) scheme for primary care physicians was introduced in 2009 through the ‘Contract for Improving Individual Practice’ programme. Its objective was to reduce healthcare expenditures while enhancing improvement in guidelines' observance. Nevertheless, in all countries where the scheme was implemented, it raised several concerns in the domain of professional ethics. Objective To draw out in France the ethical tensions arising in the general practitioner's (GP) profession linked to the introduction of P4P. Method (...) Qualitative research using two focus groups: first one with a sample of GPs who joined P4P and second one with those who did not. All collective interviews were recorded and fully transcribed. An inductive analysis of thematic content with construction of categories was conducted. All the data were triangulated. Results All participants agreed that conflicts of interest were a real issue, leading to the resurgence of doctor's dirigisme, which could be detrimental for patient's autonomy. GPs who did not join P4P believed that the scheme would lead to patient's selection while those who joined P4P did not. The level of the maximal bonus of the P4P was considered low by all GPs. This was considered as an offense by non-participating GPs, whereas for participating ones, this low level minimised the risk of patient's selection. Conclusion This work identified several areas of ethical tension, some being different from those previously described in other countries. The authors discuss the potential impact of institutional contexts and variability of implementation processes on shaping these differences. (shrink)

Clinical trials emerged in rapid succession as the COVID-19 pandemic created an unprecedented need for life-saving therapies. Fair and equitable subject selection in clinical trials offering investigational therapies ought to be an urgent moral concern. Subject selection determines the distribution of risks and benefits, and impacts the applicability of the study results for the larger population. While Research Ethics Committees monitor fair subject selection within each trial, no standard oversight exists for subject selection across multiple trials for the same disease. (...) Drawing on the experience of multiple clinical trials at a single academic medical centre in the USA, we posit that concurrent COVID-19 trials are liable to unfair and inequitable subject selection on account of scientific uncertainty, lack of transparency, scarcity and, lastly, structural barriers to equity compounded by implicit bias. To address the critical gap in the current literature and international regulation, we propose new ethical guidelines for research design and conduct that bolsters fair and equitable subject selection. Although the proposed guidelines are tailored to the research design and protocol of concurrent trials in the COVID-19 pandemic, they may have broader relevance to single COVID-19 trials. (shrink)

Previous research shows that simultaneously executed grasp and vocalization responses are faster when the precision grip is performed with the vowel [i] and the power grip is performed with the vowel [ɑ]. Research also shows that observing an object that is graspable with a precision or power grip can activate the grip congruent with the object. Given the connection between vowel articulation and grasping, this study explores whether grasp‐related size of observed objects can influence not only grasp responses but also (...) vowel pronunciation. The participants had to categorize small and large objects into natural and manufactured categories by pronouncing the vowel [i] or [ɑ]. As predicted, [i] was produced faster when the object's grasp‐related size was congruent with the precision grip while [ɑ] was produced faster when the size was congruent with the power grip (Experiment 1). The effect was not, however, observed when the participants were presented with large objects that are not typically grasped by the power grip (Experiment 2). This study demonstrates that vowel production is systematically influenced by grasp‐related size of a viewed object, supporting the account that sensory‐motor processes related to grasp planning and representing grasp‐related properties of viewed objects interact with articulation processes. The paper discusses these findings in the context of size–sound symbolism, suggesting that mechanisms that transform size‐grasp affordances into corresponding grasp‐ and articulation‐related motor programs might provide a neural basis for size‐sound phenomena that links small objects with closed‐front vowels and large objects with open‐back vowels. En comparant sur plusieurs scènes la réception de mes recherches sur le travail bénévole – désenchantement pour les un.es, truisme pour les autres – et en prenant au sérieux le processus de politisation par l’enquête qui a été le mien, cet article propose une analyse située à la fois socialement et politiquement du désenchantement que produirait la sociologie catégorisée comme critique. Il met en lumière deux défenses de l’autonomie de l’engagement, au cœur de la critique de la critique : celui (...) de l’autonomie de « l’engagement citoyen » des acteur.trices et de leur rapport au travail, et celui de l’autonomie du travail du chercheur.se et de ses « engagements », généralement présenté sous le topos de la « neutralité » de la recherche. Ce retour réflexif sur les effets de l’enquête sur les autres, mais aussi sur moi-même, vient questionner in fine la portée sociale et politique de cette « conception des mondes antagonistes » inscrite dans une « doctrine de la séparation des sphères » du travail et de l’engagement qui concerne ici tant l’objet que la pratique de recherche. In “Milvian Bridges in Science, Religion, and Theology: Debunking Arguments and Cultural Evolution,” Lari Launonen and Aku Visala engage with an EDA against religious belief that appeals to cultural rather than biological evolution. According to this EDA, religious beliefs are unjustified, not because they are generated by biologically shaped cognitive processes that are unreliable as far as those beliefs are concerned but because they are generated by cultural processes that select for those beliefs for their ability to produce prosocial behavior (...) rather than for their truth sensitivity. Scientific beliefs, by contrast, are truth-sensitive because their cultural fitness depends on their power to produce accurate predictions. Their truth sensitivity explains the great amount of convergence on them that exists across cultures. In response to the EDA in question, Launonen and Visala argue that the difference between science and religion is actually more a matter of degree than a matter of kind, that there is considerable cross-cultural convergence on theistic and Christian beliefs, and that folk Christian beliefs, just as folk scientific ones, are truth-sensitive to the extent that they are constrained by expert beliefs. Background In June 2016, the Parliament of Canada passed federal legislation allowing eligible adults to request Medical Assistance in Dying (MAID). Since its implementation, there likely exists a degree of hesitancy among some healthcare providers due to the law being inconsistent with personal beliefs and values. It is imperative to explore how nurses in Quebec experience the shift from accompanying palliative clients through “a natural death” to participating in “a premeditated death.” Research question/aim/objectives This study aims to explore how Quebec (...) nurses personally and professionally face the new practice of MAID and their role evolution. Research design A grounded theory design was used. Participants and research context We recruited 37 nurses who participated in or coordinated at least one MAID. Semi-structured interviews and focus groups were conducted and audiotaped. Data collection and analysis followed Strauss and Corbin steps. Ethical considerations Ethics approval was received from the investigator’s affiliated University. Participants were informed regarding the research goal, signed a written consent, and were assigned pseudonyms. Findings/results Results show that nurses experienced the wide range of paradoxe during MAID centering around the following eight elements: 1) confrontation abouth death, 2) choice, 3) time of death, 4) emotional load, 5) new Bill, 6) relationship with the person, 7) communication skills, and 8) healthcare setting. The shifting of views and values in this new role is presented by the contradiction of opposites. Conclusions A better understanding of the paradox experienced by nurses involved with MAID paves the way for the development of interventions. (shrink)

Cognitive science of religion (CSR) has inspired a number of debunking arguments against god-belief. They aim to show that the belief-forming processes that underlie belief in god(s) are unreliable. The debate surrounding these arguments gives the impression that CSR offers new scientific evidence that threatens the rationality of religious belief. This impression, however, is partly misleading. A close look at a few widely discussed debunking arguments shows, first, that CSR theories as such are far from providing sufficient empirical evidence that (...) the belief-forming processes behind god-belief are unreliable. Thus, appealing solely to CSR theories makes a debunking argument weak. Second, there are strong arguments that also invoke CSR, but these gain their strength primarily from more familiar claims about evolutionary epistemology and religious diversity. What CSR actually does in these arguments is providing an explanation of why people might believe in gods even if gods did not exist. But explaining is not debunking. (shrink)

Le diptyque « Corps/Guerre(s) » s’impose comme une problématique essentielle au cœur du renouvellement de la connaissance du phénomène guerrier. La réflexion autour de la corporéité de la guerre a ouvert de nouveaux territoires afin de repenser l’expérience guerrière, notamment par une réévaluation des expériences collectives et intimes des violences. Les deux numéros de la revue Quasimodo s’inscrivent dans cet axe – au travers d’une démarche comparatiste, pluridisciplinaire et chronologique...

Décrire adéquatement la signification d’un terme, ou d’un énoncé, suppose souvent de faire appel au co-texte ou au contexte. Le linguiste doit alors recourir à des corpus authentiques et proposer des procédures de contextualisation. Une telle démarche, que l’on peut à bon droit qualifier d’étique, est loin d’être suffisante. Elle ne tient pas compte des stratégies de contextualisation et de recontextualisation des discours par les locuteurs eux-mêmes, sans aucun doute liées à l’existence d’une compétence métalinguistique et métapragmatique. La contextualisation est (...) donc aussi un problème émique. Dans le cadre d’une enquête ethnographique au sein d’une troupe de théâtre, incluant l’observation et l’enregistrement audiovisuel des différentes activités des comédiens, on s’est intéressé aux phases de travail théâtral – lecture à la table et répétitions – pendant lesquelles les participants se confrontent à des textes qui leur posent des difficultés d’interprétation. Face à des énoncés dont la signification ne fait pas nécessairement problème, mais dont le sens en contexte peut sembler problématique, les comédiens et les metteurs en scène sont amenés à devoir recontextualiser. Nous étudierons ces pratiques de contextualisation, leur émergence – soit parce que les participants l’exigent, soit parce que les locuteurs eux-mêmes en éprouvent la nécessité pour parvenir à une pertinence communicative plus forte – en en soulignant la dimension collective. Il s'agit d'observer le rôle du dispositif communicationnel et la manière dont ses membres en usent: privilégient-ils la dimension conversationnelle ou publicitaire? quelle est la nature de cet espace public et des échanges qui s'y déroulent? L'analyse statistique et de contenu des courriels révèle un espace interactionnel de groupe où la publicité l'emporte sur la sociabilité, ainsi qu'une parole publique dégradée marquée par (...) l'incommunication et une dérive ethniciste.Space for expression and discussion forums are media meet individuals with varied opinions and affiliations. It is to observe the role of communicative device and how its members wear: they prefer the conversational dimension or advertising? What is the nature of public space and exchanges that take place? Despite the rapid adoption of technology in human resource departments, there is little empirical work that examines the potential challenges of algorithmic decision-making in the recruitment process. In this paper, we take the perspective of job applicants and examine how they perceive the use of algorithms in selection and recruitment. Across four studies on Amazon Mechanical Turk, we show that people in the role of a job applicant perceive algorithm-driven recruitment processes as less fair compared to human only or algorithm-assisted (...) human processes. This effect persists regardless of whether the outcome is favorable to the applicant or not. A potential mechanism underlying algorithm resistance is the belief that algorithms will not be able to recognize their uniqueness as a candidate. Although the use of algorithms has several benefits for organizations such as improved efficiency and bias reduction, our results highlight a potential cost of using them to screen potential employees during recruitment. I identify and resolve an internal tension in Critical Contextual Empiricism (CCE) – the normative account of science developed by Helen Longino. CCE includes two seemingly conflicting principles: on one hand, the cognitive goals of epistemic communities should be open to critical discussion (the openness of goals to criticism principle, OGC); on the other hand, criticism must be aligned with the cognitive goals of that community to count as “relevant” and thus require a response (the goal-relativity of response-requiring criticism principle, (...) GRC). The co-existence of OGC and GRC enables one to draw both approving and condemning judgments about a situation in which an epistemic community ignores criticism against its goals. This tension results from conflating two contexts of argumentation that require different regulative standards. In the first-level scientific discussion, GRC is a reasonable principle but OGC is not; in the meta-level discussion about science, the reverse holds. In meta-level discussion, the relevance of criticism can be established by appealing to goals of science that are more general than the goals of a specific epistemic community. To illustrate my revision of CCE, I discuss why feminist economists’ criticism of the narrowness of the goals pursued in mainstream economics is relevant criticism. (shrink)

An intuitively appealing argument for pluralism in economics can be made on the grounds that schools of economic thought complement one another. Let us call this the complementarity-based argument for pluralism (CAP). The concepts of complementarity, pluralism, and school of thought are scrutinized in this paper to evaluate this argument. I argue that the complementarity of schools is relative to scientific goals, which implies that discussing complementarity of schools of economic thought requires discussing the goals of economic research. I also (...) distinguish weak from strong complementarity and show that some alleged complementarity relations between schools are weak and thus provide little support for CAP. However, if strong complementarity relations, relative to a valuable goal, can be demonstrated to exist between specific schools, this is a strong reason for pluralism about those schools. Finally, I provide suggestions on how to distinguish strong from weak complementarity. (shrink)

Against claims that cognitive science of religion undercuts belief in God, many defenders of theistic belief have invoked the Religious Reasons Reply: science cannot undercut belief in God if one has good independent reasons to believe. However, it is unclear whether this response helps salvage the god beliefs of most people. This paper considers four questions: (1) What reasons do Christians have for believing in God? (2) What kinds of beliefs about God can the reasons support? (3) Are the reasons (...) rationalizations? (4) Can cognitive science undercut the reasons? Many Christians invoke everyday religious experiences (EREs)—such as experiences of divine presence, guidance, and communication—as reasons to believe. Unlike another popular reason to believe in God (the appearance of design and beauty in nature), EREs can support beliefs about a relational God who is present to me, who guides my life, and who speaks to me. EREs are not rationalizations since they seem to cause and sustain such beliefs. Nonetheless, EREs like experiences of hearing God speak are problematic reasons to believe. ‘Soft’ voice-hearing experiences are easily undercut. ‘Hard’ experiences of an external, audible voice are probably underpinned by similar cognitive processes as audio-verbal hallucinations. À partir des deux théophanies de Nicolas de Cues et de Leibniz, qui donnent à l’homme une place privilégiée au sein du monde créé, du fait de son statut de miroir ou image vivante qui reflète ou exprime le monde dans sa totalité, et de conceptions qui pensent la présence de l’infini dans le fini, on s’interroge ici sur la conception de la connaissance comme perspective de la monade chez Leibniz et la connaissance « quo modo capere possunt » des (...) créatures connaissantes dans l’univers cusain afin de voir si se tissent des liens de filiation évidents. On se demandera enfin si le système de l’expression, chez Leibniz, qui fait que toute monade exprime l’univers tout entier – ce qui semble proche de l’idée cusaine de la mens comme miroir ou image vivante – ne dépasse pas le perspectivisme « restrictif » de la conception cusaine et n’inscrit pas la démarche leibnizienne dans un dessein beaucoup plus large, qui nécessite un tissu de relations entre les différentes monades que constitue la compossibilité. Tout mouvement de connaissance est connaissance de toutes choses, mais dans un système de relations qui précède l’existence de la monade et qui résulte du calcul du meilleur, soumis au principe de non-contradiction.Ainsi, si un héritage réel semble se dessiner entre Nicolas de Cues et Leibniz, qui place le sujet connaissant au centre de l’édifice créé par Dieu, ou Création, dans une démarche à la fois libre et dépendante du principe premier, il faut comprendre que les deux systèmes de pensée ne répondent pas tout à fait au même dessein. The contemporary books of Cassius Dio's Roman History are known for their anecdotal quality and lack of interpretive sophistication. This paper aims to recuperate another layer of meaning for Dio's anecdotes by examining episodes in his contemporary books that feature masquerades and impersonation. It suggests that these themes owe their prominence to political conditions in Dio's lifetime, particularly the revival, after a hundred-year lapse, of usurpation and damnatio memoriae, practices that rendered personal identity problematic. The central claim is that narratives (...) in Dio's last books use masquerades and impersonation to explore paradoxes of personal identity and signification, issues made salient by abrupt changes of social status at the highest levels of imperial society. Commissions of experts regularly meet to reply to questions such as: What will be the population of the country, or even of our planet, in ten, fifteen or twenty-five years? In what proportion will production have increased, what modifications will its composition and utilizations have undergone? The attraction of efforts to forecast the future continues. That is a fact. How does it proceed? That is a problem, one on which de Jouvenel focuses on in this book. The Art of Conjecture (...) clearly explains what the "study of the future" can mean. De Jouvenel emphasizes the logical and political problems of forecasting and discusses methods in economics, sociology, and political science by which the future can be studied. More importantly, he discusses the fallacies to which the "study of the future" is peculiarly likely to give rise. The author argues that it is natural and necessary for the population to have visions of the future. Without this, he states, we would only be able to set one opinion of the future against another. If the origins and meanings of these predictions remained obscure, only the event could decide among the opinions. If any man can be said to have created the serious "study of the future" in our time, it is Bertrand de Jouvenel. Futuribles, a periodical he created, continues to represent a major turning point in contemporary social science. Jouvenel aimed to show how "the art of conjecture" could inform prudential judgment and allow citizens and statesmen to detect troubles before they arise. (shrink)
