Frank Jackson has abandoned his famous knowledge argument, and has explained why in a brief "Postscript on Qualia" . This explanation consists of a direct argument, and an attempt to explain away the intuition that lies at the heart of the knowledge argument. The direct argument is clarified and found to be subtly question-begging. The attempt to explain away the key intuition is reviewed and found to be inadequate. False memory traces, which Jackson mentions at the beginning of the (...) direct argument, are discussed and found not to materially affect the force of the knowledge argument. (shrink)

Robinson's defense of moral realism is stimulating, admirable, and convincing in many respects. He is particularly effective in mounting a multi-faceted attack on Mackie's famous "argument from queerness" and other views that deny that moral realities can be part of the furniture of the world. Certain other of his arguments about the ontological standing of moral entities, however, might be seen to open rather a wide gulf between them and ordinary experience. Some people, not just beginning students, are at first surprised to learn that the proposition “If zero is odd, then zero is not odd” is not self-contradictory. Some people are surprised to find out that there are logically equivalent false universal propositions that have no counterexamples in common, i. e., that no counterexample for one is a counterexample for the other. Some people would be surprised (...) to find out that in normal first-order logic existential import is quite common: some universals “Everything that is S is P” —actually quite a few—imply their corresponding existentials “Something that is S is P”. Anyway, perhaps contrary to its title, this paper is not a cataloging of surprises in logic but rather about the mistakes that did or might have or might still lead people to think that there are no surprises in logic. Gödel gave some to Hilbert. Tarski gave us several. When we get a surprise, we are often delighted, puzzled, or skeptical. Sometimes we feel or say “Nice!”, “Wow, I didn’t know that!”, “Is that so?”, or the like. Every surprise belongs to someone. There are no disembodied surprises. Saying there are surprises in logic means that logicians experience surprises doing logic—not that among logical propositions some are intrinsically or objectively “surprising”. The expression “That isn’t surprising” often denigrates logical results. Logicians often aim for surprises. In fact, [1] argues that logic’s potential for surprises helps motivate its study and, indeed, helps justify logic’s existence as a discipline. Besides big surprises that change logicians’ perspectives, the logician’s daily life brings little surprises, e.g. that Gödel’s induction axiom alone implies Robinson’s axiom. Sometimes wild guesses succeed. Sometimes promising ideas fail. Perhaps one of the least surprising things about logic is that it is full of surprises. Against the above is Wittgenstein’s surprising conclusion : “Hence there can never be surprises in logic”. This paper unearths basic mistakes in [2] that might help to explain how Wittgenstein arrived at his false conclusion and why he never caught it. The mistakes include: unawareness that surprise is personal, confusing logicians having certainty with propositions having logical necessity, confusing definitions with criteria, and thinking that facts demonstrate truths. It was a bad day. First I presented my idea about a Central America protest to the faculty committee, but the committee played ping-pong with the idea until it was crushed. Then I met Robinson, who has somehow been able to present his theory of action in a serious journal. But the theory is a house of cards, and once his critics rattle the table a bit, the theory will come crashing down. And his book on the history of (...) philosophy, just published, is a cheap TV dinner. He does not understand how to study the history of thought. It is necessary to dig into hidden layers of thought, to uncover earlier strata, to map the subterranean patterns, and then to explain why upheavals take place when they do.The above paragraph contains a number of metaphorical sentences. Now all of the following are, I believe, facts about, or relevant to, those sentences. They can be true or false, and our behavior towards them shows that we take them as candidates for truth. I will be expected to offer evidence in support of their truth, and Robinson's supporters on the faculty, if they hear me state the sentences about him, will accuse me of having made false claims. It is generally clear, in regard to the metaphorical sentences under consideration, what would count as evidence for them and against them. (shrink)

Recent financial fraud legislation such as the Dodd–Frank Act and the Sarbanes–Oxley Act (U.S. House of Representatives, Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, [H.R. 4173], 2010 ; U.S. House of Representatives, The Sarbanes–Oxley Act of 2002, Public Law 107-204 [H.R. 3763], 2002 ) relies heavily on whistleblowers for enforcement, and offers protection and incentives for whistleblowers. However, little is known about many aspects of the whistleblowing decision, especially the effects of contextual and wrongdoing attributes (...) on organizational members’ willingness to report fraud. We extend the ethics literature by experimentally investigating how the nature of the wrongdoing and the awareness of those surrounding the whistleblower can influence whistleblowing. As predicted, we find that employees are less likely to report: (1) financial statement fraud than theft; (2) immaterial than material financial statement fraud; (3) when the wrongdoer is aware that the potential whistleblower has knowledge of the fraud; and (4) when others in addition to the wrongdoer are not aware of the fraud. Our findings extend whistleblowing research in several ways. For instance, prior research provides little evidence concerning the effects of fraud type, wrongdoer awareness, and others’ awareness on whistleblowing intentions. We also provide evidence that whistleblowing settings represent an exception to the well-accepted theory of diffusion of responsibility. Our participants are professionals who represent the likely pool of potential whistleblowers in organizations. (shrink)

This chapter considers the establishment freedom, concentrating on three aspects where recent European Court of Justice decisions have appeared to enlarge its scope but have also left unsolved questions on particular aspects. First, it looks at the nature of the establishment freedom, distinguishing it from the other freedoms, in particular the right to provide services and free movement of capital. Second, the chapter examines who are the beneficiaries of the right of establishment and, in particular, the position of legal persons, (...) companies, where harmonization of member states' company laws has achieved results but has not solved all problems. Finally, it addresses the question of which parties are obliged by the treaty to respect the right of establishment and considers a 2007 judgment, Viking, which, with the Laval decision concerning services, caused much criticism. The neural cell adhesion molecule (N‐CAM) is believed to be a key regulator of adhesive events in the nervous system and skeletal muscle. The recent isolation of N‐CAM cDNAs from different tissues has identified a high degree of diversity in primary amino acid sequence between different isoforms. In this article, we review these recent studies and discuss methods for unravelling the functional consequences of the generation of multiple N‐CAM polypeptides using gene transfection approaches.

In this article, we use a corporate social responsibility (CSR) framework to analyze the payday loan industry by critically examining its practices from an economic, legal, and ethical perspective. Payday loans are essentially a very high cost, unsecured, short‐term personal loan. Given the inherent nature of the product being offered, the industry appears on the face of it to be in a position to potentially exploit vulnerable consumers in pursuit of profits. With this concern in mind, our analysis investigates the (...) following three issues: Can the payday loan industry currently be considered to be acting in a socially responsible manner? If the industry cannot be considered to be socially responsible, should it be further regulated? If the industry should be further regulated, how should it be regulated? To address these issues, we first provide a brief historical overview of payday loans. Second, we describe the important characteristics of payday loans and how the industry operates. Third, we draw on various sources of evidence to demonstrate that the payday loan industry, while fulfilling its basic economic obligations, falls outside of both the legal and ethical domains of the Three Domain Model of CSR. Based on our analysis, our conclusion is that the payday loan industry requires additional government legal regulation, particularly with respect to allowable fees, and we conclude that there is a strong ethical case for banning payday loans altogether. : The Centers for Disease Control and Prevention (CDC) has recommended that HIV testing be routinely offered to certain patients in hospitals with a high prevalence of HIV infection and on all pregnant women. The CDC does not, however, offer implementation level guidelines for obtaining informed consent. We provide a moral justification for requiring informed consent for HIV testing and propose guidelines for securing such consent.
