:A good deal of contemporary moral nonconsequentialism assumes that agents have perfect knowledge about the various features and consequences of their options. This assumption is unrealistic. More often than not, moral agents can only assess with a certain degree of probability the factual circumstances that are morally relevant for their decision making. My aim in this essay is to discuss the problem of moral decisions under risk from the point of view of nonconsequentialism. Basically, I analyze how objective moral principles (...) can be transformed into subjective, decisional prescriptions, and argue that the standard nonconsequentialist approach to moral decision making, which focuses on probability thresholds, is wrong. In accordance with the fundamental postulates of nonconsequentialism, I seek to solve the problem of risk in moral choice by proposing a theory about the marginal moral value of various options. Actions can vary along various dimensions, and each of these dimensions can offer a different moral value function. Nonconsequentialist marginalism can level the playing field with consequentialism. Whereas consequentialism can simply borrow the notion of expected utility from economics, nonconsequentialism must introduce the notion of expectational obligation to formulate a general principle of moral choice under risk. I finally suggest that further empirical work is needed to delineate the shape of various moral value functions that are critical for applying the general principle of moral decision making under risk to well-known cases. Contemporary political philosophers discuss the idea of freedom in terms of two distinctions: Berlin's famous distinction between negative and positive liberty, and Skinner and Pettit's divide between liberal and republican liberty. In this essay I proceed to recast the debate by showing that there are two strands in liberalism, Hobbesian and Lockean, and that the latter inherited its conception of civil liberty from republican thought. I also argue that the contemporary debate on freedom lacks a perspicuous account of the various (...) conceptions of freedom, mainly because it leaves aside the classic contrast between natural liberty and civil liberty. Once we consider both the negative/positive distinction and the natural/civil one, we can classify all conceptions of freedom within four basic irreducible categories. In light of the resulting framework I show that there are two distinct conceptions of republican liberty, natural and civil, and that the former is coupled with an ideal of individual self-control. Raz holds that necessarily all legal authorities, even de facto authorities, make a claim to legitimate authority. He does not say that legitimacy is a necessary property of law. This view, which I call the claim view, constitutes my focal point in this paper. Many commentators have criticized this view. I discuss and dismiss three critiques of the claim view: the verification critique (the claim view is not empirically confirmed), the legalistic critique (law claims legal authority, not moral authority), and (...) the semantic critique (legal obligations are semantically distinct from moral obligations). I submit that Raz equates the meaning of legal duties with that of moral duties and yet denies that legal statements entail moral propositions. In other words, I distinguish the semantic identity thesis from the semantic entailment thesis. Instead of a semantic interpretation of the claim view, I defend a presuppositional ascription of a general claim to moral authority to authoritative duty‐imposing and normatively committed uses of legal language by official spokesmen. I show that law’s claim to authority does not prove the truth of the sources thesis, because conceptual confusion or insincerity can affect the epistemic reliability of the propositions embodied in the claim, and because blatant immorality can altogether cancel law’s pragmatically presupposed claim to moral authority. I also argue that the claim view can only warrant two qualified versions of exclusive legal positivism, one of which is almost tautological, the other self‐contradictory. Finally, I suggest that exclusive legal positivism cannot be defended on conceptual grounds. (shrink)

The article distinguishes metaphysical from practical communitarianism. Metaphysical communitarianism is alleged to involve a concealed ideological element, which leads its adherents to stereotypes when trying to capture the essence of the modern self. The claim is examined that minorities, or other ethnic and cultural groups have collective rights, either moral or legal in nature. Justifications of collective rights resorting to the value of cultural identity are said to be in need of explaining why the proper way of protecting such value (...) is through rights. It is argued that practical communitarianism’s case for collective rights needs embracing meta-normative and normative relativism, whose application to political action yields consequences at odds with widespread ethical intuitions. Bulygin cree que Raz omite advertir que los enunciados jurídicos son proposiciones normativas de segundo nivel y que las únicas permisiones capaces de cerrar el sistema jurídico son las permisiones fuertes o explícitas. En este trabajo sostengo que Raz se refiere a un tipo de clausura que es (...) inconcebible en el contexto de un programa reduccionista como el de Bulygin. Una vez que se visualiza que los enunciados jurídicos son proposiciones prácticas del primer nivel, parece obvio que la regla de clausura de Raz es un teorema deóntico. Eugenio Bulygin claims that Joseph Raz's theory on the necessary closure of normative systems derives from the error to take weak or negative permissions as normative solutions. Bulygin believes that Raz fails to notice that legal statements are second-level normative propositions and that the only permissions capable of closing a normative system are strong or explicit permissions. In this paper I argue that Raz focuses on one kind of closure that is inconceivable within the context of a reductionist program such as Bulygin's. Once one visualizes that legal statements are first-level practical claims, it seems obvious that Raz's closure rule is a deontic theorem. (shrink)

Exploro una lectura diferente que evita una dicotomía tajante entre las razones prudenciales y las razones morales y subraya en cambio la discontinuidad entre la normatividad subjetiva de la ley natural y la normatividad objetiva de la ley positiva. Sostengo que el contrato de sujeción política establece obligaciones objetivas recién cuando el soberano exige el cumplimiento de los contratos. La obligación política es entonces (...) una forma de obligación jurídica. Además, enfatizo que la comunidad moral de Hobbes solo es posible dentro del Estado. In this paper, I criticize Luciano Venezia's moralized interpretation of the Hobbesian concept of political obligation. I explore a different reading that avoids a clear-cut dichotomy between prudential and moral reasons and underscores instead the discontinuity between natural law's subjective normativity and civil law's objective normativity. I contend that the pact of political subjection establishes objective obligations only when the sovereign requires the fulfillment of contracts. Political obligation is then a form of legal obligation. In addition, I emphasize that Hobbes's moral community is only possible within the State. (shrink)

En este trabajo diseño un posible marco de análisis fenomenológico para describir la experiencia de percibir la performance de que se cuenta un chiste. Partiendo del análisis de Michael Barber en su Religion and Humor as Emancipating Provinces of Meaning, Cham, Suiza, Springer / CARP, 2017 me ocupo de lo que sucede en el ámbito finito de sentido del humor. El chiste presenta una estructura de relato. El análisis del discurso y la semántica lingüística han avanzado en este tema de (...) manera relevante y me apropiaré de algunas de sus consideraciones sobre la estructura del chiste para mi indagación. En la segunda sección me dirigiré a tematizar la experiencia perceptiva de la situación mencionada. Puesto que adhiero a la posición filosófica que sostiene que la risa se produce por la percepción de una incongruencia entre dos historias que se parecen contar en el relato que es el chiste, relacionaré la experiencia de percibir (auditiva y visualmente) ese relato dislocado en la performance con los análisis de las síntesis pasivas temporales de Husserl. Finalmente, si logro explicitar que las síntesis pasivas operan en la experiencia del chiste, entonces mostraré que dicha experiencia es del orden de lo teatral. (shrink)

A rational moral code must satisfy the condition of completeness. This same condition applies to a set of moral rights, where it takes the form of requiring that all the rights in that set be compossible: that their respective correlatively entailed duties be jointly fulfillable. Such joint fulfillability is guaranteed only by a set of fully differentiated individual domains. And if moral rights are to play any independent role in moral reasoning - any role logically independent of the values that (...) bring persons into conflict - those domains must be determined by rules which are not derived from those values. Practical wisdom eliminativism has recently been proposed in both philosophy and psychology, on the grounds of the alleged redundancy of practical wisdom (Miller 2021 ) and its purported developmental/psychological implausibility (Lapsley 2021 ). Here we respond to these challenges by drawing on an improved version of a view of practical wisdom, the “Aretai model”, that we have presented elsewhere (De Caro et al. 2021 ; Vaccarezza et al. 2023 ; De Caro et al. forthcoming ). According to this model, practical (...) wisdom is conceptualized: (i) as virtuousness _tout court_, i.e., as the _ratio essendi_ of the virtues, and (ii) as a form of ethical expertise. By appealing to the first thesis, we counter the charge of psychological implausibility, while we rely on the second thesis to address the accusation of redundancy. In conclusion we argue that the Aretai model implies a significant paradigm shift in virtue ethics. Practical wisdom emerges as both necessary and sufficient for virtuousness, thereby downsizing – without eliminating entirely – the role that individual virtues play in our ethical lives. (shrink)

Building on the original formulation of the autopoietic theory (AT), extended enactivism argues that living beings are autopoietic systems that extend beyond the spatial boundaries of the organism. In this article, we argue that extended enactivism, despite having some basis in AT’s original formulation, mistakes AT’s definition of living beings as autopoietic entities. We offer, as a reply to this interpretation, a more embodied reformulation of autopoiesis, which we think is necessary to counterbalance the (excessively) disembodied spirit of AT’s original (...) formulation. The article aims to clarify and correct what we take to be a misinterpretation of AT as a research program. AT, contrary to what some enactivists seem to believe, did not (and does not) intend to motivate an extended conception of living beings. AT’s primary purpose, we argue, was (and is) to provide a universal individuation criterion for living beings, these understood as discrete bodies that are embedded in, but not constituted by, the environment that surrounds them. However, by giving a more explicitly embodied definition of living beings, AT can rectify and accommodate, so we argue, the enactive extended interpretation of autopoiesis, showing that although living beings do not extend beyond their boundaries as autopoietic unities, they do form part, in normal conditions, of broader autopoietic systems that include the environment. This essay compares Rawls's and Nozick's theories of justice. Nozick thinks patterned principles of justice are false, and offers a historical alternative. Along the way, Nozick accepts Rawls's claim that the natural distribution of talent is morally arbitrary, but denies that there is any short step from this premise to any conclusion that the natural distribution is unjust. Nozick also agrees with Rawls on the core idea of natural rights liberalism: namely, that we are separate persons. However, Rawls and Nozick (...) interpret that idea in different ways-momentously different ways. The tension between their interpretations is among the forces shaping political philosophy to this day. The paper aims to sketch Kant’s response to the mind-body problem in his first work, Thoughts on the true estimation of living forces (1747). This is accomplished by first examining the origins of the problem in Descartes, then exploring the traditional responses to the problem, occasionalism, pre-established harmony, and physical influx. Finally, the paper positions Kant as a proponent of physical influx and highlights the unique features and challenges of his perspective.

This paper examines a fundamental philosophical difference between two radical postcognitivist theories that are usually assumed to offer the same view of cognition; namely the autopoietic theory and the enactive approach. The ways these two theories understand cognition, it is argued, are not compatible nor incompatible but rather incommensurable. The reason, so it is argued, is that while enactivism, following the traditional stance held by most of the cognitive theories, understands cognitive systems as constituting a natural kind, the autopoietic theory (...) understands them as constituting only a conventional kind. Additionally, the paper shows that AT’s conventionalist stance about cognition, far from being an undesirable or useless position, offers some methodological virtues that might be timely and welcome in the agitated and revolutionary climate of current cognitive science. Building on an illustrative case of a systemic environmental threat and its multi‐stakeholder response, this paper draws attention to the changing political impacts of corporations in the digital age. Political Corporate Social Responsibility (PCSR) theory suggests an expanded sense of politics and corporations, including impacts that may range from voluntary initiatives to overcome governance gaps, to avoiding state regulation via corporate political activity. Considering digitalization as a stimulus, we explore potential responsibilities of corporations toward public goods in contexts with functioning (...) governments. We show that digitalization—in the form of transparency, surveillance, and data‐sharing—offers corporations’ scope for deliberative public participation. The starry sky beetle infestation endangering public and private goods is thereby used to illustrate the possibility of expanding the political role of corporations in the digital sphere. We offer a contribution by conceptualizing data‐deliberation as a Habermasian variation of PCSR, defined as the (a) voluntary disclosure of corporate data and its transparent, open sharing with the public sector (b) along with the cooperation with governmental institutions on data analytics methods for examining large‐scale datasets (c) thereby complying with existing national and international regulations on data protection, in particular with respect to privacy and personal data. This paper analyses the right to repair (R2R) movement through the lens of radical democracy, elucidating the opportunities and limitations for advancing a democratic repair ethics against a backdrop of power imbalances and vested interests. We commence our analysis by exploring broader political-economic trends, demonstrating that Original Equipment Manufacturers (OEMs) are increasingly shifting towards asset-based repair strategies. In this landscape, hegemony is preserved not solely through deterrence tactics like planned obsolescence but also by conceding repairability while monopolizing repair and maintenance (...) services. We further argue that the R2R serves as an ‘empty signifier’, whose content is shaped by four counter-hegemonic frames used by the R2R movement: consumer advocacy, environmental sustainability, communitarian values, and creative tinkering. These frames, when viewed through Laclau and Mouffe’s theory of radical democracy, reveal different potentials for sustaining dissent and confronting OEMs' hegemony in the field of repair. Analysed in this way, an emerging business ethics of repair can be understood as driven by _the politics of repair beyond repair._ This notion foregrounds the centrality of non-violent conflict and antagonism for bringing radical democratic principles to repair debates, looking beyond narrow instrumentalist conversations, where repairability is treated as an apolitical arena solely defined by concerns for eco-efficiency and resource productivity. El único de los textos mencionados que no es alemán y que tiene como autor a alguien que pertenece al escenario intelectual de Foucault es Cynisme et passion de André Glucksmann, trabajo que ha sido (...) obviado por las diferentes investigaciones en torno a la filosofía cínica y por los estudios sobre la “vuelta” foucaultiana a los griegos. En el presente ensayo no procuraremos apenas dejar en evidencia la originalidad y pertinencia de la concepción glucksmanniana del cinismo, sino, además, mostraremos los elementos en los que se descubre un paralelismo entre dicha concepción y lo sostenido por Foucault en el último de sus seminarios impartidos en el Collège.: In Le courage de la vérité, just prior to his analysis of Cynicism, Foucault refers to a series of texts that have addressed, to some extent, the influence of Ancient Cynicism beyond the margins of ancient times. Among the texts mentioned, there is only one that is not German, whose author belongs to Foucault’s intellectual environment: André Glucksmann’s Cynisme et passion. This work has been ignored by both different pieces of research on Cynicism, and the studies regarding Foucault’s “return” to the Greeks. The present article will not merely highlight the originality and relevance of Glucksmann’s conception of Cynicism, but it will also reveal the elements in which parallelisms can be found between such conception and what Foucault claims in his last course at the Collège de France. A Neuroscientist Offers Evidence of Where the Brain Ends and Consciousness Begins.

The aim of this research is to propose a framework to remedy potential dignity violations to families with children with disabilities seeking tourism experiences. We build on a systematic literature review on the topic of tourism of families with children with disabilities to propose a conceptual framework of dignity protection for this segment. This framework analyzes the responsibilities of four stakeholders (service providers, government, other tourists, and families) classified into dignity thresholds, to reduce attitudinal, information, and infrastructure barriers faced by (...) children with disabilities and their families when traveling. This paper is one of the few studies that connects the concept of dignity to the family tourism literature (with a special focus on a type of family variation neglected in terms of adequate tourism experiences) through a stakeholder approach focusing on the collaboration among actors within the industry to advance the creation of suitable tourism experiences for families with children with disabilities.
