Multiple states are at risk of becoming uninhabitable due to climate change, forcing their populations to flee. While the 1951 Refugee Convention provides the gold standard of international protection, it is only applied to a limited subset of people fleeing their countries, those who suffer persecution, which most people fleeing climate change cannot establish. While many journalists and non-lawyers freely use the term “climate refugees,” governments, and courts, as well as UNHCR and many refugee experts, have excluded most climate refugees (...) from the Convention as a matter of legal interpretation. In our 2015 paper, “Unable to Return in the 1951 Refugee Convention: Stateless Refugees and Climate Change”, we sought to reopen the debate on “climate refugees” by arguing that some climate refugees qualify under the 1951 Convention as it is currently written (even if they are not persecuted): those who are stateless and are unable to return to their country of origin because climate change has rendered it uninhabitable. Our interpretation, however, has been rejected by Goodwin-Gill and McAdam (2021) and by Foster and Lambert (2019), which explicitly responds to our paper. Here, we address and respond to their arguments, and develop a new supplementary one, drawing on the principle of systemic integration, as enshrined in Article 31(3)(c) of the Vienna Convention on the Law of Treaties. Cognitive science is, of course, not really a new discipline, but a recognition of a fundamental set of common concerns shared by the disciplines of psychology, computer science, linguistics, economics, epistemology, and the social sciences generally. All of these disciplines are concerned with information processing systems, and all of them are concerned with systems that are adaptive—that are what they are from being ground between the nether millstone of their physiology or hardware, as the case may be, and the upper (...) millstone of a complex environment in which they exist. Systems that are adaptive may equally well be described as “artificial,” for as environments change, they can be expected to change too, as though they were deliberately designed to fit those environments (as indeed they sometimes are).The task of empirical science is to discover and verify invariants in the phenomena under study. The artificiality of information processing systems creates a subtle problem in defining empirical invariants in such systems. For observed regularities are very likely invariant only within a limited range of variation in their environments, and any accurate statement of the laws of such systems must contain reference to their relativity to environmental features. It is a common experience in experimental psychology, for example, to discover that we are studying sociology—the effects of the past histories of our subjects—when we think we are studying physiology—the effects of properties of the human nervous system. Similarly, business cycle economists are only now becoming aware of the extent to which the parameters of the system they are studying are dependent on the experiences of a population with economic events over the previous generation.In artificial sciences, the descriptive and the normative are never far apart. Thus, in economics, the “principle of rationality” is sometimes asserted as a descriptive invariant, sometimes as advice to decision makers. Similarly, in psychology, the processes of adaptation (learning) have always been a central topic, at one time a topic that dominated the whole field of research. Linguistics, too, has suffered its confusions between descriptive and normative attitudes towards its subject. But we must avoid the error, in studying information processing systems, of thinking that the adaptive processes themselves must be invariant; and we must be prepared to face the complexities of regression in the possibility that they themselves may be subject to improvement and adaptation.It might have been necessary a decade ago to argue for the commonality of the information processes that are employed by such disparate systems as computers and human nervous systems. The evidence for that commonality is now overwhelming, and the remaining questions about the boundaries of cognitive science have more to do with whether there also exist nontrivial commonalities with information processing in genetic systems than with whether men and machines both think. It is often claimed that there can be no such thing as a logic of scientific discovery, but only a logic of verification. By 'logic of discovery' is usually meant a normative theory of discovery processes. The claim that such a normative theory is impossible is shown to be incorrect; and two examples are provided of domains where formal processes of varying efficacy for discovering lawfulness can be constructed and compared. The analysis shows how one can treat operationally and formally (...) phenomena that have usually been dismissed with fuzzy labels like 'intuition' and 'creativity'. (shrink)

What can reason do for us and what can't it do? This is the question examined by Herbert A. Simon, who received the 1978 Nobel Prize in Economic Sciences "for his pioneering work on decision-making processes in economic organizations." The ability to apply reason to the choice of actions is supposed to be one of the defining characteristics of our species. In the first two chapters, the author explores the nature and limits of human reason, comparing and evaluating (...) the major theoretical frameworks that have been erected to explain reasoning processes. He also discusses the interaction of thinking and emotion in the choice of our actions. In the third and final chapter, the author applies the theory of bounded rationality to social institutions and human behavior, and points out the problems created by limited attention span human inability to deal with more than one difficult problem at a time. He concludes that we must recognize the limitations on our capabilities for rational choice and pursue goals that, in their tentativeness and flexibility, are compatible with those limits. (shrink)

ObjectiveCo-morbid insomnia and sleep apnea is a common and debilitating condition that is more difficult to treat compared to insomnia or sleep apnea-alone. Emerging evidence suggests that cognitive behavioral therapy for insomnia is effective in patients with COMISA, however, those with more severe sleep apnea and evidence of greater objective sleep disturbance may be less responsive to CBTi. Polysomnographic sleep study data has been used to predict treatment response to CBTi in patients with insomnia-alone, but not in patients with COMISA. (...) We used randomized controlled trial data to investigate polysomnographic predictors of insomnia improvement following CBTi, versus control in participants with COMISA.MethodsOne hundred and forty five participants with insomnia and sleep apnea [apnea-hypopnea index ≥ 15] were randomized to CBTi or no-treatment control. Mixed models were used to investigate the effect of pre-treatment AHI, sleep duration, and other traditional, and novel [quantitative electroencephalography ] polysomnographic predictors of between-group changes in Insomnia Severity Index scores from pre-treatment to post-treatment.ResultsCompared to control, CBTi was associated with greater ISI improvement among participants with; higher AHI, less wake after sleep onset, and less N3 sleep. No quantitative electroencephalographic, or other traditional polysomnographic variables predicted between-group ISI change.DiscussionAmong participants with COMISA, higher OSA severity predicted a greater treatment-response to CBTi, versus control. People with COMISA should be treated with CBTi, which is effective even in the presence of severe OSA and objective sleep disturbance. (shrink)

The reductive, as opposed to deductive, view of logic is the form of logic that is, perhaps, most widely employed in practical reasoning. In particular, it is the basis of logic programming. Here, building on the idea of uniform proof in reductive logic, we give a treatment of logic programming for BI, the logic of bunched implications, giving both operational and denotational semantics, together with soundness and completeness theorems, all couched in terms of the resource interpretation of BI’s semantics. We (...) use this set-up as a basis for exploring how coalgebraic semantics can, in contrast to the basic denotational semantics, be used to describe the concrete operational choices that are an essential part of proof-search. The overall aim, toward which this paper can be seen as an initial step, is to develop a uniform, generic, mathematical framework for understanding the relationship between the deductive structure of logics and the control structures of the corresponding reductive paradigm. Capturing the lively modernist milieu of Kenneth Burke's early career in Greenwich Village, where Burke arrived in 1915 fresh from high school in Pittsburgh, this book discovers him as an intellectual apprentice conversing with "the moderns." Burke found himself in the midst of an avant-garde peopled by Malcolm Cowley, Marianne Moore, Jean Toomer, Katherine Anne Porter, William Carlos Williams, Allen Tate, Hart Crane, Alfred Stieglitz, and a host of other fascinating figures. Burke himself, who died in 1993 at the age (...) of 96, has been hailed as America's most brilliant and suggestive critic and the most significant theorist of rhetoric since Cicero. Many schools of thought have claimed him as their own, but Burke has defied classification and indeed has often been considered a solitary, eccentric genius immune to intellectual fashions. But Burke's formative work of the 1920s, when he first defined himself and his work in the context of the modernist conversation, has gone relatively unexamined. Here we see Burke living and working with the crowd of poets, painters, and dramatists affiliated with Others magazine, Stieglitz's "291" gallery, and Eugene O'Neill's Provincetown Players; the leftists associated with the magazines The Masses and Seven Arts; the Dadaists; and the modernist writers working on literary journals like The Dial, where Burke in his capacity as an associate editor saw T. S. Eliot's "The Wasteland" into print for the first time and provided other editorial services for Thomas Mann, e.e. cummings, Ezra Pound, and many other writers of note. Burke also met the iconoclasts of the older generation represented by Theodore Dreiser and H. L. Mencken, the New Humanists, and the literary nationalists who founded Contact and The New Republic. Jack Selzer shows how Burke's own early poems, fiction, and essays emerged from and contributed to the modernist conversation in Greenwich Village. He draws on a wonderfully rich array of letters between Burke and his modernist friends and on the memoirs of his associates to create a vibrant portrait of the young Burke's transformation from aesthete to social critic. It is shown how a causal ordering can be defined in a complete structure, and how it is equivalent to identifying the mechanisms of a system. Several techniques are shown that may be useful in actually accomplishing such identification. Finally, it is shown how this explication of causal ordering can be used to analyse causal counterfactual conditionals. First the counterfactual proposition at issue is articulated through the device of a belief-contravening supposition. Then the causal ordering is used to provide modal (...) categories for the factual propositions, and the logical contradiction in the system is resolved by ordering the factual propositions according to these causal categories. If rising seas render small islands uninhabitable, will displaced islanders become stateless? The modern intellectual and legal tradition tells us that states must have defined, habitable territory. If so, small islands will cease to be states, and their inhabitants will accordingly become stateless. Against this, leading scholars have recently argued that the principle of presumption of continuity of state existence implies that island states continue to be states even after becoming uninhabitable. We argue to the contrary: the principle of presumption (...) of continuity of state existence implies no such thing. If nothing is done to prevent the loss of their territory, small islands will lose their statehood, making displaced islanders stateless. (shrink)

Our thinking often uses rich memories of particular past events. Yet frequently we would do better to use other forms of memory. I show that existing accounts of the function of episodic memory cannot account for such cases, then develop an account which can. Roughly: rich representations of particular past events are required for Unrestricted Learning, learning which is not limited in how much of the world’s complexity it can capture; and episodic memory’s selection for Unrestricted Learning could explain its (...) ubiquitous (and often inappropriate) use for other tasks. Concluding with four philosophical essays, this volume of case studies demonstrates how the inventive and persuasive dimensions of scholarly discourse point the way to forms of argument appropriate to our postmodern age.

The task of axiomatizing physical theories has attracted, in recent years, some interest among both empirical scientists and logicians. However, the axiomatizations produced by either one of these two groups seldom appear satisfactory to the members of the other. It is the purpose of this paper to develop an approach that will satisfy the criteria of both, hence permit us to construct axiomatizations that will meet simultaneously the standards and needs of logicians and of empirical scientists.

Intent and mitigating circumstances play a central role in moral and legal assessments in large-scale industrialized societies. Al- though these features of moral assessment are widely assumed to be universal, to date, they have only been studied in a narrow range of societies. We show that there is substantial cross-cultural variation among eight traditional small-scale societies (ranging from hunter-gatherer to pastoralist to horticulturalist) and two Western societies (one urban, one rural) in the extent to which intent and mitigating circumstances influence (...) moral judgments. Although participants in all societies took such factors into account to some degree, they did so to very different extents, varying in both the types of considerations taken into account and the types of violations to which such considerations were applied. The particular patterns of assessment characteristic of large-scale industrialized societies may thus reflect relatively recently culturally evolved norms rather than inherent features of human moral judgment.
