Reuven Leigh provides the first in-depth introduction to the pioneering philosophy of Rabbi Shalom Schneersohn. Bringing him into dialogue with key continental philosophers Emmanuel Levinas, Jacques Derrida and Julia Kristeva, this book reveals how Schneersohn's views anticipated many prominent themes in 20th-century thought. Shalom Schneersohn (1860-1920) was the fifth Rebbe of the Habad-Lubavitch dynasty. He was a traditional, kabbalistic thinker and yet, beyond mysticism, he wrote extensively on speech, gender and the body. So why is he not better known? (...) Examining Schneersohn on language, too, he highlights how Derridean deconstruction involves a more positive approach to presence that was already anticipated in the writings of Schneersohn. And from the disruption of the hierarchy of signification to the semiotic aspect of language and the maternal body, this book demonstrates how Schneersohn foreshadows a number of Kristeva's central philosophical concerns. It also tests the outer limits of the ethical deployment of power. I. Types of Wars The Jewish ethics of war focuses on two issues: its legitimation and its conduct. The Talmud classifies wars according to their source oflegitimation. Biblically mandated wars (...) are termed mandatory (milhemet mitzvah or milhemet hovah). Wars undertaken at the discretion of the Sanhédrin are termed discretionary (milhemet reshut). There are three types of mandatory wars: Joshua's war of conquest againstthe seven Canaanite nations, the war againstAmaleq, anddefensive wars against an already launched attack. Discretionary wars are usually expansionary efforts undertaken to enhance the political prestige of the government or to secure economic gain. The first type of mandatory war is only of historical interest as the Canaanite nations lost their national identity already in ancient times. This ruling, which appears repeatedly in rabbinic literature, is part ofa tendency to blunt the impact of the seven-nations policy. The Bible points out that these policies were not implemented even during the zenith of ancient Israel's power (Kings 9:20; 2 Chr 8:7-9; see also Judges 1:21-33, Ps 106:34). Indeed, an ancient Midrash explicitly excludes the possibility of transferring the seven-nations ruling to other non-Jewish residents of the Land ofIsrael. Maimonides is just as explicit in emphasizing that all trace 44Reuven Kimmelman of them has vanished. By limiting the jurisdiction of the seven-nations ruling to the conditions ofancient Canaan it was effectively removed from the postbiblical ethical agendaand vitiated as aprecedent forcontemporary practice. The second category ofmandatory war, against Amaleq, has also been rendered operationally defunct by comparing them with the Canaanites, or by postponing the battle to the immediate premessianic struggle, or by viewing them as a metaphor for genocidal evil. The two remaining categories, reactive defensive wars (which are classified as mandatory) and expansionary wars (which are classified as discretionary) remain intact. So, for example, King David's response to the Philistine attackaredesignated mandatory, whereashis wars "to expandthe border of Israel" are designated discretionary. Intermediate wars such as preventive, anticipatory, or preemptive defy so neat a classification. Not only are the classifications debated in the Talmud, but commentators disagree on the categorization of the differing positions in the Talmud. The major clash occurs between the eleventh century Franco-German scholar Rashi and the thirteenth century Franco-Provencal scholar Meiri. According to Rashi, the majority position considers preemptive action to be discretionary whereas the minority position expounded by Rabbi Judah considers it to be mandatory. According to Meiri, a preemptive strike, against an enemy who it is feared might attack or who is already known to be preparing for war is deemed mandatory by the majority ofthe rabbis, but discretionaryby Rabbi Judah. Accordingly, Rabbi Judah defines a counterattack as mandatory only in response to an already launched attack. A similar reading of Maimonides also limits the mandatory classification to a defensive war launched in response to an attack. With these distinctions between mandatory and discretionary wars in mind, we should be able to investigate the Jewish concerns with the problematics ofwarby focusing on preemptive strikes, declarations ofwar, ethics of warfare, and draftability. II. Preemptive Strikes as Self-Defense Not only Machiavellians view the security and survival ofthe state as nonnegotiable. National self-defense is as much amoral right as is personal self-preservation. Whereas it is clear that offensive war cannot be subsumed under the inalienable right of self-defense, the moral status of pre-emptive attacks is not as clear. Is the moral category of self-defense Working Warfare and Its Restrictions in the Jewish Tradition 45 limited to an already launched attack? The majority talmudic position, according to Rashi, and that of Rabbi Judah, according to Meiri, would answer in the affirmative. Their position is seconded by Article 51 of the United Nations Charter, which states: "Nothing in the present Charter shall impair the inherentright ofindividual ofcollective self-defense ifan armed attack occurs against a member." Chow's defense of NHSTP ignores the fact that in psychology it is used to test substantive hypotheses in theory-corroborating research. In this role, NHSTP is not only inadequate, but damaging to the progress of psychology as a science. NHSTP does not fulfill the Popperian requirement that theories be tested severely. It also encourages nonspecific predictions and feeble theoretical formulations.

Postema's article discusses, lucidly and probingly, a central jurisprudential idea, which he calls the autonomy thesis. In its general form it is shared by many writers who otherwise support divergent accounts of the nature of law. It is, according to Postema, a thesis that is meant to account for a core idea, that the law's “defining aim is to … unify public political judgment and coordinate social interaction.” In some form or another this core idea is probably supported by Postema (...) himself. However, in this article his concern is to criticize what he takes to be the widespread belief that it is explained by the autonomy thesis. The autonomy thesis is flawed and must be rejected. In arguing to that conclusion he succumbs to one of the unattractive tendencies of contemporary legal and political philosophy, namely he does not discuss anyone's view, but a family of views. This allows one to construct one's target by selecting features from a variety of authors so that the combined picture is in fact no one's view, and all those cited as adhering to it would disagree with it. Scepticism has been the driving force in the development of Greco-Roman culture in the past, and the impetus for far-reaching scientific achievements and philosophical investigation. Early Jewish culture, in contrast, avoided creating consistent representations of its philosophical doctrines. Sceptical notions can nevertheless be found in some early Jewish literature such as the Book of Ecclesiastes. One encounters there expressions of doubt with respect to Divine justice or even Divine involvement in earthly affairs. During the first centuries of the common era, (...) however, Jewish thought, as reflected in rabbinic works, was engaged in persistent intellectual activity devoted to the laws, norms, regulations, exegesis and other traditional areas of Jewish religious knowledge. An effort to detect sceptical ideas in ancient Judaism, therefore, requires a closer analysis of this literary heritage and its cultural context. This volume of collected essays seeks to tackle the question of scepticism in an Early Jewish context, including Ecclesiastes and other Jewish Second Temple works, rabbinic midrashic and talmudic literature, and reflections of Jewish thought in early Christian and patristic writings. What are our duties or rights? How should we act? What are we responsible for? Joseph Raz examines the philosophical issues underlying these everyday questions. He explores the nature of normativity--the reasoning behind certain beliefs and emotions about how we should behave--and offers a novel account of responsibility.

I have based my psychological hypotheses on studies in perception and in personality. Research in these two areas began independently, but by the late forties the supposedly unconnected processes came to be seen as different aspects of one process. For instance, a low tolerance for perceptual ambiguity and cognitive dissonance was found to be significantly correlated with lack of emotional responsiveness, dogmatism, and authoritarianism; conversely, a high tolerance for perceptual ambiguity and cognitive dissonance was found to be significantly correlated with (...) tolerance of emotional ambivalence, openness to new experience, and a liberal world view.1 Later studies, primarily those conducted in the sixties, then established strong correlations between these findings and information-processing styles. Information processing involves three stages: first, stimuli are selected from the environment ; these stimuli are then arranged into "dimensions"; finally, if two or more dimensions result, they are compared and/or combined according to certain rules. H. M. Schroder and his colleagues have established correlations between personality styles and styles of information processing.2 For example, an intolerant personality—that is, one with a low integration index—"identifies and organizes stimuli in a fixed way, and the rules derived from existing schemata are explicit in defining this one way" . What psychologists call an "abstract personality" and identify in terms of "flexibility" or "tolerance of ambiguity"—what in literary studies is most conveniently called "negative capability"—is not necessarily characterized as lacking rules but rather as possessing a greater number of conflicting rules on a lower level which may be accommodated by rules on a higher level. · 1. Is it true that the suffering associated with chronic illness can be controlled in all but a few intractable cases? The bio-ethical literature gives the impression that suffering is primarily pain and that a competent physician should be able to control suffering. This perception jibes neither with my forty years of clinical experience nor with suffering as depicted in novels. Using Kenaz' novel,The Way to the Cats as a starting point, I argue that, with regard to suffering and illness, fiction (...) is closer to reality than professional literature, and suffering is far more than pain. I content that the control of suffering is a modern myth. This argument applies equally well to the control of non-insulin dependent diabetes. Patient selection, duration of follow-up, remembering what we want to remember, bias, self-fulfilled prophecy, and asking the wrong questions are offered as partial explanation for the gap between perception and reality. The complexity of suffering and the elusiveness of its control should be honestly recognized. (shrink)

In Law's Empire Prof. Ronald Dworkin has advanced a new theory of law, complex and intriguing. He calls it law as integrity. But in some ways the more radical and surprising claim he makes is that not only were previous legal philosophers mistaken about the nature of law, they were also mistaken about the nature of the philosophy of law or jurisprudence. Perhaps it is possible to summarize his main contentions on the nature of jurisprudence in three theses: First, jurisprudence (...) is interpretive: “General theories of law… aim to interpret the main point and structure of legal practice”. Second, legal philosophy cannot be a semantic account of the word “law.” Legal philosophers “cannot produce useful semantic theories of law”. We are responsible for not only our actions but also for all that which is our own and under our control. Some machine learning models, in particular deep neural networks (DNNs), are not very well understood; nevertheless, they are frequently used in science. Does this lack of understanding pose a problem for using DNNs to understand empirical phenomena? Emily Sullivan has recently argued that understanding with DNNs is not limited by our lack of understanding of DNNs themselves. In the present paper, we will argue, _contra_ Sullivan, that our current lack of understanding of DNNs does limit our ability to understand with (...) DNNs. Sullivan’s claim hinges on which notion of understanding is at play. If we employ a weak notion of understanding, then her claim is tenable, but rather weak. If, however, we employ a strong notion of understanding, particularly explanatory understanding, then her claim is not tenable. (shrink)

Abraham Joshua Heschel's oeuvre deals with the continuum of Jewish religious consciousness from the biblical and rabbinic periods through the kabbalistic and Hasidic ones with regard to God's concern for humanity. The goal of this study is to show how such a “Nachmanidean” reading has partially displaced the discontinuous “Maimonidean” reading promoted by Yehezkel Kaufman, Ephraim Urbach, and Gershom Scholem. The result is that Heschel's understanding of the development of Jewish theologizing is more influential now than it was during his (...) lifetime. This study traces the growth of that development and explores how Heschel became the scholar-theologian who most succeeded in bridging the gap between scholarship and constructive theology. (shrink)

Cognitive scientists distinguish between automatic and controlled mental processes. Automatic processes are either innately involuntary or become automatized through extensive practice. For example, reading words is a purportedly automatic process for proficient readers and the Stroop effect is consequently considered the “gold standard” of automated performance. Although the question of whether it is possible to regain control over an automatic process is mostly unasked, we provide compelling data showing that posthypnotic suggestion reduced and even removed Stroop interference in highly hypnotizable (...) individuals. Drawing on a large sample of highly hypnotizable participants, we examined the effects of suggestion on Stroop performance both with and without a posthypnotic suggestion to perceive the input stream as meaningless symbols. We show that suggestion administered to highly hypnotizable persons significantly reduced Stroop interference and derailed a seemingly automatic process. (shrink)

Autonomy is an ideal of self‐creation, or self‐authorship; it consists in an agent's successful pursuit of willingly embraced, valuable options, where the agent's activities are not dominated by worries about mere survival. Autonomy in its primary sense is to be understood as the actual living of an autonomous life; autonomy in its secondary sense is to be understood as the capacity to live autonomously. To be autonomous, agents have to meet three conditions: they must possess certain mental capacities, they must (...) have an adequate range of valuable options, and they must enjoy independence from coercion and manipulation. Autonomy should be distinguished from self‐realization, as autonomous persons may choose not to realize their capacities. Autonomy itself, in an environment that supports autonomy, is not similarly optional, as living autonomously is the only way of flourishing within an autonomy‐supporting environment. (shrink)

This chapter addresses the question: what is authority? Authority cannot simply be regarded as a right to rule, as Robert Ladenson has claimed. The recognitional conception of authority, which regards authoritative utterances as reasons to believe that one has a reason to act as instructed, fails to explain why authoritative utterances are also reasons for action. The inspirational conception of authority describes authority in terms of love, but this conception cannot account for authorities that are not ‘loved’ by those whom (...) it rules, nor can it account for the conceptual distinctness of love and authority. Authoritative utterances provide content independent reasons for action, as do promises, threats, offers, and requests, in the sense that there is no direct connection between the reason and the action for which it is a reason. Against Rawls's ‘separateness of persons’ objection to consequentialism, it can be replied that consequentialism does take into account differing personal viewpoints in legitimating trade‐offs between persons’ interests. Nozick's Kantian‐inspired view of rights as side‐constraints is also indecisive, as this view can only proscribe trade‐offs between individuals’ interests that have already been deemed, on independent grounds, to be impermissible. The appearance of agent‐relativity, which underlies both Nozick's case for constraints, and Nagel's argument for partiality, can to some degree be rendered consistent (...) with consequentialism's commitment to agent‐neutrality. More precisely, what might appear to be agent‐relativity may be just agent‐neutrality, but agent‐neutrality as applied to agents’ action's reasons, rather than to their outcome reasons. Williams's argument from integrity, despite its elusiveness, may offer more promising materials for challenging consequentialism. (shrink)

Egalitarian principles should be distinguished from principles, which merely state relevantly complete grounds for the distribution of goods, and which thereafter enjoy a generality of application to those who meet the relevant conditions. Strict or paradigmatic egalitarian principles aim at an equal distribution of a certain good, on grounds generated by existing inequalities in the distribution of that good. Strict egalitarianism should be distinguished from rhetorical egalitarianism, in which equality is invoked simply as a way of drawing attention to the (...) bad effects of inequality; effects that might have arisen in the absence of inequality. Strict egalitarian principles cannot be applied to diminishing principles of entitlement, which already have distributive commitments built into them. Strict egalitarian principles could be applied to non‐diminishing principles of entitlement, but these principles are of doubtful significance to political morality. (shrink)

The ideal of autonomy, together with pluralism, underlies the doctrine of political freedom. Autonomy underlies both positive and negative freedom. Toleration is underpinned by the competitive pluralism that is essential to autonomy. Autonomy is consistent with perfectionism, yet also underlies the ‘harm principle’, which asserts that the only purpose for which the law may use its coercive power is to prevent harm. Perfectionism and the harm principle are consistent with one another because the recommended type of perfectionism abjures coercion, focusing (...) instead on maintaining the framework conditions that are conducive for pluralism and autonomy. This paper argues that a notion of statistical explanation, based on Salmon’s statistical relevance model, can help us better understand deep neural networks. It is proved that homogeneous partitions, the core notion of Salmon’s model, are equivalent to minimal sufficient statistics, an important notion from statistical inference. This establishes a link to deep neural networks via the so-called Information Bottleneck method, an information-theoretic framework, according to which deep neural networks implicitly solve an optimization problem that generalizes minimal sufficient statistics. Meditative poetry has the ability to reproduce aspects of the meditative experience. In this paper we explore this ability, trying to clarify the phenomenon by pointing out the cognitive processes involved. We focus on Christian Jesuit meditation and pinpoint one of its most effective elements: “the composition of place”. We argue that three main abilities associated with “the composition of place” are responsible for the meditative quality detected in poetic meditative texts: The text’s ability to evoke an orientation process; the (...) text’s ability to support diffuse perception and encourage divergent ways of processing; the text’s ability to generate the mental set required for this experience, the absence of purpose, and to supply the conditions that enable such a mental set to exist over time. We illustrate our theoretical discussion through a close reading of two meditative poetic masterpieces: Donne’s Holy Sonnet No. 7, and the Spanish anonymous sonnet “A Cristo Crucificado”. (shrink)
