All over Europe, the provision of healthcare services is widely considered a primary duty of the government. Universal access to medical care can be considered a basic ingredient of the so-called “European social model.” But if universal access to medical care is seldom questioned, European governments—faced with expanding costs caused by an increasing demand driven by an aging population and technology-driven improvements—are contemplating the possibility of “rationing”1 treatments, or the possibility of allowing a greater role for private suppliers. If a (...) “multi-tier” healthcare system has long been anathema to the European leadership, guaranteeing a uniform access to state-of-the-art care seems to be well beyond the means of states suffering from persisting debt crisis. Was the failure of state-controlled “adequate” healthcare totally unpredictable? Far-sighted criticisms had been offered by two eminent thinkers in the classical liberal tradition, Herbert Spencer and Friedrich A. von Hayek . Neither author is usually recognized as a forerunner of contemporary critics of the welfare state, and both investigated the issue of the state financing and providing health services well before or right after the establishment of national health services. With the benefit of hindsight, reading Spencer and Hayek helps us to understand how the crisis of state-supplied healthcare is not rooted in the mere progress of clinical technology, but is rather the logical consequence of the theoretical basis of the model itself. Whereas modern theorists of the welfare state tend to offer theories that are impervious to a critical appraisal of their unintended consequences—insofar as they are framed in a language of “rights”—both Hayek and Spencer understood that human systems are complex, and that unwanted effects of public policy should be taken into account. Although Spencer emphasized the moral hazards accruing from the paternalism involved in governmental provision of health services, Hayek explained how modern healthcare systems differ from real, private insurance designed to offer proper coverage against risks. These authors appreciated that the politicization of healthcare was bound to result in both standardization of care and disregard for the responsibility that comes with personal freedom. These two “diagnoses before the illness” can help us in defining the challenges and the potential solutions that healthcare systems face today. Understanding the fatal conceits inherent in the very architecture of national health services can be the first step toward healing our healthcare systems. (shrink)

Antonio Rosmini-Serbati was one of the first natural law scholars to bring natural law thinking into a conversation with the market economic order that was beginning to emerge in Europe in the 19th century. His reflections on matters such as the origin, nature, and limits of private property, the role of the state, and the nature of human reason show him to be a unique, innovative thinker who nonetheless was determined to work within the parameters of Catholic doctrine. Many of (...) these ideas are concretized in his seminal work The Constitution Under Social Justice, a text that has profound instights to offer those today seeking to integrate theology, philosophy, and economics into their conceptions of a social order that aspires to be both free and just. This essay is my review of Colleen Dyble’s book, Taming Leviathan: Waging a War of Ideas around the World. Dyble is affiliated with the legendary classical liberal British think tank, the Institute of Economic Affairs. Her anthology is a collection of essays by people around the world who have been involved with similar free-market think tanks in countries with historically statist economic systems. These writers include Greg Lindsay, founder of the Center for Independent Studies in Australia; Margaret Tse, of the (...) Instituto Liberdade in Brazil; Michael Walker, co-founder of the Fraser Institute in Canada; Cristian Larroulet, of Libertad y Desarrollo in Chile; Giancarlo Ibarguen, of the Center for Economic and Social Studies in Guatemala (which actually founded a free-market-oriented university); Parth Shah, founder of the Center for Civil Society in India; Daniel Doron, co-founder of the Israeli Center for Social and Economic Progress; Alberto Mingardi, of the Instituto Bruno Leoni in Italy; Masaru Uchigama, founder of the Japanese for Tax Reform; Elena Leontjeva, co-founder of the Lithuanian Free Market Institute; Alexander Magno, co-founder of the Foundation for Economic Freedom in the Philippines; and last, Leon Louw, of the Free Market Foundation of South Africa. What is racism? is a timely question that is hotly contested in the philosophy of race. Yet disagreement about racism’s nature does not begin in philosophy, but in the sociopolitical domain. Alberto G. Urquidez argues that philosophers of race have failed to pay sufficient attention to the practical considerations that prompt the question “What is racism?” Most theorists assume that “racism” signifies a language-independent phenomenon that needs to be “discovered” by the relevant science or “uncovered” by close scrutiny of (...) everyday usage of this term. (Re-)Defining Racism challenges this metaphysical paradigm. Urquidez develops a Wittgenstein-inspired framework that illuminates the use of terms like “definition,” “meaning,” “explanation of meaning,” and “disagreement,” for the analysis of contested normative concepts. These elucidations reveal that providing a definition of “racism” amounts to recommending a form of moral representation—a rule for the correct use of “racism.” As definitional recommendations must be justified on pragmatic grounds, Urquidez takes as a starting point for justification the interests of racism's historical victims. Beginning from some passages by Vācaspati Miśra and Bhāskararāya Makhin discussing the relationship between a crown and the gold of which it is made, this paper investigates the complex underlying connections among difference, non-difference, coreferentiality, and qualification qua relations. Methodologically, philological care is paired with formal logical analysis on the basis of ‘Navya-Nyāya Formal Language’ premises and an axiomatic set theory-based approach. Gregorio Klimovsky argumentó en contra de los análisis sintacticistas de la noción de lenguaje. En este trabajo se examinan sus argumentos, destacando su vínculo con las discusiones recientes sobre universalidad expresiva, y se plantean algunas réplicas atendibles. Luego se adopta un enfoque general de la cuestión que resulta incompatible con el sintacticismo estricto pero que permite una reformulación aceptable, vinculada con una idea minimalista sobre el alcance de la teoría semántica. In this paper I examine his arguments, noting their links with recent discussions of universal expressibility, and raise some plausible objections. Afterwards I adopt a general approach to the issue which is incompatible with strict syntacticism but allowing an acceptable reformulation, associated with a minimalist notion of the scope of the semantic theory. The present paper is a continuation of a previous one by the same title, the content of which faced the issue concerning the relations of coreference and qualification in compliance with the Navya-Nyāya theoretical framework, although prompted by the Advaita-Vedānta enquiry regarding non-difference. In a complementary manner, by means of a formal analysis of equivalence, equality, and identity, this section closes the loop by assessing the extent to which non-difference, the main issue here, cannot be reduced to any of the (...) former. Focusing especially on Science and the Modern World, this article explores Whitehead's understanding of the social contexts and repercussions of mathematical and scientific abstraction. It investigates his remarks on the need to offset pernicious practices of abstraction in the context of a renewed concern with the link between conceptuality and materiality in social theory. Whitehead's inquiry into the problematic legacy of Galileo and scientific materialism is then contrasted with a different diagnosis of the abstractive maladies of modern society, the one (...) put forward under the Marxist rubric of `real abstraction'. While both stances allow us to explore the social repercussions of abstractive practices, it is argued that an understanding of the practically abstract character of capitalism permits us to identify the limits of Whitehead's pedagogical wish to reform our culture of abstraction. The Covid-19 pandemic has further intensified a crisis in the functions and the perception of the state. It has also revealed underlying contradictions in both mainstream and radical ideologies of the state. A desire for the state as guarantor of public welfare vies with fear of the state’s hypertrophic capacities for surveillance and control. Following a brief exploration of the intimate modern connection between plagues and the state, the article tries to map some of the ways in which the state (...) has been at stake in political and theoretical commentaries on the pandemic. Is an epidemiological politics from below, beyond the plague state, possible? Can recent emergency measures be seen as incomplete or inverted anticipations of a communist use of the state of exception? We prove that such maximal chain cannot be found computably, not even hyperarithmetically: No hyperarithmetic set can compute maximal chains in all computable wpos. However, we prove that almost every set, in the sense of category, can compute maximal chains in all computable wpos. Wolk’s original result (...) actually shows that every wpo has a strongly maximal chain, which we define below. The question examined in this article is whether the contemporary world system is leading to a world society. World system connotes that we live in an increasingly interdependent world. The author examines the nature of world system in relation to world society. Then the author examines the nature of the world system as a growing interconnected global order, and the yet non-existent world or global society, a society as a network of social relations with mutual expectations and normative consensus. Difference (...) perspectives of world society are discussed, followed by a focus on cosmopolitan ethics and transnational civil society. Institutions of democratic world society and the implications are examined. The author concludes: more and more people come to live in a single world system; a transnational civil society and an international public space are growing; a global communitarian culture and a cosmopolitan ethics are gaining ground. There has been some concern m recent years that economic interests in the biotechnology area could, particularly through patenting, have a constricting influence on scientific research. Despite this concern, there have been no studies of this phenomenon beyond isolated cases. In this article we examine the evolution of the biomedical field of hybridoma/monoclonal antibody research with detailed examples of the three types of patent claims that have emerged there—basic claims, claims on application techniques, and claims on specific antibodies. We analyze (...) the impact of these claims and their legal histories on the free flow of scientific information and, the activity of scientific researchers. We conclude that such patent claims present severe restrictions for both, not only in the monoclonal area but in general, amounting to a subtle but significant shift in the political economy of science and technology. Positional notation and related numerical manipulation techniques of Indian origin were introduced to Europe during the twelfth century through Arabic mediation and vividly described by Fibonacci as modus Indorum, the method of the Indians. This article aims to juxtapose Sanskrit and Latin texts to highlight the connections and differences between matrix and reflection in a complex cultural process of diffusion and assimilation. With reference to positional notation, this contribution examines a conceptual distinction between the graphical notion of position and a (...) logical-classificatory principle hitherto perhaps not fully recognized, although present in the texts of both traditions. The thesis of a consequent diagrammatic conception of positional notation in its origins, as a system of rules relating graphical position and order of magnitude, is also advanced. (shrink)

This article reconsiders Marx’s thinking on religion in light of current preoccupations with the encroachment of religious practices and beliefs into political life. It argues that Marx formulates a critique of the anticlerical and Enlightenment-critique of religion, in which he subsumes the secular repudiation of spiritual authority and religious transcendence into a broader analysis of the ‘real abstractions’ that dominate our social existence. The tools forged by Marx in his engagement with critiques of religious authority allow him to discern the (...) ‘religious’ and ‘transcendent’ dimension of state and capital, and may contribute to a contemporary investigation into the links between capitalism as a religion of everyday life and what Mike Davis has called the current ‘reenchantment of catastrophic modernity’. The main argument of this article is based on a functional disanalogy, between what I will call ‘international humanity-based law’, constituted by human rights and criminal law, and the domestic rule of law. If we adopt a functionalist approach, the attention has to be focused both on Rule of Law’s pragmatical objective – a reasonable stability – and on its means – formalism and legality, for dealing with indeterminacy. Do international key players share such values, embedded in the Rule of (...) Law’s political project? Does humanity-based international law fulfil the requirements of the Rule of Law? The conclusion of this work is that institutions and mechanism to which usually legal scholars refer when stating that a legal order is a Rule of Law, are almost absent in humanity-based international law. That implies that radical indeterminacy is, in humanity issues, a too strong obstacle for achieving the ideal of the Rule of Law. (shrink)

This article concerns the role of haptic perception in the act of enjoying sculptures and it takes as a starting point an unusual experience “in the dark”. Starting with a short description of this experience, some focal theoretical constructs of Art Psychology – in the tradition of Gestalt theory and Rudolf Arnheim – are addressed, namely expressive qualities and perceptual forces and tensions. Revisiting these constructs in a haptic key allows the consideration of aesthetic behaviour in the plastic art domain (...) and the proposal of “naturalistic” research lines aimed at gaining a sharper comprehension of its features. This article seeks to trace the origins of contemporary ‘post-workerism’ in the formulation of concepts of political subjectivity, antagonism and insurrection in Tronti and Negri. In particular, it tries to excavate the seemingly paradoxical position which postulates the increasing immanence of struggles, as based on the Marxian thesis of real subsumption, together with the intensification of the political autonomy or separation of the working class. In order to grasp the political and theoretical proposals of Italian workerism and autonomism, Toscano concentrates (...) on the thesis of a historical transformation of capitalism into an increasingly parasitical and politically violent social relation, a thesis which is grounded in an interpretation of Marx’s notion of ‘tendency’ and which serves as the background to the exploration, especially in Negri, of increasingly uncompromising forms of antagonism. The article focuses especially on Tronti’s so-called ‘Copernican revolution’—giving workers’ struggles primacy in the understanding of capitalism—and critically inquires into the effect of this workerist axiom on Negri’s writings on proletarian sabotage and insurrection in the 1970s. By way of a conclusion, it notes the difficulties in prolonging the workerist gambit in light of capital’s continued effort, as Tronti would put it, to emancipate itself from the working class. In the last years, starting from the study of the foundations of human rights, Pier Cesare Bori has focused his research on the exegesis of Genesis 1, 26-28, according to which man is created in the image of God. In the Christian framework the imago Dei has led to different interpretations: a charismatic and eschatological, an ontological and a functional one. To solve the contradictions between these different exegesis of imago Dei Bori has suggested to consider a larger context, looking (...) not only at the Christian tradition, but also at the other monotheisms, cultures and religions. The proceedings here presented are the result of this attempt to develop new approaches to the study of the topic of imago Dei. It has been undertaken by an international group of scholars from different research fields (history, theology, hermeneutics, philosophy, exegesis) during a few days of scientific exchange and dialogue.
