The Architectonics of Meaning is a lucid demonstration of the purposes, methods, and implications of philosophical semantics that both supports and builds on Richard McKeon's and other noted pluralists' convictions that multiple philosophical approaches are viable. Watson ingeniously explores ways to systematize these approaches, and the result is a well-structured instrument for understanding texts. This book exemplifies both general and particular aspects of systematic pluralism, reorienting our understanding of the realms of knowing, doing, and making.

Are demands for equality motivated by envy? Nietzsche, Freud, Hayek, and Nozick all thought so. Call this the Envy Objection. For egalitarians, the Envy Objection is meant to sting. Many egalitarians have tried to evade the Envy Objection.. But should egalitarians be worried about envy? In this paper, I argue that egalitarians should stop worrying and learn to love envy. I argue that the persistent unwillingness to embrace the Envy Objection is rooted in a common misunderstanding of the nature of (...) the charge, what it reveals, and what can be said in response to it. I develop what Bernard Williams might call a vindicatory genealogy of envy, thereby allowing us to see that envy, rather than undermining egalitarian intuitions, can in fact play a distinct justificatory role (when it is fitting), which undermines the Envy Objection. Are workers dominated? A recent suite of neo-republican and relational egalitarian philosophers think they are. Suppose they are right; that is, suppose that some workers are governed by an unjust and arbitrary power existing in labour relations, which persists even in the presence of the actual ability to exit. My question is this: does that give us reason to impose restrictions on firms? According to the so-called Efficiency Objection there are relevant trade-offs that need to be considered between the efficiency (...) of firms and the freedom of workers, and upon considering these trade-offs, we should reject workplace democracy. In this paper, I present a dilemma for the Efficiency Objection. I argue that either the Efficiency Objection is justified on moral grounds or non-moral grounds; if the Efficiency Objection is justified on moral grounds, then it fails because efficiency cannot be valued for its own sake (it is only instrumentally good); if the Efficiency Objection is justified on non-moral grounds, then it fails because of the respect that we owe to persons as persons; therefore, the Efficiency Objection fails. Dorothy Edgington’s work has been at the centre of a range of ongoing debates in philosophical logic, philosophy of mind and language, metaphysics, and epistemology. This work has focused, although by no means exclusively, on the overlapping areas of conditionals, probability, and paradox. In what follows, I briefly sketch some themes from these three areas relevant to Dorothy’s work, highlighting how some of Dorothy’s work and some of the contributions of this volume fit in to these debates.

Se resume en esta obra el vasto y complejo sistema teórico-jurídico de Hans Kelsen, el jurista más grande de nuestro siglo. La doctrina de Kelsen y en particular su Teoría Pura del Derecho han conocido muchas vicisitudes y ataques debidos más a prejuicios políticos y racistas que a una verdadera confrontación con sus tesis. El autor enfatiza en el hecho de que la doctrina jurídica de Kelsen no es una teoría terminada y archivada sino en permanente desarrollo, una teoría a (...) cuya ulterior construcción están convocados todos los juristas. Der von W. SELB (S.) und H. KAUFHOLD (K.) unter dem Titel „Das Syrisch-Römische Rechtsbuch“ (SRRB) edierte Text hat seit dem Ende des 17. Jahrhunderts zunächst in Form von kleinen Fragmenten in verschiedenen orientalischen Sprachen Spuren in der europäischen rechtsgeschichtlichen Forschung hinterlassen. Erst mit der Entdeckung einer syrischen Handschrift im Britischen Museum durch J. P. N. Land 1858 ist das Werk in einem wesentlichen Textzeugen bekannt und seitdem durch weitere Funde ergänzt, ins Lateinische und moderne Sprachen übersetzt und juristisch kommentiert (...) worden. Dennoch hat es bislang keine auf allen (syrischen) Handschriften beruhende kritische Edition erfahren. Die Autoren machen dies im ersten Kapitel (Bd.1, 27–42) verständlich, indem sie die Irrungen und Wirrungen der Wissenschaftsgeschichte des Textes darlegen. In diesem ersten Kapitel werden die Grundfragen, welche sich mit dem Text und seinem Verständnis verbinden, in offener und klarer Sprache formuliert. Das SRRB ist demnach eine einheitliche Sammlung von Erklärungen zu juristischen Texten zumeist normativen Charakters (Kaiserinstitutionen, leges) oder seltener von Juristenschriften (z. B. Paulussentenzen) aus verschiedenen Zeiten, die als „interpretatio“ um das Jahr 474 n. Chr. in griechischer Sprache entstanden ist (I, 46). Diese Erkenntnis, die S. im Kern schon in seiner Habilitationsschrift thesenhaft formuliert hat, wird durch die gegenwärtige Schrift erhärtet. Sie bildet die Grundlage für jede weitere Beschäftigung mit der Quelle. Richtungsweisend sind ebenfalls die nunmehr angestellten Überlegungen zum Verfasser des SRRB. In einer Handschrift (R III) wird ein Ambrosius confessor als Autor benannt. Diese Notiz deutete die Forschung bislang als Hinweis auf den Kirchenvater Ambrosius von Mailand, der freilich als Autor eines juristischen Werkes mit prononciert östlicher Verbreitung schwerlich in Frage kommt. Dennoch haben die Autoren die handschriftliche Notiz nicht als völlig aus der Luft gegriffen betrachtet. (shrink)

The post-classical (or post-Avicennan, post-Rāzian) genre of the “protocols for dialectical inquiry and disputation” (ādāb al-baḥth wa-l-munāẓara) has its more proximate origins in the famed Risāla of Shams al-Dīn al-Samarqandī (d. 722/1322). The greater part of his conceptions and methodology, however, consists in a streamlining and universalizing of the more strictly juristic dialectic (jadal / khilāf) of his teacher Burhān al-Dīn al-Nasafī (d. 687/1288); and this in turn draws on the highly logicized dialectic of Rukn al-Dīn al-ʿAmīdī (d. 615/1218) and (...) his teacher Raḍī al-Dīn al-Nīsābūrī (d. 617/1220). At the heart of methods in this lineage, and carried forward by al-Samarqandī into the universal ādāb al-baḥth, are three truth-preserving logical relationships critical to the truth-seeking enterprise of dialectic: entailment (talāzum / mulāzama), mutual negation or exclusion (tanāfin / munāfā), and causal concomitance (dawarān). The practical elaboration of these relations reveals a logic in action—a premodern dialogical logic for living disputation praxis. In fact, so critical were these to the dialectical enterprise that al-Samarqandī devoted a specialized treatise entirely to summarizing their defining features and rules, aptly naming it the ʿAyn al-Naẓar, or “Wellspring of Rational Investigation.” In this article, and drawing upon a recently published digital critical edition, I will present an analytical outline of these core logical relations as presented in the ʿAyn al-Naẓar. Then I will address a number of points of interest in this text, grouped under six themes: the potential for cross-disciplinary advancement; notions in discursive development; significant or uniquely contributive formulations; peculiarities of content; signs of an evolving, universalist agenda; and evidence that the ʿAyn al-Naẓar was designed as an aide-mémoire for the active disputant. The Dialectical Forge identifies dialectical disputation as a primary formative dynamic in the evolution of pre-modern Islamic legal systems, promoting dialectic from relative obscurity to a more appropriate position at the forefront of Islamic legal studies. The author introduces and develops a dialectics-based analytical method for the study of pre-modern Islamic legal argumentation, examines parallels and divergences between Aristotelian dialectic and early juridical jadal-theory, and proposes a multi-component paradigm—the Dialectical Forge Model—to account for the power of jadal in shaping Islamic (...) law and legal theory.In addition to overviews of current evolutionary narratives for Islamic legal theory and dialectic, and expositions on key texts, this work shines an analytical light upon the considerably sophisticated “proto-system” of juridical dialectical teaching and practice evident in Islam’s second century, several generations before the first “full-system” treatises of legal and dialectical theory were composed. This proto-system is revealed from analyses of dialectical sequences in the 2nd/8th century Kitāb Ikhtilāf al-ʿIrāqiyyīn / ʿIrāqiyyayn through a lens molded from 5th/11th century jadal-theory treatises. Business Ethics: A European Review, EarlyView.

Academic and public debates are increasingly concerned with the question whether and how algorithmic decision-making may reinforce social inequality. Most previous research on this topic originates from computer science. The social sciences, however, have huge potentials to contribute to research on social consequences of ADM. Based on a process model of ADM systems, we demonstrate how social sciences may advance the literature on the impacts of ADM on social inequality by uncovering and mitigating biases in training data, by understanding data (...) processing and analysis, as well as by studying social contexts of algorithms in practice. Furthermore, we show that fairness notions need to be evaluated with respect to specific outcomes of ADM systems and with respect to concrete social contexts. Social sciences may evaluate how individuals handle algorithmic decisions in practice and how single decisions aggregate to macro social outcomes. In this overview, we highlight how social sciences can apply their knowledge on social stratification and on substantive domains of ADM applications to advance the understanding of social impacts of ADM. We study a class of two-player normal-form games with cyclical payoff structures. A game is called circulant if both players’ payoff matrices fulfill a rotational symmetry condition. The class of circulant games contains well-known examples such as Matching Pennies, Rock-Paper-Scissors, as well as subclasses of coordination and common interest games. The best response correspondences in circulant games induce a partition on each player’s set of pure strategies into equivalence classes. In any Nash Equilibrium, all strategies within one class are either (...) played with strictly positive or with zero probability. We further show that, strikingly, a single parameter fully determines the exact number and the structure of all Nash equilibria in these games. The parameter itself only depends on the position of the largest payoff in the first row of one of the player’s payoff matrix. (shrink)

Da gegenwärtig kein allgemeinverbindlicher Begriff des ‚Neukantianismus‘ oder gar der ‚Transzendentalphilosophie‘ zur Verfügung steht und somit unter heutigen Bedingungen nicht aufs Geratewohl eine Geschichte der transzendentalsystematischen Bemühungen des 20. Jahrhunderts verfaßt werden kann, lag es nahe, sich diesem Thema anhand einer Analyse der Diskussionen zu nähern, in denen sich die sogenannte Selbstauflösung des Neukantianismus dokumentiert. Im Zuge dieser Annäherung war insbesondere an Siegfried Marcks zweibändiges Werk über DIE DIALEKTIK IN DER PHILOSOPHIE DER GEGENWART (Tübingen 1929/31) anzuknüpfen, das die transzendentalphilosophische Diskussion (...) der 20er Jahre unter dem Aspekt einer „kritischen Dialektik“ zusammenfaßt; einer kritischen Dialektik, die sich aufgrund der Ablehnung der neukantianischen „Konstruktion eines idealen Subjekts“ und der darum nunmehr verstärkten Einsicht in die „Spannung zwischen dem existierenden Subjekte und dem Geltungsbereich“ ausgeformt habe und als das verbindende Motiv in „Jonas Cohns Theorie der Dialektik, R. Höngswalds Denkpsychologie, Br. Bauchs Ideenlehre, P. Natorps Lehre vom Grenzdenken, N. Hartmanns Aporetik, E. Cassirers philosophische[r] ‚Anthropologie‘, Max Adlers neukantische[m] Marxismus“ anzusehen sei (S. Marck [1929], S. III). Wie allein schon der Hinweis auf „N[icolai] Hartmanns Aporetik“ zeigt, geht diese,Hegel-Renaissance in der deutschen Philosophie‘ (H. Levy) auch Hand in Hand mit einer Ontologisierung der Transzendentalphilosophie. Dieser Transzendentalontologie, die sich - teils in dialektischem Einverständnis mit und teils in antidialektischem Gegensatz zur ‚Hegel-Renaissance‘ - mit einer nach den unterschiedlichsten Richtungen hin wirksamen ‚Leibniz-Renaissance‘ verband, war im Titel der vorliegenden Untersuchung um so mehr Rechnung zu tragen, als das ontologische Motiv (vorallem unter dem Eindruck der Hartmannschen Neo-Ontologie und der Heideggerschen Existentialontologie) in den transzendentalsystematischen Arbeiten der Nachkriegszeit eindeutig in den Vordergrund tritt. Der Titel KRITISCHE DIALEKTIK UND TRANSZENDENTALONTOLOGIE steckt daher sowohl den inhaltlichen wie auch den zeitlichen Rahmen der Untersuchung ab: ihr Thema sind die post-neukantianischen Systembildungen, die in Auseinandersetzung mit den dominierenden Philosophemen der Zwischen- und Nachkriegszeit (der Neo-Ontologie und der Lebens- und Existenzphilosophie) am transzendentalen Ansatz und Systemanspruch festhielten, indem sie den überzeitlichen Geltungsanspruch der Idee und die innerzeitliche Existenz ‚dialektisch‘ oder ‚monadologisch‘ zu vermitteln suchten. Nachdem aus transzendentalsystematischer Sicht das Ringen um eben diese Vermittlungsproblematik ohnehin die gesamte abendländische Philosophiegeschichte ‚seit Parmenides und Platon‘ beherrscht, sagt diese Eingrenzung der Thematik allerdings mehr über das Selbstverständnis der Systemdenker aus, als sie zu deren philosophiegeschichtlicher Positionierung beiträgt. Man kommt daher dem Eigentümlichen der post-neukantianischen Systembildungen näher, wenn man – ihre Differenz zum Neukantianismus hervorhebend – betont, daß sie sich aufgrund der Ablehnung der neukantianischen „Konstruktion eines idealen Subjekts“ (S. Marck) dem Problem der ‚Konkretisierung der Transzendentalität‘ (Erich Heintel) oder einer ‚Philosophie der konkreten Subjektivität‘ (Hans Wagner) stellen. Da man die Phänomenologie Husserls und die Philosophische Anthropologie in gleicher Weise charakterisieren kann, muß diese Problemstellung in unserem Zusammenhang freilich nicht so sehr als Verabschiedung, sondern als Weiterführung neukantianischer Traditionen verstanden werden; da der Versuch einer Rekonstruktion der neukantianischen Theoriestränge, die sich gegenüber den lebensphilosophischen, ontologischen und positivistischen Zersetzungen des kritizistischen Ansatzes resistent erwiesen, zur Revision einiger gängiger Vorurteile bezüglich des Neukantianismus zwingt, wird im Zuge der einleitenden Analyse der sogenannten Selbstauflösung des Neukantianismus aber auch der Begriff ‚Neukantianismus‘ selbst in grundsätzlicher Weise zu bestimmen sein. Diese Begriffsbestimmung liefert das gesuchte Kriterium für die systematische Eingrenzung der Thematik und somit für die Auswahl der Repräsentanten der Kritischen Dialektik und Transzendentalontologie, deren philosophische Bemühungen in der Folge dokumentiert sind. Durchaus in Verbindung und Übereinstimmung mit diesen systematischen Erwägungen war für die nähere Auseinandersetzung mit Richard Hönigswald und Wolfgang Cramer, Bruno Bauch und Hans Wagner, sowie mit Robert Reininger und Erich Heintel, nicht zuletzt der Umstand maßgeblich, daß ihre Arbeiten eine für die Philosophie des 20. Jahrhunderts bemerkenswerte Kontinuität transzendentalphilosophischer Ansätze demonstrieren und dennoch keineswegs die Beachtung gefunden haben, die sie im Interesse einer lebendigen Aneignung und kritischen Weiterführung der Transzendentalphilosophie verdienen. Die vorliegende Arbeit versucht vorallem diese Kontinuität transzendentalphilosophischer bzw. neukantianischer Ansätze herauszustellen und die aus der individuellen Problemsicht der genannten Autoren resultierende produktive Weiterbildung dieser Ansätze zu dokumentieren, indem sie jeweils monographisch die einzelnen Denkwege verfolgt. We investigated the properties of the sustained attention to response task . In the SART, participants respond to frequent neutral signals and are required to withhold response to rare critical signals. We examined whether SART performance shows characteristics of speed–accuracy tradeoffs and in addition, we examined whether SART performance is influenced by prior exposure to emotional picture stimuli. Thirty-six participants in this study performed SARTs after being exposed to neutral and negative picture stimuli. Performance in the SART changed rapidly over (...) time and there was a high correlation between participants errors of commission rate and their reaction time to the neutral targets . Regardless of exposure self-reported thoughts significantly correlated with both errors of commission and reaction times. Overall, the results support the view that the SART is a better measure of impulsive responding than sustained attention. (shrink)

This book is a discussion of the most timely and contentious issues in the two branches of neuroethics: the neuroscience of ethics; and the ethics of neuroscience. Drawing upon recent work in psychiatry, neurology, and neurosurgery, it develops a phenomenologically inspired theory of neuroscience to explain the brain-mind relation. The idea that the mind is shaped not just by the brain but also by the body and how the human subject interacts with the environment has significant implications for free will, (...) moral responsibility, and moral justification of actions. It also provides a better understanding of how different interventions in the brain can benefit or harm us. In addition, the book discusses brain imaging techniques to diagnose altered states of consciousness, deep-brain stimulation to treat neuropsychiatric disorders, and restorative neurosurgery for neurodegenerative diseases. It examines the medical and ethical trade-offs of these interventions in the brain when they produce both positive and negative physical and psychological effects, and how these trade-offs shape decisions by physicians and patients about whether to provide and undergo them. When young children learn to use language, they start to use their hands in co‐verbal gesturing. There are, however, considerable differences between children, and it is not completely understood what these individual differences are due to. We studied how children at 4 years of age employ speech and iconic gestures to convey meaning in different kinds of spatial event descriptions, and how this relates to their cognitive abilities. Focusing on spontaneous illustrations of actions, we applied a semantic feature (SF) analysis (...) to characterize combinations of speech and gesture meaning and related them to the child's visual‐spatial abilities or abstract/concrete reasoning abilities (measured using the standardized SON‐R test). Results show that children with higher cognitive abilities convey significantly more meaning via gesture and less solely via speech. These findings suggest that young children's use of cospeech representational gesturing is positively related to their mental representation and reasoning abilities. (shrink)
