Thesis Eleven is honoured to be able to publish this text by our late friend and mentor Agnes Heller. It was secured in the period before her recent death, and is published now posthumously in her memory. Echoing her earlier text written as an Imaginary Preface to Arendt’s Totalitarianism, it responds to themes in the later text, The Life of the Mind. These were among the most eminent of the minds referred to later as Women in Dark Times. Their connection (...) was not only institutional, via the New School, but represented a deep and ongoing affinity and critical engagement in political and philosophical terms. The imaginary letter arcs around issues and questions indicated by Cicero, Kant, Heidegger and Wittgenstein, including matters of republicanism, rhetoric and the question of thinking. Best of all, it shows Agnes Heller at work, at her best: it shows her thinking. Like Arendt, she offers inspiration, provocation, through thinking. (shrink)

Modern theories of authoritarianism have stressed the importance of threat to the expression of authoritarian attitudes and intolerance. Arguably, authoritarian tendencies may have increased during COVID-19 pandemic, a major threat to life and security. One issue arising when comparing mean scores is that of measurement invariance. Meaningful comparisons are only possible, if latent constructs are similar between groups and/or across time. This prerequisite is rarely ever tested in research on authoritarianism. In this study, we aim to analyze the short scale (...) for authoritarianism KSA-3 by investigating its measurement invariance on two levels and latent mean changes using two German representative samples. Specifically, we look at differences before and during the pandemic. While measurement invariance holds across both levels in all conditions, we find a decrease in latent means in 2020, contrary to expectations and established theories. Moreover, latent means differ with regard to gender, education, and east–west Germany. We conclude that analyses of latent means and measurement invariance instead of mean comparisons with composites should become the standard. Future studies should focus on threat as a moderator between authoritarianism and intolerance, and on possible interactions with context variables. (shrink)

Drawing on Charles Tilly’s work on inequality, democracy and cities, we explore the local level dynamics of democratization across urban settings in India, South Africa, and Brazil. In all three cases, democratic institutions are consolidated, but there is tremendous variation in the quality of the democratic relationship between cities and their citizens. We follow Tilly’s focus on citizenship as the key element in democratization and argue that explaining variance across our three cases calls for analyzing patterns of inequality through the (...) kind of relational lens used by Tilly and recognizing that patterns of contestation are shaped by shifting political relationships between the nation and the city. We conclude that Tilly’s theoretical frame is nicely sustained by the comparative analysis of cases very different from those that stimulated his original formulations. (shrink)

The Rest of Language When Aristotle, at the opening of his treatise on interpretation, defines the nature and function of language, he does so by referring "the things in the voice [ta en tei phonei]" to impressions on the soul (pathe¯mata), which, in turn, he refers to "things [pragmata]" [De interpretatione 16a4 ff.]. Aristotle's text establishes, in this way, that vocal utterances are signs of things. The philosophical significance of this gesture could not be more decisive. Once De interpretatione determines the canonical form of the statement as a "meaningful sentence [logos se¯mantikos]" and, more precisely, as a "proposition [logos apophantikos]" bearing truth or falsity, and once it asserts that truth and falsity reside in the composition (synthesis) of elements [16a10-15], 1 the consequence is inevitable: the paradigmatic form of true speech must be that of the "statement of one thing concerning another thing [legein ti kata tinos]" [17a25]. 2 Here it matters little whether the relation of speech to things is grasped as one of imitation or constitution, reproduction or production; it matters little, moreover, whether the things at issue--that which language means--are understood as sensible objects or supersensuous entities, material beings or logical idealities. In every utterance, speech, by virtue of its very form, is necessarily capable of being dissolved into those things of which it speaks. Indeed, the Aristotelian principle of analysis (literally, "loosening up") demands this [End Page 22] dissolution as the end toward which all speech, insofar as it is both assertive and predicative, ultimately tends. Language is thus posited only in order to be effaced; its specific constituents are identified only to be returned, in the end, to the world of things. When Augustine writes, in a lapidary formula at the start of his De doctrina christiana, that "things are learned by signs [res per signa discuntur]" [1.2.2.20], he simply summarizes what is already stated in the Aristotelian locus classicus: words, the elements of language, function in the service of things; when words show what exists, their task is accomplished.Werner Hamacher's works constitute perhaps the most powerful contemporary attempt to delineate and interrogate this aporetic structure, by which language, in its classical philosophical and theoretical elaboration, is simultaneously constructed and effaced, identified as such and destituted of all propriety. The implications of this structure, which are both logical and metaphysical, extend not only to the Aristotelian, but even to the most modern theories of language and its operation. "At the end of every semantic theory of language and its truth," Hamacher thus writes in Premises: Essays on Philosophy and Literature from Kant to Celan, "stands the aporetic verdict: language does not speak; it has nothing to say" [P 338; EV 325]. When language is determined by its "semantic and referential functions," we read, it follows that at "the end and thus the site of its destination, it no longer means anything and no longer refers to anything" [P 338; EV 325]. If Hamacher's texts often take as their point of departure contemporary doctrines of literary production and language, it is because, in the field of literary studies, the invocation of the semantic determination of language thus leads thought to eliminate the very element that might have been its subject of examination: language. The one discipline that might have resisted the apophantic dissolution of language proves itself not to be, as the German term has it, a "science of literature [Literaturwissenschaft]" but, rather, "more or less clandestinely a science against literature" [P... In “The Choice Theory of Contracts,” we explain contractual freedom and celebrate the plurality of contract types. Here, we reply to critics by refining choice theory and showing how it fits and shapes what we term the “Contract Canon”. I. Freedom. (1) Charles Fried challenges our account of Kantian autonomy, but his views, we show, largely converge with choice theory. (2) Nathan Oman argues for a commerce-enhancing account of autonomy. We counter that he arbitrarily slights noncommercial spheres central to human (...) interaction. (3) Yitzhak Benbaji suggests that choice theory’s commitment to autonomy is overly perfectionist. Happily, in response to Benbaji, we can cite with approval Charles Fried’s point that contract types are “enabling our liberties.” II. Choice. (4) Aditi Bagchi criticizes our inattention to impediments to choice. We show how choice theory’s commitments to both multiplicity and relational justice ameliorate these impediments. (5) Gregory Klass explores parol evidence to highlight the mechanisms of choice. We substantially concur with his position, and show how such mechanisms can ensure voluntariness, an essential element of choice. (6) Oren Bar-Gill and Clayton Gillette question the institutional capacity of existing legal actors to implement choice theory. Working from the example of cohabitation, we offer a somewhat more optimistic view. III. Contracts. (7) Peter Benson contends our focus on the rational slights the reasonable. Although we did not use this Rawlsian vocabulary, choice theory complies with its strictures — more so than transfer theory. (8) Daniel Markovits and Alan Schwartz claim provocatively that contract theory must: capitulate before pluralism (as they endorse); leverage it; or fall victim to a so-called “embracing” approach (their charge against us). We reject the charge that choice theory is foundationally value-pluralist. Instead, we cabin pluralism and put it to work. (9) The Contract Canon starts on the next big step for choice theory by explaining existing doctrine (rebutting Benson on lack of fit) and helping adjudicate contract practice (countering Markovits and Schwartz on the vices of our pluralism). Each Article in this Issue advances the field; each prompts us to refine choice theory — all steps, we hope, toward a more just and justified law of contract. (shrink)

Presenting a contemporary interpretation of stoicism, the essay draws on Agnes Heller's philosophy of existential choice in order to outline a reconstructed stoic theory of happiness and a pneumatic ethics addressing the context and dynamics of cybernetically structured societies in which vocational (professional) ethics play a declining role.

ABSTRACT David Roberts’ History of the Present asks what comes after the grand narratives of European modernity. Progress is over, but without a past and with no assured future, the present remains in conceptual limbo. For Roberts, we are entering a new stage of a global cultural modernity marked by the end of European modernism. Taking a fresh look at the contested endings of the modern, Roberts suggests that an extended concept of contemporaneity might replace the problematic dualism of past (...) and present, modernity and post-modernity at the end of the twentieth century. This review article discusses Roberts’ argument with reference to the work of Budapest School members, Ágnes Heller and György Markus, with reference more broadly to seminal theorists such as Georg Lukács, Walter Benjamin, Theodor Adorno, Alain Touraine and Guy Debord, and to writers including Marcel Proust, Heinrich Mann, Aldous Huxley and Michel Houellebecq, in relation to the questions of cultural modernity. Modern contract law is characterized by a certain kind of unity and multiplicity. On the one hand, it establishes fundamental principles that apply to all contracts in general. But at the same time, it specifies further principles and rules for particular kinds of contracts or transaction-types that mark out their distinctive features, incidents and effects. Clearly, a viable theory of contract law should be able to provide a suitable account of both aspects. The central critical contention of The Choice Theory (...) of Contracts is that all prior approaches, in particular rights-based theories, have failed to do so. Indeed, Dagan and Heller argue that only a theory that explains the settled rules of contract law as teleologically oriented toward facilitating individuals’ pursuit of their different substantive goods, and thus as primarily power-conferring in this particularly robust sense, can provide the needed account. Such a theory, they believe, would be not only interpretatively accurate with respect to the actual law but also fully acceptable as a liberal view of contract. This Article challenges the core contentions of choice theory, suggesting why it may be unable to meet its own goal of explaining how contract law coherently specifies and integrates the general and specific dimensions of enforceable agreements. The Article looks into basic contract doctrines in order to specify a general conception of the contractual relation that can meet this desideratum and it sketches how, beginning with that conception, contract law unfolds a rich multiplicity of transaction-types. The resulting view is liberal but rights-based rather than teleological, and it proposes an alternative understanding of how the rules of contract law are power-conferring as well as duty-imposing. The debate about the nature of modernity and postmodernity has become central to intellectual culture today. In this work, two distinguished social theorists make a distinctive contribution to this continuing discussion.

When do two sentences say the same thing, that is, express the same content? We defend two-component (2C) semantics: the view that propositional contents comprise (at least) two irreducibly distinct constituents, (1) truth-conditions, and (2) subject-matter. We contrast 2C with one-component (1C) semantics, focusing on the view that subject-matter is reducible to truth- conditions. We identify exponents of this view and argue in favor of 2C. An appendix proposes a general formal template for propositional 2C semantics.

Berkeley’s likeness principle is the claim that “an idea can be like nothing but an idea”. The likeness principle is intended to undermine representationalism: the view (that Berkeley attributes to thinkers like Descartes and Locke) that all human knowledge is mediated by ideas in the mind which represent material objects. Yet, Berkeley appears to leave the likeness principle unargued for. This has led to several attempts to explain why Berkeley accepts it. In contrast to ‘metaphysical’ and ‘epistemological’ interpretations available in (...) the literature, in this paper I defend a ‘conceptual’ interpretation. I argue that Berkeley accepts the likeness principle on the basis of (i) his commitment to the transparency of ideas, and (ii) his account of resemblance which he sets out in his works on vision. Thus, I provide an explanation for Berkeley’s reasons for accepting the likeness principle which, appropriately, focuses on his views concerning ideas and likeness. (shrink)

Margaret Macdonald was at the institutional heart of analytic philosophy in Britain in the mid-twentieth century. Yet, her views on the nature of philosophical theories diverge quite considerably from those of many of her contemporaries. In this paper, I focus on her 1953 article ‘Linguistic Philosophy and Perception’, a provocative paper in which Macdonald argues that the value of philosophical theories is more akin to that of poetry or art than science or mathematics. I do so for two reasons. First, (...) because it reveals just how far Macdonald’s meta- philosophical views diverged from those of many of her contemporaries. Second, because the discussion in LPP pre-empts recent literature on the nature of philosophical inquiry and the efficacy of philosophical arguments. Separating the concept associated with a kind term from the extension of that term, as Putnam and others have urged, raises the possibility of accepting counterexamples to compatibilistic analyses (...) without rejecting compatibilism. Even if no compatibilist analysis of our concept of free action is acceptable, a compatibilist account of the essential nature of free action may be. (shrink)

This volume constitutes the largest collection of writings by the Italian philosopher Giorgio Agamben hitherto published in any language. With one exception, the fifteen essays, which reflect the wide range of the author’s interests, appear in English for the first time. The essays consider figures in the history of philosophy and twentieth-century thought. They also examine several general topics that have always been of central concern to Agamben: the relation of linguistic and metaphysical categories; messianism in Islamic, Jewish, and Christian (...) theology; and the state and future of contemporary politics. Despite the diversity of the texts collected here, they show a consistent concern for a set of overriding philosophical themes concerning language, history, and potentiality. In the first part of the book, Agamben brings philosophical texts of Plato and Benjamin, the literary criticism of Max Kommerell, and the linguistic studies of J.-C. Milner to bear upon a question that exposes each discipline to a limit at which the possibility of language itself is at stake. The essays in the second part concern a body of texts that deal with the structure of history and historical reflection, including the idea of the end of history in Jewish and Christian messianism, as well as in Hegel, Benjamin, and Aby Warburg. In the third part, the issues confronted in the first and second parts are shown to be best grasped as issues of potentiality. Agamben argues that language and history are structures of potentiality and can be most fully understood on the basis of the Aristotelian theory of _dynamis_ and its medieval elaborations. The fourth part is an extensive essay on Herman Melville’s short story “Bartleby, the Scrivener.”. (shrink)

This paper provides a philosophical evaluation of the concept of handedness prevalent but largely unspoken in the scientific literature. This literature defines handedness as the preference or ability to use one hand rather than the other across a range of common activities. Using the philosophical discipline of phenomenology, I articulate and critique this conceptualization of handedness. Phenomenology shows defining a concept of handedness by focusing on hand use leads to a right hand biased concept. I argue further that a phenomenological (...) model based in spatial orientation rather than hand use provides a more inclusive concept of handedness. (shrink)

Psychological studies of touch and blindness have been fraught with controversy. Within this field there remains an important theoretical divide. Many researchers have taken a cognitive approach to the study of touch and blindness, relating these to higher order processes, such as memory and concept formation. Others adopt a theoretical perspective, arguing that it not necessary to consider the 'internal representation' of the stimuli, when investigating touch - thus people make use of information from the physical biomechanical properties of their (...) limbs as they assess the physical properties of objects. In addition, psychologists differ in the relative importance they place on the modality of sensory stimulation for subsequent perceptual experiences. Some psychologists argue that touch can do many of the things that are accomplished by vision, and claim that the mode of sensory stimulation is not critically important for perception, arguing that much information can be obtained through non-visual modalities. Others suggest that there are important consequences of a lack of visual experience, arguing for the importance of multiple forms of sensory input for conceptual development. New to the Debates in Psychology series, Touch, Representation, and Blindness brings together the leading investigators in these areas, each presenting the evidence for their side of the debate. An introductory chapter sets the theoretical and historical stage for the debate, and a concluding chapter draws together the different views and ideas set forth by the contributors, summarizing and resolving the discussion.
