It cannot be denied that Obama would be who he is even if he had done another job or had met another woman, yet there are reasons of the heart that make this result difficult to accept. The current and the next issues of “Spazio Filosofico”, both devoted to Festival (Festival I and II respectively), are dedicated to Ugo Perone on the occasion of his 70th birthday. Perone’s friends and colleagues have chosen to celebrate his birthday in a philosophical way, namely, with a reflection on the concept of festival/holiday [festa] and its meaning for us today. Thrifty spirits might object that a journal issue is like a gift – one is enough. Are these not times of (...) economic crisis? There is no real festival, however, without a Zugabe: without an addition, an encore, or a supplement. Hence, two issues, both devoted to a single concept. The choice of the theme has not been accidental – the concept of “festival/holiday” plays in fact an important role in Perone’s thought. In an essay that is often quoted in various contributions to the two issues, Perone understands the pair of concepts “ultimate/penultimate,” which has been discussed by Dietrich Bonhoeffer, in terms of “holidays/everydayness.” For Bonhoeffer, God is present not where human abilities fail but rather “at the center of the village.” Likewise, for Perone, the square, which is the “symbol for the holiday time,” is the center of town. The ‘bat and ball’ is one of the problems most frequently employed as a testbed for research on the dual-system hypothesis of reasoning. Frederick (J Econ Perspect 19:25–42, 2005) is the first to envisage the possibility that different numerical arrangements of the ‘bat and ball’ problem could lead to different dynamics of activation of the dual-system, and so to different performances of subjects in task accomplishment. This possibility has triggered a strand of research oriented to accomplish ‘sensitivity analyses’ of the (...) ‘bat and ball’ problem. The scope of this paper is to test experimentally the specific hypothesis that numerals are responsible for the selective activation of the two systems of reasoning in this task. In particular, we argue that their role goes beyond and cannot be reduced to that of numbers conceived as magnitudes. To test our hypothesis, we devise an experimental setting in which the role of numbers (as magnitudes) is rendered irrelevant. We find experimental results consistent with our hypothesis. We further provide a link between the literature on mathematical problem-solving and that on mathematical cognition research, in particular that branch labeled embodied mathematical cognition. In Lewis reconstructs set theory using mereology and plural quantification (MPQ). In his recontruction he assumes from the beginning that there is an infinite plurality of atoms, whose size is equivalent to that of the set theoretical universe. Since this assumption is far beyond the basic axioms of mereology, it might seem that MPQ do not play any role in order to guarantee the existence of a large infinity of objects. However, we intend to demonstrate that mereology and plural quantification (...) are, in some ways, particularly relevant to a certain conception of the infinite. More precisely, though the principles of mereology and plural quantification do not guarantee the existence of an infinite number of objects, nevertheless, once the existence of any infinite object is admitted, they are able to assure the existence of an uncountable infinity of objects. So, ifMPQ were parts of logic, the implausible consequence would follow that, given a countable infinity of individuals, logic would be able to guarantee an uncountable infinity of objects. (shrink)

At the turn of the century, the rise of digital media significantly changed our world. The digitizing of traditional media has extraordinarily increased the circulation of texts, sound, and images. Digital media have also widened our horizons and altered our relationship with others and with ourselves. Information production and communication are still undoubtedly significant aspects of (...) digital media and life. Recently, however, recording, registration and keeping track have taken the upper hand in both online practices and the imaginaries related to them. Background Italy was the first European country to be involved with the COVID-19 pandemic. As a result, many healthcare professionals were deployed and suddenly faced end-of-life care management and its challenges. Aims To understand the experiences of palliative care professionals deployed in supporting emergency and critical care staff during the COVID-19 first and second pandemic waves. Research design A qualitative descriptive design was adopted, and in-depth interviews were used to investigate and analyse participants’ perceptions and points of view. Participants and (...) research context Twenty-four healthcare professionals (physicians, nurses, psychologists, physiotherapists, and spiritual support) from the most affected areas of Italy were recruited via the Italian society of palliative care and researchers’ network. Ethical considerations The University Institutional Board granted ethical approval. Participants gave written informed consent and agreed to be video-recorded. Findings The overarching theme highlighted participants’ experience supporting health professionals to negotiate ethical complexity in end-of-life care. Crucial topics that emerged within themes were: training emergency department professionals on ethical dimensions of palliative and end-of-life care, preserving dying patients’ dignity and developing ethical competence in managing end-of-life care. Conclusions Our study showed palliative care teams’ challenges in supporting health professionals’ ethical awareness in emergencies. However, while they highlighted their concerns in dealing with the emergency staff’s lack of ethical perspectives, they also reported the positive impact of an ethically-informed palliative care approach. Lastly, this study illuminates how palliative care professionals’ clinical and ethical competence might have assisted a cultural change in caring for dying patients during COVID-19 and future emergencies. Molecular interactions are at the origin of life. How molecules get at different locations in the cell and how they locate their partners is a major and partially unresolved question in biology that is paramount to signaling. Spatio‐temporal correlations of fluctuating fluorescently tagged molecules reveal how they move, interact, and bind in the different cellular compartments. Methods based on fluctuations represent a remarkable technical advancement in biological imaging. Here we discuss image analysis methods based on spatial and temporal correlation of (...) fluctuations, raster image correlation spectroscopy, number and brightness, and spatial cross‐correlations that give us information about how individual molecules move in cells and interact with partners at the single molecule level. These methods can be implemented with a standard laser scanning microscope and produce a cellular level spatio‐temporal map of molecular interactions. (shrink)

The enormous increasing of connections between people and the noteworthy enlargement of domains and methods in sciences have augmented extraordinarily the cardinality of the set of meaningful human symbols. We know that complexity is always on the way to become complication, i.e. a non-tractable topic. For this reason scholars engage themselves more and more in attempting to tame plurality and chaos. In this book distinguished scientists, philosophers and historians of science reflect on the topic from a multidisciplinary point of view. (...) Today’s views and analyses about taxation are dominated by the social-welfare approach based on various categories of utilitarianism, most notably those developed by the optimal-tax literature. By contrast, this paper focuses on the ethical foundations of taxation and analyses a tradition that harks back to the 17th century. In particular, we emphasise the notion of legitimate taxation in the history of economic thought from the libertarian, the classical-liberal and socialist perspectives. Regardless of whether one agrees or disagrees with Stacie Friend’s claim that fiction is a genre, her notion of genre can be fruitfully applied to a paradigmatic genre such as science fiction. This article deploys Friend’s notion of genre in order to improve the influential characterization of science fiction proposed by Darko Suvin and to defend it from a criticism recently raised by Simon Evnine. According to Suvin, a work of science fiction must concern “a fictional ‘novum’ validated by cognitive (...) logic.” While Suvin conceives of his characterization as a necessary and sufficient condition for membership in the genre, I propose to cast the notions of “fictional novum” and “cognitive validation” as standard features of the genre, which works of science fiction should have but might lack. I argue that this amended version of Suvin’s characterization can better account for two basic properties of science fiction as a genre, namely its historicity and its relevance to appreciation. Lastly, I show that the amended version can shed some light on the affinity between works of science fiction and philosophical thought experiments. (shrink)

In Categories 12 (14b11–22), Aristotle famously claims that [1] true sentences and reality stand in a mutually implicative relationship, and that [2] reality causes the truth of sentences but not vice versa. In this paper, I first argue that Boethius’ reading of the above passage led medieval logicians to assess [1] and [2] within the framework of a theory of consequence. Then, I consider two important questions raised by Boethius and later logicians in relation to [1] and [2], and, namely, (...) whether the implication described in [1] really satisfies the requirement for consequence, and whether the truthmaking relation posited in [2] can be boiled down to the relation of consequence. Boethius himself, I argue, answered affirmatively to both questions and thus (much like some contemporary truthmaker theorists) committed himself to an account of truthmaking as entailment. I then consider criticisms to Boethius’ account found in the writings of William of Champeaux, two anonymous authors connected to the school of Jocelyn of Soissons, Peter Abelard, and the author of the Ars Meliduna. Here, I argue that the emergence of a concern for relevance drives the need for abandoning Boethius’ account as well as his conception of truthmaking as entailment. (shrink)

Over the past two decades, virtue ethicists have begun to devote increasing attention to applied ethics. In particular, the application of virtue ethical frameworks to the environmental ethics debate has flourished. This chapter reviews recent contributions to the literature in this field and highlights some strengths and weaknesses of thinking about climate change through a virtue ethical lens. Section “Two Benefits of Virtue Ethical Approaches to Climate Change” explores two benefits of applying virtue ethics to climate change: (a) we can (...) better capture the phenomenology of our moral experience, and (b) we avoid the problem of inconsequentialism. Section “A Catalogue of Environmental Virtues” analyzes various practical proposals that have been put forward in the form of specific environmental virtues. Section “An Objection to Virtue-Oriented Approaches to Climate Change” reconstructs a fundamental objection to the idea of using a virtue ethical normative approach to tackling the urgent and imminent dangers of climate change. Conceiving of fictional characters as types allows us to reconcile intuitions of sameness and difference about characters such as Batman that appear in different fictional worlds. Sameness occurs at the type level while difference occurs at the token level. Yet, the claim that fictional characters are types raises three main issues. Firstly, types seem to be eternal forms whereas fictional characters seem to be the outcome of a process of creation. Secondly, the tokens of a type are concrete particulars in (...) the actual world whereas the alleged tokens of a fictional character are concrete particulars in a fictional world. Thirdly, many fictional characters, unlike Batman, only appear in one work of fiction, and therefore one can wonder whether it does make sense to treat them as types. Enrico Müller legt hier die erste philosophische Gesamtdarstellung zur Bedeutung der Griechen für Nietzsches Denken vor. Er zeigt, wie sich in Auseinandersetzung mit dem Griechentum Nietzsches eigene Philosophie entwickelte, und problematisiert deren Abgrenzungen von der Logosphilosophie der griechischen Klassik. Müller kommt dabei zu dem Schluss, dass auch Nietzsches Philosophie letztlich auf die Vorgaben der sokratisch-platonischen Dialektik angewiesen bleibt.

Diachronic perceptual atomism is the view that the contents of experience do not involve temporal relations between non-simultaneous events, such as motion, succession, or duration, but only 'snapshots' of the world. Traditionally, atomism has not been a very popular view. Indeed, many philosophers think that it is obviously false and that the main debate about time consciousness takes place between models which reject atomistic commitments. This antiatomistic sentiment can be traced back to William James's slogan that 'a succession of feelings, (...) in and of itself, is not a feeling of succession'. In this paper I argue, first, that the arguments typically launched against atomism in the spirit of James's slogan fail; and second, that the viability of atomism depends on what the conditions for a mental event's being an experience are. In particular, I argue that if a mental event is an experience only if it fulfils certain downstream conditions, which concern the role of the event in the subject's cognitive life, then atomism fails. Otherwise, it is in fact a viable and in many ways attractive view. It follows from my discussion that, contrary to popular belief, atomism is by no means obviously false. Rather, its viability depends on one's further views about the relationship between experience and cognition. (shrink)

This paper develops Richard Wollheim’s claim that the proper appreciation of a picture involves not only enjoying a seeing-in experience but also abiding by a standard of correctness. While scholars have so far focused on what fixes the standard, thereby discussing the alternative between intentions and causal mechanisms, the paper focuses on what the standard does, that is, establishing which kinds, individuals, features and standpoints are relevant to the understanding of pictures. It is argued that, while standards concerning kinds, individuals (...) and features can be relevant also to ordinary perception, standards concerning standpoints are specific to pictorial experience. Drawing on all this, the paper proposes an ontology of depiction according to which a picture is constituted by both its visual appearance and its standard of correctness. (shrink)

This paper considers two issues raised by the claim that fictional characters are abstract artifacts. First, given that artifacts normally have functions, what is the function of a fictional character? Second, given that, in experiencing works of fictions, we usually treat fictional characters as concrete individuals, how can such a phenomenology fit with an ontology according to which fictional characters are abstract artifacts? I will indirectly address the second issue by directly addressing the first one. For this purpose, I will (...) rely on the notion of a mental file. I will argue that the function of fictional characters is the generation of mental files of a special kind. I will show that our experience of fictional characters as concrete individuals depends on the kind of mental files that are generated by fictional characters as abstract artifacts. I will conclude that an appreciator of a work of fiction can open two files about a certain fictional character; one about the character as an individual in the fictional world, and the other about the character as an abstract artifact in the actual world. In this sense, our relation to a fictional character is characterized by a duality of files or ‘twofileness’. (shrink)

This paper reflects my address as IAAIL president at ICAIL 2021. It is aimed to give my vision of the status of the AI and Law discipline, and possible future perspectives. In this respect, I go through different seasons of AI research : from the Winter of AI, namely a period of mistrust in AI, to the Summer of AI, namely the current period of great interest in the discipline with lots of expectations. One of the results of the first (...) decades of AI research is that “intelligence requires knowledge”. Since its inception the Web proved to be an extraordinary vehicle for knowledge creation and sharing, therefore it’s not a surprise if the evolution of AI has followed the evolution of the Web. I argue that a bottom-up approach, in terms of machine/deep learning and NLP to extract knowledge from raw data, combined with a top-down approach, in terms of legal knowledge representation and models for legal reasoning and argumentation, may represent a promotion for the development of the Semantic Web, as well as of AI systems. Finally, I provide my insight in the potential of AI development, which takes into account technological opportunities and theoretical limits. (shrink)
