Francisco Suarez (1548-1617) jesuite, juriste et theologien espagnol est un representant emblematique de la seconde scolastique. Sa reflexion se deploie dans le cadre bouillonnant de l'Universite de Salamanque qui voit la theologie se renover profondement. Considere comme un des plus grands theoriciens des questions juridiques et politiques, son maitre ouvrage, le De Legibus, a marque une etape essentielle de la reflexion anthropologique sur la nature politique de l'individu, mais est surtout remarquable pour le role qu'il a joue dans le long (...) processus de reflexion et de modernisation de la conception antique du pouvoir politique. Les reflexions et orientations qu'il propose sont, pour un certain nombre, a l'origine des outils et conceptions modernes de la politique en general et de la loi en particulier. Jean-Paul Coujou est professeur a la faculte de philosophie de l'Institut catholique de Toulouse et membre de l'Institut Michel Villey. Le pouvoir est au coeur du questionnement politique. L'émergence de l'Etot, au sens moderne, s'appuie sur différentes conceptions du pouvoir, qui évoluent au cours des siècles. L'index detaille de la Metaphysique d'Aristote publie en 1597 par Suarez, constitue une introduction aux Disputes metaphysiques. Il a pour objectif de produire les conditions d'un renouvellement de l'heritage de la Metaphysique d'Aristote en redefinissant le contenu et les limites d'une science de l'etant.Le projet de refondation de la metaphysique comme ontologie s'effectue dans cet ouvrage de presentation en quatre moments:1) L'exposition du probleme de la nature de la connaissance qui implique le depassement de l'equivocite de la notion de sagesse.2) (...) La determination de l'objet, des proprietes et des principes veritables de la metaphysique en tant que science de l'universel, c'est a dire de l'etantite de l'etant selon son abstraction la plus extreme.3) La redefinition du statut de la realite a partir d'une theorie de la representation de l'objet qui fasse abstraction de l'objet, c'est a dire qui procede a l'indifferenciation des etants afin d'en donner une representation universelle et abstraite; ainsi est affirme le primat d'une ontologie de l'essence sur toute ontotheologie.4) Enfin, la mise en place d'un systeme de reference transcendantal rendant possible une fondation universelle de la comprehension de l'etant par la mediation d'une theorie du concept.L'index prefigure ainsi, par son ambition et sa demarche, ce que Heidegger nommera, en evoquant la philosophie de Suarez, l'avenement du "caractere fondamental de la metaphysique moderne". La philosophie de Suárez dans sa confrontation implicite à l’héritage de Thomas More (1478−1535) et de Madrigal (1410?−1455), permet de dégager une double orientation au cœur de la constitution de la théorie politique : celle de la recherche du meilleur régime, du gouvernement idéal, de la meilleure des républiques qui l’emporterait dans l’ordre du bien vivre et que rien ne surpasserait en son genre, espace privilégié où s’exercerait sans contraintes l’imagination sociale ; et celle qui viserait à établir, non la (...) meilleure forme de gouvernement mais qui, en accord avec ce que les hommes sont, créerait les conditions de leur perfectionnement. Il ne s’agirait pas tant de théoriser le meilleur système de gouvernement que de se donner les moyens de poser les fondements du gouvernement le plus adéquat eu égard à la nature humaine. C’est à partir de cette alternative que Suárez se propose de penser la question des limites propres à tout exercice du politique. (shrink)

La place de l’homme dans le monde ne s’épuise pas pour Vivès aux conséquences théologiques de la Chute. L’humanité a le pouvoir de combiner l’usage de la raison théorique et de la raison pratique et fait face, par là même, à sa condition initiale par l’éducation, le savoir et l’éthique. Dès lors, le devenir historique est indissociable du monde de la culture dont la finalité est la réalisation de la liberté et de la concorde.

Selon Rivadeneira, en opposition aux doctrines de Machiavel et de Bodin, il faut désormais proposer au Prince chrétien les moyens de répondre aux dénaturations touchant la représentation du théologico-politique, en établissant les principes éthiques d’une raison d’État chrétienne dont le fondement réside dans les commandements divins, tout en demeurant conciliable avec une norme d’action politique efficace pour le souverain.

Œuvre de maturité de François Suarez (1548-1617), Des lois et du Dieu législateur a été publié en latin en 1612. Parmi les dix livres que comprend cet ouvrage, nous avons choisi de présenter pour la première fois les deux premiers en langue française. À partir de l'héritage retravaillé de la philosophie politique antique et médiévale, Suarez élabore une théorie originale de la loi et de la communauté en renouvelant leur rapport à l'éthique et à la jurisprudence. Dans une période marquée (...) notamment par la controverse de Valladolid (1550) et la Contre-Réforme, l'auteur redéfinit le contenu et la finalité des concepts fondamentaux de la théorie politique (l'état de nature, le droit naturel, le droit subjectif, la loi naturelle, le pacte social, la souveraineté, l'État et le droit des gens) en les articulant à une compréhension historique de l'homme conçu comme être libre, raisonnable et fini. Suarez instaure ainsi les conditions d'un basculement du théologico-politique dans la modernité dont les effets se feront sentir, entre autres, chez Grotius et l'École du droit naturel. Les conséquences de ce mouvement seront perceptibles jusqu'au XVIIIe siècle avec Wolf. Des lois et du Dieu législateur permet précisément d'apprécier à sa juste mesure la place privilégiée qu'il convient de redonner à la théorie suarézienne de la loi dans l'histoire de la pensée politique. El presente artículo analiza el enfrentamiento entre la obra de Suárez y la de Berkeley. Suárez es un representante de la corriente jesuita de la Contrarreforma comprometida en una polémica con Jaime I de Inglaterra sobre la fundación y la legitimidad del poder de derecho divino en la _Defensio __fidei catholicae adversus de anglicana secta_. La teoría de Berkeley, obispo anglicano ortodoxo y conservador que se ocupa de la obediencia pasiva fiel al imperativo paulino según el cual « el que (...) resiste a la autoridad civil resiste al orden que Dios ha establecido» está desarrollada en _Sobre la obediencia pasiva_. Tal enfrentamiento permite reformular la cuestión de la base del consentimiento a la ley, así como la de los límites que le corresponde o no al ser razonable y libre, poder aplicarlo. La comparación se realiza a partir del análisis de 1) Los límites del poder transferido por la comunidad política al soberano; 2) las condiciones para la desobediencia y 3) la necesidad ontológica de la resistencia. The unstated objective of his lecture (“Existentialism Is a Humanism”) was to expound his philosophy as a form of “existentialism,” a term much bandied about at the time. Sartre asserted that existentialism was essentially a doctrine for philosophers, though, ironically, he (...) was about to make it accessible to a general audience. The published text of his lecture quickly became one of the bibles of existentialism and made Sartre an international celebrity. The idea of freedom occupies the center of Sartre’s doctrine. Man, born into an empty, godless universe, is nothing to begin with. He creates his essence—his self, his being—through the choices he freely makes (“existence precedes essence”). Were it not for the contingency of his death, he would never end. Choosing to be this or that is to affirm the value of what we choose. In choosing, therefore, we commit not only ourselves but all of mankind. This book presents a new English translation of Sartre’s 1945 lecture and his analysis of Camus’s _The Stranger_, along with a discussion of these works by acclaimed Sartre biographer Annie Cohen-Solal. The Transcendence of the Ego may be regarded as a turning-point in the philosophical development of Jean-Paul Sartre. Prior to the writing of this essay, published in France in 1937, Sartre had been intimately acquainted with the phenomenological movement which originated in Germany with Edmund Husserl. It is a fundamental tenet of Husserl, the notion of a transcendent ego, which is here attacked by Sartre. First published in France in 1936 as a journal article, The Transcendence of the Ego was one of Jean-Paul Sartre's earliest philosophical publications. When it appeared, Sartre was still largely unknown, working as a school teacher in provincial France and struggling to find a publisher for his most famous fictional work, Nausea . The Transcendence of the Ego is the outcome of Sartre's intense engagement with the philosophy of Edmund Husserl, the founder of phenomenology.
