The dissertation addresses the relationship between common sense, skepticism, and naturalistic science in Hume. It is argued that Hume's moral science uncovers numerous common illusions of visual and moral perception; it is not a defense of common-sense experience. ;Firstly, Hume views the ordinary experience of causation and external reality as illusory. The former experience is a projection of human expectation; the latter a conflation of perceptions. ;Secondly, it is argued that, according to Hume, the moral judge overlooks his biases by (...) fictively projecting himself to an impartial standpoint. Impartial sentiments are weak, however, and their weakness generates another fiction: they are mistaken for the inferences of reason. Finally, the judge falsely imagines that he can "see" the character of the persons whom he judges, when all that he actually sees are their actions. ;Thirdly, the dissertation contends that, although the practice of justice arises out of self-interest, the moral agent mistakes his personal interest for public benevolence. When his hidden selfishness fails to move him, he acts justly in the hope of re-acquiring the "lost" benevolence that he never actually had. He saves himself from disappointment by misinterpreting his actions as signs of genuine reform. In the case of promising, the agent falsely imagines that he wills its moral obligation into being with the words "I promise." ;Fourthly, it is shown how Hume denies that we can find the historical root of political obedience in enlightened self-interest and instead stresses the founding role of usurpation and conquest, erased from memory by the passage of time and the efficacy of present government. ;Finally, we see that the appearance of virtue and vice is the illusory correlate of our sentiments: we project sentiments of approval and disapproval onto others and then mistake them for objective traits. ;Contrary to what some interpreters have asserted, I conclude that, according to Hume, the philosopher is never cured of his profound skepticism. Skepticism recurs as long as the philosopher philosophizes. This is problematic, however, because at its most radical, skepticism is incompatible with moral science. (shrink)

We present a reference model for finding evidence of discrimination in datasets of historical decision records in socially sensitive tasks, including access to credit, mortgage, insurance, labor market and other benefits. We formalize the process of direct and indirect discrimination discovery in a rule-based framework, by modelling protected-by-law groups, such as minorities or disadvantaged segments, and contexts where discrimination occurs. Classification rules, extracted from the historical records, allow for unveiling contexts of unlawful discrimination, where the degree of burden over protected-by-law (...) groups is evaluated by formalizing existing norms and regulations in terms of quantitative measures. The measures are defined as functions of the contingency table of a classification rule, and their statistical significance is assessed, relying on a large body of statistical inference methods for proportions. Key legal concepts and reasonings are then used to drive the analysis on the set of classification rules, with the aim of discovering patterns of discrimination, either direct or indirect. Analyses of affirmative action, favoritism and argumentation against discrimination allegations are also modelled in the proposed framework. Finally, we present an implementation, called LP2DD, of the overall reference model that integrates induction, through data mining classification rule extraction, and deduction, through a computational logic implementation of the analytical tools. The LP2DD system is put at work on the analysis of a dataset of credit decision records. (shrink)

Investigating meta-programming within the logic programming paradigm, Meta-Logics and Logic Programming presents original research on an important extension of logic programming that makes it more amenable for knowledge representation and programming in general. The 12 contributions, many written especially for this book, explore the foundations, language design issues, and applications of meta-programming in logic programming. Meta-programming—the process of writing computer programs that can manipulate representations of other programs—has been key both in the foundations of computer science and in its practical (...) developments. Examples of meta-programs include compilers, interpreters, program analyzers, and partial evaluators. The choice of logic programming as a basis for meta-programming offers several practical and theoretical advantages: among them, the possibility of tackling critical foundational problems of meta-programming within a strong theoretical framework, and the surprising ease of programming. The usual framework of logic programming (and more generally first-order logic), however, has to be modified and extended to formally deal with meta-programs, extensions the editors call "meta-logics." Along with an exploration of meta-programming in logic programming, the definitions, formal properties, and use of these extensions constitute one of the book's main themes. The first part of the book, Foundations, focuses on the representation problem—how object programs are represented within meta-programs. The second part, Language Support for Meta-Logics, is concerned with language extensions that make meta-programming easier and more elegant. James R. Otteson’s Adam Smith’s Marketplace of Life is a wide-ranging examination of Smith’s moral philosophy which closely analyzes the notions of sentiment, sympathy, general rules, the impartial spectator, and other related topics. Otteson assesses Smith’s account of moral development and considers the extent to which Smith’s moral sentimentalism is both descriptive and prescriptive. He also discusses Smith’s views on the relationship between unintended order and final causes. Finally, Otteson finds contemporary support for some of Smith’s claims about human nature (...) in the work of sociologist James Q. Wilson. Although much in Otteson’s rich book invites comment, I will limit myself, for reasons of space, to outlining and briefly considering two of its main theses: According to Adam Smith, moral standards have emerged, and continue to emerge, from a market-like exchange of sentiments among mutually sympathizing actors; We can reconcile Smith’s claim, in The Theory of Moral Sentiments, that benevolence as an important human motive, with the discussion in The Wealth of Nations, which seemingly reduces all behavior to self-interest. This article presents the conception of negligent account management, analyses the rules of the criminal act that govern criminal liability for negligent account management, by focussing on the form of guilt and the problem of its content. The plenary session’s conclusion that the two offences – failure to administer bookkeeping and failure to protect the bookkeeping documents – can be committed both intentionally and negligently is disputed in this article. The adoption of the new Criminal Code in 2000, setting the (...) form of guilt and its content in criminal cases for negligent account management, posed no significant problems – the court practice and legal literature followed the attitude that this crime could be committed only negligently. According to Article 16(4) of the Criminal Code 2000, a person is punished for negligent commission of a crime or a misdemeanour only in individual cases stipulated in the Special Part of the Criminal Code. The problem was that no “individual case” was foreseen in Article 223 of the Criminal Code that imposed liability for negligent bookkeeping. This created preconditions for deviating from pre-existing case-law under which this crime could be qualified as negligent. Only in 2009 the Criminal Division of the Lithuanian Supreme Court concluded in its plenary session that Article 223 of the Criminal Code provided liability for criminal record-keeping and accounting only if committed negligently as a form of guilt, and other activities pursuant to this Article might be committed intentionally and recklessly. The plenary session identified a loophole of criminal law and created preconditions for the formation of uniform court practice. Only the legislator can remove the loophole of criminal law identified by the Supreme Court of Lithuania. The author states that all of the acts named in Article 223 of the Criminal Code can be committed negligently and suggests applying the rule contained in Article 16(4) of the Criminal Code to Article 223 of the Criminal Code. All of these findings are based on historical, grammatical and logical interpretation of the “neglect” concept and the analysis of Articles 222 and 223 of the Criminal Code. (shrink)

Oscar Wilde reacts to the predicament of art in the face of an increasingly blasé public. He reverses the roles and sees his art as the reception of those who were formerly the recipients – according to the topos of the ›seeing work of art‹ (Früchtl). To receive Wilde means, first of all, to know oneself received. Wilde looks back colder than he or his art could be looked at. As the one being looked at, the audience is suddenly placed (...) in the position of the work of art. It is confronted with aesthetic expectations that it cannot meet for systematic reasons. To aestheticize existence is to disavow it. Wilde does not educate his audience in this way, however. Instead, he educates them to become an audience. Nothing better should happen to the audience than to remain an audience. The cold look has been interpreted as amoralism. Yet Wilde is no good as an example of how even the morally reprehensible can be aesthetically legitimate. Instead, he demonstrates that the aesthetic is far less permissible than the ethical. Unethical things are already – and only – forbidden aesthetically. (shrink)

W niniejszym tekście autorka podjęła próbę analizy początku, jako jedynej opublikowanej do tej pory części, zapowiadanej przez Roberta Schindla powieści Der Kalte. Chodziło m. in. o odnalezienie odniesień do wcześniejszych utworów Roberta Schindla, w szczególności zaś do opublikowanej w roku 1992 i przeniesionej na ekran w roku 2001 powieści Gebürtig. Z jednej strony zwrócono uwagę na symbolikę „zimna”, obecną w obu utworach, z drugiej strony na tematykę rozliczenia z narodowosocjalistyczną przeszłością Austrii. W artykule wskazano również na nawiązania w Der Kalte (...) do wcześniejszych tradycji literackich, w tym przypadku do użytej dla wyrażenia własnych treści tradycji romantyzmu. (shrink)

Derrida Has Lost Nietzsche's Umbrella: On Philipp Felsch's Book Wie Nietzsche aus der Kälte kam. This essay discusses the story of the critical edition of Nietzsche’s complete works by Giorgio Colli and Mazzino Montinari as presented in Philipp Felsch’s book Wie Nietzsche aus der Kälte kam. The book, which is based on biographical material of the two editors, takes up an important episode in European intellectual history in its political, cultural historical context. However, it often presents a questionable use of (...) these sources. A closer examination of that the same source material would situate the history of the edition and its editors in a different context. Likewise, Felsch’s account of the history of Nietzsche’s reception in France, and his reception in the neighboring countries, lacks nuance and reveals some remarkable examples of misreading. Like in other genres of history, scholars of discourse history and intellectual history need to read sources closely and critically. When we talk of dealing with primary sources, the work that editors have done in commentaries and editions should be taken into account. Finally, I argue that we should not dismiss recent innovations in editing methods as confusing or “vulcano-like,” but we would do well to appreciate the opportunities offered by the digital humanities, both for a professional readership and a wider audience. The article deals with the concept of the court’s fault in the action for damages against a state suffered due to infringement of European Union law. The author searches for the right position of the criterion in the system of the conditions of state liability and discusses whether European Union law establishes a uniform standard of fault, or at least the guidance on the application of the criterion that would enable uniform national judicial practices concerning state liability for the infringements (...) attributable to the courts of last instance. The article also analyses national legal regulation and jurisprudence of several Member States such as France, Belgium and Italy, providing the definitions of different forms of fault and (or) examples of their practical implementation. Egal was der heutige Tag auch bringen mag, der 1. April 2063 wird zumindest als der Tag in die Geschichte des Wissenschaftsjournalismus eingehen, der die bisher aufwändigste Berichterstattung erfahren hat. So viele Kamerateams, wie hier vor den Toren der Australian National University in Canberra, hat bisher kein wissenschaftliches Experiment anziehen können. Selbst der Knüller des Vorjahres, als es einer 48jährigen Hausfrau in einem Vorort von London gelang, mit einfachsten Küchenutensilien einen kleinen Kalte-Fusion-Reaktor herzustellen, der den Staubsauger und die Mikrowelle zuverlässig (...) mit sauberer Energie versorgte, hatte bei weitem nicht ein solches Echo in der Wissenschaftspresse erfahren. Es war zwar noch nichts über den Experimentausgang zu erfahren, trotzdem wurde freilich seit drei Tagen ununterbrochen live auf fast allen Kanälen aus Canberra darüber berichtet, dass nun zwar noch nichts zu erfahren sei, dass es aber ja sehr bald soweit sein müsse. Das Experiment, dessen Ausgang man hier so gespannt erwartete, war schon im Vorfeld hitzig diskutiert worden und überhaupt nur durch einen Sonderbeschluss der Vereinten Nationen zustande gekommen. Immerhin läuft die Vorbereitung bereits seit fast 30 Jahren, als sich mehrere Philosophen und Bürgerinitiativen zusammenschlossen, die UNO um eine endgültige Klärung einer der ältesten Fragen der Menschheit zu bitten: Was ist Bewusstsein? Und insbesondere: Ist Bewusstsein etwas anderes als physikalisch beschreibbare Zustände unseres Gehirns, oder sind alle Tatsachen letztlich physikalische Tatsachen? Dass diese Fragen trotz ihres Ehrfurcht einflößenden Alters zunehmend auf den Nägeln brannten, hatte nicht zuletzt die jüngste Entwicklung der Computertechnologie befördert. Nachdem die KI in den letzten Jahrzehnten einen großen Schritt vorwärts gemacht hatte, war man in Sorge, dass ohne endgültige begriffliche Klärung dieser Fragen unser zukünftiger Umgang mit unseren elektronischen Helfern auf moralisch unsicherem Boden stehen könne. Man hatte sich daher nach langer Abwägung der ethischen Aspekte dieses Experiments dazu entschieden, ein gerade neugeborenes Waisenkind in einem völlig schwarz-weiß-grauen Raum groß werden zu lassen, sorgsam darum bemüht, dass die kleine Mary (so hatte man das Mädchen in Anlehnung an die Protagonistin einer fiktiven philosophischen Geschichte genannt) keine Farben zu Gesicht bekommt.. Während in den letzten Jahrzehnten der Begriff der Armut immer mehr ins Zentrum von detaillierten philosophischen Analysen systematischer Natur rückte und die Ausführungen von u. a. John Rawls, Peter Singer, Thomas Pogge, Amartya Sen, Robert Nozick und Martha Nussbaum eine einflussreiche und facettenreiche Diskussion bezeugen, wird die historische Untersuchung der philosophischen Auseinandersetzung mit dem Thema in der Neuzeit im Allgemeinen vernachlässigt. Im Wörterbuch der philosophischen Begriffe fehlt der Begriff ›Armut‹. Im neuen Historischen Wörterbuch der Philosophie findet sich kein der Armut (...) gewidmetes Lemma. Auch wenn im neuen Wörterbuch dank des Pauperismus- Lemmas zumindest ein Aspekt der Armutsdiskussion vertreten ist, scheint sich die »Armutsvergessenheit « angesichts des verbreiteten Leidens und Sterben armer Menschen noch »als blind, wenn nicht gar als kalt und zynisch« zu erweisen. Tiere haben erstaunliche kognitive Fähigkeiten, ein diesen Fähigkeiten entsprechendes Bewußtsein und Formen des Selbstbewußtseins. Das Denken in diskreten Einheiten von Urteilen scheint ihnen jedoch nicht zugänglich zu sein, damit auch nicht die Unterscheidung von Bejahung und Verneinung und von wahr und falsch. Wie ist das Denken und damit das objektive Erkennen beim Menschen entstanden? Welche Rolle spielt das Gehirn bei Mensch und Tier? Wir Menschen leben in zwei Welten, die paradoxerweise zugleich eine ist. Das Tageslicht, Gerüche, die Hauswand, an der (...) wir entlanggehen und die wir nicht durchschreiten können diese unsere Lebenswelt unterscheidet sich zunächst nicht von der des Hundes, der uns begleitet. Tiere nehmen sinnlich wahr wie wir, sie erschrecken wie wir bei einem lauten Geräusch, sie zeigen dieselbe freudige Erregung wie wir. Zugleich gibt es für uns eine andere, wiewohl identische Welt, von der die Tiere offenbar nichts wissen: Wir Menschen machen die Dinge zu Objekten der Erkenntnis; dieselbe Sonne, die uns blendet und die sich im Tageslauf langsam von Osten nach Westen bewegt, steht, so erkennen wir, fest im Zentrum des Planetensystems. Wir spüren die Kälte, aber wir erkennen in ihr zugleich die Ursache der Eisbildung; kein Tier weiß, was eine Ursache ist, kein Tier kann sich wundern, und auch denken kann es nicht. These: Natürlich können Tiere denken. "Ach, Sie werden es nicht glauben, aber unser Leo versteht jedes Wort." Gegenthese: Natürlich können Tiere nicht denken. Es fehlen ihnen vor allem zwei Voraussetzungen des Urteilens und Denkens: Sie verfügen über keine geeigneten Begriffe, und sie kennen keine gemeinsame Öffentlichkeit, die durch das Zeigen geschaffen und im Urteil vertieft wird. Siden 2007 har HOD og KS satset store ressurser på prosjektet «Samarbeid om etisk kompetanseheving» i kommunale helse- og omsorgstjenester. Hensikten med prosjektet har vært å heve de ansattes etiske kompetanse, og ett av de iverksatte tiltakene har vært å etablere refleksjonsgrupper i etikk. Denne artikkelen er basert på en evaluering av arbeidet i refleksjonsgruppene med fokus på hvordan etikkveilederen, også kalt fasilitator, beskriver arbeidet i gruppene. Hensikten med studien var å utvikle kunnskap om hvordan arbeidet med etikk-refleksjon foregår, samt (...) å diskutere om måten det arbeides på kan forventes å bidra til etisk kompetanseheving blant gruppemedlemmene. Vinteren 2012 gjennomførte vi fokusgruppeintervju i åtte kommuner med ansatte fra ulike deler av den kommunale helse- og omsorgstjenesten, ett intervju i hver kommune, til sammen 33 personer. Data ble analysert og fortolket i tråd med hermeneutisk metode. Resultatene viser at de i refleksjonsgruppene diskuterer alt fra verdier, begreper, fiktive case, dilemmaer til vanskelig situasjoner fra egen praksis. Refleksjonsmetodene varierer i spennet fra fri diskusjon til en strukturert samtale. Fasiltatorenes helsefaglige grunnutdanning og kunnskap om etikk og refleksjon ser ut til å være avgjørende faktorer for om refleksjonsgrupper i etikk mest fungerer som et pusterom, eller blir en læringsarena for etisk kompetanseheving. One of many measures has been to establish ethics reflection groups. The purpose of this study was to obtain knowledge about how ethics reflection is carried out and if the reflection strengthens the participants´ competence in ethics. In this article, we focus on how the role of the facilitator, and the objective is to describe and discuss how the facilitator work and facilitate in the groups. We conducted focus group interviews with facilitators from various clinical settings in eight different municipalities. Data were analysed and interpreted according to hermeneutic methodology. The findings show that the discussions in the reflection groups varied from values, concepts and fictional cases to dilemmas and ethically difficult situations from the participants own practice. The methods used varied from free conversation to structured reflection. Competence in ethics and methods of reflection are essential skills facilitators must employ/have to run the groups. Diskurso analitinis požiūris propagandos tyrime gali padėti ne tik ištirti propagandos turinį, žodyną, bet ir jo kūrimo kontekstą, kurio analizė tampa vis svarbesnė, plėtojantis sunkiau atpažįstamoms propagandos formoms. Šiame straipsnyje, taikant pusiau sisteminę literatūros apžvalgą ir dedukcinę teminę analizę, nagrinėjama, kaip jungiant propagandos ir diskurso terminus suvokiama propaganda bei kokiose tyrimų tematikose, interpretaciniuose kontekstuose ir kokius metodus pasitelkiant naudojama tokia jungtis. Į apžvalgą įtraukti anglų kalba 2012–2021 m. publikuoti mokslo darbai, kurių pavadinimuose minimi propagandos, diskurso ar propagandinio diskurso terminai. Tyrimo (...) rezultatai rodo, kad propagandos analizei pasitelkdami diskurso analitinį požiūrį, tyrėjai propagandą daugeliu atveju suvokia kaip neigiamą reiškinį, todėl jos analizei dažniausiai pasitelkia kritinę diskurso analizę. Propagandos ir diskurso terminų jungtis moksliniuose tyrimuose naudojama vis dažniau ir yra ypač būdinga visuomenę poliarizuojančių propagandinių pranešimų analizei. Tačiau moksliniuose darbuose propagandos ir diskurso terminų jungtis ne visada išplėtojama tinkamai. (shrink)

I debatten om fastlegers adgang til reservasjon mot henvisning til abort hevdet noen at reservasjonslegenes ønske er selvmotsigende og utilstrekkelig begrunnet. Det ble hevdet at reservasjonslegenes foreslåtte balansegang – å nekte henvisning til abort, men i stedet legge til rette for at en kollega henviser – er etisk inkonsistent og innebærer et særegent etisk hykleri, som har blitt kalt «de rene henders etikk». Ved nærmere ettersyn viser det seg at denne viktige kritikken har brodd mot noen måter å praktisere reservasjon (...) på, men ikke mot alle. Selv om den konkrete saken fikk en løsning som ikke innebærer reservasjonsadgang, er anklagen om «de rene henders etikk» prinsipielt interessant og kan anspore en diskusjon om samvittighetsfrihetens og toleransens grenser, et tema som vil vende tilbake til offentlighetens søkelys i stadig nye former.Nøkkelord: medisinsk etikk, naturrett, reservasjonsrett, samvittighetsfrihetEnglish summary: Conscientious objection for general practitioners – hypocritical or well-justified?In the Norwegian debate about General Practitioners’ right to conscientious objection to referrals for abortion, some claimed that the GPs’ request was self-contradictory and inadequately justified. It was claimed that the GPs’ suggested balancing act, that is, refusing referral for abortion, while instead facilitating referral by a colleague, is ethically inconsistent and implies a particular kind of ethical hypocrisy, termed ‘the ethics of clean hands’. Upon closer inspection, however, it turns out that this important critique applies to some ways of practicing conscientious refusal, but not to all. Even though this particular case was resolved in a way that does not involve toleration of conscientious objection, the charge of ‘ethics of clean hands’ is fundamentally interesting, and may spur a discussion of freedom of conscience and the limits of tolerance, a topic that will be recurring in the public square in ever new shapes. Wenn es 'archetypische' Grund- und Tiefenstrukturen des menschlichen Denkens gibt, dann werden sie uns zugänglich durch ständige Bilder und Metaphern, wie z. B. die vier Grundelemente: Luft, Erde, Wasser, Feuer. Diese Elemente reichten für das Altertum zur Bildung der Welt aus. Diese Sicht der Dinge ist teilweise und in unterschiedlicher Art und Weise auch noch heute festzustellen. Ihre Spuren finden wir in den unzähligen Ausdrucksmodi der Modernität. So läßt sich kurz das Thema dieses Sammelbandes beschreiben, der die Ergebnisse einer Tagung (...) über 'Politische Metaphorik in historischer Perspektive' zusammenfaßt. Sie hat im Frühjahr 1993 in Verbania (Lago Maggiore) stattgefunden und ist vom Seminar für Politikwissenschaft der Georg-August-Universität Göttingen, vom italienisch-deutschen historischen Institut in Trento, vom Istituto italiano per gli studi filosofici di Napoli und von der Gemeinde Verbania organisiert worden. Über Metaphern, Bilder und die Zusammenhänge zwischen Bildern, die sich auf die vier Elemente zurückführen lassen, haben Forscher unterschiedlicher kultureller Herkunft diskutiert, Historiker, Philosophen, Linguisten, Literaten und Politologen. Sie alle verbindet das Bewußtsein, daß die Fragen nach den metaphorischen und symbolischen Bedeutungen nur schwer von einem einzigen Zweig der Humanwissenschaften aus und vielleicht sogar nicht einmal von den Humanwissenschaften allein beantwortet werden können. Insgesamt kann man sagen, daß die Stellung und die Identifizierung der Elemente, aus denen das Universum besteht, die durchgängigste Frage der philosophischen und wissenschaftlichen Forschung aller Zeiten gewesen ist. Die Aufgliederung des Universums auf der Grundlage der vier Elemente entspricht überdies in der traditionellen Vorstellungswelt der Struktur des menschlichen Körpers und kann wiederum durch zwei geteilt werden, entsprechend den gegensätzlichen Qualitäten warm und kalt, männlich und weiblich, gut und böse, oben und unten usw. The author investigates the necessity of fault as the prerequisite of contractual civil liability. The author makes the conclusion that Lithuanian law, following most of the countries belonging to the civil law tradition and contrary to the common law systems, as well as Vienna convention, UNIDROIT principles, PECL and DCFR, begins with the theory that fault is a requirement for contractual liability. Strict liability in Lithuanian law is the exception of this general rule. Nevertheless, the author argues that the general (...) rule is subject to important exceptions, and the practical importance of these exceptions is as great as the cases falling within the general rule. In case of no agreement of the parties or any provision of law regarding fault as the necessary prerequisite for contractual liability, in Lithuania, similar to France, the distinction between the obligations to produce a given result and the obligations to use reasonable care is essential: according to Article 6.200(4) of the Lithuanian Civil Code (hereinafter – the CC), a party in breach of an obligation to use best efforts is liable for fault. According to the Finnish Penal Code a corporation may be sentenced to a corporate fine if a person who is part of its statutory organ or other management or who exercises actual decision-making authority therein 1) has been an accomplice in an offence or allowed the commission of the offence, or 2) if the care and diligence necessary for the prevention of the offence has not been observed in the operations of the corporation. Criminal liability of legal persons is based (...) on the intentional or negligent acts of individuals who are in a certain relationship with the corporation. The Finnish legal doctrine clearly rejects the identification theory according to which an individual is considered as acting not for a company but as a company. According to Finnish scholarly writings, the acts of an individual offender could be attributed to the legal person under certain conditions not as acts of the legal person but as acts of the individual for the company. Nonetheless, Finnish law does not abandon the fault requirement. In this respect, Finnish law differs from the traditional common law theory of vicarious liability. (shrink)
