Fomentar a atuação das micro e pequenas empresas deve se tornar um dos principais escopos das políticas públicas brasileiras direcionadas ao desenvolvimento socioeconômico, considerando o tratamento diferenciado previsto no ordenamento jurídico brasileiro, que também prevê legalmente a possibilidade da aplicação de benefícios aos microempreendedores, mas que ainda não atingem os objetivos que transcendem à seara econômica. O estudo almeja trazer reflexões e a compreensão de alguns dos dispositivos de fomento às micro e pequenas empresas à luz da nova lei de (...) licitações e contratos. A partir dele, depreende-se que os efeitos diretos e indiretos trazidos por estas sociedades empresária são extremamente valiosos, relevantes e perceptíveis no cotidiano, motivo pelo qual o Poder Público deve priorizá-las, monitorando, periodicamente, a efetivação de medidas em prol da manutenção ou incremento dos benefícios alcançados em um cenário nacional. Utilizou-se na presente análise o método dedutivo, com pesquisa bibliográfica, doutrina e legislação nacional e estrangeira. (shrink)

Este artigo traça um paralelo entre os eventos da Odisseia e a exploração dos jogos de azar. Para tanto, utilizando-se livremente de várias abordagens filosóficas, é defendido que o ser humano é naturalmente um jogador, com uma liberdade que é restrita a partir do surgimento do Estado. Este, tendo seus desdobramentos representados por Calipso, Cila e Caríbdis, terá que harmonizar essa natureza com seu poder soberano, regulamentando a exploração dos jogos de azar.

Situado no norte da África durante a antiguidade tardia, o pensamento político de Santo Agostinho não está sistematizado em um conjunto teórico de obras. É fruto de sua reflexão sobre problemas concretos como a legitimidade de intervenção estatal em querelas religiosas como o conflito entre católicos e donatistas. A visão agostiniana de Estado prevê um engajamento do cristão na esfera política, não no sentido da teocracia medieval, mas tendo em vista sua purificação moral. Acredita que ele deva intervir (...) na esfera privada da fé para evitar a violência extrema, mas não crê que suas instituições possam ser justas se não orientadas pela verdadeira piedade da fé cristã. Para Agostinho uma das razões para a decadência social de Roma é sua crença em falsas narrativas que não levaram os cidadãos a um crescimento moral autêntico, no que em sua visão a Igreja pode e deve colaborar com o Estado. O presente estudo aborda o modo de intervenção estatal junto das Misericórdias da comarca de Évora, através da acção dos ministros territoriais de finais do Antigo Regime. Incide particularmente sobre o Alvará Régio de 18 de Outubro de 1806, que consideramos a última tentativa do poder central de enquadrar as Santas Casas na política de absolutismo esclarecido. Analisamos ainda as diferentes reacções destas instituições de assistência face ao referido diploma.

Resumo: O texto é uma análise sobre a corrente crítica à relação entre direitos humanos e soberania popular no século XX, uma interpretação segundo a qual direitos humanos significam cada vez mais intervenção estatal e, em concomitância, seguem uma proceduralização da democracia. Ao contrário dessa posição, constatamos que direitos humanos, no momento atual, são impensáveis sem planejamento estatal, sem experts e funcionários estatais para efeito de sua implementação. Isso, se compromete a idéia clássica de soberania popular que (...) supõe legislação política por parte do povo, não a anula deveras: desde que não se pretenda manter a pureza clássica desse conceito, não parece ser incoerente pensar os direitos humanos, quando garantidos pelo Estado, como um meio, provavelmente o mais importante, de consolidação da vida democrática de um povo. Logo, se a concretização dos direitos humanos não admite ou não é acompanhada pela legislação do povo, é inegável, contudo, que é uma potencializadora de sua expressão, com o que, em decorrência, a relação entre Estado e sociedade civil não se manterá estática, podendo sofrer influências dos portadores de direitos.Palavras-chave: direitos humanos - soberania popular - Estado - sociedade civil - democracia.: The text is an analysis on the critical chain to the relation between human rights and popular sovereignty in century XX, an interpretation according to which human rights mean each time more state intervention and, in concurrence, follow a processing of the democracy. In contrast of this position, we evidence that if it cannot think about human rights without state planning, experts and state employees for effect of implementation of them. This, if compromises the classic idea of popular sovereignty that assumes legislation politics on the part of the people, does not annul it indeed: since that if it does not intend to keep the classic pureness of this concept, does not seem to be incoherent to think the human rights, when guaranteed for the State, as the way, probably most important, of consolidation of the democratic life of a people. Soon, if the concretion of the human rights does not admit or it is not followed by the legislation of the people, is undeniable, however, that it is an enabling to one of its expression, with what, in result, the relation between State and civil society will not remain static, being able to suffer influences from the carriers of rights. A reforma trabalhista vem sendo normalmente apresentada como uma ruptura neoliberal com a tradição de protecionismo da Justiça do Trabalho e da legislação referente ao tema. Existe, todavia, um elemento de continuidade, que é a persistência na promessa da paz perpétua. A CLT apresenta a fraternidade entre as classes como imposição cristã. A Reforma Trabalhista insiste na superação dos conflitos como imposição da democracia, uma vez removida a intervenção estatal representada pela justiça do trabalho. O artigo examina o conceito schmittiano de Estado total, usado para descrever o Estado social weimariano que intervém em todas as esferas da vida humana, superando a divisão entre Estado e sociedade. Trata-se para Schmitt de um Estado total por fraqueza – pois não consegue frear as demandas sociais e fazer frente ao pluralismo de interesses partidários –, daí sua aposta em um Estado total de qualidade e energia, capaz de despolitizar a sociedade e de sobrepor-se aos interesses de grupos (...) que buscam tomar o controle estatal. Somente um Estado verdadeiramente forte seria capaz de manter livres de intervenção estatal as esferas não-estatais – inclusive a economia –, e garantir a unidade política em seu interior. (shrink)

O presente artigo procura resgatar um dos períodos mais intensos e menos estudados da Guerra Fria no Brasil, quando duas correntes militares antípodas política e ideológicas atuaram na perspectiva de influenciar através de suas entidades de classe um projeto de nação. Entretanto, essa reflexão tem por foco, os militares nacionalistas e de esquerda, oficiais e praças das forças armadas cuja intervenção foi bem sucedida ao final, com a vitória da Tese do Monopólio Estatal do Petróleo e não (...) class='Hi'>intervenção brasileira no conflito coreano, embora ao custo de uma repressão sobre centenas de militares, muitos deles presos e torturados e até hoje não anistiados, demonstrando em última instância, a fragilidade da democracia e do Estado Democrático e de Direito no Brasil.The Military and the Cold War in Brazil The present article seeks to recover one of the most intense and least studied period of the Cold War in Brazil, when two military antipodal political and ideological currents acted in the perspective of influencing through its class entities a nation project. However, this reflection is focused on the nationalist and leftist military, officers and squares of the armed forces whose intervention was successful in the end, with the victory of the Thesis of the State Petroleum Monopoly and not Brazilian intervention in the Korean conflict, although at cost of a crackdown on hundreds of soldiers, many of them imprisoned and tortured and still unamused, demonstrating in the last instance the fragility of democracy and the Democratic State and Law in Brazil. Resumen Los Militares y la Guerra Fría en Brasil El presente artículo busca rescatar uno del período más intensos y menos estudiados de la Guerra Fría en Brasil, cuando dos corrientes militares antípodas políticas e ideológicas actuaron en la perspectiva de influenciar a través de sus entidades de clase un proyecto de nación. Sin embargo, esta reflexión tiene por foco, los militares nacionalistas y de izquierda, oficiales y plazas de las fuerzas armadas cuya intervención fue exitosa al final, con la victoria de la Tesis del Monopolio Estatal del Petróleo y no intervención brasileña en el conflicto coreano, aunque al costo de una represión sobre cientos de militares, muchos de ellos presos y torturados y hasta hoy no aniquilados, demostrando en última instancia, la fragilidad de la democracia y del Estado Democrático y de Derecho en Brasil. Resumo: A violência doméstica contra as mulheres é um mal que atinge todo o mundo e que é prati- cado comumente no interior das residências, pelas pessoas de seu convívio íntimo. Apesar da grande subnotificação, as polícias estaduais recebem alta demanda de denúncias dessa natureza. Diante das dificuldades de atuação policial inerentes a essa violência, uma estratégia de prevenção e intervenção a ser considerada é a entrevista motivacional: uma abordagem colaborativa que visa a mudança de comportamento baseada em estímulos (...) com foco na ambivalência. Baseamo-nos na premissa de que essa abordagem vem mudando comportamentos nocivos em várias áreas com resultados promissores, inclusive na violência doméstica, podendo, assim, contribuir para a interrupção do ciclo da violência. Esse artigo, fundamentado em pesquisa bibliográfica de abordagem qualitativa, analisa em que medida a entrevista motivacional pode ser aplicada pela polícia nos casos de violência doméstica contra a mulher. The article discusses selected findings from two Norwegian studies among real‐estate agents and real‐estate students, and their relevance for real‐estate education in professional ethics. The survey data‐set indicates that the industry morality of real‐estate agents is more peer‐group oriented, less individualistic and more intersubjective than in other comparable Norwegian industries. The qualitative material shows how respondents perceive and discuss three professional role conflict scenarios in a rule‐ or consequence‐focused pattern. That is, your possession of a shirt constitutes a strong presumption in favor of your ownership of the shirt. In the case of land, however, this is not the case. Here possession is not only not a strong presumption in favor of ownership; it is not even clear what possession is. (...) Possessing a thing like a hat or a shirt is a rather straightforward affair: the person wearing the hat or shirt possesses the shirt or the hat. But what is possession in the case of land? RESPONSABILIDADE ESTATAL NOS CRIMES COMETIDOS CONTRA OS DIREITOS HUMANOS DURANTE A VIGÊNCIA DA DITADURA MILITAR BRASILEIRA.

The study aimed to identify risk attitudes of users of the Food and Nutrition Unit (UAN)located in Botucatu, SP; correlate them to food safety and to observe if there were behavioral changes after indirect educational intervention. This is an exploratory qualitative analysis study, using a non-participant observation technique. Initially, we sought to identify the most common risk attitudes among users, to develop educational materials relating the conduct during self-service to the possible risks of contamination, and thus to verify if there (...) were behavioral changes. Poor hand hygiene was seen as one of the most important points to work on, as none of the diner participants performed such an attitude. It was possible to observe small changes in the behavior of some users, showing that educational measures should be applied continuously for better awareness and greater effects. (shrink)

One of the most common terms in late-medieval discourse is “estate” in its Latin or vernacular forms: status, estat, estado, stato, stav, stat, stand, etc. Its basic sense, derived from stare and common to a wide variety of meanings in various contexts, can be recognized in such modern English equivalents as “status,” “station,” “estate,” “stately,” “state,” “standing,” and the like. Its secondary, particular meanings, however, cannot be regularly perceived on this basis, and in all cases there are problems beneath the (...) surface due to the structural differences between Alteuropa and the “modern” world of the nineteenth century, as well as the postmodernity of the twentieth. Mães exercem papel importante no processo de hospitalização das crianças. As intervenções em psicologia positiva podem contribuir com o fortalecimento dos recursos positivos delas, o que por sua vez auxilia na recuperação da saúde das crianças. Este estudo teve por objetivo apresentar o relato da aplicação e avaliação de uma intervenção em psicologia positiva para mães de crianças hospitalizadas, visando demonstrar evidências de utilidade clínica da intervenção. A intervenção buscou diminuir sintomas de estresse, ansiedade e depressão, aumentar (...) os níveis de bem-estar subjetivo e promover o uso de estratégias de enfrentamento adaptadas ao contexto da hospitalização infantil entre as mães. Os resultados mostraram que o procedimento pode ter auxiliado as mães usarem estratégias favorecedoras durante a hospitalização, bem como alternarem o seu uso conforme a demanda. Além disso, elas puderam vislumbrar elementos positivos presentes e sentirem-se apoiadas. (shrink)

En A Letter Concerning Toleration John Locke argumenta en favor de la tolerancia religiosa afirmando que el Estado no puede mejorar la vida de las personas forzándolas a vivir de acuerdo con creencias que ellas no suscriben. Más recientemente, Ronald Dworkin y Will Kymlicka han desarrollado argumentos similares. En el caso del primero, contra ciertas políticas paternalistas; en el del segundo, en apoyo de la tesis liberal de la neutralidad estatal. Mi propósito en el presente artículo es analizar la (...) plausibilidad de dichos argumentos concebidos como una defensa de la tesis de la neutralidad estatal. Intentaré demostrar que ambas versiones del argumento fracasan. En la sección II, cuestionaré la capacidad de los argumentos para respaldar las conclusiones que aspiran establecer, sin objetar la plausibilidad de las premisas involucradas. En la sección III, desarrollaré tres objeciones contra la concepción del bienestar crítico que constituye el corazón de ambas versiones del argumento. This study examines the apparently well-established rule that the equitable doctrine of conversion operates on a contract to grant an interest only so long as it is specifically enforceable. It observes that in principle and in practice there is good reason to believe this not to be the case. It looks at the original culture of conversion, in terms of the historical relationship of property and contract from which it emerged, but suggests that the specific enforceability rule first arose out (...) of the narrowness of the original availability of common injunctions. But when, in the late nineteenth century, common injunctions began to lie more expansively and the rule could have been discarded, it was in fact preserved, and indeed insisted upon. It is suggested that this was because adherence to the old narrow view on common injunctions and to its concomitant, the specific enforceability rule in estate contracts, served the purposes of the Chancery lawyers who were contemporaneously adopting a restrictive attitude to the effects of the Judicature Acts 1873–5, by emphasizing the distinctiveness of equitable institutions. However, such views were not a doctrinally necessary consequence of that attitude, and, given the a priori unsuitability of the specific performance rule, there seems no reason why it should not nowadays be regarded as obsolete. But the lessons which equity had thus had to learn by experience can usefully be extrapolated into conclusions of more general applicability for legal development. (shrink)

The thesis that an analysis of property rights is essential to an adequate analysis of the state is a mainstay of political philosophy. The contours of the type of government a society has are shaped by the system regulating the property rights prevailing in that society. Views of this sort are widespread. They range from Locke to Nozick and encompass pretty much everything else in between. Defenders of this sort of view accord to property rights supreme importance. La découverte d’un nouveau mois à Ténos et l’identification d’un graveur à Paros conduisent à formuler de nouvelles hypothèses sur le problème des sûretés réelles en droit grec. L’examen du registre de Ténos (IG XII 5, 872) en vue de sa réédition a fait apparaître une erreur de découpage entre les actes 17 et 18 chez les éditeurs antérieurs, qui n’ont pas reconnu le nom d’un mois, Èrès[iôn], équivalent du mois délien Arèsiôn attesté depuis peu à Andros, l’île voisine. En (...) faisant disparaître une clause obscure de ce document, cette découverte invite à réexaminer le fonctionnement d’un gage hypothécaire d’un type particulier, l’apotimèma dotal, auquel l’un des actes du registre fait allusion. Ce point acquis, on aborde ce qui fait par contraste la spécificité de la vente avec faculté de rachat (prasis épi lysei) : à Ténos comme à Athènes, elle se caractérise par un transfert de propriété immédiat au profit du créancier, au moyen d’un acte de vente complété le cas échéant par un contrat de location. Le rapprochement entre une borne récemment découverte à Paros (SEG 54, 794) et une célèbre loi sur les archives, gravée par le même lapicide, permet en dernier lieu de préciser la relation entre la prasis épi lysei et les pratiques d’archivage public à l’époque hellénistique. For a variety of reasons, Hegel's theory of the estates remains an unexpected and unappreciated feature of his practical philosophy. In fact, it is the key element of his social philosophy, which grounds his more properly political philosophy. Most fundamentally, it plays this role because the estates provide the forms of visibility required by Hegel's distinctive theory of self-determination, and so the estates constitute conditions for the possibility of human agency as such. With respect to political agency in particular, this (...) ramifies into the view that the estates are social preconditions for legal and political practices, forms of political participation in their own right, and conditions of possibility of moderate government (three functions also attributed to the estates by Montesquieu). This study evaluates responses to the Real Estate Ethical Code. Voice Stress Analysis (VSA) is used to evaluate the responses of real estate sales people to ethically-based questions. The process and the responses given enabled the authors to gain insight into pressure-causing ethical situations and to explore new uses of VSA. Some respondents were stressed while following the ethical code guidelines. Others showed no stress about breaking the formal code. The study reaffirms that the presence of formal ethical guidelines does (...) not assure that the rules will be willingly followed. (shrink)

Seres humanos intervêm frequentemente na natureza por razões antropocêntricas ou ambientalistas. Um exemplo de intervenção consiste na reintrodução de lobos em áreas previamente habitadas por eles com a finalidade de se criar o que é conhecido como “ecologia do medo”. Na primeira parte deste artigo discutem-se as razões que têm sido utilizadas em favor dessa medida, e explica-se por que são incompatíveis com um enfoque não especista. Para tal, expõem-se os motivos pelos quais tal medida prejudica notavelmente animais como (...) os cervos, sem tampouco ser benéfica para os próprios lobos. Em seguida, argumenta-se que, se abandonamos uma perspectiva especista, devemos mudar por completo o modo pelo qual intervimos na natureza. Em vez de intervir por motivos ecologistas ou antropocêntricos, nosso objetivo ao fazê-lo deve ser o de reduzir os danos sofridos pelos animais não humanos. A visão idílica segundo a qual os animais não humanos vivem vidas paradisíacas na natureza é completamente incorreta, e de fato há fortes razões para considerar que o sofrimento e a morte prematura prevalecem de forma clara sobre a felicidade desses animais. Isso faz com que seja ainda mais importante que nosso objetivo seja melhorar sua situação e dar-lhes nossa ajuda, em vez de causar-lhes danos. Isso entra em conflito de maneira significativa com alguns ideais ecologistas fundamentais cuja defesa não é compatível com a consideração dos interesses dos animais não humanos. (shrink)

Although much has been written globally about the key issues of corporate governance in REITs, there are not enough studies inspired by the systematic literature review method. This study reviews the literature on corporate governance in real estate investment trusts (REITs) published after 2004 and addresses three interrelated research questions. We examined 77 peer-reviewed journal articles using a systematic literature review approach. We found that there has been a rise in studies since 2010, with a brief decrease in 2015 and (...) 2017 before increasing again in 2016. Moreover, the vast majority of the studies were published in the areas of economics/econometrics/finance and business/management/accounting. In addition, most of the papers are single-country studies, and the minority are multi-country. The majority of the papers are focused on the USA and Asia. Este relato apresenta formas de intervenção na atuação do psicólogo em situação de racismo. A experiência ocorre em uma instituição de ensino superior e discutimos sobre o racismo e saúde mental a partir do curso promovido pelo Nucleo de Estudos e Pesquisa em Psicanalise, Identidade, Negritude e Sociedade da Universidade Estadual do Recôncavo da Bahia. Inicialmente serão descritos as atribuições do profissional de psicologia na área educacional da assistência estudantil. Em seguida serão abordados dois estudos de casos com suas (...) respectivas análise. O texto finaliza-se com as possíveis intervenções psicológicas nesta temática, a importância da expansão das suas práticas coletivas, não apenas individual/clínico, bem como o olhar crítico sobre a atuação das instituições educacionais e o racismo institucional. This case study chronicles the entrepreneurial and real estate investment activities of a recent Ph.D. graduate in business administration. The protagonist learns that clear focus is necessary for entrepreneurial success and that trust does not mix with entrepreneurship and negotiation. Ethics are sometimes problematic for entrepreneurs.

The main narratives of prevailing ideas of the Fourth Estate were articulated in the era of traditional mass media, and these traditional narratives are challenged by the changing media landscapes. This raises the question whether traditional narratives of the Fourth Estate should be maintained. We will argue – through a close reading of Derrida’s reflections on the relationship between communicative significance and silence, combined with a deliberative ideal for democracy – that the new structures of communication call for a Fourth (...) Estate that focuses on creating spaces for flexible structures of silence in the public sphere. The Fourth Estate has an obvious assignment of counteracting problematic structures of silence. In this article, we will, however, bring out assignments of creating spaces of silence in the public sphere: by silencing certain dominant voices, making room for an increased lack of answers and creating an awareness of the insufficiencies of the public spheres. Qualsevol que es llegeixi aquest llibre s'adonarà que molts d'aquests mites amb els quals ens han promès la felicitat no són ni tan sòlids, ni tan certs, ni tan "progres" com sembla. Amb lúcida ironia, Ignasi Riera reflexiona sobre algunes de les qüestions que actualment saturen els mitjans de comunicació i que, com a polític i periodista, l'han preocupat al llarg de la seva vida: la idealització del món rural, l'obsessió per la salut, però també el maniqueisme de certes actituds (...) pseudodemocràtiques, les paradoxes de la societat del benestar o el fals esquerrisme. Research into the work of UK estate agents reveals a love‐hate attitude on the part of the public and profound ethical ambivalences. Esse estudo consiste numa reflexão sobre uma intervenção pedagógica com docentes que atuam na EJA em prisões, trazendo à tona problematizações das questões étnico-raciais, suas percepções, e saberes e realidades da comunidade negra. Discute-se como os docentes da Penitenciária de Serrinha (BA) percebem a questão racial e a própria efetivação da Lei 10.639/03 na sua prática pedagógica. Assim, partimos da execução de uma proposta formativa dialógica dos direitos raciais, da reparação histórica e da inclusão da história da África e (...) da cultura afro-brasileira nos currículos. Os resultados demonstraram a existencialidade do silenciamento étnico-racial e que as concepções hegemônicas construídas ideologicamente sobre a questão racial permanecem vivazes nas memórias e atitudes dos sujeitos de forma camuflada. Os achados relativos aos efeitos da intervenção evidenciaram que os professores passaram a compreender os desdobramentos de práticas racistas e buscaram conhecer mais as políticas afirmativas, concomitantemente realizando recriação das oficinas didáticas para a sala de aula, com a finalidade de empoderamento dos discentes a ponto de contrariar as violações de direitos e injustiças raciais. This article adopts an ecological view of cognition to analyze the role of the environment in scaffolding metaphorical experience. Using ethnographic material collected from two real estate showrooms in China, we describe how each showroom setting is equipped with to-be-phenomenologically-experienced objects designed to stimulate desirable sensorimotor experiences and altered bodily states during the guided showroom tours. By analyzing the qualities of such settings and identifying the processes through which visitors become environmentally coupled—including active and passive touch in highly organized auditory, (...) olfactory, and gustatory environs—we demonstrate how the showrooms constitute an affordance space for enacting metaphoricity through doubleness in experience. Implications for conceptual metaphor theory relating to the nature of environments and bodies are discussed. (shrink)

This study proposed and examined a conceptual framework on the influence of real estate brokers’ personalities, psychological empowerment, social capital, and knowledge sharing on their innovation performance, and used moral hazard as a moderating variable. We used structural equation modeling for data analysis and estimation. The participants were real estate brokers in Kaohsiung City. A total of 1,000 questionnaires were administered to 100 branch offices of real estate companies, 571 of which were later recovered from 80 branch offices. After removing (...) 52 for being invalid, we were left with 519 valid questionnaires, indicating a 51.9% recovery rate. The empirical results suggest that the real estate brokers’ personalities and psychological empowerment positively and significantly influence social capital; personality and psychological empowerment also positively and significantly influence their innovation performance; and social capital significantly influences knowledge sharing, which in turn positively and significantly influences the brokers’ innovation performance. In environments with higher levels of moral hazard, the influence of social capital on the brokers’ knowledge sharing is significantly diminished. (shrink)
