The quality of the narrations of 'Abdullah b. Salih al-Misrî (d. 223/838), one of al-Bukhârî's famous teachers, in al-Jâmi al-Sahîh has been a matter of debate among hadîth scholars. Abdullah b. Salih, whose narrations are narrated by Abu Dâwûd, al-Tirmidhî and Ibn Mâjah, is an important figure whom al-Bukhârî interviewed and also narrated from him in his works such as al-Adab al-mufred, al-Kirâʾa Khalfa al-imâm and al-Târîkh al-kabîr. However, whether he narrated directly from him in al-Jâmi al-Sahîh has (...) been a matter of debate among the scholars of Hadith. Ismâ'îlî (d. 371/982) and al-Hâkim (d. 405/1014) claim that al-Bukhârî did not narrate any hadîth from him in his Sahîh, while al-Zaḥebî (d. 748/1347) and al-'Aynî (d. 855/1451) argue that he did. It is possible to say that this disagreement is due to two reasons. The first is that there are differences between the copies of the Sahîh, and the second is that al-Bukhârî mentioned some of the narrators in an incomplete form. In this study, we will investigate various copies of the Sahîh and focus on whether the person whose identity is mentioned as "Abdullah b. Sâlih", "Abdullah" and "Abû Sâlih" in them is really Abdullah b. Sâlih al-Misrî. In addition, we will touch upon the evidences relied upon by the muhaddithis who express an opinion on this issue in terms of narration and dirāyah, and we will also draw attention to how the sîgas of tahammul and âdâ used in the narrations should be understood. Finally, we will try to determine whether al-Bukhârî has made any tahrīj from 'Abdullah b. Salih in his Sahīh, and if so, for what purpose, i.e., for ihtijâj or istishhâd. (shrink)

Ahmed b. Hanbel, vefatıyla neticelenen hastalığı esnasında oğlu Abdullah’tan, şu hadisin el-Müsned’inden çıkartılmasını istemiştir: “Allah Rasûlü ‘Ümmetimi Kureyş’ten şu grup helâk edecek’ buyurunca oradakiler ‘(bu durumda) bize neyi emredersin?’ diye sordular. O da ‘İnsanlar onlardan uzak durup ayrılsalar!’ cevabını verdi”. Ahmed b. Hanbel bu hadisin, diğer rivayetlerle çeliştiğini düşünmektedir. Oğlu Abdullah’a göre bu hadisin çeliştiği rivayetler, Hz. Peygamber’in idarecilere itaat etmeyi ve onlardan kaynaklanan yanlışlara karşı sabırlı olmayı emrettiği haberlerdir. Ahmed b. Hanbel’in tavrı ve bunun sebebi esasen açık ve net (...) gibi görünmektedir. Buna rağmen daha sonra gelen ilim adamları, onun bu tavrı ile ilgili farklı değerlendirmeler yapmışlardır. Bu değerlendirmelerden birine göre İmam’ın tavrı, kendi açıklamasında da dikkat çektiği üzere hadisin şaz olması yani halkın idarecilerle ilişkilerini düzenleyen diğer rivayetlerle çelişmesidir. Bu bakış açısı, İmam’ın açıklamasıyla uyum içinde olmasına ilaveten aynı hadisin Buharî ve Müslim gibi meşhur muhaddisler tarafından nakledilmesi açısından da önemlidir. Zira bu yorumun ulaştığı sonuca göre Buharî ve Müslim’in sadece sahih olan hadisler ihtiva ettikleri iddiasıyla takdim ettiği el-Câmi‘u’s-sahîh isimli eserlerinde, bu şarta uymayan rivayetler de bulunabilmektedir. Bununla birlikte söz konusu hadisin hem sened hem de metni üzerinde yapılan incelemeler şaz iddiasının doğru olamayacağını göstermektedir. Nitekim hadisi nakleden dört ravinin tamamı, içinde Ahmed b. Hanbel’in de bulunduğu münekkitler tarafından güvenilir bulunmuştur. Nitekim İmam, el-Müsned’inde bu ravilerin çok miktarda hadisine yer vermektedir. Hadisin metin açısından da şaz olmadığını söylemek mümkündür. Zira metnin birinci cümlesi olan “Ümmetimin helâki Kureyş’in elinden olacak” şeklindeki tespiti, farklı onlarca hadiste görebilmek mümkündür. Bu hadislerden pek çoğu el-Müsned’de bizzat Ahmed b. Hanbel tarafından da nakledilmiştir. Şaz addedilen kısmın “İnsanlar onlardan uzak dursalar” şeklindeki ikinci cümle olması da pek muhtemel görünmemektedir. Zira zalim idarecilere karşı bundan çok daha şiddetli tepkileri emreden hadislerden onlarcası yine bizzat Ahmed b. Hanbel tarafından nakledilmiş durumdadır. Ahmed b. Hanbel’in, bu hadisi kitabından çıkarmak istemesinin sebebi bağlamında ortaya atılan ikinci iddiaya göre İmam, dönemin yönetimiyle iyi geçinmek amacıyla böyle bir talepte bulunmuştur. Zira bu dönemde Abbasî iktidarı, hadisçileri büyük bir sıkıntıya sokan Mihne sürecine son vermiş, ulemaya karşı yumuşama politikası gütmeye başlamıştır. Ahmed b. Hanbel de yönetimin bu uzlaşma arzusuna olumlu cevap vermiş ve bu çerçevede idareciye karşı sergilenecek sert tutuma işaret eden hadisleri kitabından çıkarmak istemiştir. Fakat bu iddia da yaşadığı dönemde iktidara karşı takındığı tavır sayesinde toplum önderi haline gelmiş Ahmed b. Hanbel gibi bir şahsiyetle uyuşmaz. Zira o idareci ve toplum arasındaki ilişkilerin keyfiyeti ve sıhhati konusunda gerek tavsiyeleri gerekse fiilî tatbikatı ile örnek ve simge haline gelmiştir. Hayatını Hz. Peygamber’in mirası olan hadisleri nakletmeye ve doğru anlaşılmasına hasreden böyle bir şahsiyetin, sırf iktidarla iyi geçinmek adına, sened ve metin itibariyle usûl problemi olmayan rivayetleri el-Müsned’den çıkartılması emrini vermesi çok da doğru görünmemektedir. Bu konuda yapılan üçüncü yoruma göre Ahmed b. Hanbel’in bu hadise yönelik tavrı, manasının istismara müsait olmasıdır. Nitekim İmam’ın bizzat kendisi, ehl-i bid‘attan bazılarının bu hadisi delil getirip iktidara karşı toplumda ayrımcılık yaratacak davranışlara yöneldiğini söylemiştir. Elimizde bu son yorumu güçlendiren başka veriler de vardır. Nitekim o aynı tavrı, iktidara karşı silahlı mücadeleyi emreden başka hadisler hakkında da göstermiş; bunların kitabından çıkartılmasını istemiştir. Bu tavrından anlaşıldığına göre Ahmed b. Hanbel, zalim idareciye karşı, toplumda kargaşa ve fesada sebep olacak fiilî ve silahlı mücadeleye kalkışılmasını istememektedir. Öyleyse denilebilir ki İmam’ın söz konusu hadisle ilgili tavrı, hadisin özellikle “insanların böyle idarecilerden uzak durması” yönündeki ikinci cümle ile ilgilidir. Zira İmam’ın yaşadığı dönemde Mutezile ve Haricîler gibi bazı gruplar böyle hadisleri delil getirerek toplumda tefrikaya sebebiyet vermişlerdir. Bunu bilen ve bizzat gören İmam, böyle grupların toplumsal birlik karşıtı amaçlarına alet edilebilir düşüncesiyle idarecilere karşı “uzak durmaya çalışmak” gibi basit gibi görünen tepkilere yer veren hadislerin bile kitabından çıkarılmasını istemiştir. Sonuç olarak ifade etmek gerekirse onun bu hadis hakkındaki “diğer rivayetlerle çelişiyor” şeklindeki tavrını, “Müsned’imde oluşturmaya çalıştığım ideal idareci-toplum ilişkisi ile çelişiyor” şeklinde anlamak gerekecektir. For a sample comprising 36,105 U.S. firm-year observations from 1985 to 2008, we find that firms located in more religious counties enjoy cheaper equity financing costs. This result is robust to a battery of sensitivity tests, including alternative assumptions and model specifications, additional controls for noise in analyst forecasts, and various approaches to addressing endogeneity. In another set of tests, we find that the equity pricing role that religion plays comes predominantly from Mainline Protestants. We also document that the effect (...) of religiosity on firms’ cost of equity capital is larger for firms (periods) lacking alternative monitoring (regulation) mechanisms as measured by lower institutional ownership (the pre-SOX era), implying that religion plays a corporate governance role. Finally, we find that the importance of religion to equity pricing is concentrated in firms that suffer lower visibility, which tend to be more sensitive to local social and economic factors. By examining the links between religiosity and valuation at the firm level, we provide strong, robust evidence supporting the perspective that religion facilitates economic development. (shrink)

This study challenges the conventional image of the tenth-century Sufi mystic Al-Husayn Ibn Manṣūr al-Ḥallāğ (d. 929) as an anti-philosophical mystic. Unlike the predominantly theological or text-historical studies which constitute much of the scholarly literature on Ḥallāğ, this study is completely philosophical in nature, placing Ḥallāğ within the tradition of Graeco-Arabic philosophy and emphasizing, in a positive light, his continuity with the pagan Neoplatonism of Plotinus and Proclus.

Using a large sample of 3,040 U.S. firms and 16,606 firm-year observations over the 1991–2010 period, we find strong evidence that firm internationalization is positively related to the firm’s corporate social responsibility rating. This finding persists when we use alternative estimation methods, samples, and proxies for internationalization and when we address endogeneity concerns. We also provide evidence that the positive relation between internationalization and CSR rating holds for a large sample of firms from 44 countries. Finally, we offer novel evidence (...) that firms with extensive foreign subsidiaries in countries with well-functioning political and legal institutions have better CSR ratings. Our findings shed light on the role of internationalization in influencing multinational firms’ CSR activities in the U.S. and around the world. (shrink)

Even though health care provider reporting of diseases to public health authorities is common, often there is under-reporting by providers, including for notifiable diseases; frequently, under-reporting occurs by wide margins. Two causal factors for this under-reporting by providers have been that: disclosing data may violate their patients’ privacy, and disclosed data may be used to evaluate their performance. A reluctance to disclose information due to privacy concerns exists despite the U.S. Health Insurance Portability and Accountability Act Privacy Rule permitting disclosures (...) of personal health information for public health purposes without patient authorization. On the other hand, such patient privacy concerns are somewhat justified: there have been documented breaches of patient information from public health data custodians.A common way to address this privacy issue is to de-identify patient data before it is disclosed to public health. This paper offers a contribution to debates around integrative aspects of systems biology and engages with issues related to the circumstances under which physicists look at biological problems. We use oral history as one of the methodological tools to gather the empirical material, conducting interviews with physicists working in systems biology. The interviews were conducted at several institutions in Brazil, Germany, Israel and the U.S. Biological research has been increasingly dependent on computational methods, high-throughput technologies, and multidisciplinary skills. Quantitative scientists (...) are joining biological departments and collaborations between physicists and biologists are particularly vigorous. This state of affairs raises a number of questions, such as: What are the circumstances under which physicists approach biological problems in systems biology? What kind of interdisciplinary challenges must be tackled? The paper suggests that, concerning physicists’ move to work on biological systems, there are common reasons to move, the transition must be understood in terms of degrees, physicists have a rationale for simplifying systems, and distinct conceptions of model and modeling strategies are recurrent. We identified problems regarding linguistic clarity and integration of epistemological aims. We conclude that cultural unconformities within the systems biology community have important consequences to the flow of scientific knowledge. (shrink)

This article presents two short but complete treatises on legal theory. The first was written by Ibn Surayj as an addendum to his compendium on Shāfiʿī law, al-Wadāʾiʿ, and the second by Abū Bakr al-Khaffāf, who included it as an introduction to his legal text al-Aqsām wa-l-khiṣāl. An analysis of these texts reveals the existence of a self-conscious legal-theoretical discourse around the turn of the fourth/tenth century that connects al-Shāfiʿī’s Risāla with the so-called mature uṣūl tradition known from the late (...) fourth/tenth century onward. The analysis also sheds considerable light on developments in legal theory in this period, such as the emergence of the term ʿilla, the parallel rise of legal dialectics, the consequences of adopting the idea of waḍʿ, and generally the inclusion of theological concerns in legal theory. Asimismo, se expone cómo, para Lévinas, la subjetividad y el lenguaje se implican mutuamente para cuestionar la primacía del discurso ontológico e idealizante en la tradición filosófica. Choral Identity and the Chorus of Elders in Greek Tragedy challenges the commonly held view that choruses are marginalized by the roles they play in classical Athenian tragedy. Focusing on those tragedies that feature a chorus representing old men who are elders of the community where the action is taking place, Dhuga argues that these elders, as elders, are not necessarily marginal and can even become in some ways central to the represented action.
