The rapid dynamics of COVID-19 calls for quick and effective tracking of virus transmission chains and early detection of outbreaks, especially in the “phase 2” of the pandemic, when lockdown and other restriction measures are progressively withdrawn, in order to avoid or minimize contagion resurgence. For this purpose, contact-tracing apps are being proposed for large scale adoption by many countries. A centralized approach, where data sensed by the app are all sent to a nation-wide server, raises concerns about citizens’ privacy (...) and needlessly strong digital surveillance, thus alerting us to the need to minimize personal data collection and avoiding location tracking. We advocate the conceptual advantage of a decentralized approach, where both contact and location data are collected exclusively in individual citizens’ “personal data stores”, to be shared separately and selectively, voluntarily, only when the citizen has tested positive for COVID-19, and with a privacy preserving level of granularity. This approach better protects the personal sphere of citizens and affords multiple benefits: it allows for detailed information gathering for infected people in a privacy-preserving fashion; and, in turn this enables both contact tracing, and, the early detection of outbreak hotspots on more finely-granulated geographic scale. The decentralized approach is also scalable to large populations, in that only the data of positive patients need be handled at a central level. Our recommendation is two-fold. First to extend existing decentralized architectures with a light touch, in order to manage the collection of location data locally on the device, and allow the user to share spatio-temporal aggregates—if and when they want and for specific aims—with health authorities, for instance. Second, we favour a longer-term pursuit of realizing a Personal Data Store vision, giving users the opportunity to contribute to collective good in the measure they want, enhancing self-awareness, and cultivating collective efforts for rebuilding society. Keenan (1987) observed that trivial determiners built from basic existential determiners (e.g.,either zero or else more than zero) are allowed inthere-insertion contexts, and that trivial determiners built from basic non-existential determiners (e.g.,either all or else not all) are not. This result is unexpected under the analyses ofthere-sentences proposed in Barwise and Cooper (1981), Higginbotham (1987), and Keenan (1987). I argue that the class of NPs barred from the postverbal position ofthere-sentences (strong NPs) is correctly characterized in presuppositional terms, as suggested (...) in de Jong and Verkuyl (1985) and Lumsden (1988). According to this characterization, strong NPs share one of the defining components of definiteness proposed in Heim (1982), namely the Descriptive Content Condition (DCC). How to derive the prohibition against strong NPs inthere-insertion contexts (definiteness effect) from the fact that strong NPs meet the DCC is not obvious, however. I argue that accounting for this prohibition involves regarding the XP-coda in [there be NP XP] as providing the contextual domain for the interpretation of the postverbal NP. (shrink)

In this paper, we take up an old issue that of pragmemes, broached by Mey and further explored by Capone. It is not easy to define pragmemes and distinguish them sufficiently from speech acts (units of language use broached by Austin and Searle) or from Wittgensteinian language games or from macro speech acts (see van Dijk on macrostructures) or from Goffman’s scripts. The best idea we could develop about pragmemes is that they instantiate the triple articulation of language, proposed by (...) Jock Wong; being essentially composed of phonological-syntactic units, that have a certain content relative to a social situation and to a certain culture, pragmemes express a certain function (or illocutionary force), like, e.g., modifying society or some aspect of it. They are part of a chapter that can be called either “societal pragmatics” or “emancipatory pragmatics,” to use the words by Mey. In fact, knowledge of how language is used to diminish the rights of people and to propagate the “status quo” may be instrumental to give rights and power to ordinary human beings who are oppressed by political and economical structures. -/- . A number of companies allocate ownership rights to stakeholders different from shareholders, despite the fact that the law attributes these rights to the equity holders. This article contributes to an understanding of this evidence by developing a contingency model for the allocation of ownership rights. The model sheds light on why companies, despite pressures from the law, vary in their allocation of ownership rights. The model is based on the assumption that corporations increase their chance to survive and prosper if (...) the stakeholders supplying “critical contributions” receive the ownership rights. According to the model, “critical” contributions involve (1) contractual problems due to specific investments, long-term relationships, and low measurability; (2) the assumption of the uncertainty resting on the company; and (3) the supply of scarce and valuable resources. The model is dynamic because it also provides a basis for understanding why the allocation of ownership rights changes with time. Finally, the article presents the strategies companies can use to realize an efficient distribution of ownership rights among their stakeholders. (shrink)

What kind of reality is legal reality, how is it created, and what are its a priori foundations? These are the central questions asked by the early phenomenologists who took interest in social ontology and law. While Reinach represents the well-known “realist” approach to phenomenology of law, Felix Kaufmann and Fritz Schreier belonged to the “positivist” “Vienna School of Jurisprudence,” combining Hans Kelsen’s Pure Theory of Law with Edmund Husserl’s phenomenology—and thereby challenging Reinach’s views on how legal reality and the (...) legal a priori were to be conceived. This paper addresses the controversy between these positivist and realist approaches to phenomenology of law, with the goal of introducing the lesser known theories of Kaufmann and Schreier. The special focus on their critique of Reinach’s outline should give us an overview of their positions vis-à-vis the basic and a priori elements of which legal reality consists and the role that phenomenology plays in analyzing them. There is one general tendency to be noted: While the phenomenological legal positivists see the root of legal reality in an act of interpretation according to a “normative scheme of interpretation,” Reinach locates the roots of legal reality in social interaction and argues for the existence of entities independent of any interpretation. Cristina Lafont’s Democracy Without Shortcuts enriches the discussion of deliberative democracy with new insights. After discussing her three objections against Waldron’s denunciation of judicial review as antidemocratic, the main flaw of Waldron’s thesis is argued to remain out of focus. The constitution is understood by him as owned by the living citizens, in a pattern of serial sovereignty that raises three problems: the ‘wanton republic’; the under-individuation of the polity; generational inequality. The answer to Lafont’s question ‘Can We Own the (...) Constitution?’ is then argued to be that only ‘we the people’, including past, present and future ‘free and equal’ generations, own the constitution. The living citizens are the segment of ‘the people’ endowed with agency, have a voice, can modify the inherited political scheme, but cannot legitimately disfigure it, under penalty of destroying the regulatory function of the constitution. Alessandro Ferrara suggests that the notion of reflective (...) authenticity offers the key to a new kind of exemplary universalism which, different from the generalizing universalism typical of modern thought, does not fall under the critique of foundationalism articulated by postmodernist thinkers. Abstract -/- In this paper, I shall deal with quasi-(proper) names, that is expressions like ‘Mum’, ‘Dad’, ‘Grandpa’, ‘Grandma’ in English or ‘Papà’, ‘Mamma’, ‘Nonna’, ‘Nonno’ in Italian. I shall use examples both from English and Italian. Quasi-names are directly referential like proper names, even if they apparently exhibit some conceptual materials, which, however, are not active and are inert. They can be used as vocatives or as arguments of verbs. I called terms like ‘Mum’, ‘Dad’ ‘quasi-names’ because they have (...) certain characteristics of names (but they could also be called ‘indexical names’). They confer significance to an individual. The theme of conspiracies plays a key role in Machiavelli's writings, in which can be found considerations and analyses on the use of conspiracy as an instrument of conquest of power, and as a technique for political fighting. This volume denies an interpretation in which Machiavelli limited himself to warning against conspiracies, judging them as a dangerous and useless tool. In reality, he elaborated a real phenomenology or anatomy of the conspiracy. His thoughts on this theme represent a practical manual (...) for the "coup d'état" and the violent seizure of power. But as always, they also contain brilliant intuitions on political psychology, the sociology of power, and social anthropology. (shrink)

Alfred North Whitehead famously compares the philosophical method of knowledge acquisition with the process of flying an airplane. Likewise, “shamanic flight” marks stages of cognitive processing in navigation through perceptible and imperceptible worlds. This article focuses on the cosmovision of the Amazon people Huni Kuin, the Whiteheadian method of imaginative rationalization, and the concept of Amerindian perspectivism. This study also investigates shamanism as an experience of knowledge generation. Furthermore, “shamanic flight,” as an ecstatic technique experienced in many diverse Amerindian rituals, (...) will be explored as a method in the discovery and organization of nonhuman alterities. Finally, Amazonian-based shamanic epistemology will be discussed within a “multinaturalist” ontology. (shrink)

Whiteheadian concepts of life, food, "empty" and "occupied space" provide a theoretical basis to unpack an ontogenetic perspective on aging. Focusing on the so-called "Selective Optimization with Compensation " strategy, this work will explore this concept in relation to some scientific evidence in the fields of "epigenetics " and molecular nutrition. Further, the role of caloric restriction in health and longevity will be discussed as a SOC strategy, based on the metabolic theory of aging. SOC strategy applied to the processes (...) of aging, when linked with Whitehead's philosophy of organism, makes it possible for us to think about life as a selective process provided by "empty space. In this paper, I distinguish between linguistic and non-linguistic presuppositions. I also propose that we should be interested in conversational presuppositions, which could also be called speaker-meant presuppositions or speaker's presuppositions. I also distinguish between potential and actual presuppositions. I propose that, in some cases, presuppositions can be conversationally implicated and cancellation is possible. I specify what the hard cases are and I try to explain them through ontological considerations. I try to reduce the hard cases through (a) the notion (...) that all actual presuppositions are speaker-meant; (b) the distinction between ontological and linguistic presuppositions; and (c) the uncontroversial notion that even ontological presuppositions are susceptible to semantic under-determination that has to be tackled though pragmatic intrusion. Pragmatic intrusion for presuppositional cases, however, cannot really amount to completing or expanding or in any case computing an explicature in an ordinary sense, as explicatures have to do with truth-conditions and aim to create propositionally complete forms that are truth-evaluable, unlike propositional fragments or schemata that are usually expressed in sentences (; , 2012). They are processes similar to explicatures, but since presuppositions are only pre-conditions for an utterance's being true or false (; Macagno; 2016; ; ), we cannot say that these processes are completely like those of explicatures. Nevertheless, they are pragmatically-motivated, even if hard to cancel. (See on lack of cancellability or on entrenched meanings.) An important international discussion began because of some pioneer studies carried out by Young (1996a) on the internet addiction disorder (IAD). In the fifth and most recent version of the Diagnostic, and Statistical Manual of Mental Disorders (DSM) there is no mention of this disorder and among researchers there are basically two opposite positions. Those who are in favor of a specific diagnosis and those who are claiming the importance of specific criteria characterizing this behavior and the precise role it (...) has in the patient’s life. The aim of the present paper is to answer the question whether it is possible or not to formulate diagnoses of internet-related disorders. We revised literature on the history of diagnostic criteria, on neurocognitive evidence, on the topic debate and on IAD instrumental measures. We found that the disorder was not univocally defined and that the construct was somehow too broad and generic to be explicative for a diagnosis. Indeed, the models are borrowed from other addiction pathologies and they are often formulated before the development of internet as intended in current society. In conclusion, we think we need a more innovative, integrated and comprehensive model for an IAD diagnosis. (shrink)

In this brief discussion, we explicate and evaluate Heyes and colleagues’ deflationary approach to interpreting apparent evidence of domain-specific processes for social percep- tion. We argue that the deflationary approach sheds important light on how functionally specific processes in social perception can be subserved at least in part by domain-general processes. On the other hand, we also argue that the fruitfulness of this approach has been unnecessarily hampered by a contrastive conception of the relationship between domain- general and domain-specific processes. As an alternative, we propose a complementary conception: the identification of domain-general processes that are engaged in instances of social perception can play a positive, structuring role by adding additional constraints to be accounted for in modelling the domain-specific processes that are also involved in such instances. John Searle’s account of collective intentions in action appears to have all the theoretical pros of the non-reductivist view on collective intentionality without the metaphysical cons of committing to the existence of group minds. According to Searle, when we collectively intend to do something together, we intend to cooperate in order to reach a collective goal. Intentions in the first-person plural form therefore have a particular psychological form or mode, for the we-intender conceives of his or her intended actions as (...) singular contributions by means of which – or: by way of which – a collective goal is pursued. Accordingly, we-intentions are held to have a psychological mode with a “collective goal by means of singular contribution” structure, which makes them primitive and irreducible to intentions in the I-form. It is further contended that, albeit primitive and irreducible, we-intentions are not the mental states of an alleged group mind but always of an individual’s mind. This paper targets Searle’s claim of irreducibility by developing an argument whose aim is to show that, pace Searle, it is possible to track the idea of intentions with a psychological mode structured in terms of “collective goal by means of singular contribution” back to the concept of intentions in the I-form. The argument mainly relies on the idea that Searle’s technical expressions “being a collective goal by means of singular contribution intention in action” or “being a collective goal by way of singular contribution intention in action” are susceptible to conceptual analysis. The upshot of this analysis is that we-intentions can be reduced to complex bundles of mental states, all of which come in the first-person singular form. If this argument is sound, Searlean we-intentions do not belong to a primitive kind of mental states. (shrink)

This paper is an example of how contextual information interacts with the interpretation of noun phrases (NPs) in discourse. When we encounter an NP escorted by the definite article or a proper name, the expectation is triggered that the speaker is referring to some referent x that the hearer can normally identify. Strawson and Russell have agreed that a referent must be associated with a definite description so that the assertion containing it can be said to be true. In the (...) case where a description does not refer to anything, the assertion is considered by Russell to be false, while Strawson says that the issue of truth or falsity does not arise. In this paper, we examine a case in which contextual information interacts with the interpretation of NPs in discourse and the hearer is not expected to identify a referent when hearing a proper name. In this case, the issue of truth or falsity does not arise, because the hearer does not identify the referent. In fact, s/he does not intend for the discourse to about a referent at all. These situations are primarily represented by sentences uttered during the course of a grammar lecture, in which the lecturer is explaining a rule of language and does not focus on external reality. The hearers are aware of this focus and do not process the NP (in general a proper name) to identify a specific referent. This study on the contemporary relevance of Rousseau’s ethical and social thought, the “ethic of authenticity,” responds to the tensions of modern morality and rivals the answers generated by the more mainstream tradition of the “ethic of autonomy.”.

In 2020, with the outbreak of the COVID-19 pandemic, academics and scientists began to question the triage criteria for allocating insufficient healthcare resources, trying to ethically justify the answer to the question, Who should receive medical care first? In this article, I will argue that even if we apply triage criteria, we won't be able to avoid the violation of human dignity or of the right to life and to health care. I will then suggest that, maybe, the real ethical (...) triage dilemma lies not in the question, Who should receive medical care first? but in the question, How are we to decide who should receive medical care first? Self-conscious emotions such as shame and pride are emotions that typically focus on the self of the person who feels them. In other words, the intentional object of these emotions is assumed to be the subject that experiences them. Many reasons speak in its favor and yet this account seems to leave a question open: how to cash out those cases in which one genuinely feels ashamed or proud of what someone else does? This paper contends that such cases do (...) not necessarily challenge the idea that shame and pride are about the emoting subject. Rather, we claim that some of the most paradigmatic scenarios of shame and pride induced by others can be accommodated by taking seriously the consideration that, in such cases, the subject “group-identifies” with the other. This is the idea that, in feeling these forms of shame or pride, the subject is conceiving of herself as a member of the same group as the subject acting shamefully or in an admirable way. In other words, these peculiar emotive responses are elicited in the subject insofar as, and to the extent that, she is (or sees herself as being) a member of a group – the group to which those who act shamefully or admirably also belong. By looking into the way in which the notion of group identification can allow for an account of hetero-induced shame and pride, this paper attempts to achieve a sort of mutual enlightenment that brings to light not only an important and generally neglected form of self-conscious emotions, but also relevant features of group identification. In particular, it generates evidence for the idea that group identification is a psychological process that the subject does not have to carry out intentionally in the sense that it is not necessarily triggered by the subject’s conative states like desires or intentions. Social interaction, especially for older people living alone is a challenge currently facing human-robot interaction (HRI). There has been little research on user preference towards HRI interfaces. In this paper, we took both objective observations and participants’ opinions into account in studying older users with a robot partner. The developed dual-modal robot interface offered older users options of speech or touch screen to perform tasks. Fifteen people aged from 70 to 89 years old, participated. We analyzed the spontaneous actions of (...) the participants, including their attentional activities and conversational activities, the temporal characteristics of these social behaviours, as well as questionnaires. It has been revealed that social engagement with the robot demonstrated by older people was no different from what might be expected towards a human partner. This study is an early attempt to reveal the social connections between human beings and a personal robot in real life. (shrink)

What is the relation between the three following elements: words, pictures, and conceptual representations? And how do these three elements work, in defining and explaining metaphors? These are the questions that we tackle in our interdisciplinary contribution, which moves across cognitive linguistics, cognitive sciences, philosophy and semiotics. Within the cognitive linguistic tradition, scholars have assumed that there are equivalent and comparable structures characterizing the way in which metaphor works in language and in pictures. In this paper we analyze contextual visual (...) metaphors, which are considered to be the most complex ones, and we compare them to those that in language are called indirect metaphors. Our proposal is that a syllogistic mechanism of comprehension permeates both metaphors expressed in the verbal modality as well as metaphors expressed in the pictorial modality. While in the verbal modality the metaphoric syllogism is solved by inference, we argue that in the pictorial modality the role of inference is performed through mental imagery. (shrink)

The idea of a ‘true’ account of pluralism is ultimately contradictory. Liberal political philosophers often fell prey to a special version of this fallacy by presupposing that there might be only one correct argument for justifying the acceptance of pluralism as the core of a liberal democratic polity. Avoiding this trap, Rawls’s ‘political liberalism’ has offered a more sophisticated view of reasonable pluralism as linked with the ‘burdens of judgement’. His philosophical agenda, however, left some questions underexplored: What is the (...) relation of pluralism to relativism? How can a conception of pluralism avoid being either one view among others with no special claim to truth, or a foundationalist claim? If pluralism is a fact, in what sense can it bind us? Two rival conceptions of well-being are reconstructed and contrasted, which have contended for philosophical pre-eminence throughout the Western conversation of philosophy. One view understands well-being as a life course in which as many as possible of a subject’s preferences are satisfied. The other view understands well-being as a life course in which some unique project of the subject comes to be realized. In the second part of the paper the aggregative view of well-being, championed by Hobbes and Locke is shown (...) to correlate with a radically or moderately understanding of freedom, and the holistic view of well-being with a positive notion of freedom, championed by Rousseau, Kierkegaard and Kohut. After showing how some of the conceptual difficulties of the radically negative view of freedom reverberate on the aggregative notion of well-being, in the final section some constitutive dimensions of the holistic view are discussed.
