Our society is being shaped in a non-negligible way by the technological advances of recent years, especially in information and communications technologies. The pervasiveness and democratization of ICTs have allowed people from all backgrounds to access and use them, which has resulted in new information-based assets. At the same time, this phenomenon has brought a new class of problems, in the form of activists, criminals and state actors that target the new assets to achieve their goals, legitimate or not. Cybersecurity (...) includes the research, tools and techniques to protect information assets. However, some cybersecurity measures may clash with the ethical values of citizens. We analyze the synergies and tensions between some of these values, namely security, privacy, fairness and autonomy. From this analysis, we derive a value graph, and then we set out to identify those paths in the graph that lead to satisfying all four aforementioned values in the cybersecurity setting, by taking advantage of their synergies and avoiding their tensions. We illustrate our conceptual discussion with examples of enabling technologies. We also sketch how our methodology can be generalized to any setting where several potentially conflicting values have to be satisfied. (shrink)

The rapid dynamics of COVID-19 calls for quick and effective tracking of virus transmission chains and early detection of outbreaks, especially in the “phase 2” of the pandemic, when lockdown and other restriction measures are progressively withdrawn, in order to avoid or minimize contagion resurgence. For this purpose, contact-tracing apps are being proposed for large scale adoption by many countries. A centralized approach, where data sensed by the app are all sent to a nation-wide server, raises concerns about citizens’ privacy (...) and needlessly strong digital surveillance, thus alerting us to the need to minimize personal data collection and avoiding location tracking. We advocate the conceptual advantage of a decentralized approach, where both contact and location data are collected exclusively in individual citizens’ “personal data stores”, to be shared separately and selectively, voluntarily, only when the citizen has tested positive for COVID-19, and with a privacy preserving level of granularity. This approach better protects the personal sphere of citizens and affords multiple benefits: it allows for detailed information gathering for infected people in a privacy-preserving fashion; and, in turn this enables both contact tracing, and, the early detection of outbreak hotspots on more finely-granulated geographic scale. The decentralized approach is also scalable to large populations, in that only the data of positive patients need be handled at a central level. Our recommendation is two-fold. First to extend existing decentralized architectures with a light touch, in order to manage the collection of location data locally on the device, and allow the user to share spatio-temporal aggregates—if and when they want and for specific aims—with health authorities, for instance. Second, we favour a longer-term pursuit of realizing a Personal Data Store vision, giving users the opportunity to contribute to collective good in the measure they want, enhancing self-awareness, and cultivating collective efforts for rebuilding society. BackgroundThe H2020 i-CONSENT project has developed a set of guidelines that offer ethical recommendations and practical tools aimed at making the informed consent process in clinical studies more comprehensive, tailored, and inclusive. An analysis of the appropriateness of some of its novel recommendations was carried out by a group of experts representing different stakeholders.MethodsAn adaptation of the RAND/ucla Appropriateness Method was used to assess the level of agreement on the recommendations among 14 representatives of different stakeholders, including patients, regulators, investigators, (...) ethics experts, and the pharmaceutical industry. The process included two rounds of rating and a virtual meeting.ResultsFifty-three recommendations were evaluated. After the first round, 34 recommendations were judged “appropriate”; 19 were judged “uncertain”; and none was judged “inappropriate”. After the second round, 9 “uncertains” changed to “appropriate”. All recommendations rated medians of 6.5–9 on a 1–9 scale (1 = “extremely inappropriate”, 5 = “uncertain”, 9 = “extremely appropriate”). The sections “General recommendations” and “Gender perspective during the consent process for clinical studies” showed the highest “uncertainty” rating. The four keys to improving the understanding of the ICP in clinical studies are to: (1) consider consent a two-way continuous interaction that begins at the first contact with the potential participant and continues until the end of the study; (2) improve investigators’ communication skills; (3) co-create the information; and (4) use a layered approach, including information to compensate for the potential participant’s possible lack of health literacy and a glossary of terms.ConclusionsThe RAND/ucla method has demonstrated validity for assessing the appropriateness of recommendations in ethical guidelines. The recommendations of the i-CONSENT guidelines were mostly judged “appropriate” by all stakeholders involved in the informed consent process. (shrink)

BackgroundSeveral authors have shown that children and adolescents have limited understanding of critical elements of the research studies in which they are participating. The inclusion of graphic elements is a promising approach to increase the understandability of assent forms of clinical trials.ObjectivesTo design a new assent form in comic strip format for minors participating in clinical trials and to compare the comprehension of this new document with a traditional assent form.MethodsThis study included an assessment of the readability of standard informed (...) assents, the evaluation of the comprehension of one of these documents, the development of a new (comic format) informed assent from the original document previously evaluated, and the analysis of readability and comprehension of the new informed assent. The readability of the documents was assessed using previously validated formulas, whereas comprehension analyses were performed through a questionnaire taken by two groups of 12-year-old students of secondary schools. Ethical considerations: All procedures involving human participants were in accordance with the ethical standards of the 1964 Helsinki Declaration and its later amendments.FindingsCompared with the original document, the comic assent form improved the grammatical readability of the “Aims, Risks and Benefits and How to Get More Information” sections, the comprehension scores in the Aims and Procedure sections, the understanding of ideas, and the formation of macro-ideas. The benefits of the comic strip format were more noticeable among participants in the lower percentiles of the comprehension score.ConclusionsOur results show that the comic assent form has high readability and comprehensibility compared with its original form, particularly in the domains of knowledge-based inferences and macro-ideas formation. The use of forms that combine text and comic strips may help the comprehension of minors participating of a clinical trial, supporting their autonomy in decision-making. (shrink)

The First World Congress on Evidential Legal Reasoning, organised by the Legal Culture Chair of the University of Girona, was held between June 6 and 8, 2018. The Congress was attended by 350 participants and featured 18 speakers from four continents. The three days of formal and informal presentations and discussions yielded excellent results, strengthening the interrelation between the legal communities and specialists of different traditions. Además, constituye una buena introducción a quienes se aproximan a la filosofía del fundador de la fenomenología, y un buen servicio incluso para quienes ya conocen su pensamiento solamente en relación con la teoría del conocimiento o con la lógica. Concretamente, la ética de Husserl —en un cuidado y ajustado (...) equilibrio entre el papel de la razón, el de la voluntad y el del sentimiento— ofrece la posibilidad de rescatar la afectividad del sentimentalismo ciego e instintivo sin caer en el extremo contrario del racionalismo inhumano; enseña cómo tomar libre y realmente nuestra vida en nuestras propias manos y dirigirnos a un ideal personal; muestra cómo comportarnos con nuestros semejantes reconociéndolos en su verdadera dignidad, y cómo podemos ayudarnos los unos a los otros. Y para todo ello, en fin, nos proporciona el suelo seguro de la experiencia interna evidente, resistente a toda crítica procedente de la ciencia empírica o del cinismo posmoderno. La exposición del discurso ético pasa necesariamente por meandros psicológicos y antropológicos, como no podía ser de otra manera. De modo que la doctrina moral de Husserl desvela asimismo e inseparablemente un sustancioso contenido psicológico y antropológico. Desde hace ya bastante tiempo existe una tendencia a afirmar que el derecho o las normas de diferente tipo no son adecuadas o aplicables para las diferentes nuevas tecnologías que van apareciendo de forma continua. Este trabajo intentará dar la vuelta a ese razonamiento y, centrándose en la inteligencia artificial, tratará de plantear criterios adecuados para que esa tecnología y muchas otras sean desarrolladas y aplicadas de forma adecuada a los derechos fundamentales en general y a la privacidad en particular. Dentro de esos criterios se analizará lo que debe aportar la explicabilidad de la tecnología mencionada y se profundizará en algunos conceptos adicionales como la posibilidad y la necesidad de controlar y de auditar sistemas de inteligencia artificial. Para realizar la mencionada profundización se recurrirá a lo que se conoce como objetivos de protección y a los principios de la ciberética, incluyendo una referencia especial a la sostenibilidad y a la resiliencia de este tipo de sistemas. This paper explores the writings of Jose Rizal as a source of insight into the predominant role of Mary, as the Mother of God, in Christian devotion and salvation during the Spanish Colonial period in the Philippines. It demonstrates the implication of the contradiction of the feminine spiritual authority of Mary—as the mediatrix of salvation, on the one hand, and the symbol of religious oppression, on the other hand—to the construction of the Filipina identity in Philippine Colonial Catholicism.
