The article takes into consideration human pain from a threefold approach. First, it considers pain as an anthropological reality; second, it shows how medical sciences have contributed to such a reality; and finally, it addresses spiritual pain, recognizing how relevant the latter is for the care of patients, mainly for palliative care. Thus, the aim of the article is to motivate a reflection on how to treat human pain in a comprehensive way.

Se propone una reflexión filosófica sobre el imperativo ético y político de pensar y reconstruir nuestro pasado a partir de la experiencia del sujeto latinoamericano oprimido y resistente. En este orden de ideas, el objetivo principal del artículo es emprender una búsqueda de aquellos lugares en los que habitan y se conservan en el tiempo las memorias de los latino-americanos antes y después del proceso de colonización o de “invasión” de la Modernidad europea. Esta indagación se inclina específicamente hacia esas (...) memorias “no oficiales”, construidas desde las comunidades en sus prácticas culturales, que mediante la rememoración y la tradición oral crearon vínculos de resistencia contra el olvido, al tiempo que preservaban aspectos fundamentales de sus tradiciones. Así, llamamos lugares a aquellos elementos que albergan fragmentos de lo pretérito invisibilizado por el discurso histórico oficial y que permiten establecer un vínculo trascendente entre pasado y presente, una recreación del pasado que surge a partir de la reconstrucción interpretativa de ruinas, rastros y vestigios de un tiempo que no ha dejado de ser y al que aún es posible acceder y conocer. Posteriormente, se destacan algunos episodios importantes de nuestra historia latinoamericana en los que esas memorias encuentran su lugar. (shrink)

La narrativa de José Saramago es centro de análisis reciente para todos aquel que incursionen en la literatura contemporánea. A través de La caverna, el escritor expone un sinnúmero de situaciones que deben ser reflexionadas y que en el presente artículo se abordan desde la perspectiva de los estudios culturales. Entre otros, se resalta el uso del lenguaje popular, la dialéctica entre lo rural y lo urbano, y finalmente la exclusión social y el consumismo. Este es, por lo tanto, un (...) estudio de análisis crítico de la obra La caverna de José Saramago, apoyado además en los trabajos interdisciplinarios que otros pensadores han ofrecido al respecto. El aporte desde los estudios culturales y la crítica realizada por Saramago no son ajenos a la preocupación por el ser, pues este se ve acorralado por las dinámicas que la sociedad impone. (shrink)

El presente artículo se centra en una investigación sobre los vínculos entre la teoría crítica de la educación inclusiva, la justicia social y la literatura de tradición oral, puesto que a través de los referentes hallados se interpela a la literatura desde el mismo contexto del Sur Global, visto como un punto de partida para comprender los problemas culturales, sociales e interculturales. Desde estas consideraciones, se hizo una revisión sistemática de la producción y publicación de trabajos investigativos referentes al estudio (...) de las variables Literatura de tradición oral, Justicia social y Educación inclusiva, bajo el enfoque PRISMA (Preferred Reporting Items for Systematic reviews and Meta-Analyses). El objetivo del análisis propuesto fue conocer las características principales de las publicaciones registradas en base de datos Scopus y Web of Science y su alcance en el estudio de las variables propuestas, logrando la identificación de 106 publicaciones en total. Gracias a esta primera identificación, se refinaron los resultados a través de dos palabras clave, “Social justice (and) Inclusive education”, llegando a un total de 23 documentos, después de excluir los duplicados y aquellos que no cumplían con los criterios de análisis. Luego fueron analizados esperando conocer la relación entre las variables, y cómo en América se ha avanzado en materia de lucha contra la corrupción. Los hallazgos apuntan a: 1) que la educación inclusiva establece vínculos con la literatura de tradición oral desde el reconocimiento de la pluralidad y las diferencias culturales; 2) que los autores resaltan expresiones culturales transmitidas de generación en generación para fecundar nuevos conocimientos desde la comunidad; 3) y que la justicia social se traduce en una educación que reconoce diferencias y genera espacios para otros saberes, como es el caso de la literatura de tradición. O objetivo deste artigo é apresentar uma argumentação sobre a possibilidade de se pensar a justiça como uma experiência do i m possível. Parte-se da distinção derridiana entre justiça e direito. Essa distinção trará algumas implicações no que tradicionalmente é entendido como ética. At the outset of an ethnographic inquiry, we navigated national and international resources to search for theoretical and practical guidance on obtaining parents and children’s informed consent/assent. While much theoretical guidance debating ethical issues to children’s participation in research was found, a paucity of published papers offering practical guidance on assent processes and/or visual representations of child assent forms and information sheets was discovered. The purpose of this article is to describe our experiences, both theoretically and practically, of negotiating the (...) process of obtaining informed consent and assent with parents and children for a non-therapeutic qualitative research study. We hope this article instigates a platform for others to explicate their experience and contributes to the construction of a coherent body of knowledge which will clearly delineate important elements that must be considered when negotiating children’s agreement to participate in research. In this paper, we examine the scientific, legal, and ethical foundations for inclusion of transgender women athletes in competitive sport, drawing on IOC principles and relevant Court of Arbitration for Sport decisions. We argue that the inclusion of trans athletes in competition commensurate with their legal gender is the most consistent position with these principles of fair and equitable sport. Biological restrictions, such as endogenous testosterone limits, are not consistent with IOC and CAS principles. We explore the implications for recognizing (...) that endogenous testosterone values are a ‘natural physical trait’ and that excluding legally recognized women for high endogenous testosterone values constitutes discrimination on the basis of a natural physical trait. We suggest that the justificatory burden for such prima facie discrimination is unlikely to be met. Thus, in place of a limit on endogenous testosterone for women, we argue that ‘legally recognized gender’ is most fully in line with IOC and CAS principles. (shrink)

It is commonly thought that that the best system account of lawhood ((Mill (1843), Ramsey (1978)[fp. 1928], Lewis (1973)) makes available a nice explanation for why laws are ‘distinctively appropriate targets of scientific inquiry’ (Hall, 2015). The explanation takes the following general form: laws are especially valuable for agents like us because they efficiently encode a lot of valuable (non-nomic) information in a tractable format. The goal of this paper is to challenge this style of explanation: I argue that the (...) general principle it presupposes is in conflict with our best account of practical rationality. After considering and rejecting a number of proposals for dissolving the tension, I conclude that BSA proponents may need to scale back the explanatory ambitions of their theory; in particular, they may need to give up the hope of non-circular explanations of the value of nomic information. I end by outlining some challenges for the humean world-view that results after this shift. (shrink)

Deep brain stimulation (DBS) is a developing technology. New generations of DBS technology are already in the pipeline, yet this particular fact has been largely ignored among ethicists interested in DBS. Focusing only on ethical concerns raised by the current DBS technology is, albeit necessary, not sufficient. Since current bioethical concerns raised by a specific technology could be quite different from the concerns it will raise a couple of years ahead, an ethical analysis should be sensitive to such alterations, or (...) it could end up with results that soon become dated. The goal of this analysis is to address these changing bioethical concerns, to think ahead on upcoming and future DBS concerns both in terms of a changing technology and changing moral attitudes. By employing the distinction between inherent and noninherent bioethical concerns we identify and make explicit the particular limits and potentials for change within each category, respectively, including how present and upcoming bioethical concerns regarding DBS emerge and become obsolete. Many of the currently identified ethical problems with DBS, such as stimulation-induced mania, are a result of suboptimal technology. These challenges could be addressed by technical advances, while for instance perceptions of an altered body image caused by the mere awareness of having an implant may not. Other concerns will not emerge until the technology has become sophisticated enough for new uses to be realized, such as concerns on DBS for enhancement purposes. As a part of the present analysis, concerns regarding authenticity are used as an example. (shrink)

Este artículo problematiza la forma en la que el feminismo ha interpretado al escepticismo como una amenaza para su proyecto epistemológico, ético y político, y plantea que, a pesar de dicha interpretación, el escepticismo es inherente a la filosofía feminista y un aliado útil para su proyecto. El problema ha estado en cómo el feminismo ha reducido su comprensión del escepticismo a una versión cartesiana extrema y ha pasado por alto otras corrientes de la tradición —como la de David Hume— (...) que podrían ser fructíferas para promover una actitud crítica y emancipatoria. Muestra así como una alianza entre una comprensión moderada del escepticismo y el feminismo puede brindar las herramientas necesarias para cuestionar formas de dominación patriarcal y poner en marcha investigaciones que combatan la opresión de género. Dominant development discourse and policy are based on crucial misconceptions about peasants and their livelihoods. Peasants are viewed as inherently poor and hungry and their farming systems are considered inefficient, of low productivity, and sometimes even environmentally degrading. Consequently, dominant development policies have tried to transform peasants into something else: industrialised commercial farmers, wage labourers, urban workers, etc. This article seeks to deconstruct three key misconceptions about peasants by explaining how and why marginalised peasants around the world face poverty and (...) hunger. An explanation of the process of marginalisation of peasants through the influence of five “mediating factors” is put forward. It is contended that by addressing the mediating factors through policies devised with the active participation of peasants, the marginalisation of peasants would be reduced or eliminated. This would allow peasants to forge an adequate livelihood in rural areas based on their independent farming, and thereby contribute to the achievement of food sovereignty. (shrink)

The aim of this paper is to show that we are entitled to see in Schütz’s article “Equality and the Social Meaning Structure” the proposal for a formal analysis of group membership understood as a kind of We-experience irreducible to pure We-relationships. First I argue that such an account defines the experience of group membership as a “situation definition process”. Then I show the relevance of this approach for the description of membership experiences and current debates on Collective Intentionality. Finally, (...) I point to its unclarified conceptual presuppositions—such as the at­tribution of situations to groups—, and propose an interpretative solution by drawing on the notions of “social situation” and community of relevances from The Structures of the Life-World. El presente artículo presenta dos aproximaciones teóricas para entender, desde la criminología, el control punitivo del Estado sobre los flujos migratorios. Por un lado, bajo la idea que el control penal y el control migratorio son dos funciones esenciales de la soberanía del Estado, investigaciones recientes han mostrado un novedoso ensamblaje entre éstas, resultando en un control penal de la migración conocido como “crimigración”. Por otro, desde la criminología crítica se insiste en que el control punitivo de la migración no (...) es algo novedoso, sino que representa una dimensión más de la regulación económica desde el Estado, sobretodo en relación al mercado del trabajo, sosteniendo con ello una mirada desde la economía política del castigo.En un contexto donde Chile ha duplicado la cantidad de población extranjera durante la última década, se discuten los resultados de una investigación reciente sobre aplicación de sanciones administrativas entre los años 2011 y 2014, en las cuatro regiones del país que presentan mayor proporción de migrantes. Así, con el objetivo de explorar y describir la cantidad y tipos de sanciones aplicadas por infracciones a la regulación de extranjería, así como su relación con características del infractor y aspectos procesales de la aplicación de sanciones, se analiza una muestra representativa de los actos administrativos que imponen sanciones durante este período en las regiones de Arica y Parinacota, Tarapacá, Antofagasta y Metropolitana, a través de pruebas chi-cuadrado y análisis de correspondencias múltiples.Se concluye que a pesar de ser aparentemente contradictorias, ambas pueden ser de gran utilidad en los estudios sobre control de la migración, sobretodo en relación al significativo flujo de migración latinoamericana que se observa en el país. La interacción entre los presupuestos de la doble o múltiple afiliación religiosa con las reflexiones de la teología el (...) pluralismo religioso, tiene como intención una aproximación a la comprensión de la religiosidad de los pueblos ancestrales, que bajo otras categorías birreligiosidad, posterior Teología propia y el sincretismo teológico, ubican las religiones aborígenes y afrodescendientes en relación con el cristianismo, como experiencias de fe y tradición considerando la Revelación como esencia de su identidad religiosa, ancestral y cultural. Las aproximaciones teológicas a partir del pluralismo religioso y la doble creencia religiosa, podrán generar la comprensión de la afiliación religiosa en creencias religiosas propias para el contexto tomando como referencia la fe del pueblo discernida. The osmotic activity produced by internal, non‐permeable, anionic nucleic acids and metabolites causes a persistent and life‐threatening cell swelling, or cellular edema, produced by the Gibbs‐Donnan effect. This evolutionary‐critical osmotic challenge must have been resolved by LUCA or its ancestors, but we lack a cell‐physiology look into the biophysical constraints to the solutions. Like mycoplasma, early cells conceivably preserved their volume with Cl−, Na+, and K+‐channels, Na+/H+‐exchangers, and a light‐dependent bacteriorhodopsin‐like H+‐pump. Here, I simulated protocells having these ionic‐permeabilities and inhabiting (...) an oceanic pond before the Great‐Oxygenation‐Event. Protocells showed better volume control and stable resting potentials at lower external pH and higher temperatures, favoring a certain type of extremophile life. Prevention of Na+‐influx at night, with low bacteriorhodopsin activity, required deep shutdown of highly voltage‐sensitive Na+‐channels and extremely selective K+‐channels, two conserved features essential for modern neuronal encoding. The Gibbs‐Donnan effect universality implies that extraterrestrial cells, if they exist, may reveal similar volume‐controlling mechanisms. (shrink)

This paper aims to analyze the metaphorological project of Hans Blumenberg in relation to the philosophical developments of conceptual history in the mid-twentieth century. It is argued that Blumenberg, based on the study of metaphor, seeks to endow philosophy with a historical substrate that gives rise to the concept, forgotten by the inheritance of the cartesian philosophy. In this way, metaphors, but also myths and anecdotes, fulfill a pragmatic guiding function of thought and expe- rience, becoming indispensable for human life.

Strauss considers the search of natural right qua representation of the idea of justice a distinct alternative to the affirmation of the will through sovereign power. RESUMEN Se analiza si la versión de la justicia como equidad, presentada en El liberalismo político, es genuinamente una concepción política. Se examina el problema de la razonabilidad de las doctrinas comprehensivas, y se indaga luego si el argumento en dos etapas afecta la integridad estructural del liberalismo político. Se concluye que J. Rawls fracasa en su intento de justificar un liberalismo independiente de una doctrina comprehensiva de carácter liberal. ABSTRACT The article analyzes whether the conception of justice as fairness, (...) set forth by Rawls in Political Liberalism, is a genuine political conception. It first examines the issue of reasonableness of comprehensive doctrines and then goes on to inquire whether the two-step argument affects the structural integrity of political liberalism. Let ‘semantic relevance’ be the thesis that the wide semantic properties of representational mental states (like beliefs and desires) are causally relevant to behavior. A popular way of arguing for semantic relevance runs as follows: start with a sufficient counterfactual condition for causal or explanatory relevance, and show that wide semantic properties meet it with respect to behavior (e.g., Loewer & Lepore (1987,1989), Rescorla (2014), Yablo (2003)).This paper discusses an in‐principle limitation of this strategy: even the most sophisticated counterfactual criteria (...) systematically misclassify irrelevant properties as relevant when they stand in certain kinds of modal co‐variation or ‘entanglement’ relations to genuinely relevant properties. This entanglement problem, I argue, is more general and more serious than proponents of the counterfactual strategy have recognized: it threatens recent interventionist arguments for semantic relevance, and is not easily solved by appeal to proportionality or naturalness. I end by suggesting that proponents of semantic relevance may need to shift their attention from patterns of counterfactuals to the lawful psychological generalizations that explain them. (shrink)

I’ve already argued for the legal, ethical, and scientific basis for full and equal inclusion of trans and intersex women in women’s sport. In this paper, I want to analyze what I take to be a representative selection of recent arguments against full and equal inclusion of trans and intersex women in women’s (...) sport. In short, these arguments tend to be based on mere assumption, unsupported “common sense,” straw arguments, fallacious question begging, and a number of hypotheticals and unsupported counterfactuals rather than established fact. Background:Ethical competence in nursing practice helps clinical nurses to think critically, analyse issues, make ethical decisions, solve ethical problems and behave ethically in their daily work. Thus, ethical competence contributes to the promotion of high-quality care. However, studies on ethical competence in Malawi are scanty.Objectives:The aim of this study was to explore ethical competence among clinical nurses in selected hospitals in Malawi.Methodology:A cross-sectional survey was conducted in four selected hospitals in Malawi with a sample of 271 clinical nurses. Data were (...) collected using self-administered questionnaires, which included a Moral Competence Scale for Home Care Nurses. Descriptive statistics and logistic regression were computed for the dataset using STATA version 12.0.Ethical consideration:The study protocol complied with all ethical requirements and was approved by the College of Medicine Research Ethics Committee under the University of Malawi.Results:The clinical nurses in Malawi are ethically competent. However, there is a significantly high number (p 0.05). Three determinants of high ethical competence level (strong will, judgement skills and recognition of discrepancy of intention) were identified through a reduced model after stepwise logistic regression analysis. Furthermore, results show that indicators of ethical competence include caring, confidentiality and observance of nurses dressing code. The study has also confirmed that the Moral Competence Scale for Home Care Nurses is a reliable tool to assess ethical competence in low-resource settings.Conclusion:The majority of nurses who completed the survey had low ethical competence. However, clinical nurses with high ethical competence level are required to competently manage complex ethical challenges in health facilities. Strategies for enhancing ethical competence such as continuing ethics education, establishment of ethics committees and provision of supportive supervision are recommended to enable nurses in Malawi attain a high level of ethical competence. In this paper we look at a few of the most prominent ways of articulating Kant’s critical argument for Noumenal Ignorance — i.e., the claim that we cannot cognize or have knowledge of any substantive, synthetic truths about things-in-themselves — and then provide two different accounts of our own.

Abstract:Brain–computer interfaces (BCIs) can enable communication for persons in severe paralysis including locked-in syndrome (LIS); that is, being unable to move or speak while aware. In cases of complete loss of muscle control, termed “complete locked-in syndrome,” a BCI may be the only viable solution to restore communication. However, a widespread ignorance regarding quality of life in LIS, current BCIs, and their potential as an assistive technology for persons in LIS, needlessly causes a harmful situation for this cohort. In addition (...) to their medical condition, these persons also face social barriers often perceived as more impairing than their physical condition. Through social exclusion, stigmatization, and frequently being underestimated in their abilities, these persons are being locked out in addition to being locked-in. In this article, we (1) show how persons in LIS are being locked out, including how key issues addressed in the existing literature on ethics, LIS, and BCIs for communication, such as autonomy, quality of life, and advance directives, may reinforce these confinements; (2) show how these practices violate the United Nations Convention on the Rights of Persons with Disabilities, and suggest that we have a moral responsibility to prevent and stop this exclusion; and (3) discuss the role of BCIs for communication as one means to this end and suggest that a novel approach to BCI research is necessary to acknowledge the moral responsibility toward the end users and avoid violating the human rights of persons in LIS.
