Removing a black hole conic singularity by means of Kruskal representation is equivalent to imposing extensibility on the Kasner–Fronsdal local isometric embedding of the corresponding black hole geometry. Allowing for globally non-trivial embeddings, living in Kaluza–Klein-like M 5 × S 1 (rather than in standard Minkowski M 6 ) and parametrized by some wave number k, extensibility can be achieved for apparently “forbidden” frequencies ω in the range ω 1 (k) ≤ ω ≤ ω 2 (k). As k → 0, (...) ω 1, 2 (0) → ωH (e.g., ωH = 1/4M in the Schwarzschild case) such that the Hawking–Gibbons limit is fully recovered. The various Kruskal sheets are then viewed as slices of the Kaluza–Klein background. This paper takes a simple, informal suggestion by Broome and another more explicit suggestion by Kamm for how to deal with asymmetric claims and shows how they can be interpreted to be consistent with two different social welfare functions: Sum-of-square-roots of individual utilities, and product of utilities. These functions are then used to analyze more complicated situations but I show that the first yields more intuitive results, and a better compromise of efficiency and justice, than the other. The controversy between Euclidean and non-Euclidean geometry arose new philosophical and scientific insights which were relevant to the later development of natural science. Here we want to consider Poincaré and Helmholtz’s positions as two of the most important and original ones who contributed to the subsequent development of the epistemology of natural sciences. Based in these conceptions, we will show that the role of philosophy is still important for some aspects of science.

It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. Resumen El objetivo de este trabajo es determinar la relevancia de la teoría informacional del conocimiento para el problema de la suerte epistémica. Argumento que el clásico enfoque de Dretske es equivalente a la condición de seguridad de Pritchard. Sin embargo, considero que esta manera de eludir la suerte epistémica exige lidiar con el llamado "problema de la generalidad". Argumento que una respuesta a este problema requiere una noción de seguridad diferente y propongo un enfoque informacional equivalente a esta versión (...) del requisito. Concluyo que este enfoque es preferible a la condición de seguridad propuesta porque desvela relaciones conceptuales entre los elementos que constituyen el conocimiento.The aim of this paper is to determine the relevance of an informational theory of knowledge to address recently discussed epistemic problems. I argue that Dretske's classical approach is equivalent to the safety condition proposed by Pritchard to avoid epistemic luck. However, I claim that Pritchard's condition has to be modified to avoid the so-called "generality problem" for reliabilism. I propose an alternative version of the requirement to deal with these problems and provide an equivalent informational condition. I conclude that this informational version is preferable since it reveals conceptual relationships between the constituents of knowledge. (shrink)

Se sostiene que la satisfacción de una condición anti-suerte implica cumplir con la condición de habilidad, primero, porque, las características centrales del caso de D. Pritchard en contra de esta implicación son compartidas con casos en los que hay habilidad; y segundo, el caso de A. Goldman del dios benevolente es más efectivo que (...) TEMP, pero involucra un tipo de seguridad diferente a la requerida para el conocimiento. Por último, se muestra que la respuesta de D. Pritchard al problema de la generalidad bloquea la implicación de seguridad a habilidad. Se propone un contraejemplo, adaptando un caso tomado de la epistemología del testimonio. ABSTRACT D. Pritchard holds that knowledge requires the satisfaction of an ability condition and an anti-luck condition that bear no relation of implication to each other. The article argues that the satisfaction of the anti-luck condition implies satisfying the ability condition for two reasons: first, that the main characteristics of Pritchard's case against this implication are shared by cases in which there is ability; and, second, that although A. Goldman's benevolent demon case is more effective than TEMP, it involves a different type of certainty than that required for knowledge. Finally, the article shows that Pritchard's response to the generality problem blocks the implication between certainty and ability, and proposes a counterexample that draws on the epistemology of testimony. The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

The two leading theoretical approaches to tort law — economic analysis and corrective justice — are blind to distributive considerations. Moreover, even the main distributive approaches to tort law — loss-spreading and fairness — fail to emphasize egalitarianism as a distributive consideration. This article argues that egalitarianism should influence the normative evaluation of one’s conduct as negligent or not. It first explains why normatively negligence law should be sensitive to the egalitarian concern, suggesting three different accounts for this claim, based (...) on needs, equality, and desert as criteria for distribution. Second, it argues that egalitarianism is commensurate with the basic understanding of negligence law as reflecting corrective justice and notions of fault. The notion of fault is, therefore, reformulated from within, in order to accommodate egalitarianism. Third, I maintain that in order for egalitarianism to accommodate notions of corrective justice, egalitarian concerns should matter also at the stage of the standard of care. While the egalitarian concern can and should be integrated into the duty stage, I argue that such integration is insufficient. A correct and full understanding of the egalitarian concern and the tort of negligence requires a conclusion that the normative evaluation of one’s action as negligent or not cannot be separated from the distributive results that this action entails. The egalitarian concern works at the duty stage as an excuse for not imposing liability for wrongful activity. In contrast, at the standard stage, it works as a justification that turns an otherwise wrongful activity into a legitimate one. My claim is that morally we should usually expect more care from the better-off than from the disadvantaged. Findings of negligence are based on the failure to balance properly between one’s interests and those of another. In deciding to what extent the defendant should burden herself in order to prevent a loss to potential victims, one morally relevant criterion is the relative ability of the injurer and victim to bear precaution costs and expected accident loss, respectively. This paper aims at understanding the concept of convention in mechanics as a notion transferred from the field of jurisprudence. This enables us to clarify it as a new epistemic category having a pertinent role in the transformation of mechanics in the nineteenth century. Such understanding permits a separation from linguistic and arbitrary conventions, thus highlighting its epistemic features and not transforming fundamental principles into mere arbitrary agreements. After addressing the main references in the literature discussing the role of convention (...) in mechanics, we analyze its classical use as a concept originating from law. Then we explain its use by Carl G. Jacobi, Ferdinand F. Reech, and J. Henri Poincaré. Here we also show how their uses conform to the features analyzed regarding conventions in jurisprudence. Finally, we try to explain how the use of this concept, among other factors, contributed to the transformation of mechanics. (shrink)

In the introduction to his famous book, La Science et l’hypothèse, Poincaré remarks on the necessary role and legitimacy of hypotheses. He establishes a triple classification of hypotheses, dividing them into verifiable, useful, and apparent. However, in chapter 9, entitled ‘Les hypothèses en physique’, he gives a slightly different triadic classification: natural hypotheses, indifferent hypotheses, and real generalizations. The origin of this second classification is a lecture given at the International Congress of Physics, Paris, 1900. What are the similarities and (...) differences between these two classifications? My main purpose is to provide a possible equivalence between the two classifications in order to clarify the role of hypotheses in Poincaré’s epistemology of natural science. The discussion will be based on the two fundamental texts mentioned above and on the contrast between Poincaré’s use of the notion of hypothesis and that of some of his contemporaries. (shrink)

The Krueger & Funder (K&F) article would gain in constructive value if the authors spelled out what role the heuristics-and-biases approach could play in balancing the field of social cognition, lowering the burden of blame on it, cautioning overly enthusiastic readers from championing the “enough-with-the-biases” movement, and acknowledging that not all biases are caused by minorities.

The American and some other constitutions entrench property rights by requiring super majoritarian voting as a condition for amending or revoking their own provisions. Following Buchanan and Tullock [The Calculus of Consent, Logical Foundations of Constitutional Democracy (University of Michigan Press, Ann Arbor), 1962], this paper analyzes individuals' interests behind a veil of ignorance, and shows that under some standard assumptions, a (simple) majoritarian rule should be adopted. This result changes if one assumes that preferences are consistent with the behavioral (...) phenomenon known as the endowment effect. It then follows that (at least some) property rights are best defended by super majoritarian protection. The paper then shows that its theoretical results are consistent with a number of doctrines underlying American Constitutional Law. (shrink)

We investigate the procedure of "random sampling" where the alternatives are random variables. When comparing any two alternatives, the decision maker samples each of the alternatives once and ranks them according to the comparison between the two realizations. Our main result is that when applied to three alternatives, the procedure yields a cycle with a probability bounded above by 8 27 . Bounds are also obtained for other related procedures.

In this paper I will defend the idea of the success of post-truth as one of the main features of hypermodernity. In order to understand such a claim, I will start by defining “post-truth” and showing the key differences that separate it from simple manipulation or lies. I will explain how post-truth characterizes a whole new way of understanding the difference between truth and falsity: a new attitude of indifference to the sharp distinction that moderns and ancients had placed between (...) these two notions. I will contend that this new attitude had been announced by the work of at least three recent philosophers: Harry Frankfurt, Gianni Vattimo and Mario Perniola. They give different names to “post-truth”, though, and attribute it to different causes (from anti-intellectualism to the new media and to sheer carelessness). After that, I will explore how two key aspects of hypermodernity (according to Gilles Lipovetsky), i.e. hyperindividualism and hyperconsumption, cohere with this spread of post-truth. Finally, I will summarily refer to some political and geopolitical events that corroborate the relevance of post-truth in our hypermodern world. (shrink)

Hablar de poesía y hablar de poesía escrita por mujeres es fundamentalmente abrirse a lo diferente desde una mirada interadora.

The aim of this paper is to argue that there existed relevant interactions between mechanics and geometry during the first half of the nineteenth century, following a path that goes from Gauss to Riemann through Jacobi. By presenting a rich historical context we hope to throw light on the philosophical change of epistemological categories applied by these authors to the fundamental principles of both disciplines. We intend to show that presentations of the changing status of the principles of mechanics as (...) a mere epiphenomenon of the emergence of non-Euclidean geometries are inaccurate, that the relations between the two disciplines were richer than what is usually considered in the literature. These claims will be based on historical and philosophical arguments, starting from the fact that disciplinary boundaries at the time were not rigid as we are used today. It is widely known that the main figures we target worked in different areas, which is a first piece of evidence for the plausibility of our main thesis. (shrink)

From classical antiquity to contemporary times, challenging situations of dilemmatic or paradoxical nature continue to fascinate both scholars and the casual reader. Although Western literature provides a fruitful source of philosophical discussion on the circumstances under which a morally competent agent faces incompatible moral requirements, Sinology has rarely accepted the idea of moral dilemmas in Chinese philosophy in general and Confucianism in particular. The present paper explores moral and morally motivated dilemmas in Liu Xiang’s 劉向 Lienü Zhuan 列女傳 and the (...) philosophical strategies employed for their resolution within the framework of the Confucian tradition, emphasizing similarities with Western traditions such as Greek tragedy or Thomistic philosophy.
