Perú es un caso claro de conflicto interno violento. Este conflicto, dominado por las acciones del grupo guerrillero Sendero Luminoso tuvo sus años más duros durante las décadas de los años 80 y 90. Sin embrago, es peculiar la poca producción académica que existe analizando los aspectos de paz y conflicto del país. Este trabajo busca repasar los trabajos realizados en el país sobre la violencia y analizar la existencia de contribuciones académicas que traten el conflicto peruano desde la perspectiva (...) de los estudios de paz y conflicto. Para ello se presentan los conceptos de construcción de paz y reconciliación según los autores seminales de los estudios de paz y se contrastan esos conceptos con las contribuciones académicas más destacadas. Este artículo concluye que existe un cuerpo limitado de trabajo al respecto, generado en dos épocas diferenciadas. Durante los años de la violencia serán trabajos que cuestionan las acciones de Sendero Luminoso y después de la creación de la Comisión de la Verdad aparecerán trabajos más alineados con los estudios de paz, sobre todo con los conceptos de memoria y reconciliación. It has been argued that the approximate number system (ANS) constitutes a problem for the grounded approach to cognition because it implies that some conceptual tasks are performed by non-perceptual systems. The ANS is considered non-perceptual mainly because it processes stimuli from different modalities. Jones (2015) has recently argued that this system has many features (such as being modular) which are characteristic of sensory systems. Additionally, he affirms that traditional sensory systems also process inputs from different modalities. This suggests that (...) the ANS is a perceptual system and therefore it is not problematic for the grounded view. In this paper, I defend the amodal approach to the ANS against these two arguments. In the first place, perceptual systems do not possess the properties attributed to the ANS and therefore these properties do not imply that the ANS is perceptual. In the second place, I will propose that a sensory system only needs to be dedicated to process modality-specific information, which is consistent with responding to inputs from different modalities. I argue that the cross-modal responses exhibited by traditional sensory systems are consistent with modality-specific information whereas some responses exhibited by the ANS are not. (shrink)

This study explores the rationality behind firms’ decision to admit or deny their involvement in bribery when responding to confidential surveys conducted by international agencies. Specifically, we posit that firms’ reluctance to provide accurate information about their engagement in bribery is at least to some extent contingent on certain situational factors. In other words, we claim that this behavior is context dependent. The paper uses the notions provided by the theory of planned behavior to understand the way in which the (...) corruption of the legal environment, the intensity of market competition, and identification risk influence firms’ decision to lie about their involvement in bribery. To test these notions, we use databases from the fifth wave of the EBRD-World Bank Business Environment and Enterprise Performance Survey, country-level data from the Kauffman Foundation and macroeconomic information from the World Bank database. We run ordinary least squares with geographic region-clustered standard errors on data from 30 countries and 6122 individual firms during the period 2012–2013. Consistent with our expectations, the results indicate that firms operating within more corrupt legal environments, facing more competition, and bearing a higher risk of being identified are less likely to deny their involvement in bribery. We conclude that not all firms have the same incentives to lie about their participation in bribery, and therefore, identifying the drivers of this heterogeneity may help policymakers better assess the reliability of bribery information collected through confidential surveys. This volume presents a selection of papers from the Poincaré Project of the Center for the Philosophy of Science, University of Lisbon, bringing together an international group of scholars with new assessments of Henri Poincaré's philosophy of science-both its historical impact on the foundations of science and mathematics, and its relevance to contemporary philosophical inquiry. The work of Poincaré (1854-1912) extends over many fields within mathematics and mathematical physics. But his scientific work was inseparable from his groundbreaking philosophical reflections, and (...) the scientific ferment in which he participated was inseparable from the philosophical controversies in which he played a pre-eminent part. The subsequent history of the mathematical sciences was profoundly influenced by Poincaré's philosophical analyses of the relations between and among mathematics, logic, and physics, and, more generally, the relations between formal structures and the world of experience. The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. Modern management reporting on its company''s performance is influenced by individuals ethical considerations. Stakeholders philosophies have continued to change over the last 75 years affecting reporting systems for companies reporting information internally and externally. These fundamental changes in philosophy have affected how information is conveyed. We are not claiming that only one philosophical viewpoint dominates companies reporting practices, but there does appear to be a changing trend of philosophies building on one another. We use resource dependence theory in relationship to (...) a decision-making model to explain changing stakeholders positions over time. This paper argues that six dominant philosophical theories have influenced the way individuals and organizations report financial and other information. Further, these philosophies then are depicted in a model that helps us to understand what influences companies to present themselves to the outside world. The present paper offers a libertarian reading of one of the most important Chinese novels of the twentieth century, The Travels of Laocan, written by Chinese entrepreneur Liu E between 1903 and 1906. I start with an exposition of the ideas associated with the concept of “Asian values,” the evident cultural unviability of this notion, and how “Asian authoritarianism” has been rationalized and justified on the basis of a Hobbesian conception of human nature. Next, I examine Liu E’s life and (...) career as an entrepreneur in a highly interventionist society. Finally, I focus on his magnum opus, The Travels of Laocan, a fictionalized autobiography that explains Liu E’s philosophical and libertarian ideas. (shrink)

Para este trabajo, seleccionamos los programas Bailando por un sueño, Intratables y El show de la mañana, y retomamos algunas expresiones de los sujetos que participaron en grupos de discusión durante los meses de octubre, noviembre y diciembre de 2016 en Ciudad Autónoma de Buenos Aires, Rosario y Córdoba.Estos programas televisivos, en tiempos de una “democracia mediatizada”, son centrales en la modelización de lo político en un sentido muy distinto a lo que definía el concepto de “videopolítica” en los 90. (...) Uno de los cambios a considerar remite al impacto del desarrollo de internet y a los dispositivos asociados para un tipo de “participación mediatizada” en vivo, que transforma sustantivamente el lugar y la posición que tenía el espectador de los viejos medios masivos de comunicación. Con relación al “objeto” de estos programas, es posible identificar y reconstruir una modelización recurrente en el qué se dice y cómo; construcción ideológica que encuentra en la macro forma compartida del panel, por ejemplo, una manera de presentar “diversidad de voces”, en tanto expresión resultante del proceso de trabajo que vincula estética y política en la construcción de una “verdad” sobre el contexto político actual.La estrategia expositiva y argumentativa es la siguiente: 1) Presentamos y caracterizamos estructuralmente a los programas seleccionados y los vinculamos con expresiones rescatadas de los grupos de discusión. 2) Seleccionamos ejes de comparación que posibilitan la precisión de recurrencias entre ellos. 3) Finalmente, con los resultados del recorrido descriptivo y analítico, exponemos rasgos y dinámicas de las novedosas formas de estetización de lo político —en el sentido benjaminiano— como proceso orientado a que las masas —en nuestro caso, los individuos— expresen sus demandas. The dispute on mongrelization starts to play a fundamental role in Latin America inside the modernist debates about the national unity between the end of the XIX century and the beginning of the XX century, to later acquire an unprecedented global diffusion in the eighties and the nineties of the last century. Using the writings of the Bolivian sociologist Silvia River Cusicanqui and of the Argentinian anthropologist, who has long since been active in Brazil, Rita Segato, the essay reconstructs the (...) historic and political happening of metissage in Latin America. The authors show that it is an historical concept which worked as an instance of legitimation both in the period of colonial oppression and later in the epoch of republican modernization. It represents the instrument to hide – if not to delete – the original character of modern State; for this reason it has been able to play a fundamental role in the epoch of liberalism as much as in the neoliberal one. However in mongrelization what is also at stake is that it can express the radically de-colonizing impulse of the differences as forms of litigation which inhabit the complex contemporary Latin American territories. This article develops and applies a knowledge-based framework for understanding and interpreting executive compensation under the rubric of ethical consideration. This framework classifies six major ethical considerations that reflect issues in compensation design. We emphasize that these six ethical considerations are influenced by liberty and equality concepts. This framework helps to highlight areas where executive compensation has not been well spelled out.

Autocracies draw their political power from cronyism and organized repression. The opacity of business information protects these regimes and their crony firms from any opposition. However, autocracies might also desire to eliminate cronyism because it dampens economic growth. Autocracies survive through repression that engenders tensions, as evident in the Spanish newspaper industry during the Francoist dictatorship. State control over this industry was important because the press disseminated news to the public. From 1939 to 1957, the autocracy institutionalized both cronyism and (...) the opacity of circulation figures to sustain the political powers of Franco and the single party state. Opacity concealed the economic performance of newspapers owned by sole legal party and any distribution of resources in its favor. Franco authorized voluntary disclosure of reliable circulation figures in 1964, after eliminating cronyism in favor of a freer market. Repression guaranteed support for this industry until Franco's death. (shrink)

The recent frauds in organizations have been a point for reflection among researchers and practitioners regarding the lack of morality in certain decision-making. We argue for a modification of decision-making models that has been accepted in organizations with stronger links with ethics and morality. With this aim we propose a return to the base value of Christianity, supported by Bible scriptures, underlying six dominant ethical approaches that drive practices in organizations.

Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

Tanto sus escritos de juventud como los de madurez brindan una teoría crítica del Estado y del Derecho que estaría animada por una insobornable inspiración ética. Esta nada tendría que ver con la tan denostada “moralización” de la política. Diferentes investigaciones han abordado el fenómeno de cómo el jugador de ajedrez alcanza un nivel alto de experticia; sin embargo, la gran mayoría se han llevado a cabo desde una perspectiva en tercera persona, es decir, sin tomar en cuenta la experiencia subjetiva del ajedrecista. El presente trabajo tiene como objetivos: 1) analizar la experticia de ajedrecistas de nivel proficiente desde una perspectiva fenomenológica, esto es, desde la experiencia subjetiva del jugador; 2) señalar los estados internos que parecen ser cognitivamente (...) relevantes en las acciones de los ajedrecistas; 3) teorizar sobre el eventual papel que juega la intuición en las acciones de los jugadores de ajedrez. Para ello se realizó un estudio exploratorio con cinco jugadores de ajedrez durante una competencia de corte nacional en México, utilizando como método la entrevista microfenomenológica propuesta por Claire Petitmengin. Los resultados indican que hay regularidades en los estados internos de los jugadores a nivel intra e interpersonal asociadas implícitamente a momentos críticos de las partidas. Lo anterior permite ofrecer una definición operacional de la intuición y afirmar que esta, en efecto, forma parte de los procesos cognitivamente relevantes de los ajedrecistas de nivel proficiente, aunque las acciones de estos aún dependen, en buena medida, de los cálculos explícitos que realizan durante los momentos críticos. Este libro está integrado por las aportaciones de diferentes especialistas sobre un tema interdisciplinar de interés creciente, que incluye, además de los conceptos de estar sano o sentirse enfermo, también los que se recogen desde antiguo en la expresión pathos y que alberga, en general, formas de existencia del ser humano, las disposiciones afectivas que son vividas y los sentimientos en que se manifiestan. Las pasiones humanas entendidas, en suma, como los diversos modos de encontrarse o de ser comprometidos en (...) las diferentes formas de autocomprensión inherentes a la relación con los otros y el mundo. Aportaciones, en definitiva, sobre la afectividad y su relevancia para dilucidar lo específico del ser humano, un tema en el que actualmente se da un fecundo diálogo con otras áreas de investigación afines a la antropología filosófica, como son la fenomenología, la psico(pato)logía, la filosofía de la cultura, la hermenéutica, la antropología médica o la antropología cultural, tal como queda de manifiesto en este volumen colectivo. The two leading theoretical approaches to tort law — economic analysis and corrective justice — are blind to distributive considerations. Moreover, even the main distributive approaches to tort law — loss-spreading and fairness — fail to emphasize egalitarianism as a distributive consideration. This article argues that egalitarianism should influence the normative evaluation of one’s conduct as negligent or not. It first explains why normatively negligence law should be sensitive to the egalitarian concern, suggesting three different accounts for this claim, based (...) on needs, equality, and desert as criteria for distribution. Second, it argues that egalitarianism is commensurate with the basic understanding of negligence law as reflecting corrective justice and notions of fault. The notion of fault is, therefore, reformulated from within, in order to accommodate egalitarianism. Third, I maintain that in order for egalitarianism to accommodate notions of corrective justice, egalitarian concerns should matter also at the stage of the standard of care. While the egalitarian concern can and should be integrated into the duty stage, I argue that such integration is insufficient. A correct and full understanding of the egalitarian concern and the tort of negligence requires a conclusion that the normative evaluation of one’s action as negligent or not cannot be separated from the distributive results that this action entails. The egalitarian concern works at the duty stage as an excuse for not imposing liability for wrongful activity. In contrast, at the standard stage, it works as a justification that turns an otherwise wrongful activity into a legitimate one. My claim is that morally we should usually expect more care from the better-off than from the disadvantaged. Findings of negligence are based on the failure to balance properly between one’s interests and those of another. In deciding to what extent the defendant should burden herself in order to prevent a loss to potential victims, one morally relevant criterion is the relative ability of the injurer and victim to bear precaution costs and expected accident loss, respectively. Technoscience is increasingly present in our daily lives, establishing new social rules and patterns of communication and interaction in a physical space, which implements electronic devices and telematic systems in its design. In the race for scientific progress, the goal is making man a God, like Nietzsche’s Superman, without determining how the new human morphology will be fitted. This paradigm is treated by artists who warn of the possible fate of humanity while the technoscientific, as if he or she was (...) Prometheus, dares to defy the laws of nature. Art exposes the actual course of science, and some artists complain that the false promises of scientific discourse, which is dominated by male vision, fail to be aware of the impossibility that technology is going to improve the moral dimension of human being. Some artists say that the science sermon does not deal with humanity and that the building of our future is merely phallocentric, an excessive anthropocentric vision. (shrink)
