Translators at the European Court of Human Rights, as at other international courts, have to deal with two different types of legal terminology in judgments and decisions: on the one hand, terms that would be used by a national practitioner in the relevant language, and on the other, the supranational language that has evolved in general international law or that is specific to the Court itself, being enshrined in its basic texts or case-law. The choice of translation will (...) often be imposed by the source text, which may be a constraint; extensive knowledge of the Court’s autonomous terms and other “linguistic precedent” is vital if they are to be used accurately and consistently. The task of devising and using supranational terms to encompass domestic realities in as many as 47 States is not only that of the drafter; the linguist also has a crucial role to play in conveying the Court’s message in a culture-neutral manner. The article discusses issues related to overcoming the crisis situation of non-Western countries, including Russia, caused by the uncritical acceptance of the neoliberal universalistic paradigm of development at the turn of the century. The intellectual response to the crisis led the initiative of civilizational self-identification of these countries based on the formation of a new principle of supranational organization in the form of a “civilizationstate,” which is perceived by Western analysts as a fundamental global challenge of modernity requiring a (...) comprehensive theoretical understanding. As of the present time, in their opinion, China, India, and Russia can be classified as “civilization states.” It is asserted that the civilizational turn emerged as a result of the opposition of the “core” states (in the terminology of S. Huntington) of unipolar hegemony, which initiates the conflict potential for the development of the world community, threatening the integrity of the existing Euro-American order. Russian researchers, for their part, note the negative consequences of the universalistic aspiration to spread the model of the “nation-state” to the whole world, which occurs within the logic of limited sovereignty and is destructive for Russia. Actions to overcome the internal crisis discussed in the article include a transition to a national-civilizational form of identity and the implementation of the idea of a “Russian-centric world.” This corresponds to the global trend of forming macro-regional “civilization-worlds” based on common cultural and social values developed during a long period of coexistence. The article demonstrates that the revival of “civilizationalism” is taking place against the background of the worldwide trend of the split of modernity. There is an actualization of the project of the “East-Westphalian system,” called the “Eastphalian” world order, which rejects European universalism and opens the way to a new multipolar world order. The idea that transnational dynamics challenge the regulatory capacity of the state has hardly ever received as much attention as in contemporary debates. Different voices denounce the crisis of the state and advocate the establishment of supranational institutions with legally coercive power. It is tempting to jump to the conclusion that these voices are concerned with the same cluster of problems. We think that one should resist this temptation. Firstly, not all the problems pointed out by the advocates of (...) supranational sovereignty are of the same kind and structure. Some concern the need to limit the power of states, whereas others address the almost opposite necessity to support and strengthen their problem-solving capacity through forms of international regulation. Secondly, the corresponding solutions are different. In particular, although they may all imply the establishment of supranational institutions, not all such institutions need be global. The creation of a full-blown global rule of criminal law, for instance, would raise serious concerns of global despotism and cultural imperialism, and we therefore make a case for regional and context-sensitive solutions in this case. However, problems of supranational socioeconomic justice can only be addressed through global regulatory institutions, for regional institutions would, in this case, only recreate current problems at the interregional level. In The Crisis of the European Union Jürgen Habermas claims that the constituent power in the EU is shared between the community of EU citizens and the political communities of the member states. By his own account, Habermas arrives at this concept of a dual constituent subject through a rational reconstruction of the genesis of the European constitution. This explanation, however, is not particularly illuminating since it is controversial what the term ‘rational reconstruction’ stands for. Power-sharing agreements, despite their disappointing history, are still the prevailing tool used for diffusing intrastate conflicts in Africa. One element that requires additional analysis is the role of third-parties in power-sharing negotiations. An analysis of the role of France in power-sharing negotiations in Chad, Mali, Central African Republic, Rwanda, and the Ivory Coast, suggests a biased approach that harmed the outcomes and sustainability of those negotiations. A better approach is to increase the power of third-parties like the African Union (AU). (...) Currently, this organization lacks the executive capacity to guarantee the implementation of power-sharing negotiations. Empowering the AU’s executive arm through the formation of a military force, should allow for enhanced capacity in power-sharing negotiations. (shrink)

In the management of biomedical data, vocabularies such as ontologies and terminologies (O/Ts) are used for (i) domain knowledge representation and (ii) interoperability. The knowledge representation role supports the automated reasoning on, and analysis of, data annotated with O/Ts. At an interoperability level, the use of a communal vocabulary standard for a particular domain is essential for large data repositories and information management systems to communicate consistently with one other. Consequently, the interoperability benefit of selecting a particular O/T as a (...) standard for data exchange purposes is often seen by the end-user as a function of the number of applications using that vocabulary (and, by extension, the size of the user base). Furthermore, the adoption of an O/T as an interoperability standard requires confidence in its stability and guaranteed continuity as a resource. (shrink)

We performed a qualitative analysis of the Thesaurus in order to assess its conformity with principles of good practice in terminology and ontology design. We used both the on-line browsable version of the Thesaurus and its OWL-representation (version 04.08b, released on August 2, 2004), measuring each in light of the requirements put forward in relevant ISO terminology standards and in light of ontological principles advanced in the recent literature. Version 04.08b of the NCI Thesaurus suffers from the same (...) broad range of problems that have been observed in other biomedical terminologies. For its further development, we recommend the use of a more principled approach that allows the Thesaurus to be tested not just for internal consistency but also for its degree of correspondence to that part of reality which it is designed to represent. This paper recommends that experimental analysts of language development abandon for the purposes of experimental inquiry both the term "language" and the concept it designates. In support of this recommendation, the paper dis cusses the multiple meanings of "language," the proposal that "language" refers to behavior, the implicit acceptance by behavior analysts of psycholinguistic thought despite their ostensible rejection of it, and the nature of language as a subject matter. In addition, the nature of common-sense psychology, the domain of behavior (...) analysis, the formal nature of Chomskyan linguistics, and the rela tion between psychology and behavior analysis are discussed. During the summer of 1900, the Chemical Section of the Society for the Promotion of Russian Industry and Commerce in Warsaw published a very special booklet in which prominent philologists debated proposals concerning adjustments to chemical nomenclature. Several issues were discussed, including systems of classification of chemical compounds, new specialist terms, and which element names to select among the many then in use. Chemists translated and modified these proposals while strongly disagreeing with using philological expertise. But both the booklet and (...) the debate were novelties within discussions on chemical terminology, which provides an opportunity to examine the peculiarities of such endeavors. This article examines this special moment in the history of chemistry when chemists ceded (partially) their authority over their subject to philologists. I discuss how this episode was shaped by the low grade of academic professionalization in the Polish-language scholarly community and the practical needs of industry, which engendered different habitus among scholars debating chemical issues. This paper asks what language was for chemists and philologists and which epistemic ideals were linked with it. I argue that this episode was a form of interdisciplinary interrogation in which philologists and their arguments were instrumentalized for the needs of chemists. (shrink)

In my previous Editorial, I took a short detour from the main topic (telepathy and mental privacy) to comment briefly on one of the deeper flaws in the trendy, but seriously misguided, practice of replacing the terms “ESP” and “PK” with (respectively) “anomalous cognition” and “anomalous perturbation.” As I’ve discussed in great detail elsewhere (Braude, 2020), there’s actually quite a lot that’s wrong with this terminological folly. And it’s hardly the only time psi researchers have botched efforts to explicate or (...) replace some of the field’s key concepts. The terminological error that I discussed in my earlier Editorial was the failure to accommodate the valuable distinction between ESP-cognition and ESP-interaction. And in that Editorial, I also noted that another, and increasingly trendy, practice likewise commits this error. It’s the strategy of abandoning the venerable arsenal of psi-terms and replacing them with a single expression—either “nonlocal awareness” or “nonlocal consciousness.” (The underlying rationale for this is usually that the traditional vocabulary is likely to be professionally toxic.) I’m thinking about these matters again because recent events have conspired to remind me of still another, but less trendy and prevalent, approach to parapsychological terminology that also deserves a few words of disapproval. This paper discusses some models purported to legitimise a European supranational legal order. In particular, the author focuses on an application of the so‐called regulatory model to the complex structure of the European Community and the European Union. First of all, he tackles the very concept of legitimacy, contrasting it with both efficacy and efficiency. Secondly, he summarises the most prominent positions in the long‐standing debate on the sources of legitimation for the European Community. Thirdly, in this perspective, he (...) analyses several, sometimes contradictory, notions of the rule of law. His contention is that we can single out five fundamental notions of the rule of law and that some but not all of them are incompatible with or oppose democracy. Finally, the paper addresses the regulatory model as a possible application of the rule of the law to the European supranational order. The conclusion is that the regulatory model should be rejected if it is presented as an alternative to classical democratic thought, though it might be fruitful if reshaped differently and no longer assessed from a functionalist standpoint of deliberation. In this paper we will discuss some epistemological aspects of lexical and terminological usage in the international arena, with special reference to the different rhetorics of the social and natural sciences. Sociolinguistic research confined to monolingual communities suggests that close-knit network structure is an important mechanism of language maintenance, in that speakers are able to form a cohesive group capable of resisting pressure, linguistic and social, from outside the group (MILROY, 1987). The concept of a linguistic norm in sociolinguistic theory (...) can be viewed here as the product of "cultural focusing". In the same way, intercultural communication is characterized by the spreading of standardized terminologies (ISO) and conceptual modes of thinking associated with a common scientific and technological practice in cross-border communities. A basic feature is frequent language interaction, based upon the need for scientific exchange and upon the extralinguistic models conveyed by powerful inter/transnational links and shared scientific paradigms. In this context, an international standard language could be seen as another case of cultural focusing, where intercultural contact would evolve along monocultural lines. However, a formally standardized language may conceal conceptual fuzziness, as has been shown for example in analyses of the kind of language used by social scientists (INTERCOCTA) or found in political rhetoric (ECCRDSS). The semantic and pragmatic differentiations of these latter forms of intercultural communication, and more generally, the interactions between the ordering of knowledge, the transfer of this knowledge through standardized language and the variety of cultural perceptions, call for a polylogic framework that accounts for their coexistence. In the last few decades, the study of terminology has undergone a cognitive shift that has led to the development of several approaches that study the social, linguistic, and cognitive dimension of terms, such as Communicative Theory of Terminology (CTT) and Frame-Based Terminology (FBT). CTT was developed in the early 1990s and argues that the study of terminology should be based on a communicative perspective, taking into account aspects such as the communicators and the context of (...) communication. FBT has been developed from 2007 and uses certain aspects of Frame Semantics to conceptualise specialised domains and create non-language-specific representations through the analysis of the domain event and on the study of the behaviour of the terminological units in texts. The two theories share many of the same premises and propose the representation of the concepts of a domain in an ontology. FBT also proposes a representation in frames. We explore how these two methods of domain representation can be used to represent the terminology of the domain of seafood in Germany and Spain. (shrink)

This article explores the way in which social explanations underpin the names of particular disciplines. Taking the example of pharmacogenomics, it shows how this term has been constructed since it appeared in 1997, the differences and similarities between it and its precursor, pharmacogenetics, and the way in which commercial interests underpin this new term. Drawing on the idea of visions and the sociology of expectation, the article shows how different actors compete to have their preferred definitions of the term accepted (...) by the world at large. By reference to the illustrative case of the supranational regulation of local systems of food production, we aim to show the importance of identifying issues of international legitimacy as a discrete component – alongside issues of global distributive justice – of the liberal project of public justification of supranational collective decisions. Therefore, we offer the diagnosis of a problem but do not prescribe the therapy to cure it.

The task of this article is to clarify the appropriateness and adequacy of peace-making (confessional) rhetoric in the situation of the war of aggression of the Russian Federation against Ukraine, in particular, the meaningful correspondence of the concept of «peace» in its application or reading by the bearers of different worldview paradigms. The «russkii mir» cannot be translated either as «Russian peace» or as «Russian world». This is because the scope and content of these concepts are different. Rus (Kyiv`s Rus) (...) — a thousand-year-old princely state with its center in Kyiv, where the ancestors of modern Ukrainians lived, baptized by Prince Volodymyr in 988. Rus is not Russia. But Muscovy adopted the name Russia to derive its historiography from Rus. «Russkii mir» actually refutes the axiological principles laid down by ancient Rus’s civilization (freedom, dignity, partnership, co-creation, mutual responsibility). «Russkii mir» destroys peace in global or any local images, trying to grab the territory it decided to own. «Russkii mir» encroaches on world domination and therefore tries to impose its rules of the game on the world, which would reshape the world structure according to the wishes of the Russian dictators. For this, «russkii mir» uses any means and institutions as a tool: the army, weapons of mass destruction, atrocities, terror, lies, propaganda, the church and peace-making rhetoric. The goal is not to restore peace, but to establish the world domination of the Russian Empire in any of its variants (Muscovy, Russian Empire, Soviet Union, Russian Federation or Orthodox Civilization). Russian Orthodox Church plays a leading role in this — it uses religious rhetoric to formu- late a worldview model of the «russkii mir», consolidates the Russian population for a war of aggression, and justifies the atrocities of the Russian military with the sacred mission of restoring the Holy Rus’. Russian Orthodox Church justifies the «civilizing mission» of the Russian troops, actually calls to protect «our Common Russian Fatherland» by killing Ukrainians on the territo- ry of Ukraine. False messianism, manichaeism, paternalism, hatred of the civilized world that lives by democratic standards and respects the dignity and freedom of the individual, Russian arrogance, conceit, supremacy and egomania — this is what Russian Orthodoxy promotes with its religious rhetoric. Therefore, if we hear calls for «peace» from the bearer of the «russkii mir»’s worldview, it actually means a demand to come to terms with all their whims, to give up one’s own identity, one’s own world, one’s own life, if they do not fit into the concept of «russkii mir». Ontology is currently perceived as the solution of first resort for all problems related to biomedical terminology, and the use of description logics is seen as a minimal requirement on adequate ontology-based systems. Contrary to common conceptions, however, description logics alone are not able to prevent incorrect representations; this is because they do not come with a theory indicating what is computed by using them, just as classical arithmetic does not tell us anything about the entities that are added (...) or subtracted. In this paper we shall show that ontology is indeed an essential part of any solution to the problems of medical terminology – but only if it is understood in the right sort of way. Ontological engineering, we shall argue, should in every case go hand in hand with a sound ontological theory. (shrink)

The purpose of this paper is to highlight the importance and impact of terminology used to describe corporate social responsibility (CSR). Through a review of key literature and concepts, we uncover how the economic business case has become the dominant driver behind CSR action. With reference to the literature on semiotics, connotative meaning and social marketing we explore how the terminology itself may have facilitated this co-opting of an ethical concept by economic interests. The broader issue of moral (...) muteness and its relation to ethical behaviour is considered. We conclude by proposing a number of important attributes for any proposed terminology relating to ethical/socially responsible/sustainable business. (shrink)

An ancient Greek proverb declares: ‘beautiful things are difficult’. One obvious difficulty arises from their almost limitless variety: sights, sounds, people, natural phenomena, man-made objects and abstract ideas may all bebeautiful, but what do these things have in common? It is not just beauty's breadth of application, then, that makes it difficult, but the way in which its meaning varies depending on context. The beauty of a child may mean something quite different from the beauty of an old and wizened (...) face, let alone the beauty of a supermodel. In common parlance,beautifulmay be used as a general term of approbation alongside others likelovelyorfine, while in academic discourse, the wordbeautyhas a life of its own: since the emergence of aesthetics as an independent discipline in the mid eighteenth century, beauty has been constantly theorized and responded to in different ways that have laden the term with its own peculiar historical baggage. And although some of these philosophical reflections on beauty may have trickled into the common cultural consciousness, in general they seem a far cry from beauty's most ubiquitous incarnation in modern Western society, in the cosmetics industry; to put it another way, if you go into a beauty salon in search of a Kantian ideal of disinterested contemplation, I suspect you will be disappointed. The authors note that theoretical revision is likely to be required to refine and clarify a general theory of selection so that it is capable of accounting for selection processes across different subject matters. Some aspects of conceptual language from the biological realm work across all three domains. However, terminological revision may be required where concepts of “replication” and “information” pose particular problems for the general theory as that is applied to operant research.

Not the least noticeable is the fact that the ancient Greek compound euthanasia, formed by Francis Bacon, has retained its original terminological form since it was first used in the 17th century. Among all other controversial ethical issues, however, the conceptual notion of euthanasia categorically evokes rather important controversies. The questions that arise in this context are whether there is a definition, or at least a determination, of the term euthanasia and whether we are aware of its use in scientific (...) discourse, what exactly is euthanasia. The paper offers a terminological elaboration of the term euthanasia in a linguistic, but mainly legal and medical-procedural context, in order to examine the coherence in defining the term between these categories and, consequently, to determine the key determinants of euthanasia according to categorical sections. The key facts stated are the primary determination or the possible definition of the term for any further scientific study of euthanasia as one of the most controversial issues within bioethical doctrine. Among the political changes brought about by the First World War was the formation of new countries, including Latvia. This in turn resulted in a strong need for the first national legislative acts and thus a substantial amount of effort to develop Latvian legal terminology which dates back to the beginning of the 19th century. The purpose of the paper is to study the development of Latvian terminology of marriage in the 20th century through analysis of the relevant (...) body of laws. The paper focuses on marriage-related terms extracted from the major legislative acts governing the institution of marriage in the 20th century. The present study adopts the qualitative research approach which constitutes data collection and data analysis. For the purposes of a comprehensive and efficient analysis of the extracted legal terms, marriage terms are divided into the following five thematic groups: 1) engagement; 2) entering into marriage; 3) nullity of marriage; 4) dissolution of marriage ; and 5) consequences of dissolution or nullity of marriage. The paper suggests that the core of the Latvian terminology of marriage has remained stable, as entering into marriage is a solid procedure where two interested parties give notice to a public or religious institution in order to officially register their relationship. Similarly, both parties often feel the need to terminate this relationship just as officially. This stability of fundamental processes contributes to terminological continuity. (shrink)

It is only by fixing on agreed meanings of terms in biomedical terminologies that we will be in a position to achieve that accumulation and integration of knowledge that is indispensable to progress at the frontiers of biomedicine. Standardly, the goal of fixing meanings is seen as being realized through the alignment of terms on what are called ‘concepts’. Part I addresses three versions of the concept-based approach – by Cimino, by Wüster, and by Campbell and associates – and surveys (...) some of the problems to which they give rise, all of which have to do with a failure to anchor the terms in terminologies to corresponding referents in reality. Part II outlines a new, realist solution to this anchorage problem, which sees terminology construction as being motivated by the goal of alignment not on concepts but on the universals (kinds, types) in reality and thereby also on the corresponding instances (individuals, tokens). We outline the realist approach, and show how on its basis we can provide a benchmark of correctness for terminologies which will at the same time allow a new type of integration of terminologies and electronic health records. We conclude by outlining ways in which the framework thus defined might be exploited for purposes of diagnostic decision-support. (shrink)

Over the past four decades, stakeholder research has united a chorus of voices from different disciplines using different terminology for different audiences all related to a seemingly similar topic: those that affect and are affected by business. By juxtaposing a comprehensive review of the early years of stakeholder research against more recent stakeholder research, we identify areas of common convergence as well as emergent scholarship. We develop an organizing framework consisting of three stakeholder-related themes: who or what is a (...) stakeholder; mechanisms underlying stakeholder relationships; and outcomes-oriented stakeholder research. Future research opportunities include: simultaneously examining multiple stakeholders at multiple levels; multiplier effects along the value chain and across geographies; and net impacts. We conclude by identifying how stakeholder research can “move the needle” on important business issues such as: income inequality and CEO pay; human rights and building community inclusion; disease alleviation; and food security in firms’ continuous quest to create value.
