Research teams have used extra-uterine systems to support premature fetal lambs and to bring them to maturation in a way not previously possible. The researchers have called attention to possible implications of these systems for sustaining premature human fetuses in a similar way. Some commentators have pointed out that perfecting these systems for human fetuses might alter a standard expectation in abortion practices: that the termination of a pregnancy also entails the death of the fetus. With Biobags, it might be (...) possible, some argue, that no woman has the right to expect that outcome if the technology is able to sustain fetal life _after_ an abortion. In order to protect the expectation that the termination of a pregnancy always entails the death of the fetus, Elizabeth Romanis has argued that fetuses sustained in Biobags have a status different than otherwise ‘born’ children. In support of that view, she argues that these ‘gestatelings’ are incapable of independent life. This argument involves a misunderstanding of the gestational support involved, as well as a misapprehension of neonatology practice. Here, we argue that any human fetus sustained in a Biobag would be as ‘independent’ as any other premature infant, and just as ‘born’. Neonatologists would seem to have certain presumptive moral responsibilities toward any human fetus gestating in a Biobag. It remains a separate question whether the perfection and widespread application of Biobags for premature human beings would or should alter the expectation that ending a pregnancy also entails fetal death. What is life? A gathering consensus in anthropology, science studies, and philosophy of biology suggests that the theoretical object of biology, “life,” is today in transformation, if not dissolution. Proliferating reproductive technologies, along with genomic reshufflings of biomatter in such practices as cloning, have unwound the facts of life.

How ought you to evaluate your options if you’re uncertain about which axiology is true? One prominent response is Expected Moral Value Maximisation, the view that under axiological uncertainty, an option is better than another if and only if it has the greater expected moral value across axiologies. EMVM raises two fundamental questions. First, there’s a question about what it should even mean. In particular, it presupposes that we can compare moral value across axiologies. So to even understand EMVM, we (...) need to explain what it is for such comparisons to hold. Second, assuming that we understand it, there’s a question about whether EMVM is true. Since there are many plausible rivals, we need an argument to defend it. In this paper, I’ll introduce a representation theorem for axiological uncertainty to answer these two questions. Roughly, the theorem shows that if all our axiologies satisfy the von Neumann–Morgenstern axioms, and if the facts about which options are better than which in light of your uncertainty also satisfy these axioms as well as a Pareto condition, then these facts have a relevantly unique expected utility representation. If I’m right, this theorem at once affords us a compelling way to understand EMVM—and specifically intertheoretic comparisons—and a systematic argument for its truth. (shrink)

This article shows how activists in the open data movement re-articulate notions of democracy, participation, and journalism by applying practices and values from open source culture to the creation and use of data. Focusing on the Open Knowledge Foundation Germany and drawing from a combination of interviews and content analysis, it argues that this process leads activists to develop new rationalities around datafication that can support the agency of datafied publics. Three modulations of open source are identified: First, by regarding (...) data as a prerequisite for generating knowledge, activists transform the sharing of source code to include the sharing of raw data. Sharing raw data should break the interpretative monopoly of governments and would allow people to make their own interpretation of data about public issues. Second, activists connect this idea to an open and flexible form of representative democracy by applying the open source model of participation to political participation. Third, activists acknowledge that intermediaries are necessary to make raw data accessible to the public. This leads them to an interest in transforming journalism to become an intermediary in this sense. At the same time, they try to act as intermediaries themselves and develop civic technologies to put their ideas into practice. The article concludes with suggesting that the practices and ideas of open data activists are relevant because they illustrate the connection between datafication and open source culture and help to understand how datafication might support the agency of publics and actors outside big government and big business. The topic of this thesis is axiological uncertainty – the question of how you should evaluate your options if you are uncertain about which axiology is true. As an answer, I defend Expected Value Maximisation (EVM), the view that one option is better than another if and only if it has the greater expected value across axiologies. More precisely, I explore the axiomatic foundations of this view. I employ results from state-dependent utility theory, extend them in various ways and interpret (...) them accordingly, and thus provide axiomatisations of EVM as a theory of axiological uncertainty. On the basis of an earlier contribution to the philosophy of computer science by Amnon Eden, this essay discusses to what extent Eden’s ‘paradigms’ of computer science can be transferred or applied to software engineering. This discussion implies an analysis of how software engineering and computer science are related to each other. The essay concludes that software engineering can neither be fully subsumed by computer science, nor vice versa. Consequently, also the philosophies of computer science and software engineering—though related to (...) each other—are not identical branches of a general philosophy of science. This also implies that not all of Eden’s earlier arguments can be directly mapped from the domain of computer science into the domain of software science. After the discussion of this main topic, the essay also points to some further problems and open issues for future studies in the philosophy of software science and engineering. (shrink)

According to the standard account of forgiveness, you forgive your wrongdoer by overcoming your resentment towards them. But how exactly must you do so? And when is such overcoming fitting? The aim of this paper is to introduce a novel version of the standard account to answer these questions. Its core idea is that the reactive attitudes are a fitting response not just to someone’s blameworthiness, but to their blameworthiness being significant for you, or worthy of your caring, in virtue (...) of your relationship to it. Someone’s blameworthiness is significant for you to the extent you’re bound up with what grounds it––e.g. with the wrongdoer’s being a participant in human relationships, with their attitudes, or with the victim’s being a source of demands. So you may fittingly not care about someone’s blameworthiness if it’s sufficiently insignificant for you in this manner––e.g. if their wrong happened far off in place and time. And forgiveness revolves around this. You forgive your wrongdoer if and only if, partly out of goodwill towards them, you cease to care about their blameworthiness––a bit as if their wrong had happened far off. If I’m right, this agent-relativity-based account can resolve the apparent ‘paradoxy of forgiveness’, satisfies a number of desiderata, and is plausible on an intuitive level. (shrink)

The rise of causality and the attendant graph-theoretic modeling tools in the study of counterfactual reasoning has had resounding effects in many areas of cognitive science, but it has thus far not permeated the mainstream in linguistic theory to a comparable degree. In this study I show that a version of the predominant framework for the formal semantic analysis of conditionals, Kratzer-style premise semantics, allows for a straightforward implementation of the crucial ideas and insights of Pearl-style causal networks. I spell (...) out the details of such an implementation, focusing especially on the notions of intervention on a network and backtracking interpretations of counterfactuals. (shrink)

A very common argument against restrictions on hate speech says that since such restrictions curtail freedom of speech, they cause more harm than they prevent. A no less common reply has it that the harms caused by hate speech are sufficiently great to justify legal restrictions on free speech. In ‘Freedom of Expression and Derogatory Words’, West questions a common assumption of both arguments concerning the use of slurs, i.e. that restricting the use of slurs necessarily curtails freedom of speech. (...) According to West, everything that can be said with a slur can be said with its neutral counterpart. Given the psychological and social harms of slurs, this would give us a compelling reason to put legal restrictions on their use. However, in this article, I will argue that, according to the main theories of slurs, slurs can be used to express derogatory information which cannot be expressed by their neutral counterparts. This will leave us with two options when it comes to avoiding the negative effects of slurs: (i) to restrict freedom of speech or (ii) to argue that the derogatory information expressed by slurs is not covered by free speech. Both options will depart significantly from West's argument. (shrink)

Against content theories of slurs, according to which slurs have some kind of derogatory content, Anderson and Lepore have objected that they cannot explain that even slurs under quotation can cause offense. If slurs had some kind of derogatory content, the argument goes, quotation would render this content inert and, thus, quoted slurs should not be offensive. Following this, Anderson and Lepore propose that slurs are offensive because they are prohibited words. In this paper, we will show that, pace Anderson (...) and Lepore, content theories of slurs do provide an explanation of the fact that quoted slurs can cause offense: even under quotation, the explanation goes, the derogatory content of a slur can still be psychologically efficacious. We will go one step further by pointing out that offensiveness is not the only function of slurs, but that slurs can also be used to create and reinforce negative attitudes towards the target group. While content theories can easily explain this by referring to some kind of derogatory content, Anderson and Lepore’s prohibitionism will lack a satisfactory explanation of this second function of slurs. Concluding, we will argue that, unlike uses of slurs, uses of quoted slurs normally do not derogate the target group. This will again speak in favor of content theories. Accordingly, uses of quoted slurs are not derogatory because quotation renders the derogatory content inert. Hence, rather than speaking against content theories, quoted slurs speak in their favor. “Existential risks” are risks that threaten the destruction of humanity’s long-term potential: risks of nuclear wars, pandemics, supervolcano eruptions, and so on. On standard utilitarianism, it seems, the reduction of such risks should be a key global priority today. Many effective altruists agree with this verdict. But how should the importance of these risks be assessed on a Christian moral theory? In this paper, I begin to answer this question – taking Thomas Aquinas as a reference, and the risks of (...) anthropogenic extinction as an example. I’ll suggest that on a Thomist framework, driving ourselves extinct would constitute a complete failure to fulfil our God-given nature, a radical form of hubris, and a loss of cosmological significance. So the reduction of such risks seems vital for Thomists, or Christians more broadly. Indeed, I end with the thought that these considerations are not parochially Christian, or indeed specifically religious: everyone with a similar view of mankind – as immensely valuable yet fallen and fragile – should agree that existential risks are a pressing moral concern. Many people think that if you're uncertain about which moral theory is correct, you ought to maximize the expected choice-worthiness of your actions. This idea presupposes that the strengths of our moral reasons are comparable across theories – for instance, that our reasons to create new people, according to total utilitarianism, can be stronger than our reasons to benefit an existing person, according to a person-affecting view. But how can we make sense of such comparisons? In this article, I introduce (...) a constructivist account of intertheoretic comparisons. On this account, such comparisons don't hold independently of facts about morally uncertain agents. They're simply the result of an ideal deliberation in terms of certain epistemic norms about what you ought to do in light of your uncertainty. If I'm right, this account is metaphysically more parsimonious than some existing proposals, and yet has plausible and strong implications. (shrink)

Using a variant of Schiffer’s puzzle regarding de re belief, I recently presented a new argument against the so-called Naive Russellian theory, consisting of the following theses: ( \(NR_{1}\) ) The propositions we say and believe are Russellian propositions, i.e., structured propositions consisting of the objects, properties, and relations our thoughts and speech acts are about; ( \(NR_{2}\) ) Names (and other singular terms) are directly referential terms, i.e., the propositional content of a name is just its referent; ( \(NR_{3}\) (...) ) A sentence of the form ‘_A_ believes/disbelieves that _S_’ is true in a context _c_ if and only if the referent of _A_ in _c_ believes/disbelieves the proposition expressed by _S_ in _c_. In this paper, I will argue that my variant of Schiffer’s puzzle is not only a problem for the Naive Russellian theory, but for every theory of belief ascriptions entailing ( \(NR_{3}\) ). Such theories are also called _relational analyses of belief ascriptions_. Here the main alternative to a Neo-Russellian theory, consisting of ( \(NR_{1}\) ) and ( \(NR_{2}\) ), is a Fregean theory, according to which the propositions we say and believe are Fregean propositions, i.e., structured propositions consisting of ways the objects, properties, and relations our thoughts and speech acts are about are presented to the speaker or agent. I will argue that such variants of the relational analysis are committed to principles very similar to the principles used by my Schiffer puzzle. Concluding, I will discuss Fregean and Neo-Russellian alternatives to the relational analysis, and I will argue that, although there are Neo-Russellian alternatives to the relational analysis which provide a solution to my variant of Schiffer’s puzzle, there seem to be no such Fregean alternatives. In this paper, we argue that antecedents of modern corporate social responsibility prior to the Industrial Revolution can be referred to as “proto-CSR” to describe a practice that influenced modern CSR, but which is different from its modern counterparts in form and structure. We develop our argument with the history of miners’ guilds in medieval Germany—religious fraternities and secular mutual aid societies. Based on historical data collected by historians and archeologists, we reconstruct a long-term process of pragmatic experimentation with institutions (...) of mutual aid that address social problems in the early mining industry, and thus before the rise of the modern state and the capitalist firm. Co-shaped by economic and political actors, these institutions of mutual aid have influenced the social responsibility programs of early industrialists, modern social welfare legislation, and contemporary CSR. We conjecture that other elements of proto-CSR might have evolved according to similar trajectories. (shrink)

What sort of image does the planet Earth possess at the opening of the 21st century? If in the 1960s, the Whole Earth, the planet as seen from space, became a cold war, proto-environmentalist icon for a fragile ocean planet, in the 2010s, Google Earth, the globe encountered as a manipulable virtual object on our computer screens, has become an index for multiple and socially various interpretations and interventions; its thicket of satellite images, text legends, and street level photographs can (...) all be tagged, commented upon, modified. In this essay, I examine a kindred image-object, Google Ocean, asking what sort of representation of the planetary sea is in the making in our digital days. Stirring up the century-old classification of signs by semiotician Charles Sanders Peirce, I argue that Google Ocean is a mottled mash of icons, indexes, and symbols of the marine and maritime world as well as a simultaneously dystopian and utopian diagram of the sea - though one that floats in a media ecology that tends to occlude its infrastructural history and conditions of possibility. In order to explain that sentences containing empty definite descriptions are nevertheless true or false, Russell famously analyzes sentences of the form ‘The F is G’ as ‘There is exactly one F and it is G’. Against this it has been objected that Russell’s analysis provides the wrong truth-conditions when it comes to non-doxastic attitude ascriptions. For example, according to Heim, Kripke, and Elbourne (HKE), there are circumstances in which (1) is true and (2) is false. Hans wants the ghost (...) in his attic to be quiet tonight.Hans wants there to be exactly one ghost in his attic and for it to be quiet tonight. After all, the argument goes, unlike (2), (1) can be true without Hans wanting there to be exactly one ghost in his attic. Kaplan and Neale famously reply that the HKE objection presupposes that non-doxastic attitudes are closed under entailment, which they are not. For Rostworowski, on the other hand, the problematic principle used by the HKE objection is a substitutivity principle for non-doxastic attitude ascriptions. This is further supported by the fact that, as Elbourne points out, Russell’s analysis already leads to a problem similar to the HKE objection together with substitutivity alone. By questioning substitutivity for non-doxastic attitude ascriptions, Rostworowski tries to block both the HKE objection and Elbourne’s variant of the HKE objection. In this paper, I will argue that Russell’s analysis of definite descriptions leads to a variant of the HKE objection even in the context of doxastic attitude ascriptions. Since, as we will see, doxastic attitude ascriptions do not seem to suffer from the substitutivity problems discussed by Rostworowski in the context of non-doxastic attitude ascriptions, this will further exacerbate the problem for Russell’s analysis. I will then discuss the possibility to reject substitutivity for doxastic attitude ascriptions using a contextualist analysis of attitude ascriptions. However, we will see that, independent of whether we accept substitutivity for doxastic attitude ascriptions, a complete solution of the doxastic problem has to reject Russell’s analysis of the truth-conditions of sentences of the form ‘The F is G’. Concluding, I will show that, unlike Russell’s analysis, the Frege–Strawson analysis of definite descriptions, according to which a sentence of the form ‘The F is G’ presupposes that there is exactly one F, rather than asserting it, provides an explanation of the HKE objection, Elbourne’s variant of the HKE objection, and the doxastic problem presented in this paper. This will speak not only in favor of a Fregean analysis of definite descriptions, but also of a Fregean conception of propositions. (shrink)

This paper examines women’s experiences with decision-making about non-invasive prenatal testing (NIPT). Such tests offer knowledge about chromosomal disorders early in pregnancy, without the risk of miscarriage associated with invasive procedures such as amniocentesis. Based on qualitative interviews with women in Germany who used, or declined, NIPT, we show how some women, who would not consider amniocentesis due to the risk of miscarriage, welcome the knowledge provided by, and the additional agency resulting from, NIPT. For others, declining the offer to (...) “know more” becomes increasingly difficult to articulate. The absence of risk strips women of a “good reason” to justify their decision not to test, thus implicitly challenging their “right not to know.” Moreover, NIPT heightens moral dilemmas within relationships with partners, existing children, and sometimes other close relatives. While clinically “non-invasive,” we argue that NIPT changes decision-making in an ethically and socially highly significant way. (shrink)

Is it appropriate to blame people unequally if the only difference between them was a matter of luck? Suppose Alice would drive recklessly if she could, Belen drove recklessly but didn’t harm anyone, and Cleo drove recklessly and killed a child. Luck-advocates emphasize that in real life we do blame such agents very unequally. Luck-skeptics counter that people aren’t responsible for factors beyond their control, or beyond their quality of will. I’ll defend a somewhat reconciliatory view. I’ll concede to the (...) skeptics that these agents are equally culpable. Nonetheless, I’ll suggest with the luck-advocates that it’s fitting to blame them unequally. That’s because their culpability is unequally significant for us: Cleo’s culpability concerns us more than Belen’s, and Belen’s more than Alice’s—just like the fault of a close aggressor concerns us more than that of an aggressor far off in place and time. And it’s fitting for us to respond with more blame to faults that concern us more. Indeed, blaming people simply in proportion to their culpability manifests a form of fetishism, or problematic mere-matter-of-principle concern. So while many skeptical tenets may hold, in substance the luck-advocates are right. (shrink)

Was Marxism a variety of German Idealist self-actualization in economic form? A deeply flawed blueprint for social engineering? A catechism for post-colonial insurgencies? the intellectual foundations of modern social democracy? In this wide ranging summation, Sullivan tackles the multi-tentacled reach of Marx's legacy, and explores both the limits and the lasting significance of his ideas. Structured around three obstacles to freedom - poverty, corruption and banality - the work engages both Marx and his critics in addressing unresolved issues of the (...) current social and political order. As such, the work, after two introductory chapters, leaves behind Marxology and its familiar cast of characters (Bernstein, Kautsky, Adorno, Lukacs, Fanon, Horkheimer, Marcuse, etc.) to address both neo-Marxist and non-Marxist interpretations of these obstacles. Neo-Russellians like Salmon and Braun hold that: the semantic contents of sentences are structured propositions whose basic components are objects and properties, names are directly referential terms, and a sentence of the form ‘n believes that S’ is true in a context c iff the referent of the name n in c believes the proposition expressed by S in c. This is sometimes referred to as ‘the Naive Russellian theory’. In this talk, I will discuss the Naive Russellian theory primarily (...) in connection with a problem known as Schiffer’s puzzle. Schiffer first presented the puzzle as an argument against the Naive Russellian theory. Schiffer’s argument proceeds in two steps. In step one, Schiffer argues that the Naive Russellian theory is committed to two principles regarding de re belief; the special-case consequence and Frege’s constraint. Then, in step two, Schiffer argues that the special-case consequence is not consistent with Frege’s constraint. Salmon and Braun reply to Schiffer’s argument that although the Naive Russellian theory is committed to Frege’s constraint, it is not committed to the special-case consequence. However, in this paper, I will argue with a new Schiffer-case that even if the Naive Russellian theory is not committed to the special-case consequence, it is still not consistent with Frege’s constraint. Concluding, I will discuss the possibility to reject Frege’s constraint within the Naive Russellian theory. (shrink)

There are several important criticisms against the unificationist model of scientific explanation: Unification is a broad and heterogeneous notion and it is hard to see how a model of explanation based exclusively on unification can make a distinction between genuine explanatory unification from cases of ordering or classification. Unification alone cannot solve the asymmetry and irrelevance problems. Unification and explanation pull in different directions and should be decoupled, because for good scientific explanation extra ad explanandum information is often required. I (...) am presenting a possible solution to those problems, by focusing on an often overlooked but important element of how theoretic unification is achieved—the conceptual frameworks of theories. The core conceptual assumptions behind theories are decisive for discriminating between explanatory and non-explanatory unification. The conceptual framework is also flexible enough to balance the tension between informativeness and maximum systematization in constructing explanatory inferences. A short case study of orthogenetic and Darwinian explanations in paleontology is presented as an illustration of how my addition to the unificationist model is applicable to a historical debate between rival explanations. On Shapiro’s view, any viable legal theory must successfully respond to his Possibility Puzzle and Humean Challenge. Moreover, he argues that Hartian legal theory fails in this respect. Here, I take issue with his characterization of these challenges and the Hartian response to them. I argue that he equivocates with respect to a number of the key terms and relations that inform his Possibility Puzzle, and I argue that if we disambiguate its terms consistently and plausibly, we will see that (...) its putative challenge to Hartian legal theory is illusory. I also argue that once we adequately characterize Hartian legal theory, it easily meets the Humean Challenge. If correct, these arguments undermine Shapiro’s larger project of defending his planning theory of law, for a key pillar supporting his theory is that it meets challenges that rival theories cannot. I also consider his planning theory directly, and I argue that it compares unfavourably to the Hartian approach in a crucial respect. It obscures the Hartian insight that customary practice is an ineliminable and fundamental feature of legal systems. Thus, I conclude that though Shapiro’s Legality brings to the fore many of the key issues in contemporary analytic jurisprudence and does so in an insightful and provocative way, it does not succeed in its ultimate ambition of improving upon and supplanting Hartian legal theory. Der Thuringer Karl Christian Friedrich Krause, Schuler von Fichte und Schelling in Jena, entwickelte eine eigenstandige Philosophie, die sich einerseits der epochalen abendlandischen Geistestradition verpflichtet weiss, zugleich aber auch von der Kantischen Philosophie und ihrem kritischen Geist beeinflusst wurde. Krause ist einerseits Systemphilosoph, der immer wieder die Thematik des Absoluten oder Gottes in den Vordergrund stellt - in dieser Hinsicht (...) ist er spekulativer Idealist. Andererseits muss alle Philosophie beim Ich beginnen, sofern zeigt er sich als Denker des Transzendentalen. Krauses Philosophie ist zweistrahlig aufgebaut: Zum einen will er die endliche Welt aus Gott ableiten, andererseits soll das Ich zur Erkenntnis Gottes aufsteigen. In their Minds and Machines essay How would you know if you synthesized a Thinking Thing? (Kary & Mahner, Minds and Machines, 12(1), 61–86, 2002), Kary and Mahner have chosen to occupy a high ground of materialism and empiricism from which to attack the philosophical and methodological positions of believers in artificial intelligence (AI) and artificial life (AL). In this review I discuss some of their main arguments as well as their philosophical foundations. Their central argument: ‘AI is Platonism’, which (...) is based on a particular interpretation of the notion of ‘definition’ and used as a critique against AI, can be counter criticized from two directions: first, Anti-Platonism is not a necessary precondition for criticizing AI, because outspoken Platonist criticism against AI is already known (Penrose, The emperor’s new mind (with a foreword by M. Gardner), 1989). Second, even in case that AI would essentially be ‘Platonism’ this would not be a sufficient argument for proving AI wrong. In my counter criticism I assume a more or less Popperian position by emphasizing the openness of the future: Not by quasi-Scholastic arguments (like Kary and Mahner’s), but only after being confronted with a novel ‘thinking thing’ by future AI engineers we can start to analyze its particular properties (Let me use a history analogon to illustrate my position: In the 19th century, mechanized aviation was widely regarded impossible—only natural organisms (such as birds or bees) could fly, and any science of aerodynamics or aviation did not exist. Only after some non-scientific technicians had confronted their astonished fellows with the first (obviously) flying machine the science of ‘Artificial Aviation’ came into existence, motivated by the need for understanding and mastering that challenging and puzzling new phenomenon). The four best-preserved aulos pipes unearthed at Pompeii are examined and their original pitches are as far as possible determined by mathematical analysis. It is argued that the scales of the instruments as well as specific details of their mechanism fit well with our knowledge of music from the Roman Imperial period.
