This Element argues that although Kant's political thought does not tackle issues of global poverty and inequality head on, it nonetheless offers important conceptual and normative resources to think of our global socioeconomic duties. It delves into the Kantian duty to enter a rightful condition beyond the state and shows that a proper understanding of this duty not only leads us to acknowledge a duty of right to assist states that are unable to fulfil the core functions of a state, (...) but also provides valuable hints at what just transnational trade relations and a just regulation of immigration should look like. The article revisits the idea that writing may be gendered and asks whether we can define what a “woman writing” practice might be. We do this through a comparative study of the work of Julia Kristeva and Judith Butler. Both have expressed reservations about, even objected to, the essentializing of gender and therefore of writing as a woman. They have, however, provided us with useful tools to define what a non-essentialist understanding of “woman” might entail. The article proposes to do (...) three things: first, to look at the way each author presents “woman” and what I term “woman writing” in their work; second, to find, beyond epistemic differences, the common grounds shared by the two authors; and third, to clarify the places where the two disagree. In a concluding part, we will highlight how that disagreement is reconciled in revisiting Kristeva’s and Butler’s use of loss in their apprehension of “woman,” allowing us to formulate a non-essentialist definition of “woman writing.”. En 1989, une prospection archéologique de la plaine de Malia a permis la découverte d'une route à l'Est du site fouillé, conservée sur plus de 800 m entre la baie d'Haghia Varvara et le camping de Sissi. In his review of Bernard Williams' Ethics and the Limits of Philosophy, Hart eloquently formulated an apprehension that still haunts much of contemporary jurisprudence: if the moral 'I must' has to be 'seen as coming not from outside, but from what is most deeply inside us? the fear is that this will not be enough'. I argue that this fear is the byproduct of the dualist outlook within which Hart—and a significant part of contemporary legal theory—is confined: because of his (...) bald naturalist premise, Hart could not conceive of moral objectivity except in terms presupposing an order of Reason resolutely distinct from the 'natural' world. This paper seeks to debunk this dualist outlook by engaging with the kind of 'non-bald' naturalism advocated in different ways by both McDowell and Blackburn. In considering contemporary efforts to draw a middle way between ethical scepticism and metaphysical rationalism, the paper draws on the pragmatic elements emerging from the confrontation between Habermas and Rawls. Some studies report that the sport context increases the risk of exposure to sexual violence for athletes. In contrast, others indicate a protective effect of sport participation against sexual violence, particularly among varsity athletes. Studies of sexual violence towards varsity athletes are limited by their failure to include control groups and various known risk factors such as age, graduate level, gender and sexual identity, disability status, international and Indigenous student status, and childhood sexual abuse. The purpose of the present study (...) is to fill in these gaps to determine whether varsity athletes are at greater risk than non-athletes of sexual violence towards them or whether, on the contrary, involvement in a varsity sport is coherent with the Sport Protection Hypothesis. Data for this article come from the ESSIMU study, a broad survey of students, professors, and other employees at six francophone universities regarding sexual violence on university campuses. A total of 6,485 students with complete data on sexual violence, athlete status, and gender were included in the study. From this total, 267 participants identified themselves as varsity athletes. Data were analyzed using a series of logistic regressions on each form of violence using athlete status as a predictor and characteristics associated with sexual violence victimization or distinguishing between varsity athletes and non-athletes as confounding variables. When considering all confounding variables in the regression analyses on four yearly incidence rates of sexual violence, the results revealed that being a varsity athlete did not significantly increase the risk of exposure to sexual violence at university. All considered other variables were more significant predictors of the past year’s risk of sexual violence victimization than athlete status was. (shrink)

The concept of substantial equivalence,introduced for the risk assessment of geneticallymodified (GM) food, is a reducing concept because itignores the context in which these products have beenproduced and brought to the consumer at the end of thefood chain. Food quality cannot be restricted to meresubstance and food acts on human beings not only atthe level of nutrition but also through theirrelationship to environment and society. To make thiscontext explicit, I will introduce an ``equivalencescale'' for the evaluation of food chains (GM (...) or notGM). By contrast with substantial equivalence, whichinvolves mainly quantitative, analytical methods ofevaluation, ``qualitative equivalence'' refers to ``less''or non-substantial factors that require new methodsof evaluation based on qualitative principles.``Ethical equivalence'' refers to factors that show themoral value contained in food products. To analyze thedifferent levels at which ethics is needed in foodchains, I will use the French principles: ``Liberty,Equality, Fraternity,'' or freedom, equality,solidarity, and add a fourth principle:sustainability. Sustainability, solidarity, andfreedom can be applied to the evaluation ofenvironmental, socio-economic, and socio-culturalethical equivalence, respectively. Equality refers tojustice and should operate so as to guarantee thatsustainability, solidarity, and freedom are satisfied.I suggest that ethics can provide a basis for arenewal of the food chain concept. Besides QualityAssurance, it is now essential to develop an ``EthicalAssurance'' and this equivalence scale could provide abasis to set up ``Ethical Assurance Standards'' (EAS)for food chains. This paper describes the construction method of a legal application ontology. This method is based on the merging of micro-ontologies built from European community directives. The terminae construction method from texts enhanced by an alignment process with a core legal ontology is used for building micro-ontologies. A merging process allows constructing the legal ontology.

The present work finds in Heidegger's 'being towards death' the basis for theological-philosophical thinking. Only the one who embraces 'being towards death' has the courage to think and poetize. This thinking, in turn, makes 'being towards death' possible, and in this circular movement of thinking and being the mystery of being reveals itself and yet remains hidden. In other words, the work describes the human response to the divine gift that precedes every human initiation.

Dans son inventaire des « lieux théologiques », Melchior Cano ne faisait aucune place à l’expérience spirituelle, les « spirituels » ne paraissant même pas comme théologiens… La frontière qui, relayant une distinction paisible, s’était élevée entre théologie et spiritualité, sur la base d’une évolution de la théologie vers une scientificité et sous l’effet des interrogations du nominalisme, semble être devenue poreuse, sinon avoir disparu. De fait, la théologie contemporaine pense l’expérience croyante. La question pourrait se formuler ainsi : où (...) et comment peut se faire la prise en charge théologique de la vie spirituelle, du capital chrétien d’expérience spirituelle ? Est-ce par une discipline propre, la théologie spirituelle ? Qu’est-ce qui la caractériserait ? Pour réfléchir ainsi au devenir de la théologie spirituelle, on commencera par observer, avec quelques exemples d’élaborations théologiques significatives, comment la théologie contemporaine prend en compte la dimension expérientielle de la foi chrétienne. Si oui, une théologie spirituelle n’aurait plus de raison d’être ; si non, quelle est la vocation d’une telle théologie ?In his inventory of “theological loci”, Melchior Cano did not at all include spiritual experience and “spirituals” do not even appear in his listing as theologians… Following after a period of peaceful distinction, the border that has arisen between theology and spirituality - on the basis of an evolution of theology towards scientificity and under the influence of the questions raised by nominalism – seems now to have become porous, if not to have altogether vanished. In fact, contemporary theology reflects on believing experience. We could put the question this way: where and how can theology take charge of spiritual life, valorizing the Christian capital of spiritual experience ? Is it through a specific discipline, spiritual theology? What would characterize it ? In order to think through the way spiritual theology is developing, we shall begin by observing, thanks to a few examples of significant theological texts, how contemporary theology takes into account the experiential dimension of Christian faith. However, is taking into account this constitutive part of experience the same as taking charge of spiritual experience ? If so, a spiritual theology would no longer have a raison d’être; if not, what then is the task of such a theology ? (shrink)

In three experiments, picture quality between test items was manipulated to examine whether subjects’ expectations about the fluency normally associated with these different stimuli might influence the effects of fluency on preference or familiarity-based recognition responses. The results showed that fluency due to pre-exposure influenced responses less when objects were presented with high picture quality, suggesting that attributions of fluency to preference and familiarity are adjusted according to expectations about the different test pictures. However, this expectations influence depended on subjects’ (...) awareness of these different quality levels. Indeed, imperceptible differences seemed not to induce expectations about the test item fluency. In this context, fluency due to both picture quality and pre-exposure influenced direct responses. Conversely, obvious, and noticed, differences in test picture quality did no affect responses, suggesting that expectations moderated attributions of fluency only when fluency normally associated with these different stimuli was perceptible but difficult to assess. This article approaches world poverty from the perspective of rectificatory justice and investigates whether the global rich can be said to have special obligations toward the global poor on the grounds that they have been harming them. The focus rests on the present situation, and more specifically on Thomas Pogge's thesis of a causal link between world poverty and the conduct of present citizens (and governments) in wealthy countries. I argue that, if Pogge does not want his position to boil (...) down to an institutional version of the ‘negative causation'-thesis – according to which one can cause harm simply by failing to alleviate it – and if he wants it to be accepted by those he seeks to convince – namely right-libertarians – he must specify that it is enough for institutions to be just that they do not actively deprive their members of the means of subsistence, even if many of them still do not have the capacity to enjoy the means of subsistence. Les fictions sont un outil privilégié de l’éthique du fait de la matière à la fois singulière et universelle qu’elles fournissent, qui permet de se prémunir contre les écueils opposés du trop-plein d’abstraction et d’implication. Ainsi, à la lumière du débat entre déontologisme et conséquentialisme tel qu’il est exploré dans la série 24 heures chrono (Fox, 2001-2010) via notamment son héros Jack Bauer, je propose une relecture croisée de deux textes fondamentaux de la tradition occidentale : l’opuscule de Kant « (...) D’un prétendu droit de mentir par humanité » et la tragédie Œdipe roi de Sophocle. Si ces œuvres peuvent sembler d’abord hétérogènes, tant dans leur nature (une série états-unienne du XXI e siècle, le texte d’un philosophe allemand du XVIII e siècle, une tragédie de l’Antiquité grecque) que dans leur niveau de reconnaissance philosophique, elles convergent en fait toutes trois vers une question morale clé : quel rôle doit être accordé à l’anticipation des conséquences dans nos décisions morales? Les situations auxquelles nous sommes confrontés aujourd'hui dans nos pratiques d'information et de communication sont marquées par l'incertitude et la multidimensionnalité. Les approches adoptées ne peuvent s'appuyer sur la seule logique rationnelle et font appel à des savoirs pratiques, parfois issus de traditions anciennes, qui mobilisent l'abduction. Du point de vue de la connaissance, et contrairement à l'opinion courante, l'abduction associe étroitement déduction et induction. Les exemples empruntés à la science, à la littérature, à l'épistémologie et à l'esthétique soulignent la (...) pertinence d'une approche transdisciplinaire de ce mode de découverte.In today's information and communication activities we are faced with situations characterized by uncertainty and multidimensionality. These approaches we adopt to these cannot only be guided by rational logic and require practical know-how, sometimes from ancient traditions, which imply abductive thinking. Contrary to the widely-held opinion, abduction closely combines induction and deduction. Examples from science, literature, epistemology and aesthetics stress how relevant a transdisciplinary approach of this discovery mode really is. (shrink)

ABSTRACTThis essay aims to contribute robust grounds to question the Susskinds’ influential, consequentialist logic when it comes to the legitimacy of automation within the legal profession. It does so by questioning their minimalist understanding of the professions. If it is our commitment to moral equality that is at stake every time lawyers hail the specific vulnerability inherent in their professional relationship, the case for wholesale automation is turned on its head. One can no longer assume that, as a rule, wholesale (...) automation is both legitimate and desirable, provided it improves the quality and accessibility of legal services. The assumption, instead, is firmly in favour of designing systems that better enable legal professionals to live up to their specific responsibility. The rest of the essay outlines key challenges in the design of such profession-specific, ‘ethics aware’ decision-support systems. (shrink)
