ABSTRACT:Should companies’ human rights responsibilities arise, in part, from their “leverage”—their ability to influence others’ actions through their relationships? Special Representative John Ruggie rejected this proposition in the United Nations Framework for business and human rights. I argue that leverage is a source of responsibility where there is a morally significant connection between the company and a rights-holder or rights-violator, the company is able to make a contribution to ameliorating the situation, it can do so at modest cost, and the (...) threat to human rights is substantial. In such circumstances companies have a responsibility to exercise leverage even though they did nothing to contribute to the situation. Such responsibility is qualified, not categorical; graduated, not binary; context-specific; practicable; consistent with the social role of business; and not merely a negative responsibility to avoid harm but a positive responsibility to do good. It is one thing for a given proposition to follow or to not follow from a given set of propositions and it is quite another thing for it to be shown either that the given proposition follows or that it does not follow.* Using a formal deduction to show that a conclusion follows and using a countermodel to show that a conclusion does not follow are both traditional practices recognized by Aristotle and used down through the history of logic. These (...) practices presuppose, respectively, a criterion of validity and a criterion of invalidity each of which has been extended and refined by modern logicians: deductions are studied in formal syntax (proof theory) and coun¬termodels are studied in formal semantics (model theory). The purpose of this paper is to compare these two criteria to the corresponding criteria employed in Boole’s first logical work, The Mathematical Analysis of Logic (1847). In particular, this paper presents a detailed study of the relevant metalogical passages and an analysis of Boole’s symbolic derivations. It is well known, of course, that Boole’s logical analysis of compound terms (involving ‘not’, ‘and’, ‘or’, ‘except’, etc.) contributed to the enlargement of the class of propositions and arguments formally treatable in logic. The present study shows, in addition, that Boole made significant contributions to the study of deduc¬tive reasoning. He identified the role of logical axioms (as opposed to inference rules) in formal deductions, he conceived of the idea of an axiomatic deductive sys¬tem (which yields logical truths by itself and which yields consequences when ap¬plied to arbitrary premises). Nevertheless, surprisingly, Boole’s attempt to imple¬ment his idea of an axiomatic deductive system involved striking omissions: Boole does not use his own formal deductions to establish validity. Boole does give symbolic derivations, several of which are vitiated by “Boole’s Solutions Fallacy”: the fallacy of supposing that a solution to an equation is necessarily a logical consequence of the equation. This fallacy seems to have led Boole to confuse equational calculi (i.e., methods for gen-erating solutions) with deduction procedures (i.e., methods for generating consequences). The methodological confusion is closely related to the fact, shown in detail below, that Boole had adopted an unsound criterion of validity. It is also shown that Boole totally ignored the countermodel criterion of invalid¬ity. Careful examination of the text does not reveal with certainty a test for invalidity which was adopted by Boole. However, we have isolated a test that he seems to use in this way and we show that this test is ineffectual in the sense that it does not serve to identify invalid arguments. We go beyond the simple goal stated above. Besides comparing Boole’s earliest criteria of validity and invalidity with those traditionally (and still generally) employed, this paper also investigates the framework and details of THE MATHEMATICAL ANALYSIS OF LOGIC. With complex buyer-driven global production networks and a labour-intensive manufacturing process, the fashion industry has become a focal point for debates on the social responsibility of business. Utilising an interview methodology with influential actors from seven export garment manufacturers in Sri Lanka, we explore the situated knowledge at one nodal point of the production network. We conceptualise factory management perspectives on the implementation of corporate social responsibility in terms of the strategic balancing of ethical considerations against the commercial pressures of (...) cost and lead time. Factory managers framed CSR in terms of compliance, rather than going above and beyond regulatory requirements; seeing it as a strategic competitive imperative and less a developmental mechanism. Sri Lankan manufacturers maintain that they have benefitted from a unique combination of factors, including strict national labour laws, an educated workforce, the characteristics of the garments produced, industrial upgrading, and long-term non-adversarial buyer–supplier relationships, which they argue has supported the establishment and maintenance of CSR practices. The paper thus provides managerial implications that relate CSR activities to CSR outcomes which include both reputational and production benefits. Such insights will be of strategic relevance for lead retail buyers as well as apparel producers keen to invest in CSR to partly mitigate against increasing price-based competition. (shrink)

How do newborns learn to recognize objects? According to temporal learning models in computational neuroscience, the brain constructs object representations by extracting smoothly changing features from the environment. To date, however, it is unknown whether newborns depend on smoothly changing features to build invariant object representations. Here, we used an automated controlled-rearing method to examine whether visual experience with smoothly changing features facilitates the development of view-invariant object recognition in a newborn animal model—the domestic chick. When newborn chicks were reared (...) with a virtual object that moved smoothly over time, the chicks created view-invariant representations that were selective for object identity and tolerant to viewpoint changes. Conversely, when newborn chicks were reared with a temporally non-smooth object, the chicks developed less selectivity for identity features and less tolerance to viewpoint changes. These results provide evidence for a “smoothness constraint” on the development of invariant object recognition and indicate that newborns leverage the temporal smoothness of natural visual environments to build abstract mental models of objects. Public protest continued to represent a prominent form of social activism in democratic societies during the COVID-19 pandemic. In Australia, a lack of specific legislation articulating protest rights has meant that, in the context of pandemic restrictions, such events have been treated as illegal mass gatherings. Numerous large protests in major cities have, indeed, stirred significant public debate regarding rights of assembly during COVID-19 outbreaks. The ethics of infringing on protest rights continues to be controversial, with opinion divided as to (...) whether public health goals or human rights should take precedence. This paper applies public health ethical theory to an in-depth analysis of arguments on both sides of the debate. Using the Nuffield Council on Bioethics framework as a backdrop, proportionality and necessity of restrictions are understood as key concepts that are common to both public health and human rights perspectives. The analysis presented here finds a middle-ground between the prevailing arguments on opposing sides and is further able to rationalize the use of protest itself as an important element of a mature public health ethics response to restrictive policy. Thus, this paper aims to influence public health policy and legislation regarding protest rights during public health emergencies. (shrink)

As the COVID-19 pandemic was unfolding, a surge in scams was registered across the globe. While COVID-19 poses higher health risks for older adults, it is unknown whether older adults are also facing higher financial risks as a result of COVID-19 scams. Here, we examined age differences in vulnerability to COVID-19 scams and individual difference measures that might help explain them. A lifespan sample of sixty-eight younger, 79 middle-aged, and 63 older adults recruited through Prolific completed questions and questionnaires online. (...) In a within-subjects design, each participant responded to five COVID-19 solicitations, psychological measures, and demographic questions. Age group comparisons revealed that older adults were marginally less likely to perceive COVID-19 solicitations as genuine than middle-aged adults were. In addition, older adults perceived significantly fewer benefits than both younger and middle-aged adults did and perceived marginally higher risks than younger adults did. Hence, older adults did not exhibit greater vulnerability to COVID-19 scams. Regardless of age, intentions to respond to COVID-19 solicitations were positively predicted by higher levels of educational attainment, being married, past fraud victimization, and higher levels of positive urgency. As expected, stronger genuineness and benefit perceptions positively predicted action intentions, whereas stronger risk perceptions negatively predicted action intentions As such, COVID-19 scam susceptibility appears to be the result of a impulse control issue that is not easily inhibited, not even by past experiences of scam victimization. It explores such themes as the twentieth century context preceding the council; parallels between Vatican II and previous councils; its distinctively pastoral character; the legacy of the council in relation to issues such as church-world dynamics, as well as to ethics, social justice, economic activity. Wilmington, Del.: Michael Glazier, 1989. Pp. 158. $15.95. Rather than offering a sustained study of the question of authority and leadership in the Church, Rausch presents a collection of essays related to the topic. The format reflects the book's genesis: much of the material was developed for the 23rd Faith and Order Conference of the Texas Conference of Churches on the subject "Authority in the Body of Christ." Although the title does not reflect the hook's ecumenical focus, readers who want a general introduction to the present status of agreement in ecumenical discussion of authority and ministry may find Rausch's hook helpful. In " Authority in the Ecumenical Dialogue " Rausch reviews and summarizes the ARCIC Final Report, the Lutheran-Roman Catholic Dialogue, the WCC Baptism, Eucharist and Ministry text, and the Consultation on Church Union. The emerging consensus on the value of ordained ministry in these documents indicates that this ministry is permanent, although the threefold ministry of bishop, presbyter, and deacon stands in need of reform. Rausch notes that the documents do not limit " valid " ministry to ordained ministry in communion with the historic episcopate. As for the shape of ministry in the church of tomorrow, not surprisingly, he identifies shared responsibility and collegiality as the marks of the future exercise of authority. Among the important issues still unresolved by the churches are Petrine ministry and primacy and the problem of the " reception " of ecumenical documents. The chapter on authority and reception, originally published in Theological Studies, may well be the most original contribution of the book. It broadens the discussion of reception from its historical " classical " understanding as " the acceptance by local churches of particular ecclesiastical or conciliar decisions " to an ecumenical understanding of the concept as " the acceptance by one church of a theo- 166 BOOK REVIEWS logical consensus arrived at with another church, and ultimately, the recognition of the other church's faith and ecclesial life as authentically Christian (p. 103)." He concludes that (1) reception is more properly understood as a process rather than as a juridical determination, (2) it also involves formal decisions on the part of church authorities, (3) it cannot be reduced to the acceptance of doctrinal formulations, and (4) the norm for recognizing a common faith is not agreement with a particular ecclesial position but agreement with the apostolic tradition. Ultimately, reception involves the whole church and is not the sole product of theologians or church authorities. Ecumenical dialogues will only be effective when they enter into the practical life of the churches. In "Imaging Tomorrow's Church: Models of Christian Unity" Rausch summarizes four models of church unity: organic union, conciliar fellowship, reconciled diversity, and communion of Churches. He opts for the fourth model. The chapter does not offer any new information to someone familiar with ecumenical discussions, but it does serve as an introduction for the neophyte. Rausch's image of authority in the future lies somewhere between a strictly hierarchical or institutional model and a more egalitarian model. His final chapter, " Authority in Tomorrow's Church," predicts that the church of the future will be " ordered " in the sense that it will combine an authoritative ordained ministry (based on the church's apostolic office) with a recognition of multiple and diverse charismatic gifts. He retrieves Karl Rahner's suggestion that recognition of charism for leadership in an individual may result in that person's " relative" ordination for a particular local community. Authority of the future will be collegial with a more participatory style of decision-making. The renewed papacy will encourage not only a more participatory style of decision-making but also a broader participation in the formulation of church teaching. What role does experience play in the development of face recognition? A growing body of evidence indicates that newborn brains need slowly changing visual experiences to develop accurate visual recognition abilities. All of the work supporting this “slowness constraint” on visual development comes from studies testing basic‐level object recognition. Here, we present the results of controlled‐rearing experiments that provide evidence for a slowness constraint on the development of face recognition, a prototypical subordinate‐level object recognition task. We found that (1) newborn (...) chicks can rapidly develop view‐invariant face recognition and (2) the development of this ability relies on experience with slowly moving faces. When chicks were reared with quickly moving faces, they built distorted face representations that largely lacked invariance to viewpoint changes, effectively “breaking” their face recognition abilities. These results provide causal evidence that slowly changing visual experiences play a critical role in the development of face recognition, akin to basic‐level object recognition. Thus, face recognition is not a hardwired property of vision but is learned rapidly as the visual system adapts to the temporal structure of the animal's visual environment. (shrink)

Octavia Butler's 1979 novel Kindred is a hybrid text: part historical novel, part science fiction/fantasy and part slave narrative. The story transports a contemporary black heroine into 19th–century Maryland in order to explore, recreate and connect with African American narratives of identity. Providing two narrative strands, one in 19th–century Maryland and the other in 20th–century California, the text is able to juxtapose the realities of slavery with its legacy. Conflating these time–periods, Kindred aims to interrogate the marginalization of African American (...) history, but specifically the role black women played in that history, in America's bicentennial year. While Butler adapts what has been regarded as the quintessential African American literary mode of the slave narrative, her fiction consciously draws upon a literary heritage that foregrounds narratives written by black women. Consequently, Kindred highlights the issues and concerns that directly affect the construction of black femininity and its role in the community of slaves as well as examining the historical pressure brought to bear on the configuration of contemporary African American womanhood. In doing so, Butler's fiction articulates the right of black women to intervene in their own construction and to inscribe the existence of black women in stories of originary identity. What this article seeks to explore is how Butler's fiction develops and extends the traditional slave narrative, how this is utilized in order to interrogate the ‘realities’ of both slavery and contemporary US society, and how effective the text is in challenging stereotypical representation of white and black femininity. But at the same time it’s not unusual to converse with ghosts, and this generalization can be taken beyond the sphere of literature, beyond the notion of writers struggling with the mighty dead for imaginative priority, as it is conceived in Harold Bloom’s readings of Browning, for instance. Derrida insists that relationship in general requires the spectral: “[w]hat happens between two, and between all the ‘two’s’ one likes, such as between life and death, can only maintain itself with some ghost, can only talk with or about some ghost [s’entretenir de quelque fantôme]” [Derrida, Specters of Marx xviii]. Perhaps, then, what happens in and between the two books reviewed here needs to be approached in terms of ghosts and the psychoanalysis of ghosts, so powerfully thematized by Nicholas Royle. [End Page 4] Both his After Derrida and Robert Smith’s Derrida and Autobiography seek to make contact with something in writing that gets things going and produces breaks, that displaces and startles. Although each volume could still be called a monograph on Derrida, it responds to something other than a corpus.The sense of shock, wonder, and discontinuity that makes the imagined interlocutor in “Memorabilia” laugh illuminates also something playing itself out across the reception of Derrida’s work. Part of that reception could be conceived in familiar terms—the development of a canon of what could be called Derrida commentaries, the establishment of a set of themes readily associated with Derrida studies (charlatanism, the deconstruction of a metaphysics of presence, and so on). Yet to speak with or about ghosts entails having to start reading, listening, and thinking again, in order to broach familiarity anew without innocent recourse to sheer intuition. These books also, despite their scholarly knowledge of the field, share a sense of responsibility to discuss an aspect of writing—hard to ignore in Derrida—that has begun without commentary, that gets commentary started and that subjects the movement of thought to something like fits. Whether these fits are of phobia, laughter, melancholy, delirium, or anger, their irruption marks interesting gaps in thought’s continuity. More than moods, these strange outbursts might be understood better in terms of the theory of metapsychological “phantoms.” The phantom, according to Nicolas Abraham, is “sustained by secreted words, invisible gnomes whose aim is to wreak havoc, from within the unconscious, in the coherence of logical progression” [“Notes on the Phantom” 175]. It is written to and for ghosts – the only ones who can survive in the blazing building that writing can become. The ghosts live in burning house scenes, in poems about dream rooms and erotic hauntings, and in the intellectual tension (...) of literary and non-literary texts. The more than fifty years of dialogue since Vatican II launched the Catholic Church into the ecumenical movement have resulted in significant convergence, but reception of these results remains slow and inconclusive despite the stunning success of the Joint Declaration on Justification signed in 1999. This presentation explores some of the challenges for reception within the ecclesial and social context of ecumenical relationships today and discusses why the ecumenical imperative is even more critical at this point in time. People may be subjected to discrimination from a variety of sources in the workplace. In this study of mental health workers, we contrast four potential perpetrators of discrimination (managers, co-workers, patients, and visitors) to investigate whether the negative impact of discrimination on victims’ well-being will vary in strength depending on the relative power of the perpetrator. We further explore whether the negative impact of discrimination is at least partly explained by its effects on people’s sense of organizational justice, and whether (...) the strength of mediation varies according to the source of discrimination. Using survey data from 1,733 UK mental health workers, a structural equation model was designed to test these hypotheses following a bootstrap approach. Discrimination from all sources was related to well-being, with that from managers having the strongest effects. The results support an explanation of the effect of discrimination on well-being in terms of organizational justice perceptions for discrimination from managers and from visitors, but less so for discrimination from co-workers or from patients. The study highlights the importance of differentiating amongst sources of discrimination at work and the salience of organizational justice perceptions in explaining the effects of discrimination from some sources. Pp. 172. $14.95. This work develops (and repeats) some of the ideas in Orsy's ar· ticle, "Magisterium: Assent and Dissent," TS 48 (1987), 473-497. One of the most neuralgic issues in the Church today is the relation· ship between the magisterium and theologians. This extended essay, notable for its irenic tone, (...) broadens the topic to a consideration of the whole church in its activity of learning and teaching. Its stated purpose is to " clarify some of the foundational concepts and to present a framework in which the interplay between the teaching authority and the whole community can be understood." In the heat of debate when lines are drawn, and each side is in danger of becoming myopic because of the intensity of focus on a given issue, each risks losing sight of the larger dialogic relationship between God and human person. To its credit, this essay counteracts this risk by describing the pattern of encounter between God and the human person. Orsy reminds us that the church in its teaching and learning responds to a mystery which always eludes absolute order and clarity even through both occur under the guidance of the Spirit. Within this dialogic interplay, the function of the episcopate is to witness to the word that God has spoken, a word always predominantly ineffable, while the task of the theologians is to penetrate into the meaning of the word through systematic theological reflection. In the three remaining chapters, Orsy discusses teaching authority, assent and dissent, and Catholic universities and academic freedom. He calls for a new hermeneutic for the interpretation of encyclicals in order to differentiate between statements of doctrine universally held, opinions of theological schools, and statements that may later be found to he erroneous. He points out the ambiguities associated with the term "ordinary magisterium," citing texts where it is the equivalent of "non-infallible," and others where it simply refers rto the manner in which a doctrine is taught. Departing from Dulles' suggestion for a dual magisterium, Orsy sketches the problems associated with the concept of a magisterium of theologians. He then cautions us against an over-simplification of the difference between fallible and non-infallible teaching which fails to account for the organic unity of Christian doctrine. As there is a dialogic interaction between God's word and human response, so is there an interplay between the bishops' witness to the truth in the Spirit and the recognition of this truth on the part of the people of God who then surrender in an act of faith. The exact nature of this obsequium fidei, however, is problematic. Orsy's identification 5!l0 BOOK REVIEWS of obsequium as a seminal locution in Lumen Gentium circumvents the dispute as to whether it means "respect" or "submission." Orsy attempts to defuse much of the emotional charge associated with the term " dissent " by noting that it is a much stronger dialectical term than such European expressions as opinion difjerent or anderer Meinung. He cautions that " to state simply that dissent from non-infallibly held doctrine is legitimate, is simplistic and incorrect " since one must note the relationship of the non-infallible doctrine to the infallible core. He concludes,that the best climate for a healthy relationship between theologians and bishops is mutual trust, a reasonable margin for honest mistakes, a recognition of limits on the part of theologians with a corresponding resolution never to call a final truth what is in reality a hypothesis. Orsy notes that history witnesses to the perils of theologians being subject to correction by their peers only. He points out that theologians should perhaps return to the practice of investigating questions rather than defending theses. The dangers associated with dissent include the possibility of the propositional dissent of a theologian becoming a feeder to a deeper attitudinal dissent in others or in some other way threatening the peace or unity of the church.
