Discussion of the ethics of forgoing medically provided nutrition and hydration tends to focus on adults rather than infants and children. Many appellate court decisions address the legal propriety of forgoing medically provided nutritional support of adults, but only a few have ruled on pediatric cases that pose the same issue.The cessation of nutritional support is implemented most commonly for patients in a permanent vegetative state ). An estimated 4,000 to 10,000 American children are in the permanent vegetative state, compared (...) to 10,000 to 25,000 adults. Yet the dearth of literature, case reports, and court decisions suggests that physicians and families of pediatric patients stop medically provided nutrition or seek court orders much less frequently. The marketing of health care services raises the prospect that an ethic of strangers will govern relations between providers and patients. A fiduciary model that emphasizes honesty and public accountability, as well as the patient's good and avoiding unnecessary services, can keep marketing consistent with the ethical tradition of medicine.

A response to “What Counts as Equipoise?” by Henry J. Silverman and Didier Dreyfuss.

Distance education has a long and complex history. It accounts for more than one-third of all higher education students in the world and, because of its very nature, has produced some of the top graduates worldwide who were unable to study fulltime and on-campus for various reasons. One of the most prestigious graduates of the DE system was the former state president of South Africa, the late Nelson Mandela. Online learning is a form of DE and fast becoming the (...) preferred method of instruction and delivery. Critiques of online learning, and of DE itself, will argue that, because of the separation of the teacher and the student, only academic skills can be taught and learnt using this medium. The so-called ‘softer skills’ – those that focus on the development of the person – are best taught in a face-to-face, traditional environment. This article focuses on a review of DE theories and models. A particular emphasis is placed on online learning theories, and how the teaching of formational learning skills can be successfully incorporated into this educational setting. The article draws from a range of studies that have been conducted, based on conceptual and empirical research evidence from various authors. Drawing from Garrison, Anderson and Archer’s Community of Inquiry framework for online education, it presents key elements that relate to the formational training of theology students. The article examines research that both supports and cautions against online learning for formative development. It concludes by suggesting a blended model of both face-to-face and online learning, where meaningful interactions between the learner and teacher take place, is desirable. The article highlights the important role that DE can play in developing the human component of education. (shrink)

Patricia Williams made a number of claims concerning the methods and practise of cladistic analysis and classification. Her argument rests upon the distinction of two kinds of hierarchy: a divisional hierarchy depicting evolutionary descent and the Linnean hierarchy describing taxonomic groups in a classification. Williams goes on to outline five problems with cladistics that lead her to the conclusion that systematists should eliminate cladism as a school of biological taxonomy and to replace it either with something that is philosophically coherent (...) or to replace it with pure methodology, untainted by theory (Williams 1992, 151). Williams makes a number of points which she feels collectively add up to insurmountable problems for cladistics. We examine Williams' views concerning the two hierarchies and consider what cladists currently understand about the status of ancestors. We will demonstrate that Williams has seriously misunderstood many modern commentators on this subject and all of her five persistent problems are derivable from this misunderstanding. Some persons believe and argue, on grounds approaching faith it seems to me, that phylogeny comes from our knowledge of evolution. On the other side, he presents the PDM as an alternative to the soft theism of thinkers like Hans Kiing and as a promising approach in contemporary epistemological debates involving Thomas Kuhn, Richard Rorty, Joseph Margolis, and many others. The historians (...) of philosophy will have to take up the critique of Matteo and Marechal on the many figures which they survey in PDM and QA. No one writer can cover so much ground without raising the ire of the specialists in particular thinkers or epochs. I shall simply say that the overview is helpful and that Matteo deserves credit for putting Marechal's readings to the test of his own reading of the works at issue. QA presents and evaluates this history with remarkable brevity, a virtue which can have its vicious side. I found the brevity to be a particular problem in the handling of Kant and of Marechal. The Critique of Pure Reason and PDM are elaborate analyses of thought, and Matteo proceeds in such summary fashion towards the big conclusions that he does less than justice to these analyses. Being so summary turns out to be a problem in showing that PDM can escape the accusations of subjectivism and relativism made by its scholastic attackers and that it has a way around those problems in present-day controversies. I myself am a partisan of the epistemology and metaphysics Marechal and Matteo advocate, but I find many of my doubts about the project unresolved by its presentation in QA. My particular concerns here center on conceptual relativism and theistic objectivity, hut anyone who can resolve those doubts definitively will have done a monumental service not just for the reviewer but for humankind. Marechal himself had intended a sixth volume more straight-forwardly along the Aristotelian-Thomist line, something which bad health prevented. We should wish Matteo the good health to develop the ideas of PDM and QA at the greater length required to achieve fully the promise claimed for them in this fine book. MICHAEL J. In recent years, we have seen a number of attempts to recapture the natural law doctrines of Thomas Aquinas. This book is another such BOOK REVIEWS 157 attempt, and in it Nelson attempts to do two things. First, he tries to show that prudence is the most important of the virtues and is prior to nature in the process of determining the moral character of actions. Prudence is undoubtedly a highly important virtue because it is the train that carries the agent to the moral good and it must stay on track for the agent to realize fully the aims of morality. But it is not clear that it is prior to other virtues, or to nature itself, as Nelson contends, and a strong case can he made that charity is first among the virtues, and that prudence is determined by charity. Prudence is prior to the other virtues in the sense that they are all weakened by prudential failures, hut prudence wanders aimlessly, not only in the absence of the guidance of the other virtues, hut also without the guidance of nature itself. Cut loose from its secure grounds in nature, prudence and the other virtues collapse, and they need not only the secure standards provided by justice, fortitude, and charity, hut also of nature to he authentic. Second, he is trying to show that Aquinas is not so much a natural law moralist as he is a rationalist and a virtue theorist. To do this, he argues that nature serves merely an explanatory and foundational function for morality, and provides no information about moral judgments (p. 100). He subordinates nature to reason in order to resolve disputes between modern deontologists and consequentialists, hut in doing this he transforms Aquinas from a natural law moralist to a rationalist. Moral luck occurs when factors beyond an agent’s control positively affect how much praise or blame she deserves. Kinds of moral luck are differentiated by the source of lack of control such as the results of her actions, the circumstances in which she finds herself, and the way in which she is constituted. Many philosophers accept the existence of some of these kinds of moral luck but not others, because, in their view, the existence of only some of them would (...) make morality unfair. I, however, argue that this intermediary approach is unstable, because either morality is fair in ways that rule out resultant, circumstantial, and constitutive moral luck (and this leads to moral responsibility skepticism), or morality is unfair in ways that permit the existence of those kinds of moral luck. Thus, such intermediary approaches lack the motivation that their proponents have long taken them to have. In the appendix, I point to ways in which morality is unfair concerning the scope of moral responsibility, moral obligation, moral taint, being a good or bad person, and flourishing. (shrink)

Martin Luther affirms his theological position by saying “Here I stand. I can do no other.” Supposing that Luther’s claim is true, he lacks alternative possibilities at the moment of choice. Even so, many libertarians have the intuition that he is morally responsible for his action. One way to make sense of this intuition is to assert that Luther’s action is indirectly free, because his action inherits its freedom and moral responsibility from earlier actions when he had alternative possibilities and (...) those earlier directly free actions formed him into the kind of person who must refrain from recanting. Surprisingly, libertarians have not developed a full account of indirectly free actions. I provide a more developed account. First, I explain the metaphysical nature of indirectly free actions such as Luther’s. Second, I examine the kind of metaphysical and epistemic connections that must occur between past directly free actions and the indirectly free action. Third, I argue that an attractive way to understand the kind of derivative moral responsibility at issue involves affirming the existence of resultant moral luck. (shrink)

Galen Strawson’s Basic Argument is that because self-creation is required to be truly morally responsible and self-creation is impossible, it is impossible to be truly morally responsible for anything. I contend that the Basic Argument is unpersuasive and unsound. First, I argue that the moral luck debate shows that the self-creation requirement appears to be contradicted and supported by various parts of our commonsense ideas about moral responsibility, and that this ambivalence undermines the only reason that Strawson gives for the (...) self-creation requirement. Second, I argue that the self-creation requirement is so demanding that either it is an implausible requirement for a species of true moral responsibility that we take ourselves to have or it is a plausible requirement of a species of true moral responsibility that we have never taken ourselves to have. Third, I explain that Strawson overgeneralizes from instances of constitutive luck that obviously undermine moral responsibility to all kinds of constitutive luck. (shrink)

One way to frame the problem of moral luck is as a contradiction in our ordinary ideas about moral responsibility. In the case of two identical reckless drivers where one kills a pedestrian and the other does not, we tend to intuit that they are and are not equally blameworthy. The Character Response sorts these intuitions in part by providing an account of moral responsibility: the drivers must be equally blameworthy, because they have identical character traits and people are originally (...) praiseworthy and blameworthy in virtue of, and only in virtue of, their character traits. After explicating two versions of the Character Response, I argue that they both involve implausible accounts of moral responsibility and fail to provide a good solution to the problem of moral luck. I close by noting how proponents of moral luck can preserve a kernel of truth from the Character Response to explain away the intuition that the drivers are equally blameworthy. (shrink)

It is almost unanimously accepted that Kant denies resultant moral luck—that is, he denies that the lucky consequence of a person’s action can affect how much praise or blame she deserves. Philosophers often point to the famous good will passage at the beginning of the Groundwork to justify this claim. I argue, however, that this passage does not support Kant’s denial of resultant moral luck. Subsequently, I argue that Kant allows agents to be morally responsible for certain kinds of lucky (...) consequences. Even so, I argue that it is unclear whether Kant ultimately endorses resultant moral luck. The reason is that Kant does not write enough on moral responsibility for consequences to determine definitively whether he thinks that the lucky consequence for which an agent is morally responsible can add to her degree of praiseworthiness or blameworthiness. The clear upshot, however, is that Kant does not deny resultant moral luck. (shrink)

Putnam and Searle famously argue against computational theories of mind on the skeptical ground that there is no fact of the matter as to what mathematical function a physical system is computing: both conclude (albeit for somewhat different reasons) that virtually any physical object computes every computable function, implements every program or automaton. There has been considerable discussion of Putnam's and Searle's arguments, though as yet there is little consensus as to what, if anything, is wrong with these arguments. In (...) the present paper we show that an analogous line of reasoning can be raised against the numerical measurement (i.e., numerical representation) of physical magnitudes, and we argue that this result is a reductio ad absurdum of the challenge to computational skepticism. We then use this reductio to get clearer about both (i) what's wrong with Putnam's and Searle's arguments against computationalism, and (ii) what can be learned about both computational implementation and numerical measurement from the shortcomings of both sorts of skeptical argument.
