Since its appearance in English translation in 1996, Jurgen Habermas's Between Facts and Norms has become the focus of a productive dialogue between German and Anglo-American legal and political theorists. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work. Habermas's theory of democracy has at (...)

Das „gute Leben" eine „abscheuliche Phrase" Welche Bedeutung hat die religiöse Ethik des jungen Rawls für dessen Politische Theorie?Jürgen Habermas - 2010 - Deutsche Zeitschrift für Philosophie 58 (5):797-810.
The philosophical substance of the senior thesis which the 21 years old John Rawls submitted to the Princeton Philosophy Department in 1942 consists in a religious ethics and its unfolding through communicatively mediated interaction. It already contains all the aspects essential for an egalitarian-universalistic deontology suitable for thematizing the absolute worth of the individual. The thesis shows that Rawls was not suppressing his religious socialization, but rather reworking it. We may now understand much better why Rawls was the first amongst (...)

Kant, Rawls, Habermas and the Metaphysics of Justice.Howard Williams - 1999 - Kantian Review 3:1-17.
We can distinguish between those political philosophers who are concerned to carry the original Kantian project further, like Wolfgang Kersting, Otfried Höffe, Ernest Weinrib and Fernando Teson, and those contemporary political philosophers who have given up the original project but seek to draw inspiration from Kant's thinking. Two political philosophers who belong to this latter trend are Habermas and Rawls.

  15. Justification and Application: The Revival of the Rawls–Habermas Debate.Jørgen Pedersen - 2012 - Philosophy of the Social Sciences 42 (3):399-432.
The Rawls–Habermas debate is having a revival. In this article I argue that both philosophers develop different freestanding conceptions of political legitimacy, and show how they diverge when it comes to how political legitimacy can be justified. Habermas is looking for a deeper justification than Rawls will allow for. I then proceed to show how the different meta-ethical positions yield two different versions of democratic theory, focusing in particular on rights and popular sovereignty. I demonstrate how both conceive (...)

What can we still learn from the Rawls-Habermas debate? A paradigm of political philosophy for liberal democracies.Nunzio Alì - 2022 - Voluntas: Revista Internacional de Filosofia 13 (1):e04.
This article argues about John Rawls' paradigm shift in contemporary political philosophy. In the article, this paradigm is defined as democratic insofar it claims, among other things, to leave enough room for democratic deliberations and citizens’ political autonomy. On this specific issue, Rawls and Habermas dialogue is still particularly fruitful. Both authors believe that contemporary political philosophy must be modest in some relevant theoretical and methodological aspects but they disagree on which of these aspects should be more or less (...)

  17. Procedural justice?: Implications of the Rawls-Habermas debate for discourse ethics.Cristina Lafont - 2003 - Philosophy and Social Criticism 29 (2):163-181.
In this paper I focus on the discussion between Rawls and Habermas on procedural justice. I use Rawls’s distinction between pure, perfect, and imperfect procedural justice to distinguish three possible readings of discourse ethics. Then I argue, against Habermas’s own recent claims, that only an interpretation of discourse ethics as imperfect procedural justice can make compatible its professed cognitivism with its proceduralism. Thus discourse ethics cannot be understood as a purely procedural account of the notion of justice. Finally (...)

Habermas and Rawls: Disputing the Political.James Gordon Finlayson & Fabian Freyenhagen (eds.) - 2010 - New York: Routledge.
Habermas and Rawls are two heavyweights of social and political philosophy, and they are undoubtedly the two most written about authors in this field. However, there has not been much informed and interesting work on the points of intersection between their projects, partly because their work comes from different traditions—roughly the European tradition of social and political theory and the Anglo-American analytic tradition of political philosophy. In this volume, contributors re-examine the Habermas-Rawls dispute with an eye toward the (...)

In this book, James Gordon Finlayson examines the Habermas-Rawls debate in context and considers its wider implications. He traces their dispute from its inception in their earliest works to the 1995 exchange and its aftermath, as well as its legacy in contemporary debates. Finlayson discusses Rawls’s Political Liberalism and Habermas’s Between Facts and Norms, considering them as the essential background to the dispute and using them to lay out their different conceptions of justice, politics, democratic legitimacy, individual rights, (...)

The so-called debate between Jürgen Habermas and John Rawls concentrated mainly on the latter’s political liberalism. It dealt with the many aspects of Rawls’s philosophical project. In this article, I focus only on one of them, namely the epistemic or cognitivistic nature of principles of justice. The first part provides an overview of the debate, while the second part aims to show that Habermas has not misinterpreted Rawls’s position. I argue that Habermas rightly considers Rawls’s conception of (...)

This paper discusses some of the proposals raised within the contemporary debate about normative models for a new international order. In the first part, the argumentative strategies of political realism, of John Rawls’ liberalism and of Jürgen Habermas’ deliberative model are presented. These authors’ objections to the cosmopolitan idea of a transformation in the international order based on the demands for global economic justice are debated. In the last part, the text shows that the proposal f global justice presented (...)

Rawls and Habermas on religion in the public sphere.Melissa Yates - 2007 - Philosophy and Social Criticism 33 (7):880-891.
In recent essays, Jürgen Habermas endorses an account of political liberalism much like John Rawls'. Like Rawls, he argues that laws and public policies should be justified only in neutral terms, i.e. in terms of reasons that people holding conflicting world-views could accept. Habermas also, much like Rawls, distinguishes reasonable religious citizens, whose views should be included in public discourse, from unreasonable citizens in his expectation that religious citizens self-modernize. But in sharing these Rawlsian features, Habermas is (...)

Habermas on Rawls and the normative foundations of democracy.Krzysztof Kędziora - 2021 - European Journal of Social Theory 24 (4):545-561.
The debate between Jürgen Habermas and John Rawls concerns the question of how to do political philosophy under conditions of cultural pluralism, if the aim of political philosophy is to uncover the normative foundation of a modern liberal democracy. Rawls’s political liberalism tries to bypass the problem of pluralism, using the intellectual device of the veil of ignorance, and yet paradoxically at the same time it treats it as something given and as an arbiter of justification within the political (...)

This article re-examines the Habermas–Rawls debate. It contends that what is at issue in this dispute has largely been missed. The standard view that principle and the original position form a useful point of comparison between their respective theories and that the dispute between them can be fruitfully understood on this basis is rejected. I show how this view has arisen and why it is wrong. The real issue between them lies in their respective accounts of the justification of (...)

This dissertation engages the following question: how, in the absence of an uncontroversial source of moral guidance, can liberals make political and moral claims across cultural divides? While committed to toleration, liberals cannot escape the compulsion to apply basic standards of equal individual human rights and liberties universally. Under postmetaphysical conditions, however, they no longer find credible arguments that assure them of the sources of these standards in "natural law," "human nature," or "practical reason." Aware that individual rights have their (...)
