Bentham identified the public good with the maximization of happiness, and believed that many traditional practices were inimical to the production of happiness. So in the name of maximizing the public good, Bentham advocated, for example, extending the franchise, reforming the criminal code and re-designing prisons. The conceptions of wit and irony of the early Friedrich Schlegel together constitute a philosophically ambitious form of early-romantic dialectic. This dialectic was directed especially against the closed philosophical system of Fichte, and tries to show a third way between the abandonment of a system and a closed system. The result is an open system, which can accommodate historical change and an infinite approach to the absolute. The article discusses the origin of this third way in romantic irony, and Schlegel’s (...) critique of Fichte, as well as the role poetry and the fragment as a form of philosophical discourse plays for Schlegel’s dialectic. Minimal pluralism is uncontroversial because all known moral theories are minimally pluralistic. Extreme pluralism is defective in the ways that Callicott alleges and, moreover, is inconsistent with integrity in the moral life. However, moderate pluralism of the sort that (...) I advance in Environmental Justice is distinct from extreme pluralism and free of its defects. In their jointly written book, From Chance to Choice: Genetics and Justice, Allen Buchanan, Dan Brock, Norman Daniels and Daniel Wikler defend ’the development and deployment of genetic intervention technologies?.?.?.’, including genetic enhancements, against charges that they exacerbate injustice. The present paper examines some of their arguments. The first section shows that the authors confuse real societies with just societies. The second shows that without this confusion, their arguments reveal the enormous justice-impairing potential of deploying genetic enhancements in such societies (...) as the United States. (shrink)

I find worth and deficiencies in both sides. On the one hand, I support the pragmatic approach, illustrating its use in an argument for sustainable agriculture. On the other hand, I take issue with Norton’s claim that pragmatists should confine themselves to anthrpocentric arguments. Here I agree with Callicott’s inclusion of nonanthropocentric consideration. However, I reject Callicott’s moral (...) monism. Hay diferentes maneras de definir la paradoja, pero aquí nos centramos en las cualidades literarias, retóricas y filosóficas que ofrece el tipo o tipos de paradoja utilizados, de (...) forma magistral, por el escritor inglés G.K. Chesterton. De las funciones de las paradojas (desde esta perspectiva, pero no solamente) son especialmente útiles para el análisis jurídico: criticar el sistema de pensamiento y abrir a la realidad. La primera se relaciona con el Derecho porque este siempre está bajo la amenaza del formalismo. La segunda se relaciona con él porque el Derecho es un fenómeno humano, de forma que, cuando hablamos de Derecho, estamos analizando la realidad compleja de la persona humana. Esta nos e puede reducir a una sola de sus dimensiones, y por ello es necesaria la paradoja, para equilibrar los distintos enfoques del análisis. This paper is addressed primarily to those who believe that we have moral obligations toward people of the distant future, and who consider these obligations to affect the range of energy policies which we are morally entitled to pursue. l examine utilitarian, contractarian, and formalist ethical theories to determine which provide adequate ethical (...) bases for this moral conviction. I argue that utilitarian theories lead to bizarre prescriptions concerning energy policies that affect people of the distant future. Contractarian theories, on one interpretation, fail to support any moral concern at all for such people and, on another, exclude some relevant dimensions of moral concern, i.e., beneficence, and provide policy planners with inadequate guidance in the face of moral dilemmas. Only formalism, for example, that of W. D. Ross, supports a moral concern for people of the distant future, and yields reasonable prescriptions concerning energy policies that affect such people. In the West, humans tend to separate themselves from nature, valuing nature only as a means of meeting their own needs and happiness. This domination of nature often fosters human oppression instead of freedom and progress, as those who ignore abuses of nature tend to disregard human injustice as well. Peter S. Wenz argues that this oppression involves such destructive forces as sexism, ethnic strife, and political repression, including repression of the nuclear power industry's victims. Catastrophes like the Holocaust (...) and the Gulf War are the result. In contrast to the destructive "separate from nature" attitude, Wenz looks to various indigenous peoples as an example of societies where human beings revere nature for itself--societies where human beings flourish as individuals, in families, and in communities. Unlike societies dependent on commerce and industry, many indigenous peoples consider themselves part of a circle of life, reaping benefits far greater than the technological advances of the West. Wenz considers how to adopt the perspective of some indigenous cultures and how to make it work in our fast-food world. Midcentury America was governed from the center, a bipartisan consensus of politicians and public opinion that supported government spending on education, the construction of a vast network of interstate highways, healthcare for senior citizens, and environmental protection. These projects were paid for by a steeply progressive tax code, with a top tax rate at one point during the Republican Eisenhower administration of 91 percent. Today, a similar agenda of government action would be portrayed as dangerously left wing. At the same (...) time, radically anti-government and anti-tax opinions are considered part of the mainstream. In _Take Back the Center_, Peter Wenz makes the case for a sane, reality-based politics that reclaims the center for progressive policies. The key, he argues, is taxing the wealthy at higher rates. The tax rate for the wealthiest Americans has declined from the mid-twentieth-century high of 91 percent to a twenty-first-century low of 36 percent--even as social programs are gutted and the gap betweeen rich and poor widens dramatically. Ever since Ronald Reagan famously declared that government was the problem and not the solution, conservatives have had an all-purpose answer to any question: smaller government and lower taxes. Wenz offers an impassioned counterargument. He explains the justice of raising the top tax rates significantly, making a case for less income inequality, and he offers suggestions for how to spend the increased tax revenues: K-12 education, tuition relief, transportation and energy infrastructure, and universal health care. George Orwell wrote to Roger Senhouse upon completion of 1984 that the work was designed in part “to indicate by parodying them the intellectual implications of totalitarianism.” The implications for social and political philosophy have furnished a generation of readers with frightening realizations. I will attempt in what follows to show that the implications for epistemology and metaphysics are equally central to the book’s message, and equally discomfitting to philosophers in the Anglo-American tradition. The book connects totalitarianism with the entire (...) British empiricist tradition from George Berkeley to A. J. Ayer, primarily by disclosing the totalitarian implications of Berkeley’s philosophy. The result is a vision of empiricism as the intellectual foundation for totalitarianism. (shrink)
