O presente trabalho tem o propósito de, no contexto dos Objetivos de Desenvolvimento Sustentável da Agenda 2030, estabelecidos pela Organização das Nações Unidas, refletir sobre a construção de sociedades inclusivas, equitativas e justas. Nesses termos, propusemo-nos a discutir a questão da interferência estatal nas relações econômicas como fomentadora de inserção social de grupos vulneráveis. Por meio de pesquisa bibliográfica e de dados secundários, investigamos os possíveis efeitos da Lei nº 14.133/2021, que trata da possibilidade de o edital de licitação pública (...) exigir que percentual mínimo da mão de obra responsável pela execução do objeto da contratação seja constituído por oriundos ou egressos do sistema prisional (BRASIL, 2021). Ao investigar o potencial de contratação da Administração Pública para mitigar a vulnerabilidade social no que se refere ao desemprego, identificamos que o município analisado tem grande potencial de empregabilidade por meio dos contratos públicos, visto que desenvolve diversas atividades utilizando-se de mão-de-obra da iniciativa privada. Apesar disso, o município ainda não regulamentou o instituto de inclusão previsto na Lei nº 14.133/2021 e conta com um sistema prisional deficitário que, além de não fomentar a reinserção social do egresso, não proporciona condições de encarceramento dentro dos parâmetros constitucionais. Este estudo se dispõe a reflexão sobre a relação entre o Direito Tributário e a proteção ambiental, pela análise das normas regulatórias tributárias, atuando como agente desestimulador de condutas degradantes ao meio ambiente. Normas tributárias podem ser utilizadas como instrumentos estimuladores do desenvolvimento sustentável e desestimuladores de condutas degradantes ambientais. A Constituição Federal estabeleceu as premissas do desenvolvimento econômico. A empresa deve atender a critérios, como desenvolver-se promovendo redução de desigualdades sociais, atendendo às relações de consumo e preservação ambiental. The paper studies the contribution of Joaquim de Carvalho, a teacher at the University of Coimbra in the first half of last century, to the phenomenological movement in Portugal. Its importance is not restricted to the introduction he had prepared for the Portuguese translation of The Philosophy of rigor as science. He used the lessons of Edmund Husserl to build a critique of Hegelian and positivist conceptions in his work History of Philosophy. It also draws on phenomenology to treat (...) problems such as homesickness. All these aspects of the project as publisher of phenomenology in Portugal, especially in education. (shrink)

A RESPONSABILIDADE CIVIL DO ESTADO NOS CRIMES COMETIDOS CONTRA TRANSGÊNEROS DENTRO DOS PRESÍDIOS MASCULINOS BRASILEIROS.

In semiotics, final causation can be related to the process of determination (PAPE, 1993). From Peirce’s point of view, determination is not a causal determinism, but a delimitation of a range of possibilities. One starts from objects towards interpretants, in a process mediated by the sign, in which the dynamic object works as a force that constrains interpretants to correspond to their objects. The correspondence between object and interpretant is important because it is through a generated interpretant that the object (...) of a sign can be known. Even though this process of determination coincides with the idea of final causation, there is a certain indeterminacy in it. For Peirce (EP 2:353, 1905), vagueness and generality are two types of indeterminacy. In the terms of the phenomenological categories, vagueness is an indeterminacy of the order of firstness, generality an indeterminacy of the order of thirdness, and both, to some extent, are opposed to that which is defined, which belongs to secondness. Each aspect of the sign may vary according to the three phenomenological categories. Consequently, degrees of imprecision are added to the semiotic process, which is a determination process. Peirce asserts that the perfect precision of thought is theoretically unattainable (SS 11, 1903). Every sign is vague or general at least to some degree. In this paper, we seek to perceive degrees of indetermination and causality from an analysis of the kinds of objects and interpretants proposed by Peirce in the system of 28 sign classes. (shrink)

The objective of this study is to compare the quantity of citations that retracted and nonretracted articles received in engineering based on articles indexed in the Web of Science database and published between 1945 and 2015. For data analysis, the Statistical Package for the Social Sciences was used along with the Kolmogorov–Smirnov, Mann–Whitney, Tukey–Kramer tests and descriptive statistics. The data set included 238 retracted and 236 nonretracted articles, with the retracted articles cited 2,348 times and nonretracted articles cited 2,957 times. (...) In his 1903 Syllabus, Charles S. Peirce makes a distinction between icons and iconic signs, or hypoicons, and briefly introduces a division of the latter into images, diagrams, and metaphors. Peirce scholars have tried to make better sense of those concepts by understanding iconic signs in the context of the ten classes of signs described in the same Syllabus. We will argue, however, that the three kinds of hypoicons can better be understood in the context of Peirce's sixty-six classes of (...) signs. We analyze examples of hypoicons taken from the field of information design, describing them in the framework of the sixty-six classes, and discuss the consequences of those descriptions to the debate about the order of determination of the 10 trichotomies that form those classes. Tal aparato consistiria na própria Ciência Nova, obra viquiana que pretende conferir legitimidade ao conhecimento histórico, tão desprestigiado pela tradição cartesiana, mesmo de tempos remotos nos quais a faculdade imaginativa excedera à razão. The article explores the historicity of political subjecthood, making the case that through a process of subjectification “subjects of the king” gradually became the political subjects of the state. This in turn contributed to reconstitute the state as an abstract notion that nevertheless was real through the allegiance owed to it by its subjects. Addressing the making of subjecthood in relation to state formation helps fill an important lacuna in the literature on state formation, namely the double oversight of subjecthood. (...) Either studies of state formation have taken both territory and subjecthood—the two objects of state power—for granted, or, more recently, they have assumed that changes in subjecthood were a function of changes in territoriality. I propose to address this by inquiring into early modern subjecthood in its own right, through a historical exploration of the emergence of political subjecthood in English statutes during the Tudor period. Through gradual yet incremental changes in the relation between subject/king and subject/state, the political subject’s allegiance to the state changed and acquired a “taken-for-grantedness”—maintained and reinforced through constant legal reiteration. This article presents some results of a research on computational strategies for the visualization of sign classification structures and sign processes. The focus of this research is the various classifications of signs described by Peirce. Two models are presented. One of them concerns specifically the 10-fold classification as described in the 1903 Syllabus (MS 540, EP 2: 289–299), while the other deals with the deep structure of Peirce’s various trichotomic classifications. The first is 10cubes, an interactive 3-D model of Peirce’s (...) 10-fold classification, as described in the Syllabus. The second is 3N3, a computer program that builds equivalent diagrams for any n-trichotomic classification of signs. We are specially interested in how a graphic design methodology, associated with computer graphic resources and techniques, can contribute to the construction of interactive models that serve as tools for the investigation of C. S. Peirce’s theory of signs. (shrink)

In the passage of time from the 1960s to the 1970s, the Brazilian artist Waldemar Cordeiro developed his first works in computer art by applying the mathematical concept of “derivative function.” Around the same time, he organized and took part in exhibitions, and composed a series of essays envisaging that the use of digital resources would become an inevitable process for the future of information reception and artistic communication. A closer look at Waldemar Cordeiro's production, both artistic and theoretical, after (...) almost 50 years of his first forays into the field of art and technology, is an excellent opportunity not only to revisit his trajectory, but to rewrite the history of digital art and our conception of it, locating Brazil and Latin America as situated centrally, not peripherally, in relation to the European and North American narratives. Drawing from theorists in the field of informational esthetics as well as scholars in the field of media such as Arlindo Machado and Vilém Flusser, this article seeks to demonstrate, through the analysis of Waldemar Cordeiro's theoretical–artistic productions, the relationship between his work, the field of cybernetics, and his utopian and social vision of artistic production. Resumo: Mente é, para Peirce, um sistema de crenças que age para alcançar um determinado propósito. Não apenas Peirce atribui mente a instituições e grupos sociais, mas o desenvolvimento da mente depende da extensão dela além das mentes humanas individuais. Portanto, comunidades ou instituições sociais incorporam hábitos sociais e agem como mentes, com propósitos próprios, fixando crenças de dois tipos: crenças de importância vital e crenças teóricas, que têm relação com o conhecimento e a verdade. Redes sociais, na internet, podem (...) ser vistas como uma complexa mente social composta por indivíduos e suas mídias digitais, as quais englobam gadgets, algoritmos e plataformas. Se as redes sociais na internet atuam de forma a atingir certas crenças, de que tipo elas são? São crenças de importância vital ou crenças teóricas que conduzem ao conhecimento e à verdade? Esses dois tipos de crenças são suficientes para entender os modos de ação das redes sociais na internet? (shrink)

O texto pretende mostrar que, apesar de Deleuze dizer que a univocidade possui três grandes momentos na história da filosofia, Duns Scoto, Spinoza e Nietzsche, sua filosofia mesma constitui um momento contemporâneo nesta história. Será a idéia de plano de imanência a resposta propriamente deleuziana ao problema da oposição entre a analogia de proporção e a univocidade do ser na história da filosofia.

Michel Foucault (1926-1984) ao analisar o diálogo Apologia de Sócrates de Platão afirma que Sócrates não se vale da retórica para defender-se das acusações recebidas no tribunal ateniense. Ele não faz uso de um discurso que visa a adulação do júri pela comoção e piedade. De acordo com Foucault (2009), o filósofo faz uso da fala franca (parresía) e procura examinar as acusações recebidas em busca da verdade e da promoção da justiça. Sócrates segue o conselho de seu daímon que (...) o orienta a não preparar um discurso de defesa e pratica o exame das acusações no tribunal. Sócrates age na contramão do que até então era praticado naquele espaço, colocando-se em risco de vida e sendo, posteriormente, sentenciado a pena de morte por envenenamento. (shrink)

As cidades brasileiras contemporâneas possuem espaços que ora privilegiam a realização de negócios e ora a construção de cidadania. Para compreender como são ocupados destes modos se faz necessário analisar as cidades; desde sua definição, passando pelo contexto político e econômico, para então compreender seu aspecto social. Assim, este artigo busca compreender se e em que medida as características dos espaços públicos impactam no processo de construção de cidadania. Analisando por meio de observação flutuante dois espaços públicos que são duas (...) praças urbanas centrais, localizadas em duas cidades no mesmo contexto metropolitanos. Perpassa-se pelo debate regional com o intuito de evidenciar que os conflitos são equivalentes nas diversas escalas; contudo a demonstração do contexto da Região Metropolitana do Vale do Paraíba e Litoral Norte/SP, objetiva tornar evidente que as estruturas físicas locais, dos espaços públicos urbanos centrais não direcionam as relações sociais e suas disputas, mas são um meio e resultado dessas. Os signos e as classes dos signos estão entre os tópicos mais importantes do sistema filosófico de Charles S. Peirce. As 10, 28, e 66 classes de signos são classificações desenvolvidas especialmente a partir de 1903 e representam um grande refinamento da divisão fundamental de signos – ícone, índice, símbolo. Nossa abordagem aqui define uma estratégia de visualização das classificações dos signos, com especial atenção para as 10 e 66 classes de signos. O livro está dividido em duas partes: (i) (...) bases teóricas, (ii) diagramas para as classes de signos. Na Parte I (bases teóricas), são apresentadas introdutoriamente as noções fundamentais das categorias fenomenológicas, classes de signos, as tricotomias e diagramas, assim como implicações gerais de nossa abordagem, metodologia e aplicações. Na Parte II (diagramas para as classes de signos), são apresentados e discutidos os modelos das classes, propostos por Peirce e seus comentadores, incluindo uma introdução detalhadamente documental de nossos modelos, 10cubes e 3N3, diagramas dinâmicos para as classes de signos. Pretendo debater, neste trabalho, três pressupostos que subjazem o desenvolvimento argumentativo do ensaio: I) a ideia presente no Tratado de que os homens se guiam pelos seus afetos ou, grosso modo, que a sociabilidade é permeada por paixões que se chocam, todo o tempo, com a vontade e interesse alheios (Hume também entende, como parece ter sido o caso de Maquiavel e Shaftesbury, que a sociedade, como um corpo, expressa um humor espelhado e forjado no jogo e conflito dos afetos (...) humanos); II) a compreensão de que o onflito, as disputas, o dissenso são constitutivos do mundo político, não devendo ser encarados como males a ser extirpados; III) a tese de que a estabilidade dos governos não requer a negação e supressão das disputas, mas antes se constituinum fino equilíbrio entre polos conflitantes, equilíbrio esse que é resultante de certos artifícios humanos (a saber, da invenção, instituição e controle das leis, de um sistema jurídico capaz de mediar as disputas políticas e sociais). This article presents the first results of a research on visual models for the classifications of semiotic processes. The main issue discussed is how a graphic design methodology, associated with computer graphics resources, may contribute to the construction of interactive models, that can be used as tools for the investigation of C. S. Peirce theory of signs. Two models are presented: the first is an interactive 3-D model of Peirce's 3-trichotomic classification; the second is a computer program that builds diagrams (...) for any n-trichotomic classification of signs, and facilitates the analysis and comparison of different hypothesis regarding their structures. This study assesses the retractions of scientific articles in engineering journals indexed on the Web of Science from 1945 to 2015. The data set was built based on documents containing the keywords retracted, retraction, withdrawal, or redress. We used database exploration techniques, including Structured Query Language and analysis of variance, for data analysis. We analyzed 238 retractions published by 117 journals. The most common reason for retraction was unethical research, and higher impact factors journals tended to publish more retractions. In (...) conclusion, most of the analyzed retractions were the result of unethical research and were retracted by editors. (shrink)

The aim of this article is to discuss the relations between psychology and politics that guide the action of the different political positions. The starting point will be an analysis of the proposal of the political scientist Mark Lilla to consider the "reactionary spirit" as a position structurally linked to an anti-progressivism, which allows also, by contrast, to discuss the progressive positions. This analysis is anchored in the articulation between politics and temporality, understood here as one of the elements that (...) outline a psychology of conservatism. It helps to redescribe significant features of contemporary political dilemmas, offering, for example, a distinction between the reactionary and the conservative position, as well as defining features of the worldview of the reactionary and, consequently, clues to understanding the rise of the extreme right. The aim of this paper is to discuss the presence of psychoanalysis in Adorno’s ’Philosophy of the new music’. He draws on the Benjaminian scheme of understanding Baudelaire’s poetry (understood as an elaboration of the shock experiences in life in post-industrial Revolution capitalism), but uses it in music criticism. The works of Schönberg and Stravinsky, the mostimportant composers of two schools of the so-called “new or modern music”, deals with different compositional subjects and their ways of dealing with the shocks (...) of modern life. Both Benjamin and Adorno draw on Freudian theory for the understanding of this notion of shock, in particular his theory of anxiety and trauma. The works of these composers, understood as models of trauma elaboration, offer different ways of reacting to trauma: the identification with the aggressor and resistance. Therein lie elements that help to defend the hypothesis of the centrality of the notion of suffering in Adorno’swork. (shrink)

The initial problem which motivated the writing of this thesis arose from reading of Emile by Rousseau. In this work, it was possible to detect the influence of different theoretical approaches, such as rationalism and empiricism, inspiring the development of the educational plan designed by Rousseau for his imaginary student (Emile). The very core question of the present thesis regards to whether there was a theory of knowledge pertaining to Rousseau’s philosophical thinking and, if so, how it was related to (...) his theories of education. In the set of his oeuvre, Rousseau’s affiliation to authors like Descartes, Leibniz, Locke and Malebranche, as well as Condillac, Diderot, D’Holbach and Helvétius was discovered. As the reading of the great philosophical work of Rousseau progressed, an original knowledge theory was discovered, of the kind which accepts the coexistence of opposite thoughts. Pedagogy, in the context of (the work) Emile, arose out of the miscellany of such theories and also for the intense philosophical maturing process on the core of Rousseau’s thinking. This study intended, therefore, to understand the origin and development of Rousseau’s theory of knowledge, and also to figure out how the philosopher formulated his theories on Education, especially in Emile. The object of this research, materialized through the extensive bibliography of the Swiss philosopher, was intensively read and analyzed. The methodology used was that of comparative, descriptive and critical documentary research of the mentioned authors. This research is divided into three sections: the first one intends to investigate the philosophical influence from different authors on the foundations of Rousseau’s epistemology; the second section addresses Rousseau’s theories of Education; the third and final part investigates the link between theory of knowledge and Education within Rousseau’s philosophical thought. -/- . Abstract.In recent issues of Zygon, numerous reflections have been published commenting on where the field of science‐and‐religion has been, where it presently stands, and where it should move in the future. These reflections touch on the importance of the dialogue and raise questions as to what audience the dialogue addresses and whom it should address. Some scholars see the dialogue as prospering, while others point out that much work needs to be done to make the dialogue more accessible to a (...) larger audience and more successful at tackling the provocative questions before us. Other academics view the questions themselves as needing further consideration and focus before answers to them can even be explored. In this article I provide a general overview of these essays by outlining some general categories of thought that seem to emerge from the contributors. I then present some of my own opinions concerning the future of the science‐religion field and emphasize that the dialogue, in addition to its traditional roles, must further the philosophical framework that can aid humanity in resolving the most pressing global concerns of our time. In this paper, I defend an account of how perceptual experience can bear rational relation to our empirical thought. In the first part, I elaborate two claims that are central for the justificational role of perceptual experience, namely, the claim that perception and belief share the same kind of content, and the claim that perception is independent from belief. At first sight, these claims seem not to be compatible, since the first one seems to require the truth of content conceptualism, (...) while the second one seems to require its falsity. In the second part, based on Alva Noë's actionist theory of perception, I argue in favor of a less intellectualist interpretation of the first claim, uncommitted to content conceptualism, and then I show how it can be reconciled with the second claim. Finally, I explain how perception holds rational relationships with our empirical thought through the exercise of observational concepts. These concepts link what I propose to call 'space of actions' to the logical space of reasons. (shrink)
