To obtain reliable results, some psychological experiments need to involve the deception of human subjects. This contradicts the ethical principle of autonomy and the process of informed consent that is required to ensure the subjects’ autonomy. Some solutions to this dilemma have been proposed, but all of them have drawbacks. As solution I propose a procedure that combines proxy consent and prior consent.

In this paper I will use sex by deception as a case study for highlighting some of the most tricky concepts around sexuality and moral psychology, including rape, consensual sex, sexual rights, sexual autonomy, sexual individuality, and disrespectful sex. I begin with a discussion of morally wrong sex as rooted in the breach of five sexual liberty rights that are derived from our fundamental human liberty rights: sexual self-possession, sexual autonomy, sexual individuality, sexual dignity and sexual privacy. I then argue (...) (against the standard interpretation) that experimental findings in moral psychology show that the principle of respect for persons—a principle that grounds our human liberty rights—drives our intuitive moral judgments. In light of this discussion, I examine a puzzle about sex by deception—a puzzle which at first may seem to compel us to define 'rape' strictly in terms of force rather than sexual autonomy. I proceed by presenting an argument against the view that, as a rule, sex by deception undermines consent—a position held by prominent thinkers such as Philippe Patry (2001), Onora O’Neill (2003), Rubenfeld (2012), Tom Dougherty (2013a, 2013b), Joyce M. Short (2013), and Danielle Bromwich and Joseph Millum (2013, 2018). As we will see, sex following deception to increase your chances does not always constitute rape. Lying about your age, education, job, family background, marital status, or interest in a relationship, for example, does not make your sex partner incapable of consenting, which is to say that sex by deception need not be rape. I even go so far as to say that sex with another person that is facilitated by withholding information about having a venereal disease shouldn't be classified as rape. Although sex by deception doesn't compromise consent, it nonetheless violates the principle of respect for persons, not by vitiating sexual autonomy and compromising consent, but by failing to respect other sexual rights, such as our rights to sexual dignity, individuality, and privacy. The problem of generation has been, for Kant scholars, a kind of test of Kant's successive concepts of finality. Although he deplores the absence of a naturalistic account of purposiveness (and hence of reproduction) in his pre-critical writings, in the First Critique he nevertheless presents a "reductionist" view of finality in the Transcendental Dialectic's Appendices. This finality can be used only as a language, extended to the whole of nature, but which must be filled with mechanistic explanations. Therefore, in 1781, (...) mechanism and teleology are synonymous languages. Despite the differences between its two authors, the Wolffian embryology, exposed in the Theorie der Generation (1764), and debated by Blumenbach's dissertation on Bildungstrieb, enabled Kant to resolve the philosophical problem of natural generation, and subsequently to determine what is proper to the explanation of living processes. Thus, in the Third Critique he could give another account of purposiveness, restricted to the organism, and more realistic than his former one; this philosophical reappraisal of purposiveness in embryology required the new concept of "simply reflexive judgement", and the correlated notion of "regulative principle". Thus framed, this naturalized teleology provided some answers to the Kantian problem of order and contingency after the end of classical (Leibnizian) metaphysics. (shrink)

The Pareto principle states that if the members of society express the same preference judgment between two options, this judgment is compelling for society. A building block of normative economics and social choice theory, and often borrowed by contemporary political philosophy, the principle has rarely been subjected to philosophical criticism. The paper objects to it on the ground that it indifferently applies to those cases in which the individuals agree on both their expressed preferences and their reasons for entertaining them, (...) and those cases in which they agree on their expressed preferences, while differing on their reasons. The latter are cases of "spurious unanimity", and it is normatively inappropriate, or so the paper argues, to defend unanimity preservation at the social level for them, so the Pareto principle is formulated much too broadly. The objection seems especially powerful when the principle is applied in an ex ante context of uncertainty, in which individuals can disagree on both their probabilities and utilities, and nonetheless agree on their preferences over prospects. La seconde partie detaille la situation en France, l'emergence d'une legislation sur les recherches biomedicales, les paradoxes qui persistent dans la loi et les realites nouvelles, sociologiques et scientifiques, qu'elle doit affronter. L'ouvrage montre l'urgence d'un nouveau contrat social en matiere de recherche biomedicale, articulant respect de l'autonomie, equite d'acces et protection des personnes. Et il propose des solutions. We want to highlight the strong link between learning systems such as deep learning neural networks and neutrosophy. The latter is above all a representation considering a neutral state which is at the heart of many phenomena of reality as well as mathematical and information theories. Here, we start from the recent understanding of neural networks, which considers their internal functioning and the learning that characterizes them as based on adapted representations (both of the information to be processed and of (...) the task to be performed) that are in fact optimal compressions. Compression means discriminating the similar and the different between cases by identifying representative characteristics through focusing on the most significant and rejecting of the rest. These three operations of neural processing, learning and compression owe their existence to non-linear treatments which essentially amount to distinguishing a neutral zone between two filtered zones, corresponding to the neutrosophical approach. In this article, I consider the term “environment” in various claims and models by evolutionists and ecologists. I ask whether “environment” is amenable to a philosophical explication, in the same way some key terms of evolutionary theorizing such as “fitness,” “species,” or more recently “population” have been. I will claim that it cannot. In the first section, I propose a typology of theoretical terms, according to whether they are univocal or equivocal, and whether they have been the object of formal (...) or conceptual attempts of clarification. “Environment” will appear to be in a position similar to “population,” yet almost no extant attempt has been made to make sense of its meaning and reference. In the second section, I will present several theoretical claims or issues that refer to “environment” in apparently very diverse ways, but always supposing a contrastive term, which is not always the same. The third section directly considers models in evolution and in ecology, and asks “where” in them is the environment term. The fourth section proposes that “environment” refers to a distinction between a varying and an invariant term, but shows that this does not exhaust its meaning, which requires making more conceptual differences. Then, I take on the suggestion that there might be two “environment” terms, one in ecology and one in evolution, but show that is not the case. Finally I center on the specific notion of “complex environment,” which is the object of several research programs, and propose a typology of “complex environments” across theories. (shrink)

Kripke’s theory of truth succeeded in providing a trivalent semantics for a language that contains its own truth predicate and means of self-reference; but it did so by radically restricting the expressive power of the logic. In Kripke’s analysis, the Liar (e.g. This very sentence is not true) receives the indeterminate truth value; but the logic cannot express the fact that the Liar is something other than true: in order to do so, a weak negation not* would be needed, but (...) it would also make the logic inconsistent (because the ‘Super Liar’ This very sentence is not* true could not be assigned any truth value). Taking a hint from the quantificational form of the problematic sentences (… is something other than true), we define a hierarchy of negations which each quantifies over a domain of truth values, assimilated to ordinals. The resulting logic has as many negations and truth values as there are ordinals. Unlike Kripke’s logic, it enjoys a form of expressive completeness. And although the logic is not monotonic, we show that under broad conditions we can construct a variety of fixed points; one of them emulates Kripke’s ‘least fixed point’, while another one assigns a different truth value to each Super Liar. Judgment aggregation theory, or rather, as we conceive of it here, logical aggregation theory generalizes social choice theory by having the aggregation rule bear on judgments of all kinds instead of merely preference judgments. It derives from Kornhauser and Sager’s doctrinal paradox and List and Pettit’s discursive dilemma, two problems that we distinguish emphatically here. The current theory has developed from the discursive dilemma, rather than the doctrinal paradox, and the final objective of the paper is to give the latter (...) its own theoretical development along the line of recent work by Dietrich and Mongin. However, the paper also aims at reviewing logical aggregation theory as such, and it covers impossibility theorems by Dietrich, Dietrich and List, Dokow and Holzman, List and Pettit, Mongin, Nehring and Puppe, Pauly and van Hees, providing a uniform logical framework in which they can be compared with each other. The review goes through three historical stages: the initial paradox and dilemma, the scattered early results on the independence axiom, and the so-called canonical theorem, a collective achievement that provided the theory with its specific method of analysis. The paper goes some way towards philosophical logic, first by briefly connecting the aggregative framework of judgment with the modern philosophy of judgment, and second by thoroughly discussing and axiomatizing the ‘general logic’ built in this framework. The paper analyses economic evaluations by distinguishing evaluative statements from actual value judgments. From this basis, it compares four solutions to the value neutrality problem in economics. After rebutting the strong theses about neutrality (normative economics is illegitimate) and non-neutrality (the social sciences are value-impregnated), the paper settles the case between the weak neutrality thesis (common in welfare economics) and a novel, weak non-neutrality thesis that extends the realm of normative economics more widely than the other weak thesis does.

In the tradition of quantified modal logic, it was assumed that significantly different linguistic systems underlie reference to individuals, to times and to ‘possible worlds’. Various results from recent research in formal semantics suggest that this is not so, and that there is in fact apervasive symmetrybetween the linguistic means with which we refer to these three domains. Reference to individuals, times and worlds is uniformly effected through generalized quantifiers, definite descriptions, and pronouns, and in each domain grammatical features situate (...) the reference of terms as near, far or ‘further’ from the actual or from a reported speech act. We outline various directions in which a program ofontological symmetrycould be developed, and we offer in theAppendixa symmetric fragment developed in a logic that can be seen as a compromise between an extensional and an intensional system. Stalnaker ( 1978 ) made two seminal claims about presuppositions. The most influential one was that presupposition projection is computed by a pragmatic mechanism based on a notion of ‘local context’ . Due to conceptual and technical difficulties, however, the latter notion was reinterpreted in purely semantic terms within ‘dynamic semantics’ (Heim 1983 ). The second claim was that some instances of presupposition generation should also be explained in pragmatic terms . But despite various attempts, the definition of a precise (...) ‘triggering algorithm’ has remained somewhat elusive. We discuss possible extensions of both claims. First, we offer a reconstruction of ‘local contexts’ which circumvents some of the difficulties faced by Stalnaker’s original analysis. We preserve the idea that local contexts are computed by a pragmatic mechanism that aggregates the information that follows from an incomplete sentence given the global context; but we crucially rely on a modified notion of entailment (‘R-entailment’), whose plausibility should be assessed on independent grounds. Second, we speculate that local contexts might prove necessary (though by no means sufficient) to understand how some presuppositions are triggered. In a nutshell, we suggest that a presupposition is triggered when the semantic contribution of an expression to its local context is in some sense ‘heterogeneous’. Without giving an analysis of the latter notion, we note that this architecture implies that presuppositions should be triggered on the basis of the meaning that an expression has relative to its local context (what we call its ‘local meaning’); we sketch some possible consequences of this analysis. There are two main approaches to the problem of donkey anaphora (e.g. If John owns a donkey , he beats it ). Proponents of dynamic approaches take the pronoun to be a logical variable, but they revise the semantics of quantifiers so as to allow them to bind variables that are not within their syntactic scope. Older dynamic approaches took this measure to apply solely to existential quantifiers; recent dynamic approaches have extended it to all quantifiers. By contrast, proponents of (...) E-type analyses take the pronoun to have the semantics of a definite description (with it ≈ the donkey, or the donkey that John owns ). While competing accounts make very different claims about the patterns of coindexation that are found in the syntax, these are not morphologically realized in spoken languages. But they are in sign language, namely through locus assignment and pointing. We make two main claims on the basis of ASL and LSF data. First, sign language data favor dynamic over E-type theories: in those cases in which the two approaches make conflicting predictions about possible patterns of coindexation, dynamic analyses are at an advantage. Second, among dynamic theories, sign language data favor recent ones because the very same formal mechanism is used irrespective of the indefinite or non-indefinite nature of the antecedent. Going beyond this debate, we argue that dynamic theories should allow pronouns to be bound across negative expressions, as long as the pronoun is presupposed to have a non-empty denotation. Finally, an appendix displays and explains subtle differences between overt sign language pronouns and all other pronouns in examples involving ‘disjunctive antecedents’, and suggests that counterparts of sign language loci might be found in spoken language. The paper has a twofold aim. On the one hand, it provides what appears to be the first game-theoretic modeling of Napoleon’s last campaign, which ended dramatically on 18 June 1815 at Waterloo. It is specifically concerned with the decision Napoleon made on 17 June 1815 to detach part of his army against the Prussians he had defeated, though not destroyed, on 16 June at Ligny. Military historians agree that this decision was crucial but disagree about whether it was rational. (...) Hypothesizing a zero-sum game between Napoleon and Blücher, and computing its solution, we show that it could have been a cautious strategy on the former's part to divide his army, a conclusion which runs counter to the charges of misjudgement commonly heard since Clausewitz. On the other hand, the paper addresses methodological issues. We defend its case study against the objections of irrelevance that have been raised elsewhere against “analytic narratives”, and conclude that military campaigns provide an opportunity for successful application of the formal theories of rational choice. Generalizing the argument, we finally investigate the conflict between narrative accounts – the historians' standard mode of expression – and mathematical modeling. (shrink)

Using photographs and testimonials, we will analyze details of the “miracle of the spinning sun” on October 13, 1917, at solar noon near Fatima. The phenomenon predicted ahead of time, occurred as the clouds cleared on what began as a rainy day. Various explanations have been presented but do not stand up to a comparative analysis of eyewitnesses, weather data, and photographs. This article aims to bring clarity to this event through the analysis of certified photographs and testimonies comparing them (...) to official meteorological and astronomical data. Our study confirms key points of the testimonials while focusing on objective data. The shadows and reflections reveal two soft light sources emerging from a rather dark background: one seen as a “pale sun”, and another overhead, fuzzy and as softly bright. The latter, likely being caused by a clear cloud, blurred the shadows of the weak “sun”. Strangely, the portions of clothing exposed to this “sun” dried quickly. This warm source, uncannily moonlike, was also able to cast distinct shadows on sloping surfaces and under objects. Eventually, these shadows will help us to estimate the height of the “sun” at ~30°, lower than the expected 42°. Therefore, the directly observed source could not have been the sun, and most probably not any physiological, psychological, or meteorological effect. (shrink)

Teilhard de Chardin is a fascinating character! Born in 1881 and deceased in 1955, he remains strikingly contemporary. In response to a world shattered by the atrocities of World War I, he progressively elaborates the vision of a world entirely unified through a Center beyond itself. This perception is inserted at the heart of an intellectual endeavor wherein faith and scientific pursuit call onto each other, intertwined in a dialogue of a rare fruitfulness. Books such as The Phenomenon of Man, (...) The Divine Milieu, the Writings in time of War, or The Heart of the Matter witness to his underlying insight: "true" mysticism and the thrust of science which spiritualizes the earth coincide and are in fact one. Besides introducing to the life and thought of Teilhard de Chardin, this book is an anthology of his greatest texts where he discloses for us his mystical insights. (shrink)

Several disputes about the nature of experience operate under the assumption that experiences have parts, including temporal parts. There's the widely held view, when it comes to temporal experiences, that we should follow James' exhortation that such experiences aren't mere successions of their temporal parts, but something more. And there's the question of whether it is the parts of experiences which determine whole experiences and the properties they have, or whether the determination goes instead from the whole to the parts, (...) as holists have it. But what are parts, or temporal parts, of experiences exactly—what does it mean to say that an experience is “part” of another? Are the participants in those disputes talking about the same thing—is there a univocal notion of “experiential part” available? Are there different kinds of experiential parts? And if there are, is there a systematic way of carving them out? More importantly, how should we conceive of the temporal parts of experiences, and how can we establish that experiences really do have temporal parts, against those who reject the notion? (shrink)

Kant’s analysis of the concept of natural purpose in the Critique of judgment captured several features of organisms that he argued warranted making them the objects of a special field of study, in need of a special regulative teleological principle. By showing that organisms have to be conceived as self-organizing wholes, epigenetically built according to the idea of a whole that we must presuppose, Kant accounted for three features of organisms conflated in the biological sciences of the period: adaptation, functionality (...) and conservation of forms..Kant’s unitary concept of natural purpose was subsequently split in two directions: first by Cuvier’s comparative anatomy, that would draw on the idea of adaptative functions as a regulative principle for understanding in reconstituting and classifying organisms; and then by Goethe’s and Geoffroy’s morphology, a science of the general transformations of living forms. However, such general transformations in nature, objects of an alleged ‘archaeology of nature’, were thought impossible by Kant in the §80 of the Critique of judgment. Goethe made this ‘adventure of reason’ possible by changing the sense of ‘explanation’: scientific explanation was shifted from the investigation of the mechanical processes of generation of individual organisms to the unveiling of some ideal transformations of types instantiated by those organisms. This book addresses several key issues in the biological study of death with the intent of capturing their genealogy, the assumptions and presuppositions they make, and the way that they open specific new research avenues. The book is divided into two sections: the first considers physiology and the second evolutionary biology. Huneman explains that biologists in the late 1950s put forth a research framework that evolutionarily accounts for death in terms of either an effect of the weakness of natural selection (...) or a by-product of natural selection for early reproduction. He illustrates how the biology of death is a central field and that studying it provides insight into the way that the epistemic structure of this knowledge has been constituted, persists until now, and may conflict with some traditional philosophical ideas. In the Meditations of Descartes, since metaphysics is established as a science of mind, physics can be based on it. Thus, this text evinces the pre-eminence of the science of mens over that of bodies : first of all, by turning towards itself mind knows itself as cogitatio and threrefore understands the body as being flexible, mutable, having extensity, and being changeable in diverse manners ; in short, as being its opposite. The self-asserting ego implies the consideration of the « nothing exists » hypothesis and asks for a distinction between the order of hypothesis and that of truth. (shrink)

We propose two alternatives to Xu’s axiomatization of Chellas’s STIT. The first one simplifies its presentation, and also provides an alternative axiomatization of the deliberative STIT. The second one starts from the idea that the historic necessity operator can be defined as an abbreviation of operators of agency, and can thus be eliminated from the logic of Chellas’s STIT. The second axiomatization also allows us to establish that the problem of deciding the satisfiability of a STIT formula without temporal operators (...) is NP-complete in the single-agent case, and is NEXPTIME-complete in the multiagent case, both for the deliberative and Chellas’s STIT. This paper argues that one can advocate a moral imperative to pursue enhancement technologies while at the same time rejecting the historical reality of progress and holding a pessimistic view of the future. The first half of the paper puts forth several arguments for why progress is illusory and why one has good reason to be pessimistic about the future of humanity (and posthumanity). The second half then argues that this is entirely consistent with also championing the futurological vision of (...) transhumanism. The claim is that, relative to the alternatives proposed, this vision actually offers the safest route into the future, even if it also entails an increase in the probability of self-annihilation. Jean-Luc Nancy discusses his life's work with Pierre-Philippe Jandin. As Nancy looks back on his philosophical texts, he thinks anew about democracy, community, jouissance, love, Christianity, and the arts.

Thought is the primary force of humans for their survival, it consists in the use of knowledge and beliefs to determine the most appropriate action in the current situation according to a rationally inspired treatment. The usual knowledge used in practical life is based on models that are representative of reality, such as descriptions and pairs of opposites. We discuss here our thesis that these types of representations of knowledge induce restrictive effects on thought. Indeed, in particular, these two types (...) have specific characteristics that lead to binding effects on thinking such as limitation and influence. The result is a decrease in the capacity of being a rational autonomous agent harmful to one's own interests, which is characterized by deleterious behaviors: lack of reflection (resulting in), inaction, submission, imitation, being just a follower, persuasion by one's group, confusion, handing over to others... However, types of representations that are hardly more complex allow for a better consideration of one's preferences, including a type of representation that enables to move away from couples of opposites by adding neutrality, which produces a distancing from the immediacy of choices (and contrary binary alternatives) while facilitating personal appreciation. This type is in line with the mechanism for finding an optimal solution based on preferential weighting, which is one of the most widely used cognitive operations in human life. We indicate here that this type of representation is typical of neutrosophy, which is an extension of the dialectical thinking of Western philosophy. (shrink)

Fallibilists about looks deny that the relation of looking the same as is non-transitive. Regarding familiar examples of coloured patches suggesting that such a relation is non-transitive, they argue that, in fact, indiscriminable adjacent patches may well look different, despite their perceptual indiscriminability: it’s just that we cannot notice the relevant differences in the chromatic appearances of such patches. In this paper, I present an argument that fallibilism about looks requires commitment to an empirically false consequence. To succeed in deflecting (...) putative cases of non-transitivity, fallibilists would have to claim that there can’t be any perceptual limitations of any kind on human chromatic discrimination. But there are good reasons to think such limitations exist. (shrink)
