Immanuel Kant claims that transcendental idealism yields a form of realism at the empirical level. Polite silence might best describe the reception this assertion has garnered among even sympathetic interpreters. This book challenges that prejudice, offering a controversial presentation and rehabilitation of Kant's empirical realism that places his realist credentials at the centre of the account of representation he offers in the Critique of Pure Reason. This interpretation ranges over the major themes contained in the Analytic of Principles and relevant (...) portions of the Dialectic. Kant's analysis of the conditions necessary for determinate representation is shown to involve a realist understanding of the relation of mind and world. The realist character of Kant's account of empirical truth, and his commitment to the unity of nature, are defended against competing empiricist, pragmatist, and methodological readings. 1 Adaptationism is a research strategy that seeks to identify adaptations and the specific selective forces that drove their evolution in past environments. Since the mid-1970s, paleontologist Stephen J. Gould and geneticist Richard Lewontin have been critical of adaptationism, especially as applied toward understanding human behavior and cognition. Perhaps the most prominent criticism they made was that adaptationist explanations were analogous to Rudyard Kipling's Just So Stories. Since storytelling is an inherent part of science, the criticism refers to the acceptance (...) of stories without sufficient empirical evidence. In particular, Gould, Lewontin, and their colleagues argue that adaptationists often use inappropriate evidentiary standards for identifying adaptations and their functions, and that they often fail to consider alternative hypotheses to adaptation. Playing prominently in both of these criticisms are the concepts of constraint, spandrel, and exaptation. In this article we discuss the standards of evidence that could be used to identify adaptations and when and how they may be appropriately used. Moreover, building an empirical case that certain features of a trait are best explained by exaptation, spandrel, or constraint requires demonstrating that the trait's features cannot be better accounted for by adaptationist hypotheses. Thus, we argue that the testing of alternatives requires the consideration, testing, and systematic rejection of adaptationist hypotheses. Where possible, we illustrate our points with examples taken from human behavior and cognition. De Marco and colleagues claim that the standard account of invasiveness as commonly encountered ‘…does not capture all uses of the term in relation to medical interventions1 ’. This is open to challenge. Their first example is ‘non-invasive prenatal testing’. Because it involves puncturing the skin to obtain blood, De Marco et al take this as an example of how an incision or insertion is not sufficient to make an intervention invasive; here is a procedure that involves an incision, but (...) it is regarded as non-invasive. However, this ignores the context, and the term should really be understood in reference to the fetus. It is hard to believe healthcare professionals regard taking blood to measure, for example, ferritin levels as invasive but taking blood to look for fragments of fetal DNA as not. If anyone uses the term thinking it is not invasive to the mother, the solution would be to call it invasive, not redefine what is invasive. De Marco and colleagues’ second example is describing electroconvulsive therapy (ECT) as invasive. However, this is not borne out by their referenced papers. The first cited source is about non-invasive brain stimulation2 and only contains a single sentence about ECT. This sentence may suggest that their view is that ECT …. (shrink)

In their highly topical paper, Grahamet alargued that Trusted Research Environments (TREs) are not actually about trust because they reduce or remove ‘…the need for trust in the use and sharing of patient health data’. We believe this is fundamentally mistaken. TREs mitigate or remove some risks, but they do not address all public concerns. In this regard, TREs provide evidence for people to decide whether the bodies holding and using their data can be trusted. There is a classical paradox in education that also affects the epistemic virtues: the paradox inherent in the demand to develop general strategies for training persons to be free and creative individuals. This problem becomes particularly salient with respect to the epistemic virtue of creativity, the more so if we consider a radical form of creativity, namely, genius. This paper explores a historical constellation in which rigorous claims about the standards for knowledge and morality were developed, along with a highly (...) influential notion of genius: the philosophy of Kant and of immediate post‐Kantian philosophers. The paper shows how in this historical moment came together a new notion of “science,” a theory of “genius” and of virtues, and an analysis of the promises and difficulties inherent in educating a virtuous or creative individual. In this constellation of ideas, there also emerges a potentially fruitful account of how to teach intellectual creativity. (shrink)

L'état de crise générale qui règne aujourd'hui dans la société française, comme l'a révélé, entre autres, l'ampleur sans précédent de la "manif pour tous", menace aujourd'hui l'universalité même de notre modèle sociopolitique national. Depuis que les trois notions qui fondent nos "valeurs républicaines" - liberté, égalité, fraternité - ont été détournées de leur sens véritable. La "liberté", devenue illimitée, consacre un sujet dominé par son seul ego, l'"égalité" est désormais synonyme d'une abolition de toute différence, fût-elle biologique, et la "fraternité" (...) se réduit à des promiscuités imposées. D'une promesse d'élévation citoyenne passant par l'accession de tous à l'autonomie, les principes des Lumières semblent bien conduire aujourd'hui à la négation même de ce qui définit notre humanité. Comment pareille grandeur humaniste a-t-elle pu dégénérer, en moins de trois siècles, en humanitarisme hygiénique de base? The object of this paper is to throw light on the reciprocal exchanges between legal philosophy and the theory of speech acts (as developed by Austin and Searle). The first part concerns the contributions to legal philosophy made by the theory of speech acts with a view to developing new perspectives. The second part deals with the contributions of legal philosophy to speech act theory.

This study examined the historical perspectives of eleven emergent bilingual and bilingual students at two middle schools. Data analysis revealed that the participants’ perspectives on U.S. history reflected three schematic narrative templates focused on nation-building, equality, and discrimination. The participants primarily employed the (in)equality narratives when discussing aspects of U.S. history directly linked to their identities. The findings add to the extant research on student historical perspectives and use of schematic narrative templates. The findings further suggest that engaging (emergent) bilingual (...) students in examining multiple perspectives and conducting critical history inquiry can contribute to notions of culturally and linguistically responsive social studies instruction. Quite remarkably, Friedrich Wilhelm Joseph Schelling uses the notion of “drive” in analysing important cognitive achievements: An important instance of this attitude can be found in his characterizing Kant as a philosopher who operates in the basis of instincts. His key argument in adopting “drives” as key to the cognitive faculties of humans derives from the conviction that cognitive endeavours need to be open and directed towards grasping reality not in individual items, but as a totality. He arrives, in employing (...) these terms, at an understanding of science, and of cognition in general, as an open, future-directed, and dynamic process. This chapter presents an overview of Schelling’s usage of “drive”-related terms, discusses his rather detailed description of the mechanics of drives within the structure of human faculties, and draws some conclusions as to Schelling’s understanding of “science” and the dynamics of science. When French philosopher Paul Ricoeur died in 2005, he bequeathed to the world a highly regarded, widely influential body of work which established him as one of the greatest thinkers of our time. He also left behind a number of unfinished projects that are gathered here and translated into English for the first time. Living Up to Death consists of one major essay and nine fragments. Composed in 1996, the essay is the kernel of an unrealized book on the (...) subject of mortality. Likely inspired by his wife’s approaching death, it examines not one’s own passing but one’s experience of others dying. Ricoeur notes that when thinking about death the imagination is paramount, since we cannot truly experience our own passing. But those we leave behind do, and Ricoeur posits that the idea of life after death originated in the awareness of our own end posthumously resonating with our survivors. The fragments in this volume were written over the course of the last few months of Ricoeur’s life as his health failed, and they represent his very last work. They cover a range of topics, touching on biblical scholarship, the philosophy of language, and the idea of selfhood he first addressed in Oneself as Another. And while they contain numerous philosophical insights, these fragments are perhaps most significant for providing an invaluable look at Ricoeur’s mind at work. As poignant as it is perceptive, Living Up to Death is a moving testimony to Ricoeur’s willingness to confront his own mortality with serious questions, a touching insouciance, and hope for the future. Their goal is not to show the doctrine false, but to explain how it can be true. One such approach has been developed by Peter van Inwagen. After explaining what I call the duplication objection, I present van Inwagen’s proposal and show how a proponent might attempt to solve the problem of duplication. I argue that the very features of (...) the view that aid the proponent in responding to the duplication objection entails the possibility of an impossible state of affairs—that two distinct persons can at the same time be identical with the same bundle of material simples. The religiously minded materialist is caught between the horns of a dilemma. One’s view regarding human persons must be robust enough to account for personal identity over time, and so not fall to the duplication objection. Antigen presentation to CD8+ T cells by MHC class I molecules is essential for host defense against viral infections. Various mechanisms have evolved in multiple viruses to escape immune surveillance and defense to support viral proliferation in host cells. Through in vitro SARS‐CoV‐2 infection studies and analysis of COVID‐19 patient samples, we found that SARS‐CoV‐2 suppresses the induction of the MHC class I pathway by inhibiting the expression and function of NLRC5, a major transcriptional regulator of MHC class I genes. In claiming the independence of theology from science, Ernan McMullin nevertheless saw the danger of separating these disciplines on questions of mutual significance, as his accompanying article “Biology and the Theology of the Human” in this edition of Zygon shows. This paper analyzes McMullin's adoption of emergence as a qualified endorsement of a view that avoids the excesses of both dualism and materialism. I argue that McMullin's distinctive contribution is the conceptual clarification of emergence in the light of a precise (...) understanding of matter, in light of Aristotelian metaphysics and Darwinian theory. As applied to human nature, McMullin retains an Augustinian outlook that sees spirit as emergent in the human body and which posits a credible biblical hermeneutic. I indicate briefly how McMullin's perspective could be fortified by a fuller natural theology. (shrink)

The historical reconstruction of science is linked to philosophical discussions of the eighteenth century in many ways. The historiography of philosophy and the historiography of science share the conceptual problem to assemble the multitude of scientific and philosophical practices under general concepts. The historical analysis of scientific progress offers a clue by problematizing definitions of “science” and “sciences” as well as the system of sciences (...) as a whole. By analyzing these conceptual problems and the typology of historical enterprises of the eighteenth century, this paper will discuss the close interrelations which existed between philosophical and historical discourses of eighteenth‐century reflection on science. Candor stands as the keystone element in creating the foundation of trust in the Army, yet the topic is muted. Stewards of the Army Profession build trust through authentic communication -- in education, training, and modeled in application. Candor was previously included in Army Doctrine, yet nearly no mention of it currently exists in professional military education and dialogue. Through personal experiences and review of literature, two examples -- the demands placed on the Army Reserve Components and a review of (...) the Army's counseling and evaluation environment -- serve as illustrations where candor requires revitalization. Candor must be reinforced to be valued or it remains peripheral, serving as a lesson that is equally damaging to individual character as is it institutionally to the Army. (shrink)

In 1990, the Federal Trade Commission (FTC) issued a consent order to the American Institute of Certified Public Accountants (AICPA). The order decreed the AICPA to lessen its longstanding ethics code which had until then banned the receipts of commissions, referral fees and contingent fees. The FTC alleged that the AICPA banned receipt of the fees as an attempt to restrain trade (FTC, 1990).In the present study, we sought to determine if CPAs'' preference for bans on commissions, referral fees and (...) contingent fees is related to their moral reasoning whereby CPAs perceive the bans to serve as a means of resolving ethical issues. While determining this matter cannot prove whether the bans did or did not actually result in restrained trade, it can offer insight into the perceived ethical importance to CPAs of the overturned rules. Based on a random sample of AICPA members and using Rest''s Defining Issues Test (DIT) to measure moral reasoning, we did not find a CPA''s moral reasoning to be related to his/her preference for ethics rules which ban commissions, referral fees or contingent fees. However, our results did indicate that most CPAs prefer banning commissions, referral fees and contingent fees, with those CPAs holding a higher financial stake in public accounting, namely partners, favoring banning referral fees and contingent fees significantly less than CPAs with a lesser stake. Further, we noted a significant negative relationship between financial stake and moral reasoning. These results seem to suggest that self-interest among CPAs may influence their moral reasoning.Further study is needed to examine the relationship between self-interest of CPAs and their moral reasoning. If self-interest clouds moral judgments made by CPAs, capital markets are in danger. Rendering an independent audit opinion must exclude self-interest. (shrink)
