This article argues that the movement of dogs from pounds to medical laboratories played a critically important role in debates over the use of animals in science and medicine in the United States in the twentieth century, not least by drawing the scientific community into every greater engagement with bureaucratic political governance. If we are to understand the unique characteristics of the American federal legislation that emerges in the 1960s, we need to understand the long and protracted debate over the (...) use of pound animals at the local municipal and state level between antivivisectionists, humane activists, and scientific and medical researchers. We argue that the Laboratory Animal Care Act of 1966 reflects the slow evolution of a strategy that proved most successful in local conflicts, and which would characterize a “new humanitarianism”: not the regulation of experimental practices but of the care and transportation of the animals being provided to the laboratory. Our analysis is consistent with, and draws upon, scholarship which has established the productive power of public agencies and civil society on the periphery of the American state. (shrink)

Throughout the medieval period law was seen as the product of social groups and associations that formed legal orders, as Max Weber elaborates, "either constituted in its membership by such objective characteristics of birth, political, ethnic, or religious denomination, mode of life or occupation, or arose through the process of explicit fraternization." During the second half of the Middle Ages, roughly the tenth through fifteenth centuries, there were "several distinct types of law, sometimes competing, occasionally overlapping, invariably invoking different traditions, (...) jurisdictions and modes of operation." Types of law included imperial and royal edicts and statutes, canon law, unwritten customary law of tribes and localities, written Germanic law, residual Roman law, municipal statutes, the law of merchants and of guilds, and in England the common law, on the continent the Roman law of jurists after the twelfth century revival of the Justinian Code. The types of courts included various imperial and royal courts, ecclesiastical courts, manorial or seigniorial courts, village courts, municipal courts in cities, merchant courts, and guild courts. Serving as judges in these courts, respectively, were kings or their appointees, Bishops and abbots, barons or lords of the manor or their appointees, local lay leaders, leading burghers, merchants, and members of the guild. These various positions were not wholly separate-many high government officials were in religious orders, while Churches held landed estates that came with local judicial responsibilities. "Bishops, abbots and prioresses, as lords of temporal possessions, controlled manorial or honorial courts at which they sometimes, though not generally, presided in person, exercising responsibility for criminal and customary law." "The result was the existence of numerous law communities," Weber wrote, "the autonomous jurisdictions of which overlapped, the compulsory, political association being only one such autonomous jurisdiction in so far as it existed at all." Jurisdictional rules for judicial tribunals and the laws to be applied related to the persons involved and the subject matter at issue. The personality principle linked law to a person's community or association, and under feudalism property ownership came wrapped together with the right to judge those tied to the property. "Demarcation disputes between these laws and courts were numerous." Jurisdictional conflicts arose especially in relation to ecclesiastical courts, which claimed broad jurisdiction over personal status laws (marriage, divorce, inheritance) and moral crimes, as well as church property and personnel, matters which regularly overlapped with the jurisdiction of other courts. Furthermore, different bodies of law could be applicable in a given court in a given case. "It was common to find many different codes of customary law in force in the same kingdom, town or village, even in the same house, if the ninth century bishop Agobard of Lyons is to be believed when he says, 'It often happened that five mem were present or sitting together, and not one of them had the same law as another.'" In long settled areas, the personal law of communities became local customary law. People living within cities were subject to municipal statutes and customary law on certain matters (penal law, procedural), and the community law to which they were attached. (shrink)

We investigate the association between a wide range of community-level environmental, social, and governance (ESG) outcomes and the credit risk of U.S. municipal finance fixed-income securities. We develop a novel dataset of multiple ESG outcomes for U.S. counties and connect it to a 2001-2020 panel of municipal bonds issued within those counties. Overall, we find supportive evidence that collective increases in community-level ESG factors (i.e., ESG outcomes) are associated with reductions in credit risk for U.S. municipal finance (...) instruments over time. We theorize that these associations arise from variations in investor perceptions and manifested changes in fiscal health over time as a function of changing ESG outcomes. Post hoc analyses leveraging quasi-exogenous shocks to uncertainty, as well as connecting ESG outcomes to various measures of fiscal health at the county-year level, and credit ratings at the bond-year level, help validate this theory. Our research suggests that even socially agnostic investors should investigate the environmental and social performance of a municipality as part of their credit due diligence. (shrink)

At the heart of the book (...) is a discussion of the central themes of the Theological-Political Treatise, with a good deal of attention given both to Spinoza’s other writings and to other political thinkers such as Machiavelli and Hobbes, as well as to the immediate historical situation in the mid-seventeenth-century Dutch Republic. But this is more than just a commentary on a work that for a long time has largely (and unjustly) been ignored by philosophers. Smith has a full appreciation of the radical nature of the Treatise, and uses it to bring out what is peculiarly fascinating about Spinoza’s religious and political ideas.According to Smith, it was Spinoza who first made the “Jewish Question”—the problem of how the Jews, after centuries of separation and ghettoization, can be granted admission to, and even assimilation into, the modern polity—central to reflection on the “theological-political problem,” that is, the problem of the place and role of religion in the state. Smith sees Spinoza’s solution to both problems in the process of secularization. Jews must, in order to become an integrated part of modern society, shed their ancient, traditional identity; Judaism has to be transformed from “an authoritative body of revealed law into what today would be called a modern secular identity” (xiii). The allegiance of Jews must be transferred from the Law to laws, from a life of halakhic (or Jewish legal) ritual to a life focussed on nonsectarian, civil and social duties. He argues, in fact, that the Treatise represents the “first and most profound expression of the Jewish-liberal symbiosis that has survived to the present.” For the kind of polity that will make Jewish emancipation possible and foster the emergence of a modern, secular, nonparticularistic Jewish identity is the democratic, liberal state. Rabbinic Judaism, with its emphasis on law, has long served as a model for classical liberal thought.Spinoza himself is, in Smith’s eyes (although Smith is certainly not the first to suggest this) the “prototype” of the modern emancipated Jew, liberated from (and even critical of) religious tradition and authority. This paper highlights the need to apply an equity lens when assessing the impact of preemption and related legal doctrines on community health. Community autonomy to set and pursue public health priorities is an essential part of achieving health equity. Unfortunately, the priorities of organized industry interest groups often conflict with health equity goals. These groups have a history of successfully using law to limit community autonomy to pursue public health measures, most notably through preemption and related legal doctrines. (...) We examine this phenomenon using two examples. First, we look at dental association efforts to block the spread of dental therapists in Indian Country. Native dental therapists have been improving the oral health of native people in Alaska for over a decade; yet the national and state dental associations have sought with mixed success to leverage state and federal laws to hinder other tribal governments from utilizing these providers. We compare these efforts with a restaurant association-led movement to limit what municipal governments can do to address food-based health inequities, focusing on a “model” ALEC bill that started in Ohio. Finally, we discuss how municipalities and Tribes are fighting back and continuing to pursue health equity for their communities. (shrink)

The article analyzes the forms of public participation in the implementation of local self-government at various stages of municipal reform. It studies the consolidation of various forms of participation in federal laws on local self-government. The analysis of data from the annual Monitoring of the development of the local government system has been carried out, which makes it possible to assess the real prevalence of various forms of public participation. It is shown that the new Draft (...) Law on local self-government reinforces the general trend towards reducing the municipal sphere and simplifying the institutional organization of local self-government. This, in turn, leads to a reduction in the total number of forms of public participation in self-government, a reduction in their demand and a reduction in the space of deliberative democracy as a whole. At the same time, there is a reduction in both power and advisory forms of participation. (shrink)

This paper raises a challenge for those who assume that corporate social responsibility and good corporate governance naturally go hand-in-hand. The recent spate of corporate scandals in the United States and elsewhere has dramatized, once again, the severity of the agency problems that may arise between managers and shareholders. These scandals remind us that even if we adopt an extremely narrow concept of managerial responsibility – such that we recognize no social responsibility beyond the obligation to maximize shareholder value – (...) there may still be very serious difficulties associated with the effective institutionalization of this obligation. It also suggests that if we broaden managerial responsibility, in order to include extensive responsibilities to various other stakeholder groups, we may seriously exacerbate these agency problems, making it even more difficult to impose effective discipline upon managers. Hence, our central question: is a strong commitment to corporate social responsibility institutionally feasible? In searching for an answer, we revisit the history of public management, and in particular, the experience of social-democratic governments during the 1960s and 1970s, and their attempts to impose social responsibility upon the managers of nationalized industries. The results of this inquiry are less than encouraging for proponents of corporate social responsibility. In fact, the history of public-sector management presents a number of stark warnings, which we would do well to heed if we wish to reconcile robust social responsibility with effective corporate governance. This essay argues that Speech-Language Pathology emerged as a response to the early twentieth-century demand for docile, efficient, and thus productive speech. As the capacity of speech became more central to the industrial and democratic operations of modern society, an apparatus was needed to bring speech under the fold of biopower. Beyond simple economic productivity, the importance of SLP lies in opening the speaking subject up to management and normalization—creating, in short, biopolitical subjects of communication. We argue that SLP accordingly (...) emerged not as a discreet institution, but as a set of practices which can be clustered under three headings: calculating deviance, disciplining the tongue, and speaking the truth of pathologized subjects. This edited book explores the relationship between political expertise, which is defined as scientific statesmanship or governance, and political leadership throughout the history of ideas. An outstanding group of experts study and analyze the ideas of significant philosophers, such as Plato, Aristotle, Augustine, Machiavelli, Hobbes, Locke, Montesquieu, Kant, Burke, Comte, and Weber, among others. The contributors aim to interpret these thinkers' approaches to scientific statesmanship, deepening our understanding of the idea itself and decoding its theoretical complexities.

In this commentary, we respond to the editorial letter by Professor Luciano Floridi entitled “AI as a public service: Learning from Amsterdam and Helsinki.” Here, Floridi considers the positive impact of municipal AI registers, which collect a limited number of algorithmic systems used by the city of Amsterdam and Helsinki. We question a number of assumptions about AI registers as a governance model for automated systems. We start with recent attempts to normalize AI by decontextualizing and depoliticizing it, which (...) is a fraught political project that encourages what we call ‘ethics theater’ given the proven dangers of using these systems in the context of the digital welfare state. We agree with Floridi that much can be learned from these registers about the role of AI systems in municipal city management. The lessons we draw, on the basis of our extensive ethnographic engagement with digital wellfare states, are distinctly less optimistic. (shrink)

For centuries, philosophers, political scientists, and jurists have struggled to understand the possibilities for justice and peace among a multiplicity of sovereign states. Like Dante, who sought to organize the world under the authority of the Holy Roman Empire, many theorists have tried to explain how sovereign states should be governed to ensure stability and peace in the absence of any established higher authority. Theories of World Governance traces the various conceptual approaches to world harmony from the close of the (...) Middle Ages to today. Considering the immediate problems of order in a decentralized world community, Cornelius F. Murphy, Jr., outlines what he believes are the essential long-term conditions for world peace. Covering a wide range of disciplines -- from theology and philosophy to jurisprudence, ethics, and sociology -- Murphy explores how theorists have reflected upon the necessary components of an effective global order. At the outset, the thought of Christian Europe was shaped by a belief in a natural order established by the Creator of the universe. However, with the advent of the Enlightenment, the connections between the human and the transcendent were severed. There was a movement from a theocentric understanding of the powers of the human mind to an intellectual outlook that blurred the distinctions between the divine and human. This study in the history of ideas examines the profound effects of the fundamental shift from transcendence to immanence upon the development of international theory. Murphy discusses the thought of Leibniz, Wolff, Kant, Hegel, and Phillip Allott, among others. The study concludes with an extended reflection on the importanceof a sound political philosophy to the future well-being of the global community. Possible improvements in the existing arrangements, such as reform of the United Nations, are discussed. Murphy suggests that in order for a society of sovereign states to be transformed into a world political community, human rights and self-governance within states must first be strengthened and, at the same time, individuals of all states must begin to realize their responsibilities toward the whole human family. As global history continues to take shape as an important field of research, its interactive relationships with the history of science, technology, and medicine are recognized and being investigated as significant areas of concern. Strangely, despite the fact that it is key to understanding so many of the subjects that are central to global history and would itself benefit from a broader geographical perspective, the history of chemistry has largely been left out of this process – (...) particularly for the modern historical period. This article argues for the value of integrating the history of chemistry with global history, not only for understanding the past, but also for thinking about our shared present and future. Toward this end, it explores the various ways in which ‘chemistry’ has and can be defined, with special attention to discussions of ‘indigenous knowledge systems’; examines the benefits of organizing historical inquiry around the evolving sociomaterial identities of substances; considers ways in which the concepts of ‘chemical governance’ and ‘chemical expertise’ can be expanded to match the complexities of global history, especially in relation to environmental issues, climate change, and pollution; and seeks to sketch the various geographies entailed in bringing the history of chemistry together with global histories. The objective of this paper is to balance two major conceptual tendencies in science policy studies, continuity and discontinuity theory. While the latter argue for fundamental and distinct changes in science policy in the late 20th century, continuity theorists show how changes do occur but not as abrupt and fundamental as discontinuity theorists suggests. As a point of departure, we will elaborate a typology of scientific governance developed by Hagendijk and Irwin ( 2006 ) and apply it to new empirical (...) material. This makes possible a contextualization of the governance of science related to the codification of the “third assignment” of the Swedish higher education law of 1977. The law defined the relation between university science and Swedish citizens as a dissemination project, and did so despite that several earlier initiatives actually went well beyond such a narrow conceptualisation. Our material reveals continuous interactive and rival arrangements linking the state, public authorities, the universities and private industrial enterprises. We show how different but coexisting modes of governance of science existed in Sweden during the 20th century, in clear contrast with the picture promoted by discontinuity theorists. A close study of the historical development suggests that there were several periods of layered governance when interactions and dynamics associated with continuity as well as discontinuity theories were prevalent. In addition, we conclude that the typology of governance applied in the present paper is fruitful for carrying out historical analyses of the kind embarked upon in spite of certain methodological shortcomings. A wave of recent scholarship has warned about the potential for discriminatory harms of algorithmic systems, spurring an interest in algorithmic accountability and regulation. Meanwhile, parallel concerns about surveillance practices have already led to multiple successful regulatory efforts of surveillance technologies—many of which have algorithmic components. Here, we examine municipal surveillance regulation as offering lessons for algorithmic oversight. Taking the 2017 Seattle Surveillance Ordinance as our primary case study and surveying efforts across five other cities, we describe the features (...) of existing surveillance regulation; including procedures for describing surveillance technologies in detail, requirements for public engagement, and processes for establishing acceptable uses. Although the Seattle Surveillance Ordinance was not intended to address algorithmic accountability, we find these considerations to be relevant to the law’s aim of surfacing disparate impacts of systems in use. We also find that in notable cases government employees did not identify regulated algorithmic surveillance technologies as reliant on algorithmic or machine learning systems, highlighting definitional gaps that could hinder future efforts toward algorithmic regulation. We argue that finer-grained distinctions between types of information systems in the language of law and policy, and risk assessment tools integrated into their implementation would strengthen future regulatory efforts by rendering underlying algorithmic components more legible and accountable to political and community stakeholders. In Marxist circles it is common to refer to Karl Marx’s The Civil War in France for a theoretical analysis of the historical significance of the Paris Commune, and to Prosper-Olivier Lissagaray’s History of the Commune of 1871 for a description of the facts surrounding the insurrection of the Paris workers and its repression by the National Assembly led by Adolphe Thiers. What is less well-known is that Marx himself oversaw the German translation of Lissagaray’s book and made numerous (...) additions to it. In this article we describe Marx’s addenda to Lissagaray’s work, showing how they contribute to concretising his analysis of the Paris Commune and how they relate to the split in the International Working Men’s Association between Marxists and anarchists that took place after the Commune’s defeat. We also show how Marx’s additions to the German version of Lissagaray’s book were linked to his involvement with the recently created Socialist Workers’ Party of Germany and to his criticism of the programme it had adopted at the congress celebrated in the city of Gotha. Contemporary notions of what constitutes tribal self government for Indigenous Peoples in the legal systems of the nation-states Canada, New Zealand and the United States of America have their origins in philosophies and theories developed by European nation-states generally, in relation to their colonial expansion into what is now called the Americas. This thesis examines the nature of these theories, and how they have formed the basis for legal precedent and public policy in the three nation-states. A representative analysis (...) of three contemporary issues will serve to illustrate the outcome of this legal/political history. I look at three sites. These are the British Columbia Treaty Process in Canada, the Waka Umanga legislation in New Zealand, and legal developments arising from the Indian Reorganization Act in the United States. Full sovereignty from an Indigenous Peoples worldview existed for Indigenous nations, and with it, self government. The notion of self government as a viable and contemporary public policy initiative is well grounded in law and history. It would seem that current initiatives to acknowledge this inherent right are more about preserving colonial hegemony rather then engaging in honest negotiation. Current initiatives are converging into a single public policy goal; namely the corporatisation of Indigenous Peoples legal personality and self governing capacity. What used to be distinct nation-state development now seems to be a four nation-state (CANZUS) unified plan being implemented on four different fronts. Clearly, from the legal history, self government is something fundamentally different from self-management. The advent of Legal Positivism has played a significant role in assumptions that inherent sovereignty and self government never existed under European legal systems. The framework of tribal self governance must be viewed in the context of the values of the specific People to be a true expression of an Indigenous Nation exercising self government. This fundamental distinction can be traced back to the legal history. The foundational laws regarding interactions with Indigenous Peoples were developed under theories of natural law. The contemporary state practice is conducted under positivist law, with a nod toward developing human rights standards. Only through continued advocacy for the legal recognition of inherent rights will the nation-states be challenged on their self management agenda. (shrink)

Although there is a history in urban thought wherein scholars view cities as technologies, the encompassing character of such views inherently limits them. In turn, their usefulness does not efficiently support the kind of thinking that is required to deliver worthwhile outcomes that can promote social justice and human flourishing. However, narrowing the focus through examining municipalities as technologies offers possibilities that can help us achieve such goals. To maximize the utility of this endeavor, employing the structural-ethics approach provides (...) a way to assess urban technologies to achieve success. In this paper, the author explores the ideas above, revealing how they advance our thinking when it comes to remaking, planning, and building existing and future cities. All organisations must be able to answer questions from their respective constituencies. It is not an exaggeration to say that, in this respect, it is a challenge to handle the extremely broad action platform of local government administrations (municipalities). The present paper is a walk-through of questions from the citizens that are managed at Botkyrka municipality, Sweden. It is focussed on the use of an ‘intelligent’ citizen assistant.

This paper examines the institutions for participatory governance that have been created in Chile through a case study of Huechuraba, a low income municipality in the Santiago metropolitan area. The case of Huechuraba suggests that in certain contexts, the meetings that take place between government officials and grassroots organizations can become a forum for the state to colonize public space and bolster the hegemony of the status quo by establishing the parameters of citizenship.

The article examines and analyzes the state structures of Soviet Ukraine in the 20s and 30s of the twentieth century, which were responsible for the organization, support and control in the field of culture and science of the country. In line with the postmodern transformations of this chronological segment, the system of state structures and their influence on the activities of semi-independent scientific organizations have been reconstructed. In view of postmodernism as a philosophical current, the nonviolent resistance of the scientific (...) intelligentsia to proletarian culture, forced by the Soviet nomenklatura with a mass, uncompromising character, is revealed. The political processes around state structures and scientific organizations are reproduced in historical retrospect. The activity of scientific organizations of the above historical period is investigated and an attempt is made to reproduce their organizational and social network. The article proves that the evolution of modern society is due to the complex influence of a set of important trends and factors that determine the progressive development of its economic, political, social and spiritual spheres. The relevance of the study is due to modern transformation processes in a post-communist society focused on democratic, liberal European values. With the spread and development of liberal views in Ukrainian society, we are increasingly seeing the emergence of private scientific institutions, which are the prototypes of scientific organizations of the previous century. As a result, their internal activities and connections with other organizations are of great interest today, not only among scientists, but also among business representatives. This necessitates a more in-depth development of this problem, taking into account the evolution of the theory and practice of social and public administration of various forms of ownership of organizations and enterprises. Sir John Fortesque was a leading jurist in fifteenth-century England, and while his works are not rigorously philosophical or theoretical, they are a description and defense of English government at the crucial period when England was moving from medieval to modern times. One reason Fortesque’s work is so fascinating is the tension and contrast between medieval and modern ideas.
