This paper discusses the role of Law and Legal Thinking in Critical Theory with specific reference to the arguments that Michael Hardt and Antonio Negri offer in their book Commonwealth. The core idea is that Critical Theory is no less radical, but much more concrete, when it is performing not only an external, but also an internal critique of the Law. It shows that the role of the law in critical theory emerges as a problem when the latter claims that (...) ‘there is no outside’ and that ‘the legal base of the system structures our lives.’ It then discusses optimistic and pessimistic strategies to overcome the problem, and argue for a demanding strategy which consist in articulating the external and the internal critique of the law. To make this point, the paper goes back to the epistemic context in which critical attitudes are deployed (the ‘Conflict of the Faculties’), describes the four theoretical moves constitutive of the historical moment in which, at the end of the 18th Century, modern law as we know it was conceived of and founded; and sketches the key moments of the history of the internal critique of the law. It then illustrates the demanding strategy with examples taken from the field of Intellectual Property, and concludes that the Law is malleable and open enough to allow the thinking and practicing of radical alternatives from within the legal system and also that alternatives spoken in the language of the law are no less radical, but certainly, more concrete than others. Is the science of moral cognition usefully modelled on aspects of Universal Grammar? Are human beings born with an innate 'moral grammar' that causes them to analyse human action in terms of its moral structure, with just as little awareness as they analyse human speech in terms of its grammatical structure? Questions like these have been at the forefront of moral psychology ever since John Mikhail revived them in his influential work on the linguistic analogy and its implications for (...) jurisprudence and moral theory. In this seminal book, Mikhail offers a careful and sustained analysis of the moral grammar hypothesis, showing how some of John Rawls' original ideas about the linguistic analogy, together with famous thought experiments like the trolley problem, can be used to improve our understanding of moral and legal judgement. Scientists from various disciplines have begun to focus attention on the psychology and biology of human morality. One research program that has recently gained attention is universal moral grammar (UMG). UMG seeks to describe the nature and origin of moral knowledge by using concepts and models similar to those used in Chomsky's program in linguistics. This approach is thought to provide a fruitful perspective from which to investigate moral competence from computational, ontogenetic, behavioral, physiological and phylogenetic perspectives. In this article, (...) I outline a framework for UMG and describe some of the evidence that supports it. I also propose a novel computational analysis of moral intuitions and argue that future research on this topic should draw more directly on legal theory. (shrink)

The aim of the dissertation is to formulate a research program in moral cognition modeled on aspects of Universal Grammar and organized around three classic problems in moral epistemology: What constitutes moral knowledge? How is moral knowledge acquired? How is moral knowledge put to use? Drawing on the work of Rawls and Chomsky, a framework for investigating -- is proposed. The framework is defended against a range of philosophical objections and contrasted with the approach of developmentalists like Piaget and Kohlberg. (...) ;One chapter consists of an interpretation of the analogy Rawls draws in A Theory of Justice between moral theory and generative linguistics. A second chapter clarifies the empirical significance of Rawls' linguistic analogy by formulating a solution to the problem of descriptive adequacy with respect to a class of commonsense moral intuitions, including those discussed in the trolley problem literature originating in the work of Foot and Thomson. Three remaining chapters defend Rawls' linguistic analogy against some of its critics. In response to Hare's objection that Rawls' conception of moral theory is too empirical and insufficiently normative, it is argued that Hare fails to acknowledge both the centrality of the problem of empirical adequacy in the history of moral philosophy and the complexity of Rawls' approach to the problem of normative adequacy. In response to Nagel's claim that the analogy between moral theory and linguistics is false because whatever native speakers agree on is English, but whatever ordinary men agree in condemning is not necessarily wrong, it is argued that the criticism ignores both Rawls' use of the competence-performance distinction and the theory-dependence of the corresponding distinction in linguistics. In response to Dworkin's claim that Rawls' conception of moral theory is incompatible with naturalism and presupposes constructivism, it is argued that Dworkin's distinction between naturalism and constructivism represents a false antithesis; neither is an accurate interpretation of the model of moral theory Rawls describes in A Theory of Justice. The thesis concludes by situating Rawls' linguistic analogy within the context of broader debates in metaethics, democratic theory, natural law theory, and the theory of moral development. (shrink)

My primary aims in this paper are to explain what exploitation is, when it’s wrong, and what makes it wrong. I argue that exploitation is not always wrong, but that it can be, and that its wrongness cannot be fully explained with familiar moral constraints such as those against harming people, coercing them, or using them as a means, or with familiar moral obligations such as an obligation to rescue those in distress or not to take advantage of people’s vulnerabilities. The expression “linguistic Kantianism” is widely used to refer to ideas about thought and cognition being determined by language — a conception characteristic of 20th century analytic philosophy. In this article, I conduct a comparative analysis of Kant’s philosophy and views falling under the umbrella expression “linguistic Kantianism.” First, I show that “linguistic Kantianism” usually presupposes a relativistic conception that is alien to Kant’s philosophy. Second, I analyse Kant’s treatment of linguistic determinism and the place of his ideas in the (...) 18th century intellectual milieu and provide an overview of relevant contemporary literature. Third, I show that authentic Kantianism and “linguistic Kantianism” belong to two different types of transcendentalism, to which I respectively refer as the “transcendentalism of the subject” and the “transcendentalism of the medium.” The transcendentalism of the subject assigns a central role to the faculties of the cognising subject. The transcendentalism of the medium assigns the role of an “active” element neither to the external world nor to the faculties of the cognising subject, but to something in between — language, in the case of “linguistic Kantianism.” I conclude that the expression “linguistic Kantianism” can be misleading when it comes to the origins of this theory. It would be more appropriate to refer to this theory by the expression “linguistic transcendentalism,” thus avoiding an incorrect reference to Kant. (shrink)

In the mammalian central nervous system (CNS), each neuron receives signals from other neurons through numerous synapses located on its cell body and dendrites. Molecules involved in the postsynaptic signaling pathways need to be targeted to the appropriate subcellular domains at the right time during both synaptogenesis and the maintenance of synaptic functions. The presence of messenger RNAs (mRNAs) in dendrites offers a mechanism for synthesizing the appropriate molecules at the right place in response to local extracellular stimuli. In many cell types, controls on mRNA stability play an important role in the regulation of gene expression, but it is unclear to what extent this type of control operates in dendrites. Although the Bcl‐2 family members and p53 are involved in the regulation of apoptosis, the status of apoptotic machinery (eg caspases) plays a major role in determining the mode and timing of cell death. If the apoptotic machinery is lost, inhibited, or intrinsically inactivated, the “death stars”, Bcl‐2 and p53, may become irrelevant to cell death. In this light, high levels of Bcl‐2 may indicate that downstream apoptotic pathways are still functional. This explains why Bcl‐2 overexpression can be a marker (...) of chemosensitivity and favorable prognosis in certain cancers and why retention of wild‐type p53 may manifest inactivation of caspases in aggressive cancers. When is it immoral to take advantage of another person for one's own benefit? For some, such as Ruth Sample, John Roemer, and Will Kymlicka, the answer at least partly depends on whether what one takes advantage of is the fact that this person is, or has been, the victim of injustice. I argue, however, that whether person A wrongly exploits person B is wholly unrelated to whether A takes advantage of the fact that B is, or was, the victim (...) of injustice. Adequality, or παρισóτης (parisotēs) in the original Greek of Diophantus 1 , is a crucial step in Fermat’s method of finding maxima, minima, tangents, and solving other problems that a modern mathematician would solve using infinitesimal calculus. In this paper, the predicate counterparts, defined both axiomatically and semantically by means of Kripke frames, of the modal propositional logics $\textbf {GL}$, $\textbf {Grz}$, $\textbf {wGrz}$ and their extensions are considered. It is proved that the set of semantical consequences on Kripke frames of every logic between $\textbf {QwGrz}$ and $\textbf {QGL.3}$ or between $\textbf {QwGrz}$ and $\textbf {QGrz.3}$ is $\Pi ^1_1$-hard even in languages with three (sometimes, two) individual variables, two (sometimes, one) unary predicate letters, and a single (...) proposition letter. As a corollary, it is proved that infinite families of modal predicate axiomatic systems, based on the classical first-order logic and the modal propositional logics $\textbf {GL}$, $\textbf {Grz}$, $\textbf {wGrz}$ are not Kripke complete. Already in his Logical Investigations Husserl is opposing consciousness and the world and raising the question of an objective, “true” existence of the world beyond phenomenological research. This opposition becomes increasingly radical in Husserl's subsequent works, especially in his early and mature periods. For Husserl, phenomenology is not simply about “bracketing” any conditions concerning the existence or nonexistence of the world; it is also designed to carry out a kind of “deworlding” of consciousness, which allows for revealing it not as (...) a thing or a part of the world, but as a nonobjective condition for any real existence. The question of the world in itself — the world beyond its correlation with experience in the broadest sense — is one of the sore points of phenomenology and becomes especially acute in the light of modern discussions around correlationism. These discussions, in one way or another, make phenomenology come around to the classical distinction between the phenomenon and the thing-in-itself, with the help of which Kant outlines the field of ethics as a special world lying on the other side (...) of the correlation of knowledge and object constitutive for nature. Philosophy deals with the thing-in-itself in the proper, positive sense of the word, not as phenomenology (transcendental philosophy, which reveals the correlation of knowledge and reality in the world of phenomena and the futility of attempts by theoretical reason to know anything beyond phenomena), but as a critique of practical reason. The article attempts to consider the opposition of the thing-in-itself and the phenomenon in the context of the criticism that Kant’s practical philosophy is subjected to in Hegel’s The Phenomenology of Spirit and to explicate the arguments that this criticism makes available to phenomenology for rethinking the problem of Ding an sich and the ethical dimension of the epoche. The first part of the article examines the Hegelian analysis of the main contradiction contained in the Kantian opposition of duty as something that is in itself, and nature as a phenomenon (this opposition forms what Hegel calls the moral worldview): duty does not depend on nature and therefore does not need natural (phenomenal) realization in actions, but at the same time, duty is nothing but the necessity of actions and, consequently, the necessity of a phenomenon. This contradiction, as Hegel shows, leads to the disintegration of the moral worldview and, thus, turns into the sublation of the absolute separation of duty (thing in itself) and nature (phenomenon). The restitution of the difference between the moral an sich and the phenomenon within conscience — a phenomenon that arises as a result of the destruction of the moral worldview — turns into a new paradox, which demonstrates that the thing-in-itself (ethical good), since it is freed from the phenomenon, is not only unreal, but also turns into its own opposite. The paradox consists in the fact that the consciousness of duty, taken in its independence from the phenomenal realization in actions, becomes evil itself, turning to hypocrisy in the moral judgment about other people’s actions. In the second part of the article, the significance of the Hegelian critique of Kant’s practical philosophy for the phenomenological destruction of the difference between the thing-in-itself and the phenomenon and the problematization of the ethical dimension of the phenomenological method is explicated. Tracing the naive origins of this difference in the natural attitude and their transformation in Kantian philosophy, the author tries to consider the sublation of the opposition of the thing-in-itself and the phenomenon in the field of ethics as one of the possible paths to phenomenology. It is shown how the necessary relation of the supra-worldly an sich with the situational nature of its phenomenal realization in actions calls into question the possibility of a phenomenological epoche. The author also seeks to demonstrate that the problematization of the difference between the thing-in-itself and the phenomenon does not turn phenomenology into a system in the Hegelian sense. The article is devoted to the problem of the naming crisis of modern society. The sequences by which the social and cultural history of the West is ordered, represented by the evolution of economics, technology, religion, forms of capital and wealth, communications, following the technological acceleration of time, coexist with each other, compete for primacy, creating a society of atomized subjects who have ceased to understand their place in the history of society. This situation is described in the article as (...) an identity crisis. The purpose of this work is to demonstrate the gaps that have been discovered in attempts to identify society, which are the object of criticism. The article refers to the tradition of explanatory modeling of social interactions in terms of psychopathology and psychiatry. The crisis of the identity of society is illustrated through the images of madness in modern art culture. The article hypothesizes that there is an unspoken ban on naming a society associated with the crisis of capitalism in the transition from disciplinary societies to control societies. Culture's interest in insanity serves as an indicator of a social crisis. The evolution of cultural interest in the figure of a madman from a frightening "outcast" to an attractive "rebel" is shown. The article suggests the tasks of critical philosophy that coincide with the tasks of caring for social health. The idea of the need for the deprivation of mental illness is expressed. I argue against the view that there is intrinsic value in making one's own decisions about the direction and shape of one's life.

We prove that the positive fragment of first-order intuitionistic logic in the language with two individual variables and a single monadic predicate letter, without functional symbols, constants, and equality, is undecidable. This holds true regardless of whether we consider semantics with expanding or constant domains. We then generalise this result to intervals \ and \, where QKC is the logic of the weak law of the excluded middle and QBL and QFL are first-order counterparts of Visser’s basic and formal logics, (...) respectively. We also show that, for most “natural” first-order modal logics, the two-variable fragment with a single monadic predicate letter, without functional symbols, constants, and equality, is undecidable, regardless of whether we consider semantics with expanding or constant domains. Laszlo Tengelyi’s phenomenological project, as presented in his book “World and infinity. To the problem of the phenomenological metaphysics”, published posthumously, is founded on the idea of the infinity of the world. In rehabilitating the husserlian thesis of the infinity as constitutive feature of the worldly experience, Tengelyi departs from the phenomenology of the finitude, which goes back to Heidegger. The article analyzes the origins of the infinity/finitude dilemma in transcendental phenomenology of the world in Husserl, Heidegger and Tengelyi. It (...) demonstrates that the dilemma is rooted in the ambiguity of the phenomenological concept of transcendence. On the one hand, the transcendence is interpreted as the essential openness of the experience, which renders it infinite. On the other hand, the openness is constituted by horizon as the finitude of the experience. (shrink)

In his late works Husserl interprets the crisis of European sciences as the loss of their meaning for life. The diagnosis seems to suggest therapeutic strategy: to overcome the crisis, phenomenology must return to the evidences of the life-world. The article argues that the husserlian strategy of overcoming the crisis consists not in the elimination of the break with the prescientific evidences of the natural attitude, but, on the contrary, in the radicalization of the breach. Thus, I want to show (...) that Husserl seeks to overcome the crisis of sciences by means of more radical crisis of phenomenology. In Husserl’s view, phenomenology must become the only science, which does not presuppose the life-world, since it problematizes it. I am going to argue also, that the counterintuitive strategy is not just of the historico-philosophical interest, but is meaningful for the actual philosophical understanding of the life-world. To justify those claims, I will proceed in three stages. In the first section of the article, I analyze the difference between the objective world and the life-world, which is the point of departure of husserlian interpretation of the crisis of sciences in Crisis. Bringing into correlation the difference between the objective world and the life-world in Crisis with the distinction of the ideal world and the real one in Ideas I, I disclose the ambiguity of husserlian interpretation of the crisis of European sciences. According to Husserl, the crisis arises, when science transcends the life-world through the idealizations, and, at the same time, presupposes the immediate prescientific evidences as something that is taken for granted. In the second section, I argue that the strategy of overcoming the crisis in Crisis is based on the phenomenological epoche, which allows for the porblematization of the life-world without presupposing it, Within this context I demonstrate the motivational unity of two reductions, performed by Husserl in Crisis—the reduction to the life-world, stripping the reality of the garb of ideas mistakingly taken to be the reality itself, and the reduction of the life-world, turning it into horizon and depriving phenomenologist of a right of relying on the life-worldly evidences, which is taken for granted in the natural science and renders it possible. The unity of the reductions indicates that phenomenological descent back down to the life-world is treated by Husserl as the radical break with the evidences of the natural life. The third section discusses the question, whether the problematical character of the life-world can be revealed only from the point of view of disinterested spectator, or it can be discovered, in a way, from within, in pretheoretical experience, which capacitates the life to problematizing itself and motivates phenomenological epoche. I argue that, although the question is not answered in a suitable way within husserlian analyses of the motivation for the epoche, the key to the solution of the problem is provided by the genetic phenomenology, since it thematizes the historicity of the life-world. I interpret the historicity as the ambivalent pretheoretical experience, constituting both the self-evidence and the problematical character of the life-world. (shrink)

The paper proposes an idea of explicating the invariant universal structure of dialogue through the mathematics of knots and braids, which is relevant, both for the development of particular models of communication and/or dialogue, and for constructing a general theory of dialogue, or the theory of utterances. The possibility of modeling dialogue with the help of the mathematics of braids and knots—categories, entities and their attributes—is shown by use of some well-known examples such as parts of the sentence in grammar. (...) Entities and their attributes can be considered as knots, either right or false. The idea is to visualize the chains of these entities: to formalize them not to keep in mind, neither in the text, but to work with them graphically.Nodes, as final structures, and braids that generate them, allow to reveal paradigmatic anomies, conflicts, logical and ethical disagreements, etc., and vice versa: “synonimies,” mutual understanding, unanimity, in a fundamentally new format of perception and understanding of the context of genesis (braids) and results (knots) of dialogue.The visualization of verbal utterance on the basis of the knot and braid mathematics is a significant step towards formalizing the theories of dialogue, both in general theoretical and purely practical plans. The latter is analyzed by the example of the person’s inner dialogue with herself/himself in making decisions: rational and/or irrational (emotional), which allows conducting a specific work with clients of psychotherapy, coaching, management consulting, mediation, etc. (shrink)

Could a computer be programmed to make moral judgments about cases of intentional harm and unreasonable risk that match those judgments people already make intuitively? If the human moral sense is an unconscious computational mechanism of some sort, as many cognitive scientists have suggested, then the answer should be yes. So too if the search for reflective equilibrium is a sound enterprise, since achieving this state of affairs requires demarcating a set of considered judgments, stating them as explanandum sentences, and (...) formulating a set of algorithms from which they can be derived. The same is true for theories that emphasize the role of emotions or heuristics in moral cognition, since they ultimately depend on intuitive appraisals of the stimulus that accomplish essentially the same tasks. Drawing on deontic logic, action theory, moral philosophy, and the common law of tort, particularly Terry's five-variable calculus of risk, I outline a formal model of moral grammar and intuitive jurisprudence along the foregoing lines, which defines the abstract properties of the relevant mapping and demonstrates their descriptive adequacy with respect to a range of common moral intuitions, which experimental studies have suggested may be universal or nearly so. Framing effects, protected values, and implications for the neuroscience of moral intuition are also discussed. (shrink)

In this comment on Joshua Greene's essay, The Secret Joke of Kant's Soul, I argue that a notable weakness of Greene's approach to moral psychology is its neglect of computational theory. A central problem moral cognition must solve is to recognize (i.e., compute representations of) the deontic status of human acts and omissions. How do people actually do this? What is the theory which explains their practice?
