El autor pretende desentrañar a través de la interpretación jurídica el o los sistemas jurídico penal que los legisladores tomaron en consideración para crear y dar vigencia a los Códigos Penal y de Procedimientos penales vigentes en el Estado Libre y Soberano de México, que fueron tomado como ejemplo, para demostrar que la ley no solo se crea de aspectos abstractos sino también de los criterios que han emitido los juristas en su trabajo.

From a perspective focused on Law, but open to other fields, an evaluation of the influence of Cicero’s thought the analysis of his main works is attempted. No doubt, Cicero’s ideas have been crucial in the development of Western Culture, and two thousand years later his theories still remain alive.

The reflections on music are crucial in the philosophy of language and the mind of the second Wittgenstein. These reflections go around the comparisons Wittgenstein did between meaning and understanding language, and meaning and understanding music. Musical passages show a language as independent from reality, i.e. objects, events or mental states, centered instead in intonations, conclusions, parenthesis, confirmations, questions and answers, a phenomenon enough studied in musicology. Two interpretations on the signification of musical meaning are analyzed: Ahonen’s formalist view [2005], (...) based in the following of rules, and Scruton’s expressive view [2004], based on the comparison between the intuitive recognition of a mental state “hidden” behind the facial expressions. As a conclusion we arrive to a mixed argument: Either of the alternatives whether annulling the other, are possibly telling about Wittgenstein’s conception but do not elucidate the problem itself. The sublime in classical aesthetics arrived at a famous formulation with Kant as a subjective quality more elevated than beauty, linked to commotion and respect followed by reaffirmation. However, a new interpretation of the Schopenhauerian sublime is necessary in its transforming appreciation of the importance of this feeling as a psychological state, which is not yet metaphysical as usually understood, when dealing with struggling situations without resolution. Here the focus will be on a variety of the sonorous sublime in contemporary (...) music, which finds resonances with Schopenhauer’s sublime: Witold Lutoslawski’s Three Poems of Henri Michaux for mixed chorus and orchestra focuses on unpredictability and form-contrariness, “picturing” surrealist texts of uncertainty in Pensées, violence in Le Grand Combat, and resignation in Repos dans Malheur. There are two traditions of thinking about idealization offering almost opposite views on their functioning and epistemic status. While one tradition views idealizations as epistemic deficiencies, the other one highlights the epistemic benefits of idealization. Both of these, however, identify idealization with misrepresentation. In this article, we instead approach idealization from the artifactual perspective, comparing it to the distortion-to-reality accounts of idealization, and exemplifying it through the case of the Hodgkin and Huxley model of nerve impulse. From the artifactual perspective, (...) the epistemic benefits and deficiencies introduced by idealization frequently come in a package due to the way idealization draws together different resources in model construction. Accordingly, idealization tends to be holistic in that it is not often easily attributable to just some specific parts of the model. After the global economic collapse triggered by the Great Recession, there has been an increased interest in the potential psychological implications of periods of economic decline. Recent evidence suggests that negative personal experiences linked to the economic crisis may lead to diminished generalized trust (i.e., the belief that most of the people of the society are honest and can be trusted). Adding to the growing literature on the psychological consequences of the economic crisis, we propose that the perceived personal impact (...) of the economic crisis not only would undermine generalized trust but also may lead to increased interpersonal trust (i.e., directed to specific and close people) and depersonalized in-group trust (i.e., directed to individuals who, while strangers, belong to the same group [e.g., social class]). Across three studies (N = 1379), we tested these central hypotheses and ascertained whether the perceived personal impact of the crisis would predict these types of trust (assessed using questionnaire and behavioral measures) independent of individuals’ socioeconomic status. Non-experimental data from Study 1 revealed that a higher perceived personal impact of the crisis is related to lower levels of generalized trust and higher levels of interpersonal trust. These effects were independent of participants’ socioeconomic status. Non-experimental data from Study 2 replicated the findings obtained in Study 1 and also showed a positive association between the perceived personal impact of the crisis and depersonalized in-group trust. This pattern of results emerged even after controlling for socioeconomic status, gender, age, political orientation, religiosity, and unemployment status. In Study 3, using an experimental design, we found that the salience of a possible economic downturn led to decreased generalized trust and increased interpersonal and depersonalized in-group trust—independently of socioeconomic status—compared with the control condition. These results challenge the conventional wisdom that economic crises invariably undermine trust in others. Si bien tal afirmación engloba una generalidad, el problema puede permitirse un espacio de discusión más sólido, reconociendo que el progreso es, además, reflexión desde el punto de vista kantiano y deducción de la historia por parte de Fichte. Con todo ello, se busca (...) aportar contenido al afirmar que, si bien estos autores apelan a escenarios morales y teológicos para evaluar el futuro, en rigor sus intereses son los fortalecimientos del Estado de derecho para el caso fichteano y de las instituciones para Kant, lo cual resulta en una suerte de perfectibilidad humana. The research focuses on the study of public housing built in response to the urgent housing needs in Europe throughout the 20th century. These developments share many of the characteristics of their European counterparts. The Spanish case presents certain peculiarities in its development. El presente artículo tiene como objetivo analizar la ansiedad en adultos de Quito, Ecuador; la muestra estuvo conformada por 135 hombres y mujeres de 18 a 73 años quienes no han presentado un diagnóstico previo de ansiedad. Se aplicó el Inventario de Ansiedad de Beck (BAI) y se identificó que el 14% de los participantes presentan ansiedad grave, 17% moderada, 36% mínima y el 33% leve, siendo los jóvenes quienes presentan mayor nivel de ansiedad de tipo grave en comparación con (...) los adultos. En relación con la sintomatología física y emocional se considera la preocupación, miedo y dificultades del sueño. (shrink)

In philosophy of science, abstraction tends to be subsumed under representation, often being described as the omission of a target’s features when it is represented. This approach to abstraction sidesteps cognitive aspects of abstraction processes. However, cognitive aspects of abstraction are important in understanding the role of historically grounded epistemic criteria supporting modeling in science. También se reflexiona sobre la dimensión humanista de los estudios generales y la razón de ser de la educación universitaria.

Idealization is commonly understood as distortion: representing things differently than how they actually are. In this paper, we outline an alternative artifactual approach that does not make misrepresentation central for the analysis of idealization. We examine the contrast between the Hodgkin-Huxley (1952a, b, c) and the Heimburg-Jackson (2005, 2006) models of the nerve impulse from the artifactual perspective, and argue that, since the two models draw upon different epistemic resources and research programs, it is often difficult to tell which features (...) of a system the central assumptions involved are supposed to distort. Many idealizations are holistic in nature. They cannot be locally undone without dismantling the model, as they occupy a central position in the entire research program. Nor is their holistic character mainly related to the use of mathematical and statistical modeling techniques as portrayed by Rice (2018, 2019). We suggest that holistic idealizations are implicit theoretical and representational assumptions that can only be understood in relation to the conceptual and representational tools exploited in modeling and experimental practices. This article analyses the rationality of the principle of proportionality as a justificatory method for solving cases involving conflicts of constitutional principles. It addresses the “problem of comparability”: a set of arguments claiming that proportionalists fail to understand what happens when constitutional principles collide. The problem of comparability suggests that balancing cannot be done if some conflicts of constitutional principles are, in reality, cases of noncomparability, incommensurability, incomparability, or vagueness. In this article, I challenge the views of both proportionalists and (...) their skeptics. Against the skeptics, I argue that proportionality can survive the challenge posed by the problem of comparability. Against the proportionalists, I submit that proportionality cannot be understood as a system of tradeoffs between degrees of satisfaction of principles. If comparison among constitutional principles is to be rational, we need a different approach to normativity—one that allows for the possibility of parity. (shrink)

En un primer momento se contempla el tema de la Política Institucional de Género y como soporte teórico: las políticas públicas, la teoría de género, la perspectiva de género, los principios de equidad e igualdad y, la transversalización. Con este sustento (...) se crea una tabla de variables, dividida en dimensiones y preguntas para el análisis del contexto institucional, la identificación y valoración de los avances institucionales en la materia, así como las percepciones de las y los actores involucrados en las temáticas de género. Es importante que las instituciones de Educación Superior trabajen en la incorporación de estrategias, programas y acciones en perspectiva de género para el avance así una sociedad más igualitaria, justa y libre de discriminación, así como de violencia de género. The authors state that social and political processes are continuously interrelated and modify each other in a circular fashion. The economic variable seems to be the most independent and strategic one in the complex and circular causal process of contemporary history. Its importance is due to the fact that economic forces have become the means that contribute the most to the attainment of varied social and political goals.

All around the world, but especially in the Third World, we are confronted by beggars who appeal to our sympathy. Most of us have no principled way to deal with the situation. Should we give to them? How much? To what purpose? We are inclined to let our momentary feelings dictate our response. Although applied ethicists have been tackling the general question of poverty in the world and what we ought to do, if anything, to alleviate it, nobody seems to (...) have taken an interest in the specific part of the general question which involves mendicity. This paper argues, firstly, that the question of our duties, if any, towards beggars demands a reasoned answer, and secondly, that careful reasoning indicates that we should channel the resources we are ready to give to beggars not tothem directly but rather to charities, for they have more and better information on who can and should be helped. Consensual sexual relationships between faculty and students at universities are a growing issue for administrators. Often times, administrators view these relationships as potential sexual harassment cases given the power disparities that often exist between the parties involved. Therefore, many universities have written policies essentially equating CSRs to sexual harassment. Despite the recent growth of these policies, how faculty compare CSRs and sexual harassment is often overlooked, particularly as it relates to perceived power differentials. The current study examined responses from 166 (...) faculty members to explore these perceptions. Results indicate faculty had varying opinions, depending on previous experience with CSRs and beliefs around power differentials. These findings contribute to previous literature which indicates there is rampant ambiguity and subjectivity when defining and handling CSRs on campus. (shrink)

Background: The coronavirus disease 2019 pandemic is impacting the delivery of healthcare worldwide, creating dilemmas related to the duty to care. Although understanding the ethical dilemmas about the duty to care among nurses is necessary to allow effective preparation, few studies have explored these concerns. Aim: This study aimed to identify the ethical dilemmas among clinical nurses in Spain and Chile. It primarily aimed to identify nurses’ agreement with the duty to care despite high risks for themselves and/or their families, (...) describe nurses’ well-being and describe the associations between well-being and the duty to care. Research design: Cross-sectional self-reported anonymous data were collected between May and June 2020 via electronic survey distribution. Ethical considerations: The Institutional Ethical Review Committees in both countries approved the study. Findings: In total, 345 clinical nurses answered the primary question about the duty to care for the sick. Although in the total sample 77.4% agreed they have a duty to care for the sick, significant differences were found between the Spanish and Chilean samples. Overall, 53.6% of the nurses reported low levels of well-being; however, among those reporting low well-being, statistically significant differences were found between Spanish and Chilean nurses as 19.4% and 37.8%, respectively, disagreed with the statement regarding the duty to care. Discussion: Participants in both countries reported several ethical dilemmas, safety fears, consequent stress and low well-being. These results suggest that prompt actions are required to address nurses’ ethical concerns, as they might affect their willingness to work and psychological well-being. Conclusion: Our findings shed light on the ethical dilemmas nurses are facing related to the duty to care. Not only has the coronavirus disease 2019 pandemic given rise to ethical challenges, but it has also affected nurses’ well-being and willingness to work during a pandemic. (shrink)

El presente artículo de reflexión es el resultado de una investigación que tuvo un enfoque metodológico cualitativo que se expresó en dos dimensiones: uno analítico-conceptual y otro crítico-hermenéutico, y está dirigido primordialmente a examinar el problema de la obediencia moral al derecho desde los presupuestos teóricos y conceptuales de la ética normativa. Sosteniendo como tesis principal que la ética no puede equipararse a una moral aplicada, en la medida que esto implicaría confundir la ética con la moral y por el (...) contrario, el cumplimiento de las normas se da por ser lo moralmente correcto, en consecuencia, será posible concluir a través del presente trabajo que existe una obligación moral de cumplir el derecho, salvo juicios morales concretos frente a ciertas regulaciones de conductas establecidas por normas que no estén acorde a los valores críticos o morales. Abordamos dos modulaciones históricas de un proceso más amplio. Primera : se sitúa en la relación de los organismos de derechos humanos y una serie de repertorios de acción artístico-política. New mechanical philosophy posits that explanations in the life sciences involve the decomposition of a system into its entities and their respective activities and organization that are responsible for the explanandum phenomenon. This mechanistic account of explanation has proven problematic in its application to mathematical models, leading the mechanists to suggest different ways of aligning abstract models with the mechanist program. Initially, the discussion centered on whether the Hodgkin-Huxley model is explanatory. Network models provided another complication, as they apply to (...) a wide number of materially diverse systems. In this article, we examine the various attempts to integrate abstract models within the mechanist program, also presenting a further challenge: the Heimburg-Jackson model, which was introduced as an alternative to the Hodgkin-Huxley model. We argue that although the notion of abstraction as the omission of irrelevant mechanistic details appears to give a mechanistic solution for accommodating abstract models, this notion does not suit models whose epistemic strategy is not decompositional. As a result, the mechanist has to choose whether to dilute the mechanistic approach nearly beyond recognition or to claim that many, if not most, abstract theoretical models do not deliver mechanistic explanations, or qualify as explanatory at all. Clinical and Care Bioethics Committees at Public and Private Healthcare Institutions of Medium and High Complexity Levels in Cities of the Atlantic Coast of Colombia Comitês de Bioética clínico-assistencial nas instituições de saúde públicas e privadas dos níveis de média e alta complexidade das cidades da Costa Atlântica da Colômbia Care bioethics committees are interdisciplinary groups engaged in providing education to members of said committees, all the staff in the hospital —including professors and students in their internship—, and members of (...) the community. The objective of this study is to determine the situation of clinical and care bioethics committees at healthcare institutions in the Atlantic Coast of Colombia between 2010-2016. The study is cross-sectional, descriptive, and retro-prospective. Twenty-six health institutions that met the inclusion criteria were selected and administered a semi-structured survey. The statistical software SPSS version 22 was used to analyze the information. This study adhered to ethical research guidelines. The name most commonly given to committees is Hospital Ethics Committee. Only half have staff trained in ethics or bioethics and the most outstanding function is education in ethics; however, in the same percentage there are committees whose opinion is divided as their operation is unclear. Committees should follow existing ethical and bioethical models, and bills should be brought forward to help committees at healthcare institutions become more effective as regards their structure and operation. En este texto partiremos de la conocida tensión cinematográfica entre la imagen y la narración, refiriendo a un caso concreto de cine mexicano tipológico costumbrista. Es un género que se distingue por una trama débil constituida por secuencias con un importante peso mostrativo o “descriptivo”, más que narrativo y el espectador se entretiene en el reconocimiento de los estereotipos, obteniendo un goce mimético de reconocimiento. Para abordar tal reconocimiento mimético distinguiremos entre los imaginarios literarios y los imaginarios fílmicos. Los imaginarios (...) literarios son esquemas faltos de concreción. Por el contrario, los imaginarios fílmicos no son lo absoluto una cuestión de la imaginación más o menos vaga, sino que dada su base fotográfica presentan girones de la realidad tal cual es en su apariencia. Este imaginario fílmico ya no consta de imágenes de la mera imaginación, al gusto del que se las imagina, sino que consta de fragmentos fotográficos de la apariencia real, por lo que esas imágenes de calidad fotográfica tienden a generan de inmediato aprobación o rechazo. Puede ser que se lea algo que no gusta y entonces tiende a dejarse de lado, pero es más difícil dejar de lado algo que, aunque no guste no se leyó sino se vio. Para analizar el género de narrativa débil tipologizante recurrimos a la teoría de D. Bordwell sobre la construcción de la historia combinándola con la teoría de R. Barthes acera de los núcleos, catálisis, informantes e indicios narrativos. (shrink)

La ciencia moderna ha reducido el estudio de la realidad a una sola postura mostrando una tendencia reductiva de lo real solamente exclusiva al hecho contrastable de la experiencia sensible. La propuesta es mostrar una contraparte desde una perspectiva filosófica. La filosofía contemporánea, especialmente el denominado nuevo realismo ha comenzado a problematizar esta visión única de lo real. La ontología del siglo XXI permite revalorar las nociones filosóficas de ser, existencia, realidad y cuerpo. Este artículo cuestiona críticamente los resultados científicos (...) alcanzados por una explicación de la filosofía moderna sobre el cuerpo. Una reflexión inspirada en el Cur Deus Homo de San Anselmo de Canterbury, permitirá esbozar esta alternativa crítica al entendido moderno sobre el origen de la conciencia y su corporalidad. La novedad de este pensamiento queda circunscrito al entendido ontológico medieval sobre la creatio ex nihilo, explicación que no recurre por necesidad a un reducto de lo real con sus características espacio-temporales, pues el fundamento del ser viene dado por una exterioridad de un poder creador divino, que si bien, puede no ser aceptado del todo por la filosofía y ciencia contemporánea, el nuevo realismo se ha preocupado por volver a problematizar la cuestión de Dios.
