Such an absence seems ultimately fatal. Yet as this volume amply demonstrates, the richness of his social theory can be opened up by contemporary feminism.

As has been widely observed, histories of feminism have often been conceived via notions of generation where feminism is positioned as a kind of familial property, a form of inheritance and legacy which is transmitted through generations. Thus feminism and its history have been imagined as following a familial mode of social reproduction. Despite the dominance of this model, it has nonetheless been subject to critique, not least because of its reliance on teleological and progressive notions of history. Judith Roof, (...) for example, has called for new conceptualizations of temporality in an attempt to decouple histories of feminism from a generational model. This need to move away from a generational model is also underscored by what commentators such as Angela McRobbie have identified as a dispersal of feminism – a broad-scale circulation of feminist values in popular culture – as well as by the emergence of a certain kind of reflexivity whereby past and current feminist practices are increasingly subject to critique. For McRobbie such developments are understood as part of the articulation of a post-feminism in which feminism can no longer be passed on as it is positioned as having already passed away. However, in this article via an exploration of recent accounts of the passing of feminism it is suggested that what allows for a declaration of this passing is an attachment to feminism as a particular way of knowing as well as to a particular arrangement of the social. Indeed, it will be suggested that recent histories of feminism and commentaries on the state of contemporary feminism are driven not only by generational logics but also by these attachments – attachments which lose and fix both feminism and women in time. This article engages the crisis of measure currently being articulated within social and cultural theory and the associated claim that this crisis should compel an embrace of methods which seek to know the heterogeneous, the multiple, the complex and the vague. Taking the rise of immaterial forms of labour and value as paradigmatic of the crisis of measure, it questions the use of the figure of a domestically labouring woman who lacks ownership of her labour to illuminate this crisis, as (...) well as the structural equivalence currently being forced between ‘women’s work’ (especially the work of social reproduction) and productive activities. It does so with reference to the changing relationship between women and social reproduction, a changing relationship which suggests that at the heart of the crisis of measure is a restructuring of time. This article therefore adds fuel to the view that the relations of temporality are now a key ground for feminist theory. (shrink)

In recent social theory, there has been an emphasis on the emergence of non-market, non-cash nexus or what are sometimes referred to as `traditional' forms of organization in the economic sphere. These are sometimes represented as vital to innovation and as constituting the cutting edge of socioeconomic change. In this article, my concern is to interrogate these new modes of organization. Its main argument is that such traditional forms may go hand in hand with a retraditionalization of gender in terms (...) of employment. Within the social sciences the widespread impact of the social capital concept has prompted strong critique on the part of feminists, for it is a concept which appears to reinstate a version of social worlds which for the past thirty years or more feminist social scientists have sought to problematize and move beyond. Yet do these critiques go beyond the social capital paradigm? It is the contention of this article that they do not and in particular that such critiques fail (...) to problematize the association of women with collective social goods found in the social capital literature. It will be suggested further that this association relates to the use of a dualism of instrumentality versus freedom, whereby women are overwhelmingly associated with the latter. This article therefore delineates a gendered subtext operative within the social capital debates. Recognition of this subtext should lead feminists to disengage with the social capital concept, for this is a concept whose use will always trap women in the social-historical time of industrial society. What can money do? Can it be put to work to address deepening forms of social and economic inequality associated with the financial crisis, ongoing recession and still unfolding politics of austerity? Can we have faith in money as an injustice-remedying substance in a crisis-ridden and (still thoroughly) financialised reality? While the latter scenario is implied in recent feminist calls to redistribute resources to redress widening socio-economic inequalities under austerity, in this article I suggest that such a redistributive logic fails (...) to account for the shifting capacities of resources, including the capacities of money. To track these shifting capacities, I revisit the demands of the 1970s women's liberation movement and especially the assumptions at play in these demands that money both measure and distribute justice. While these assumptions were arguably politically efficacious in that moment, in the contemporary present, pervasive financialisation has involved a material transformation to the capacities of money, a transformation that, I will suggest, leaves its justice-distributing potential in doubt. This article therefore not only calls for careful exploration of the capacities of resources in analyses of crisis, recession and austerity, but also for feminist theory to rethink redistributive justice in the light of such transformations. In many Western capitalist economies, private indebtedness is pervasive, but it has received little attention from political philosophers. Economic theory emphasizes the liberating potential of debt contracts, but its picture is based on assumptions that do not always hold, especially when there is a background of structural injustice. Private debt contracts are likely to miss their liberating potential if there is deception or lack of information, if there is insufficient access to (regular forms of) credit, or if credit is overly (...) expensive. Markets for private debt can be mechanisms of structural injustice: rather than playing a neutral role, they reinforce injustices, because the failures of debt to be liberating disproportionately hit individuals in disadvantaged positions. By individualizing what are in fact structural problems, private debt can contribute to stigmatization, social exclusion and oppression. What is at stake, from a perspective of structural justice, is not only the distribution of income, but also the distribution of risk. The problems of private debt markets therefore require political attention. In addition to fighting the structural injustices that form the background condititions of private debt, it is also worth addressing private debt markets themselves. (shrink)

Increased attention paid to inter-group genetic variability following completion of the Human Genome Project has provoked debate about race as a category of classification in biomedicine and as a biological phenomenon at the level of the genome. Philosophers of science favor a metaphysical approach relying on natural kind theorizing, the underlying assumptions of which structure the questions asked. Limitations arise the more metaphysically invested and less attuned to scientific practice these questions are. Other questions—arguably, those that matter most socially and (...) politically—remain unasked, not merely overlooked but systematically ignored and even foreclosed. Race fails as a postulated natural kind because it fails to meet expectations that as a category of classification it furnish an authoritative taxonomy that by depicting fundamental divisions in nature is conducive to fulfilling far-ranging explanatory aims. Racial, ethnic, and other group designations may nonetheless be projectible insofar as they support inductive inferences in biomedicine, but this does not render them any less social. Indeed, the statistical, contingent, accidental, localized, and interest-relative bases of such inferences serve to undercut the dichotomizing of race as either biological reality or social construct and favor the adoption of a pragmatic approach. This article focuses on the new economy. While a number of recent analyses have considered how new economic arrangements rework a range of material relations, this article suggests that such considerations have tended to stop short of considering how material relations may be reconstituting vis-à-vis the people who are working in the new economy. This is so, it will be argued, because there is a pervasive assumption of what is termed a social contract model of personhood, where people are assumed (...) to own or at least to strive to accumulate skills, capacities and abilities as forms of property in the person. However, what this article underscores is that the relations between people and their labour in the new economy are being reworked. In particular, it highlights how qualities previously associated with people are being disentangled and are becoming the object of processes of qualification and re-qualification. However, such qualities do not take the form of property in the person as claims towards the ‘ownership’ of this labour lie in the domain of audience effects - that is, in relations external to the person. This shift, it is argued further, locates labour in the new economy firmly in the domain of the production and circulation of cultural value. Indeed, more broadly this article suggests that the now commonplace idea that economy and culture are de-differentiating involves a previously unrecognized restructuring of the relations between people and property and even the end of the modern notion of personhood. This article analyses a hitherto neglected problem at the transition from ideal to non‐ideal theory: the problem of knowledge. Ideal theories often make idealising assumptions about the availability of knowledge, for example knowledge of social scientific facts. This can lead to problems when this knowledge turns out not to be available at the non‐ideal level. Knowledge can be unavailable in a number of ways: in principle, for practical reasons, or because there are normative reasons not to use it. This can (...) make it necessary to revise ideal theories, because the principle of ‘ought implies can’ rules out certain theories, at least insofar as they are understood as action‐guiding. I discuss a number of examples and argue that there are two tendencies that will increase the relevance of this problem in the future: the availability of large amounts of sensitive data whose use is problematic from a normative point of view, and the increasing complexity of an interrelated world that makes it harder to predict the effects of institutional changes. To address these issues, philosophers need to cooperate with social scientists and philosophers of the social sciences. Normative theorising can then be understood as one step in a long process that includes thinkers from different disciplines. Ideal theory can respond to many of the charges raised against it if it is understood along these lines and if it takes the problem of knowledge and its implications seriously. (shrink)

Within the ethics and science literature surrounding uterus transplantation (UTx), emphasis is often placed on the extent to which UTx might improve upon, or offer additional benefits when compared to, existing ‘treatment options’ for women with absolute uterine factor infertility, such as adoption and gestational surrogacy. Within this literature UTx is often positioned as superior to surrogacy because it can deliver things that surrogacy cannot (such as the experience of gestation). Yet, in addition to claims that UTx is superior in (...) the aforementioned sense it is also often assumed (either implicitly or explicitly) that UTx is less fraught with ethical difficulties and thus should be considered a less morally problematic option. This article seeks to examine this assumption. Given that much UTx research has been performed in Sweden, a country where surrogacy is effectively although not currently explicitly forbidden, we do this through an analysis of the arguments underpinning a 2016 Swedish white paper which considered amending existing policy such that altruistic surrogacy arrangements would be permitted. By applying the white paper’s arguments for a restrictive position on altruistic surrogacy to the case of UTx using living altruistic donors we find that such arguments, if they hold in the case of surrogacy, apply similarly to UTx. We thus suggest that, for reasons of consistency, a similar stance should be taken towards the moral and legal permissibility of these two practices. (shrink)

This paper questions the prevailing historical understanding that scientific racism “retreated” in the 1950s when anthropology adopted the concepts and methods of population genetics and race was recognized to be a social construct and replaced by the concept of population. More accurately, a “populational” concept of race was substituted for a “typological one”—this is demonstrated by looking at the work of Theodosius Dobzhansky circa 1950. The potential for contemporary research in human population genetics to contribute to racism needs to be (...) considered with respect to the ability of the typological-population distinction to arbitrate boundaries between racist society and nonracist, even anti-racist, science. I point out some ethical limits of “population thinking” in doing so. (shrink)

Despite increased interest in “intuition” within cognitive psychology, the conceptual framework of this notion remains problematic. This paper argues that conceptual shortcomings stem from a tendency to ignore the philosophical heritage of intuition or to dismiss the relevance of this heritage to contemporary theory. The paper outlines major understandings of intuition within psychology and prominent philosophical traditions, highlighting important points of inconsistency in these and examining consequences of the inconsistency. It also considers psychological conceptions of intuition that more readily overlap (...) with philosophical accounts and offers some suggestions toward a more philosophically informed notion of intuition relevant to contemporary psychological theory. A survey was administered during fall 2013 to 163 self-identified adult ethical vegans and/or ethical vegetarians in the United States to determine whether the respondents+ beliefs meet the definition of religion according to U.S. federal law. The data demonstrate that a majority of the surveyed group possesses beliefs concordant with the definition of "religion" according to federal statutes, federal judicial tests, and regulatory law. Since religion is a protected characteristic in U.S. law, and ethical veganism meets various definitions for religion, (...) then ethical veganism should be recognized as a religion and a protected characteristic under U.S. law. Analysing ten interviews with women diagnosed with and treated for congenital absence of the vagina, this article theorises the notion of ideal (hetero)relational normality. It explores how women in my case study negotiate, relate to and challenge this notion and examines the normative and bodily work for which it calls. The article specifically underscores the corporeal dimension of (hetero)relational normality. I argue that this notion of normality shapes the bodies of the women through medical interventions, while concurrently being reinforced through (...) the corporeal shapings that the women undergo. These corporeal shapings consolidate enacted norms concerning heterosexuality and form understandings of female and male bodies. The analysis also reveals how these women nevertheless find ways to re-negotiate and question the notion of ideal (hetero)relational normality and its intertwinement with medical practice. The article contributes both to the critical examination of genital surgery and to feminist discussions of how to critically examine heterosexuality without rejecting it. Furthermore, it provides a deeper understanding of how medical interventions designed to create a vagina, or dilate a vagina considered ‘too small’, are made meaningful by the women affected. Zunächst werden verschiedene Formen der deskriptiven Einbettung - soziologisch, rechtlich, und institutionell - unerschieden, was zu der These führt, dass kein Markt in einem deskriptiven Sinn „uneingebettet“ ist, und dass die Frage nach Einbettung nicht alleine durch die Betrachtung von Märkten beantwortet werden kann, sondern eine breitere institutionelle Analyse erfordert. Anschließend wird vorgeschlagen, Einbettung im moralischen Sinn als die Forderung nach der Vermeidung verschiedener Formen von (...) Schädigungen zu verstehen, und diese nach dem systematischen Ort der Schädigung und anhand der Kategorien materiell versus immateriell zu kategorisieren. Anschließend werden Hindernisse für die vorgeschlagene Konzeptualisierung und deren praktische Umsetzung diskutiert, nämlich die Frage nach den relevanten Vergleichsmaßstäben und das Problem der Dynamik unbeabsichtigter Folgen, das eine entsprechende Dynamik auch in den Reaktionen auf diese Folgen nötig macht. This paper illustrates a role that bioethics should play in developing and criticizing protocols for breast cancer genetic screening. It demonstrates how a critical bioethics, using approaches and reflecting concerns of contemporary philosophy of science and science studies, may critically interrogate the normative and conceptual schemes within which ethical considerations about such screening protocols are framed. By exploring various factors that influence the development of such protocols, including politics, cultural norms, and conceptions of disease, this paper and the critical bioethics' (...) approach it endorses illuminate and critically assess some of the competing worldviews informing protocol development. One of the frequently neglected worldviews in traditional bioethics' treatment of protocols concerning breast care is constituted by women's own views of their breasts and breast cancer, both within the technologically-oriented social practice of American medicine and in light of the social construction of their breasted experience in American society. This paper attempts to redress and critically assess this neglect on the part of traditional bioethics. Finally, in contrast to traditional bioethics, critical bioethics critically interrogates its own normative and conceptual commitments. In this final capacity, a critical bioethics' approach makes a valuable contribution to the evolution of bioethics. (shrink)

Recent social and cultural theory has emphasized that in risk culture the achievement of a reflexive self-identity is a key resource, for example, in terms of employment, citizenship and intimacy. Commentators on shifts in the organization of health have also stressed the significance of achieving a self-reflexive identity. So, for example, knowing, self-monitoring subjects have emerged as optimal citizens in relation to health. While there is certainly some critical commentary on these kinds of moves, nevertheless reflexive sexual subjects in relation (...) to health have received less critical attention. In this article, through an analysis of HIV antibody testing and, in particular, by looking at the making of reflexivity through the practice of testing, I consider the emergence of a heterosexuality defined in terms of reflexivity. In so doing I suggest that reflexivity should not be understood - as many commentators suggest - as an effect but rather as constitutive of risk culture. (shrink)

In the modern Middle East, the public institutions associated with the internationally recognized states of the region are rarely viewed as trustworthy or reliable. Born in the demise of the Ottoman Empire, midwifed by European imperial powers who paid lip service to the development of the inhabitants, and nurtured in the cold war by superpowers largely indifferent to the well-being of the peoples of the region, the existing states came to be associated with expectations of welfare provision and structures of (...) accountability that privileged external actors over local interests. In the absence of public institutions that responded to and represented local interests, people organized around those still vibrant alternative forms of community that existed – the exchange networks of informal economies or the kinship systems of extended families and the ethnic and religious communities of language, sect and confession – and sometimes they reorganized and reinterpreted these identities to supplement and ultimately supplant the failing states in which they found themselves. This article examines the use of dialogues in two texts which functioned superficially as scientific handbooks for women: Aphra Behn's translation of Bernard le Bovier de Fontenelle's Entretien sur la pluralité des Mondes and Elizabeth Carter's Sir Isaac Newton's Philosophy Explained for the Use of Ladies (1739) translated from Francesco Algarotti's Il Newtoniasnismo Per le Dame (1737). Original texts exploit the female figure for the scientific cause, but at first glance, both of the original texts appeared generous to the ‘fair (...) sex’. However, neither text is as sympathetic as it initially appears. The confused gender messages emitted by these texts are further complicated by the fact that they were translated by women. (shrink)

Fordham von ReynFatuma's* doctors were completely perplexed. It was 2003 and she had returned to the DARDAR clinic in her hometown of Dar es Salaam, Tanzania three times that week with vague complaints of various pains and aches. Her doctors were considering whether these symptoms were due (...) to the initiation of her recent treatment with antiretroviral medications for her HIV infection or related to the last administration of the investigational tuberculosis (TB) vaccine that the DARDAR Health Study was evaluating. Fatuma's doctor, Dr. Lillian Mtei, consulted with Dartmouth's chief of Infectious Disease, Dr. Ford von Reyn, who happened to be in Dar that week on a site visit. Neither physician could determine the basis for her symptoms. Dr. Mtei returned to the exam room once more and this time emerged with the answer: Fatuma had just learned that her three year old daughter was HIV-infected, likely contracted from Fatuma during or shortly after she gave birth to her daughter. Fatuma believed that her HIV diagnosis was a death sentence for her daughter since antiretroviral therapy was not widely available for children.Dr. von Reyn, Dartmouth's lead clinical researcher in Africa and a father, knew too well the harsh reality of inequities in a resource-limited country. He turned to Dr. Mtei and said decidedly, "we need to do something about this."Thus the DARDAR Pediatric Program was born.Pediatric HIV: A Neglected DiseaseThe need for HIV treatment among children in Tanzania, as in most of sub-Saharan Africa, is compelling. At the end of 2009, approximately 160,000 children aged zero to fourteen in Tanzania were living with HIV (Joint United Nations Programme on HIV/AIDS [UNAIDS], 2011). Even with successful roll out of prevention of mother to child transmission programs in Tanzania, there were nearly 29,000 perinatal infections in 2009. As of December 2010, only 18% of these were enrolled in HIV treatment programs (UNAIDS, 2011; World Health Organization [WHO], 2011). Without antiretroviral therapy (ART), one-half of HIV-infected children will die before their second birthday. Since clinical research to determine efficacy and safety of new medical treatments is conducted almost exclusively in adults, provision of new medical treatments to [End Page 75] children always lags behind advances for adults. Furthermore, children are often underrepresented in programs for antiretroviral drugs for the following reasons: 1) they are not prioritized for care; 2) facilities lack infant diagnostic capabilities; 3) there is limited pediatric HIV training and consequently, a shortage of pediatric providers; and 4) pediatric antiretroviral formulations are frequently unavailable. The unacceptable delays in pediatric HIV drug development and treatment access led the international organization Drugs for Neglected Diseases initiative to publish an editorial in which they referred to pediatric HIV as a "neglected disease" (Lallemant, Chang, Cohen, & Pecoul, 2011).The Tip of the Iceberg: More than Just MedicinesWith a grant from the New York-based Foundation for the Treatment of Children with AIDS, the DARDAR Pediatric Program, a joint collaboration between Geisel School of Medicine at Dartmouth and Muhimbili University of Health and Allied Sciences, began seeing patients in May 2006. It was the first dedicated pediatric HIV Care and Treatment Center in Tanzania and operates in accordance with Tanzania's National AIDS Control Programme's guidance. Testing for both children and infants (the latter of which requires a more sophisticated assay) is available.The day the clinic opened we celebrated this collaborative effort that would provide HIV-infected children in Dar es Salaam access to antiretroviral treatment. One of our first patients was a six-year-old boy whose mother, like Fatuma, was a participant in our TB vaccine trial. She had been advised to bring her son to us for HIV screening. Her son looked healthy so she was surprised and understandably distraught when his test results indicated that not only was he HIV-infected, but his CD4 percentage was very low. Within the health care industry, the move from regulatory cost controls to market competition has generated rapid and dramatic restructuring of providers. To enhance their competitive positions in the evolving market, many health care organizations are pursuing the ownership and integration of all elements and stages of health care delivery and payment, with the goal of increasing access to capital and lowering costs through administrative efficiencies and economies of scale. The extraction of natural resources is a controversial business practice that has profound ethical and economic risk implications for both firms involved in extractive activities and society at large. In response to these implications, the Dodd–Frank Act of 2010 directed the Securities and Exchange Commission to create the first ever rules requiring annual corporate responsibility disclosures. The two proposed rules, requiring disclosure of the source of “conflict minerals” and of payments to foreign governments by extractive firms, conjured intense debate among (...) stakeholders, largely related to the risks of firms providing the information. These risks span from required disclosures increasing compliance costs for firms to non-disclosure threatening human rights. In this study, we seek to understand the way in which stakeholders perceive the risks associated with corporate responsibility disclosures. We analyze comment letters submitted to the SEC related to the two disclosure rules through the lens of Douglas’s cultural perspectives of risk. We find consistencies across the two proposed disclosures with regard to the presence of three risk perspectives within the comment letter discourse for each proposal. We find inconsistencies, however, in the underlying nature of risk perceived across the two rules, which we argue reveals an aspect of risk that incorporates ethicality and is ultimately linked to reputational considerations. We complement these insights by analyzing the market reaction to the proposed regulations. Overall, our analysis suggests that stakeholders’ perceptions of risk have consequences for how risk is perceived and acted upon in the market. (shrink)
