This dissertation develops a psychoanalytic model of ideology which accounts for the formation of sexual difference. I attempt to distinguish both the origin of sexually differentiated identity and the necessity of a political force at work in founding that origin. With Lacan, I locate the origin in the subjects's psychical accession to the Law of the Father, an accession that is linked to the individual establishment of a relation to the phallus as transcendental signifier. I advance a critique of Lacan (...) through an inquiry into the coming-to-be of the Father's Law as origin, an analysis which is shaped through readings of Althusser, Irigaray, and Derrida. My readings are an attempt to politicize the phallus, or to defend the thesis that 'the psychical is political,' through revealing the dynamics at play in establishing an origin that only ever appears as given. If subject-formation is organized and established around sexual difference through the function of the phallus, then an understanding of this ideological 'contract' reveals subjectivity and sexual difference to be intertwined in the psychic and political development of individuals, a coalition that endures through the lawful 'interpellation' of sexual identity. Conditions of emergence are also, potentially, conditions of transformation because these conditions expose the limits of any order or organization of sexual difference, the limits of its founding principle. If the limits of the phallus are disclosed, if we can reveal the energy that founds the phallus as or at the origin, then we can begin to conceptualize other founding acts. If, in other words, the law of sexual difference functions ideologically, then it is subject to vicissitudes of force. Thus origin can be reclaimed by other significations. In particular, it might be possible to conceptualize an origin that is rooted in a feminine genealogy and that doesn't require the intervention of the Father's Name. Such a genealogy would challenge the economy that maintains patriarchy, and hence its creation might make possible a feminine subjectivity. (shrink)

I show how the two great Humean ways of understanding laws of nature, projectivism and systems theory, have unwittingly reprised developments in metaethics over the past century. This demonstration helps us explain and understand trends in both literatures. It also allows work on laws to “leap- frog” over the birth of many new positions, the nomic counterparts of new theories in metaethics. However, like leap-frogging from agriculture to the internet age, it’s hardly clear that we’ve landed in a good (...) place. My reactionary advice is to return to Hume and work on the central insights that motivated Humeanism about modality in the first place. When updated with contemporary insights, there we will find an attractive naturalistic theory of laws, or so I’ll argue, and along the way we’ll see how projectivism and systems theory both get something right about this overall theory. This article examines one of the relevant concepts in the current debate on home birth—autonomy in place of birth—and its uses in general language, ethics, and childbirth health care literature. International discussion on childbirth services. A concept analysis guided by the model of Walker and Avant. The authors suggest that autonomy in the context of choosing place of birth is defined by three main attributes: information, capacity and freedom; given the antecedent of not harming others, and the (...) consequences of accountability for the outcome. Model, borderline and contrary cases of autonomy in place of birth are presented. A woman choosing place of birth is autonomous if she receives all relevant information on available choices, risks and benefits, is capable of understanding and processing the information and choosing place of birth in the absence of coercion, provided she intends no harm to others and is accountable for the outcome. The attributes of the definition can serve as a useful tool for pregnant women, midwives, and other health professionals in contemplating their moral status and discussing place of birth. (shrink)

Plato’s pronouncements about political freedom in the Laws have sparked renewed interest in the literature. The present paper takes a new angle on that vexed question. It focusses on Plato’s account of the birth of unlawful freedom, or ‘theatrocracy’, at the end of book 3. By studying the transition from moderate to excessive freedom, it wishes to shed light on what sets the two apart. The paper provides a causal analysis of the key passage, suggesting four compatible and complementary (...) explanations for the process it describes. The central problem of the article is the paradox in the history of Newton’s mechanics: prominent researchers of the genesis of the Principia did not believe Newton’s words about the origin of the idea of universal gravity. They did not believe that he could have come up with this idea as early as 1666, considering circular orbits, and believed that Newton invented the story of the falling apple. The article proposes a “subjunctive” scenario leading to the law of universal gravity (...) and feasible at the level of Galileo’s knowledge and skills in 1611. The basis for such a scenario is the description of a thought experiment in Newton’s manuscript “The System of the World”, preceding the creation of Principia. The proposed reconstruction helps to consider and clarify the concept of “modern physics”, the birth of which was the main event of the Scientific Revolution of the XVI–XVII centuries. The traditional understanding reduces the essence of modern physics to a reliance on experience and on the language of mathematics. Such a definition, however, is not sufficient. The geometry of Euclid and the physics of Archimedes were mathematically perfect, and their axioms were based on objective experience. Despite the importance of the tools of mathematics and experiment, the key innovation of modern physics has become the belief in the hidden fundamental laws of the Universe and in the right of the researcher to invent invisible, “illogical”, “absurd” concepts and postulates, experimentally verifiable only together with the theory based on them. This postulate of fundamental cognitive optimism combines bold ingenuity with a humble need for empirical verification. (shrink)

This article discusses the function, development and maintenance of meaning and the importance of meaning-making from different perspectives, as it is based on a collaboration between professionals from health science and psychology. The aim is to discuss how meaning-making processes can be employed in the health context to enhance individuals’ well-being. Starting point is a description of the common basis of the understanding of meaning-making. Afterwards brief examples from the different professional areas will show how meaning-making can improve health care (...) practice. We will focus on the processual nature of meaning-making, its existential layers, as well as the ways in which meaning-making is at play in everyday activities and limit situations, such as illness or suicidality. The social politics of women’s alcohol use is controversial given current debates over maternal-fetal health, fetal alcohol syndrome, and debates about welfare. Exploring the early twentieth century intersections of Prohibition, birth control reform, and alcohol politics reveals the historical roots of current recommendations surrounding women, alcohol, and public assistance.

This article presents results from an empirical investigation of the role and importance of ethics in the daily work of Danish oncologyphysicians and Danish molecular biologists. The study is based on 12 semi-structured interviews with three groups of respondents: a group of oncology physicians working in a clinic at a public hospital and two groups of molecular biologists conducting basic research, one group employed at a public university and the other in a private biopharmaceutical company.We found that oncology physicians consider (...) ethical evaluation as part of their daily work. They discuss how to treat patients in groups and they have interdisciplinary seminars. In contrast, molecular biologists employed at the university do not think that basic research causes significant ethical problems, they do not talk about ethics in their daily work and they do not want to prioritise seminars on ethics. Molecular biologists employed in a private biopharmaceutical company do not think that basic research causes significant ethical problems, but the private company prioritises ethical evaluation. If the company behaves unethical, they will be punished by the consumers and by the investors in the last end. In general, oncology physicians working in the clinic experience a closer relationship between their daily work and ethical problems concerning human beings than molecular biologists conducting basic research. In the epigraph, Fisher is blaming two generations of theoretical biologists, from Darwin on, for ignoring Quetelet's statistical techniques and hence harboring confusions about evolution and natural selection. He is right to imply that Darwin and his contemporaries were aware of the core of Quetelet's work. Quetelet's seminal monograph, Sur L'homme, was widely discussed in Darwin's academic circles. We know that Darwin owned a copy (Schweber 1977). More importantly, we have in Darwin's notebooks two entries referring to Quetelet's work on (...) the cause of a large-scale global phenomenon where each year more boys were born than girls. The first entry is written sometime between April and July 1838. Darwin writes "Find out from the Statistical Society—where M. Quetelet has published his laws about sexes relative to age of Marriages" (C 268, Barrett et al., 1987, p. 324). The second is written sometime after October 16, 1838: "In the Atheneum Numbers 406, 407, 409, Quetelet papers are given, & I think facts there mentioned about proportion of sexes, at birth & causes" (Ibid, p. 379). So, even if Darwin did not read Sur L'homme directly it is likely (though not certain) that he read its review in the Atheneum. There is no doubt that Darwin eventually became familiar with Quetelet's work in statistics. The smoking gun is an essay that Darwin writes in 1874, entitled, "On the Males and Complemental Males of Certain Cirripedes, and on Rudimentary Structures" where he discusses Quetelet's laws of variation. Despite advances in feminism, the "law of the father" remains the dominant model of Western psychological and cultural analysis, and the law of the mother continues to exist as an underdeveloped and marginal concept. In her radical rereading of the Greek myth, _Oresteia_, Amber Jacobs hopes to rectify the occlusion of the mother and reinforce her role as an active agent in the laws that determine and reinforce our cultural organization. According to Greek myth, Metis, Athena's mother, was Zeus's first (...) wife. Zeus swallowed Metis to prevent her from bearing children who would overthrow him. Nevertheless, Metis bore Zeus a child-Athena-who sprang forth fully formed from his head. In Aeschylus's _Oresteia_, Athena's motherless status functions as a crucial justification for absolving Orestes of the crime of matricide. In his defense of Orestes, Zeus argues that the father is more important than the mother, using Athena's "motherless" birth as an example. Conducting a close reading of critical works on Aeschylus's text, Jacobs reveals that psychoanalytic theorists have unwittingly reproduced the denial of Metis in their own critiques. This repression, which can be found in the work of Sigmund Freud and Melanie Klein as well as in the work of more contemporary theorists such as André Green and Luce Irigaray, has resulted in both an incomplete analysis of Oresteia and an inability to account for the fantasies and unconscious processes that fall outside the oedipal/patricidal paradigm. By bringing the story of Athena's mother, Metis, to the forefront, Jacobs challenges the primacy of the Oedipus myth in Western culture and psychoanalysis and introduces a bold new theory of matricide and maternal law. She finds that the Metis myth exists in cryptic forms within Aeschylus's text, uncovering what she terms the "latent content of the Oresteian myth," and argues that the occlusion of the law of the mother is proof of the patriarchal structures underlying our contemporary social and psychic realities. Jacobs's work not only provides new insight into the Oresteian trilogy but also advances a postpatriarchal model of the symbolic order that has strong ramifications for psychoanalysis, feminism, and theories of representation, as well as for clinical practice and epistemology. Bioethics represents a dramatic revision of the centuries-old professional ethics that governed the behavior of physicians and their relationships with patients. This venerable ethics code was challenged in the years after World War II by the remarkable advances in the biomedical sciences and medicine that raised questions about the definition of death, the use of life-support systems, organ transplantation, and reproductive interventions. In response, philosophers and theologians, lawyers and social scientists joined together with physicians and scientists to rethink and revise (...) the old standards. Governments established commissions to recommend policies. Courts heard arguments and legislatures passed laws. This book is the first broad history of the growing field of bioethics. Within the caring science paradigm, variations of a method of interpretation inspired by the French philosopher Paul Ricoeur's theory of interpretation are used. This method consists of several levels of interpretation: a naïve reading, a structural analysis, and a critical analysis and discussion. Within this paradigm, the aim of this article is to present and discuss a means of creating distance in the interpretation and the text structure by using narration in a poetic language linked to the meaning of the (...) text. Ricoeur's ‘Hermeneutical function of distanciation’ will be introduced, and this concept of distanciation will be illustrated with reference to narrations from a study of patient's life experiences living with chronic illness and home mechanical ventilation in Denmark. Distanciation in the interpretation objectifies the text, and narration in a poetic language creates a particular kind of mediation in the interpretation. That narration represents an interpreted understanding of the whole, which facilitates an appropriate and evocative presentation of the interpreted data. This way of objectifying the text through narration can contribute yet another perspective to Ricoeur's rich and varied theory of interpretation. (shrink)

Bioethical research has tended to focus on theoretical discussion of the principles on which the analysis of ethical issues in biomedicine should be based. But this discussion often seems remote from biomedical practice where researchers and physicians confront ethical problems. On the other hand, published empirical research on the ethical reasoning of health care professionals offer only descriptions of how physicians and nurses actually reason ethically. The question remains whether these descriptions have any normative implications for nurses and physicians? In (...) this article, we illustrate an approach that integrates empirical research into the formulation of normative ethical principles using the moral-philosophical method of Wide Reflective Equilibrium (WRE). The research method discussed in this article was developed in connection with the project ‘Bioethics in Theory and Practice’. The purpose of this project is to investigate ethical reasoning in biomedical practice in Denmark empirically. In this article, we take the research method as our point of departure, but we exclusively discuss the theoretical framework of the method, not its empirical results. We argue that the descriptive phenomenological hermeneutical method developed by Lindseth and Norberg (2004) and Pedersen (1999) can be combined with the theory of WRE to arrive at a decision procedure and thus a foundation for the formulation of normative ethical principles. This could provide health care professionals and biomedical researchers with normative principles about how to analyse, reason and act in ethically difficult situations in their practice. We also show how to use existing bioethical principles as inspiration for interpreting the empirical findings of qualitative studies. This may help researchers design their own empirical studies in the field of ethics. (shrink)

After the birth of thermodynamics’ second principle—outlined in Carnot's Réflexions sur la puissance motrice du feu —several studies provided new arguments in the field. Mainly, they concerned the thermodynamics’ first principle—including energy conceptualisation—, the analytical aspects of the heat propagation, the statistical aspects of the mechanical theory of heat. In other words, the second half of nineteenth century was marked by an intense interdisciplinary research activity between physics and chemistry: new disciplines applied to the heat developed in the form (...) of analytical, mechanical and statistical theories. Inside all these theories, entropy—the brand-new function that Clausius coined in his Mechanical theory of heat—started to play a central epistemic role. In the present paper, we analyse some steps of the historical process of conceptualisation of such function from 1850 to 1902. Particularly, we retrace the historical–foundational path that—starting from Clausius’ Second Law—lead Boltzmann and Gibbs to their distinguished formulations of statistical entropy. As usual, our research has been unrolled through the analyses of primary sources and by leaning on critical readings of the secondary literature. As for the methodological approach, text analysis of historical documents constituted our privileged modus operandi. This paper is the expression of a collaborative historical research program focused on the thermodynamic foundations of physics–chemistry relationship; early results have already been published by the same authors upon the concepts of reversibility––and––thermal equilibrium. While avoiding the pretence of producing an exhaustive reading of such a complex object as Lars Von Trier's Dogville, this article selectively uses the film to explore the process of the emergence of a new legality and a new set of legal relationships within a community. Two superimposed layers of meaning, the biblical and the mythic, are considered and their interaction with two different reasons, the symbolic and the economic, is suggested and explored. The categories of ‘critical being’, by Fitzpatrick (...) and Tuitt, and homo sacer, by Agamben, are taken as useful tools to understand such interaction and the connected dynamics of inclusion and exclusion. Throughout the article, it is argued that the perspective of the sacrifice, as framed especially by Girard, is useful to highlight an anthropological mechanism that can be retrieved in Dogville. BackgroundThis study presents an empirical investigation of the ethical reasoning and ethical issues at stake in the daily work of physicians and molecular biologists in Denmark. The aim of this study was to test empirically whether there is a difference in ethical considerations and principles between Danish physicians and Danish molecular biologists, and whether the bioethical principles of the American bioethicists Tom L. Beauchamp and James F. Childress are applicable to these groups.MethodThis study is based on 12 semi-structured interviews with (...) three groups of respondents: a group of oncology physicians working in a clinic at a public hospital and two groups of molecular biologists conducting basic research, one group employed at a public university and the other in a private biopharmaceutical company.ResultsIn this sample, the authors found that oncology physicians and molecular biologists employed in a private biopharmaceutical company have the specific principle of beneficence in mind in their daily work. Both groups are motivated to help sick patients. According to the study, molecular biologists explicitly consider nonmaleficence in relation to the environment, the researchers' own health, and animal models; and only implicitly in relation to patients or human subjects. In contrast, considerations of nonmaleficence by oncology physicians relate to patients or human subjects. Physicians and molecular biologists both consider the principle of respect for autonomy as a negative obligation in the sense that informed consent of patients should be respected. However, in contrast to molecular biologists, physicians experience the principle of respect for autonomy as a positive obligation as the physician, in dialogue with the patient, offers a medical prognosis based upon the patients wishes and ideas, mutual understanding, and respect. Finally, this study discloses utilitarian characteristics in the overall conception of justice as conceived by oncology physicians and molecular biologists from the private biopharmaceutical company. Molecular biologists employed at a public university are, in this study, concerned with allocation, however, they do not propose a specific theory of justice.ConclusionThis study demonstrates that each of the four bioethical principles of the American bioethicists Tom L. Beauchamp & James F. Childress – respect for autonomy, beneficence, nonmaleficence and justice – are reflected in the daily work of physicians and molecular biologists in Denmark. Consequently, these principles are applicable in the Danish biomedical setting. (shrink)

This article aims to analyse a possible manner of approaching the birth of intersexual children. We start out by summing up what intersexuality is and how it is faced in the dominant clinical practice. We then argue against this paradigm, in favour of a postponement of genital surgery. In the second part of this paper, we take into consideration the general question of whether only two existing sexes are to be recognized, arguing in favour of an expansion of sex (...) categories. In the third part, we illustrate the reasons supporting provisional sex attribution: the child’s best interest and respect for their developing moral autonomy. This position aims to increase the child’s well-being and self-determination, limiting parents’ freedom to take decisions on behalf of others, in particular, those decisions concerning basic aspects of their children’s personal identity. This article presents results from a qualitative empirical investigation of how Danish oncology physicians and Danish molecular biologists experience the principle of respect for autonomy in their daily work.

The formulation of the second law of thermodynamics in the frame of general relativity is reconsidered in the case of an istotropic homogeneous universe. We show that there appears then a direct link between the cosmological state of the universe, as expressed in terms of conformal coordinates, and quantities such as energy density, pressure, and entropy associated with the description of nature. In the early universe there appears a kind of phase transition due to transfer of gravitational energy to matter (...) associated with the cosmological expansion if the universe starts with a non-Euclidian (space) state. As a result, we may envisage the possibility of a “cold big-bang model,” in which the universe would start at zero temperature and entropy. The temperature goes then through a maximum before entering the present area of cooling related to adiabatic expansion. (shrink)

Society has historically not taken a benign view of genetic disease. The laws permitting sterilization of the mentally re tarded~ and those proscribing consanguineous marriages are but two examples. Indeed as far back as the 5th-10th centuries, B.C.E., consanguineous unions were outlawed (Leviticus XVIII, 6). Case law has traditionally tended toward the conservative. It is reactive rather than directive, exerting its influence only after an individual or group has sustained injury and brought suit. In contrast, state legislatures have not been (...) inhibited in enacting statutes. Many of their products can be characterized as hasty, unnecessary, ill-conceived, and based on the heart rather than the head. Moreover the lack of expert consultation sought has also been remarkable. One state legislature, for example, has advocated immunization for sickle cell anemia! Many others have enacted laws for the screening of inborn errors of metabolism, e.g., phenylketon uria, but have poorly defined the lines of responsibility to secure compliance. A spate of specific disease-related bills has emerged in the u.S. Congress, each seeking recognition and appropriations. Sickle cell anemia, hemophilia, Cooley's anemia and Tay-Sachs disease have been among the front-runners for support. Finally, in 1975, Congress has begun to examine an omnibus bill concerning all forms of genetic disease. The bill, termed the National Genetic Diseases Act is, however, still far from being enacted. There is an old but powerful argument for the claim that exhaustive divine foreknowledge is incompatible with the freedom to do otherwise. A crucial ingredient in this argument is the principle of the “Fixity of the Past”. A seemingly new response to this argument has emerged, the so-called “dependence response,” which involves, among other things, abandoning FP for an alternative principle, the principle of the “Fixity of the Independent”. We all know that we have and are our bodies. But might it be possible to leave this common place? In the present article we try to do this by attending to the way we do our bodies. The site where we look for such action is that of handling the hypoglycaemias that sometimes happen to people with diabetes. In this site it appears that the body, active in measuring, feeling and countering hypoglycaemias is not a bounded whole: its boundaries (...) leak. Bits and pieces of the outside get incorporated within the active body; while the centre of some bodily activities is beyond the skin. The body thus enacted is not self-evidently coherent either. There are tensions between the body’s organs; between the control under which we put our bodies and the erratic character of their behaviour; and between the various needs and desires single bodies somehow try to combine. Thus to say that a body is a whole, or so we conclude, skips over a lot of work. One does not hang together as a matter of course: keeping oneself together is something the embodied person needs to do. The person who fails to do so dies. (shrink)
