This interview with Jeremy Waldron covers three topics. Firstly, we dealt with the methodology debate, that is, the discussion about how to proceed in analyzing the nature of law. Does the question ‘What is law?’ require a descriptive analysis of the concept of law or, rather, a normative exercise in political philosophy? Secondly, we spoke about the role of law in response to historic injustice, especially in relation to the restitution of property rights. On this topic Waldron vindicates the ‘supersession-thesis’, (...) the idea that, due to changed circumstances and the passage of time, historic injustices become superseded. A substantial amount of recent work in natural language generation has focused on the generation of ‘‘one‐shot’’ referring expressions whose only aim is to identify a target referent. Dale and Reiter's Incremental Algorithm (IA) is often thought to be the best algorithm for maximizing the similarity to referring expressions produced by people. We test this hypothesis by eliciting referring expressions from human subjects and computing the similarity between the expressions elicited and the ones generated by algorithms. It turns out that (...) the success of the IA depends substantially on the ‘‘preference order’’ (PO) employed by the IA, particularly in complex domains. While some POs cause the IA to produce referring expressions that are very similar to expressions produced by human subjects, others cause the IA to perform worse than its main competitors; moreover, it turns out to be difficult to predict the success of a PO on the basis of existing psycholinguistic findings or frequencies in corpora. We also examine the computational complexity of the algorithms in question and argue that there are no compelling reasons for preferring the IA over some of its main competitors on these grounds. We conclude that future research on the generation of referring expressions should explore alternatives to the IA, focusing on algorithms, inspired by the Greedy Algorithm, which do not work with a fixed PO. In this article some of the presuppositions that underly the current ideas about decision making capacity, autonomy and independence are critically examined. The focus is on chronic disorders, especially on chronic physical disorders. First, it is argued that the concepts of decision making competence and autonomy, as they are usually applied to the problem of legal (in)competence in the mentally ill, need to be modified and adapted to the situation of the chronically (physically) ill. Second, it is argued that autonomy (...) and dependence must not be considered as two mutually exclusive categories. It is suggested that decision making may take on the form of a more or less conscious decision not to be involved in making all kinds of explicit and deliberate decisions. Elaborating on Agich's distinction between ideal and actual autonomy, the concept of Socratic autonomy is introduced. (shrink)

For a few decades, patients with Parkinson's disease have been treated with intracerebral transplantations of fetal mesencephalic tissue. The results of open trials have been variable. Double blind, placebo-controlled studies have recently been started in order to further investigate the efficacy of this new medical technique. In this paper we challenge the need for sham surgery in neurotransplantation research on PD patients. Considerations regarding the research subjects' informed consent, therapeutic misconception, the integrity of the human body, and the assessment of (...) risks and benefits argue against sham surgery for patients with PD. Moreover, there is an alternative, less harmful mode of research that can provide the same or comparable scientific evidence. A plea is made for intrapatient research based on quantitative measurements of the patient's pre- and post-operative condition combined with similar research on a reference group of patients who have received the standard treatment. Starting with the analysis of the diary kept by Constantijn Huygens Jr in the second half of the 17th century, this book sketches a panoramic view of life among Dutch regents and at the court of William and Mary, including an eyewitness account of the Glorious Revolution, and highlighting themes such as scientific progress, book and art collecting.

This paper asks why information should ever be expressed vaguely, re-assessing some previously proposed answers to this question and suggesting some new ones. Particular attention is paid to the benefits that vague expressions can have in situations where agreement over the meaning of an expression cannot be taken for granted. A distinction between two different versions of the above-mentioned question is advocated. The first asks why human languages contain vague expressions, the second question asks when and why a speaker should (...) choose a vague expression when communicating with a hearer. While the former question is purely theoretical, the latter has practical implications for the computational generation of utterances in Natural Language Generation (NLG). (shrink)

Medicine does not usually consider the human body from an aesthetic point of view. This article explores the notion of the lived body as aesthetic object in anthropological medicine, concentrating on the views of Buytendijk and Straus on human uprightness and gracefulness. It is argued that their insights constitute a counter-balance to the way the human body is predominantly approached in medicine and medical ethics. In particular, (1) the relationship between anthropological, aesthetic and ethical norms, (2) the possible danger of (...) a naturalistic fallacy, (3) the implications for the care of disabled people and (4) the intrinsic aesthetic quality of the human body are dealt with. In recent years, social cognition approaches to human evolution and Material Engagement Theory have offered new theoretical resources to advance our understanding of the prehistoric hominin mind. To date, however, these two approaches have developed largely in isolation from one another. I argue that there is a gap between social- and material-centred approaches, and that this is precisely the sociomateriality of the appearance of ancestral hominin bodies, which evolved under selective pressure to develop increasingly complex, cooperative sociality. To get this (...) sociomaterial body in focus, I develop an esthesiological framework, appropriated from Merleau-Ponty (2003), for interpreting the expressive body in an evolutionary and comparative context. The guiding hypothesis of esthesiology is that before being rationality (social or material), “humanity is another corporeity” (Merleau-Ponty, 2003, p. 208). Esthesiology studies the appearance of the body and its sense organs as an intertwining locus of a sensing power (the ability to see, to touch, etc.) and a sensible character (the visible, touchable body). It is this dual-aspect character of the body that facilitates the most basic affective and sensorimotor modes of sociality. Examining these features from a comparative perspective, we find that the human body is distinctively suited to prosocial communication and cooperation: a more cooperative eye, an exposed and communicative skin. I thus propose a cooperative body hypothesis, by analogy with the cooperative eye hypothesis (Tomasello et al., 2007). Esthesiology provides a framework for integrating and interpreting a wide range of otherwise disconnected facts concerning human and nonhuman animal bodies, forms of life, cognition, and evolution, thereby bridging the gap between social cognition and material engagement perspectives. In doing so, however, it not only solves problems and proposes new directions of investigation, but also demands theoretical revisions from each. (shrink)

In this work we answer a long standing request for temporal embeddings of deontic STIT logics by introducing the multi-agent STIT logic TDS . The logic is based upon atemporal utilitarian STIT logic. Yet, the logic presented here will be neutral: instead of committing ourselves to utilitarian theories, we prove the logic TDS sound and complete with respect to relational frames not employing any utilitarian function. We demonstrate how these neutral frames can be transformed into utilitarian temporal frames, while preserving (...) validity. Last, we discuss problems that arise from employing binary utility functions in a temporal setting. (shrink)

This response discusses the experiment reported in Krahmer et al.’s Letter to the Editor of Cognitive Science. We observe that their results do not tell us whether the Incremental Algorithm is better or worse than its competitors, and we speculate about implications for reference in complex domains, and for learning from ‘‘normal” (i.e., non-semantically-balanced) corpora.

Periodic attacks of uncertain origin, where the clinical presentationresembles epilepsy but there is no evidence of a somatic disease, arecalled Pseudo-Epilepsy or Pseudo-Epileptic Attack Disorder (PEAD). PEADmay be called a `non-disease', i.e. a disorder on the fringes ofestablished disease patterns, because it lacks a rationalpathophysiological explanation. The first aim of this article is tocriticize the idea, common in medical science, that diseases are realentities which exist separately from the patient, waiting to bediscovered by the doctor. We argue that doctor and (...) patient construct adisease, and that the construction of the disease PEAD includes manynormative evaluations. The second aim is to provide insight into thesuffering of patients with PEAD. We focus on three aspects of thepatient, identity, autonomy and responsibility. We present somecharacteristic descriptions of (pseudo-)epileptic attacks by FjodorDostoevsky, Gustave Flaubert and Thomas Mann. We argue that diagnosingPEAD reduces a meaningful life event into an insignificant, thoughintriguing, medical phenomenon, and that the patient will not benefitfrom being diagnosed as having PEAD. Social health disparities are increasing in most countries around the world. During the past two decades, a large amount of evidence has emerged about the health consequences of social inequalities. Despite such evidence, the concept of medical fairness, as traditionally defined by the World Medical Association, has remained unchallenged and even reinforced by some scholars who emphasize that doctors should remain neutral to the socioeconomic status of their patients when providing clinical care. The inconsistency between public health and clinical care (...) perspectives raises tension between a narrow interpretation of the ethics of justice, which stresses the importance of equality and impartiality, and the ethics of care, which highlights the importance of particularity and individuality in clinical practice. This article analyzes the concept of medical fairness using the emerging evidence that demonstrates the impact of social health disparities on clinical care. It proposes a new approach of medical fairness based on equity rather than on equality and provides a consistent ethical framework based on Paul Ricoeur’s three levels of medical judgments. This integrative framework provides a better balance between public health and clinical care in medical practice. (shrink)

Internet is often said to open up new avenues for a more direct and deliberative democracy. In this article, the notion of ‘deliberation’ will be problematized and a typology of political web sites will be developed. Next, three case studies of Dutch discussion sites are used to test the claim that the organizational structure, aim, control of content and kind of interactivity of political web sites can explain the level and quality of participation. Except for its mostly extreme elitist participation, (...) the research presented here gives a rather ambiguous picture of e-democracy at work. Not only are we confronted with more paradoxes than clear-cut answers, the question is raised whether notions such as the ‘public sphere’ are not more of a hindrance than a help in making sense of politics on the Internet.
