En este artículo, se analiza la cuestión de si la existencia del derecho depende necesariamente de la moralidad. La cuestión que ha enfrentado a las doctrinas del derecho natural con el positivismo jurídico. Se trata de mostrar que dicho debate esconde, al menos tres cuestiones diferentes, que requieren respuestas diversas: 1) La cuestión semántica de si las normas positivas injustas son derecho, 2) la cuestión metafísica de si la existencia del contenido del derecho está fundada en hechos morales y 3) (...) la cuestión epistémica de si el contenido del derecho debe ser identificado sin recurrir a consideraciones morales. Se concluye que la primera cuestión es una mera disputa verbal. Se dan algunos argumentos para aceptar la tesis metafísica. Y una respuesta afirmativa a la tercera cuestión es puesta en duda analizando la doctrina de la autoridad de Joseph Raz y, también, tratando de mostrar que el hecho de que algo sea concebible no conlleva que sea metafísicamente posible. RESUMEN En este trabajo se analizan las principales ideas de John Rawls acerca de la naturaleza del derecho y del razonamiento jurídico. Partiendo de un trabajo de Ronald Dworkin (2004), y básicamente de acuerdo con él, se exponen las críticas dworkinianas a la doctrina rawlsiana de la razón pública, y se presenta un modo en el cual Rawls podría replicarlas. El objetivo del trabajo es mostrar la fecundidad de las ideas rawlsianas para nuestra concepción del derecho en sociedades democráticas, caracterizadas (...) por el hecho del pluralismo. (shrink)

The dual career allows elite athletes to attain their maximum competitive and academic performance, but the COVID-19 pandemic hindered their development and changed their perception of the importance given to the sporting and educational environment. For this reason, the aim of the present study was to determine the differences in the motivations and perceived barriers, the importance given to academic qualifications, and the perception of the dual career from a multifactorial perspective, of elite athletes according to sex, type of sport (...) practiced, job performance, time of sports career, type of athlete, and type of scholarship received. A total of 100 student-athletes participated in the research study by completing the “Perceptions of dual career student-athletes” questionnaire. The results showed that athletes from individual modalities and those who did not receive any scholarships described more barriers. In addition, women studied more because they enjoyed it ; athletes from individual modalities studied to work later ; athletes who do not work perceived a greater influence between study and sports performance ; at the beginning and at the best stage of their sports career, a greater influence of academics on performance was perceived ; and athletes who considered themselves professionals, and athletes who did not receive any scholarships, reported that the conciliation between sports and academic life was difficult. The results obtained point to the importance of dual career scholarships for student-athletes, as well as the need for the programs implemented for these athletes to consider sex, sport modality or type of scholarship granted. Background: Heart rate variability (HRV) has been considered as a measure of heart-brain interaction and autonomic modulation, and it is modified by cognitive and attentional tasks. In cognitive tasks, HRV was reduced in participants who achieved worse results. This could indicate the possibility of HRV predicting cognitive performance, but this association is still unclear in a high cognitive load sport such as chess Objective: To analyse modifications on HRV and subjective perception of stress, difficulty and complexity in different chess problem (...) tasks. Design: HRV was assessed at baseline. During the chess problems, HRV was also monitored, and immediately after chess problems the subjective stress, difficulty and complexity were also registered. Method: A total of 16 male chess players, age: 35.19 (13.44) and ELO: 1927.69 (167.78) were analysed while six chess problem solving tasks with different level of difficulty were conducted (two low level, two medium level and two high level chess problems). Participants were classified according to their results into two groups: high performance or low performance. Results: Friedman test showed a significant effect of tasks in HRV indexes and perceived difficulty, stress and complexity in both high and low performance groups. A decrease in HRV was observed in both groups when chess problems difficulty increased. In addition, HRV was significantly higher in the high performance group than in the low performance group during chess problems. Conclusions: An increase in autonomic modulation was observed to meet the cognitive demands of the problems, being higher while the difficulty of the tasks increased. Non-linear HRV indexes seem to be more reactive to tasks difficulty, being an interesting and useful tool in chess training. (shrink)

Objective: This study aimed to compare the effects of two intervention programs, high-intensity interval training and moderate-intensity training, on anxiety, depression, stress, and resilience during the confinement caused by the coronavirus disease 2019 in healthy adults.Methods: A total of 67 adults who participated were randomly assigned to two groups: HIIT and MIT groups. The MIT group had to perform a home-based intervention based on aerobic exercises, whereas the HIIT group had to perform a home-based intervention based on HIIT exercises. The (...) two groups had to complete the same physical exercise volume, 40 min per session during the confinement period. Depression, anxiety, stress, and resilience were assessed before and after the intervention.Results: Results showed that HIIT and MIT significantly reduced the stress, anxiety, and depression as well as increase the resilience. Moreover, the improvements obtained in the HIIT group seem to be greater than those of the MIT group in depression.Conclusions: HIIT and MIT decreased anxiety, stress, and depression as well as increased resilience during the COVID-19 confinement. In addition, the HIIT intervention seemed to be more beneficial to reduce depression than the MIT intervention. (shrink)

Background/ObjectiveSocial skills are essential in adolescence, both for their relational dimension and for their influence on other areas of adolescent life, so it is essential to include Social skills in the formal education of students.MethodThis paper presents the results of an experimental mixed factorial design pilot study in which an Interpersonal Skills Training Program for Adolescents was applied. The convenience sample consisted of 51 adolescents. An evaluation was carried out before and after the intervention, using the CEDIA and SAS-A questionnaires.ResultsThe (...) mixed factorial ANOVA show significant differences in the overall measures and in most of the subscales of both questionnaires, indicating that PEHIA is effectiveness, at least in the short term.ConclusionsThe results obtained in assertiveness, interpersonal relationships and public speaking suggest that the program is feasible and shows promising results in reducing anxiety. In this paper I aim to analyze Guerrero's position as a reader of Heidegger, particularly the conceptual continuities and discontinuities between the Argentine philosopher's methodological proposal of an "operative aesthetic" and the essay on the art of the German thinker. We will concentrate on the first volume, Estética operatoria en tres direcciones. Revelación y acogimiento de la obra de arte and the essay "The origin of the work of art". Our hypothesis is that Guerrero is an anthropophagous reader: While Guerrero (...) support some of Heidegger's proposals in his essay on art, the Argentine philosopher is also critical and from the reading of “The origin of the work of art” he elaborates an original thought. Specifically Guerrero takes, I state, the phenomenological-hermeneutical methodology and applies it in an original way to the analysis of the work of art. (shrink)

En el presente trabajo nos proponemos analizar la lectura de Martin Heidegger en la _Estética operatoria_ por parte de Luis Juan Guerrero. La tesis a defender consiste en que “El origen de la obra de arte” tiene un rol central en la obra del filósofo argentino. Pero esto no quiere decir que Guerrero no sea un autor original o que sea un mero comentador del filósofo alemán, sino todo lo contrario: el filósofo argentino hace una lectura productiva de Heidegger (...) a partir de la cual elabora una filosofía propia y auténtica. Centrándonos en el ensayo sobre el arte de Heidegger y el primer tomo de la _Estética operatoria_, analizaremos tres puntos neurálgicos: el concepto de útil, la relación mundo y tierra y el vínculo entre historia y verdad. Esta investigación tiene como objetivo principal reflexionar sobre la efectividad de las aplicaciones de arqueología virtual en públicos escolares para la comprensión y el aprendizaje del patrimonio arqueológico con el fin de aprehender de qué manera las tecnologías, como la Realidad Aumentada y la Realidad Virtual, pueden aportar un valor añadido a las propuestas educativas realizadas por museos y sitios arqueológicos que no cuentan con esta inclusión. El análisis exploratorio del caso se realiza en el Museo del Mar de Santa (...) Pola (España) que ha desarrollado este tipo de aplicaciones en el yacimiento arqueológico romano que gestiona, el Portus Ilicitanus. (shrink)

Durante la redacción de la reseña de este libro llegó la triste noticia de la muerte de su autor, Juan Trías Vejarano. Profesor entrañable que deja un afectuoso recuerdo, mantuvo hasta el final su gran inquietud intelectual y su labor investigadora. Muestra de ello es este libro, que el autor concibió como una última aportación, y que tuvo la satisfacción de ver culminada y publicada. En el presente trabajo se esclarece la noción de “información” según Gilbert Simondon, para lo cual se presenta el contexto histórico-epistemológico desde el cual surge y qué soluciones ofrece a la problemática de la época. Se hace especial énfasis en las conceptualizaciones realizadas por la teoría matemática de la información, la cibernética, y la biología. Luego, se analiza el devenir conceptual de la noción de “información” en el pensamiento de Simondon siguiendo tres momentos de su trabajo académico (clasificados por (...) class='Hi'>Juan Manuel Heredia): a) 1944-1958, b) 1959-1968; y c) 1968-1983. Resumen El artículo reflexiona sobre la estructura hermenéutica que subyace a la práctica interpretativa origeniana, tal y como se despliega en el Comentario a Mateo. Para conseguirlo, la reflexión se dispone en torno a tres aspectos de la interpretación: su finalidad, su ambiente vital y sus criterios de verificación. En su conjunto, la revisión de estos aspectos evidenciaría que la interpretación origeniana de la Escritura toma sus condiciones de sentido de las principales convicciones de la fe de la Iglesia, justificándose (...) el adjetivo eclesial para la lectura origeniana. Tal ejercicio sistemático se pone en relación con una pregunta esencial para la hermenéutica bíblica contemporánea: ¿es posible leer la Escritura de manera crítica y confesional a la vez?The article reflects on the hermeneutic structure that underlies the Origen’s interpretative practice just like it unfolds in the Commentary on Matthew. To achieve this, the paper is organied with regard to three aspects of interpretation: its purpose, its vital environment and its verification criteria. As a whole, the review of these aspects would show that Origen’s interpretation of Scripture takes its conditions of meaning from the main convictions of Church’s faith, justfying the ecclesial adjective for the Origen’s reading. Such systematic exercise is related to an essential question for contemporary biblical hermeneutics: is it possible to read Scripture critically and confessionally at the same time? (shrink)

Functionalism as a philosophical position has been recently applied to the case of emotion research. However, a number of objections have been raised against applying such a view to scientific theorizing on emotions. In this article, I argue that functionalism is still a viable strategy for emotion research. To do this, I present functionalism in philosophy of mind and offer a sketch of its application to emotions. I then discuss three recent objections raised against it and respond to each of (...) them. These objections claim that functionalism is intractable because (i) it does not support a scientifically interesting taxonomy of emotions for experimental settings, (ii) it is inherently teleological, and (iii) it cannot be falsified. I argue that these objections either rely on a simplified version of functionalism as a philosophical position or they pose challenges that functionalists can readily address. Lastly, I conclude by drawing some lessons these objections suggest for a tractable functionalist account of emotions. (shrink)

Recent literature on dialogical logic discusses the case of tonk and the notion harmony in the context of a rule-based theory of meaning. Now, since the publications of those papers, a dialogical version of constructive type theory has been developed. The aim of the present paper is to show that, from the dialogical point of view, the harmony of the CTT-rules is the consequence of a more fundamental level of meaning characterized by the independence of players. Much of our know-how is acquired through practice: we learn how to cook by cooking, how to write by writing, and how to dance by dancing. As Aristotle argues, however, this kind of learning is puzzling, since engaging in it seems to require possession of the very knowledge one seeks to obtain. After showing how a version of the puzzle arises from a set of attractive principles, I argue that the best solution is to hold that knowledge-how comes in degrees, (...) and through practice a person gradually learns how to do something. However, the two standard accounts of know-how in the literature, intellectualism and anti-intellectualism, cannot properly account for the distinctive way in which know-how is gradually acquired by practice, a process in which conceptual representations and practical abilities are intimately interwoven. Drawing on Gareth Evans's work, I outline an account that may do so, and use this account to distinguish between two forms of learning to explain why skill generally cannot be learnt through testimony, and requires practice. Agli inizi dell'anno accademico 2011-2012, si raduna un gruppo di professori della Pontificia Università Gregoriana che, grazie all'iniziativa di Giorgia Salatiello (filosofia), coinvolge a Rogelio García Mateo, SJ (spiritualità), Dariusz Kowalczyk, SJ (teologia), Ferenc Patsch, SJ (teologia), Gerald Whelan, SJ (teologia), e Rossano Zas Friz De Col, SJ (spiritualità). Il presente volume raccoglie otto anni di ricerca del gruppo, centrati nel rintracciare il rapporto tra spiritualità ignaziana e metodo trascendentale in diversi pensatori gesuiti del ventesimo secolo, come Joseph Marechal (1878-1944), (...) Johannes B. Lotz (1903-1992), Karl Rahner (1904-1984), Bernard Lonergan (1904-1984), Joseph de Finance (1904-2000), Juan Alfaro (1914-1993), Emerich Coreth (1919-2006). Attraverso il loro studio si è voluto scoprire le particolari caratteristiche di ognuno di loro per evidenziare una linea maestra che ispiri oggi il rinnovamento di questo orientamento, in modo di progredire nella consapevolezza del mistero dell'apertura e dell'accoglienza del Dio della rivelazione cristiana, che trova negli Esercizi Spirituali di Sant'Ignazio un metodo su cui è conveniente continuare a ragionare trascendentalmente. Diego Pérez de Valdivia (1525-1589), uno de los más brillantes discípulos de Juan de Ávila, biblista y profesor de Sagrada Escrituras, ha sido autor de un sermón que se transcribe aquí por primera vez y del que se ofrece una propuesta interpretativa. Por carecer de lugar y año, resulta especialmente problemática su contextualización en la biografía del sacerdote baezano y, en general, en el marco de su época. Sin embargo, la textura espiritual del sermón y la forma de vertebrar (...) el lenguaje religioso en él, dibujan un escenario catequético en el cual este sermón, dedicado al capítulo 22 del evangelio de Mateo, se insertaría como una pieza clave. Diego Pérez podría dirigirse no solo a un público indiferenciado sino también o, especialmente, a un sector de indecisos, dudosos o simplemente de católicos, cuyo arraigo en la fe cristiana, fuera o no reciente, arrastaba un profundo déficit de formación religiosa. How do nuclear technologies become commonplace? How have the borders between the exceptional and the banal been drawn and redrawn over the last 70 years in order to make nuclear energy part of everyday life? This special issue analyzes the role of fun and display, broadly construed, in shaping the cultural representation and the material circulation (or non-circulation) of nuclear technologies. Four case studies, covering the United States, Great Britain, Portugal, Spain, and Ukraine from the 1950s to the 2000s, explore (...) how specific forms of public display and playful practices of cultural production were used as means to banalize (or de-banalize) nuclear energy. La 'llegada del Señor' es ambigua en cuanto al tiempo y el modo. El presente trabajo trata de analizar el origen de esta forma de entender la acción redentora divina en un momento histórico concreto y "al final de los tiempos". Un primer marco, original y originario, arraiga en las bases culturales, cósmicas y místicas de la escena de Israel y en las primeras composiciones del Antiguo Testamento. Su esquema fue utilizado y adaptado por los profetas y, dentro de la (...) evolución natural de la profecía, acabó en laliteratura apocalíptica. De ahí siguió al Nuevo Testamento, y la catequesis de la Iglesia hizo el resto. El presente trabajo pretende seguir los diferentes momentos de esta evolución. Una vez desvelado el sentido de las formas literarias, debemos aprender a leer en ellas el mensaje revelado: ¿seguimos esperando al Dios que nos redime? o ¿Ese día llegó con Jesús y sólo estamos esperando lacelebración de su victoria? The literature on mathematical explanation contains numerous examples of explanatory, and not so explanatory proofs. In this paper we report results of an empirical study aimed at investigating mathematicians’ notion of explanatoriness, and its relationship to accounts of mathematical explanation. Using a Comparative Judgement approach, we asked 38 mathematicians to assess the explanatory value of several proofs of the same proposition. We found an extremely high level of agreement among mathematicians, and some inconsistencies between their assessments and claims in the (...) literature regarding the explanatoriness of certain types of proofs. The purpose of this paper is to expose the function of the culture and thought of the Far East, expressed in Japanese Zen Buddhism and Chinese Chan (as well as, in general, in Chinese philosophy and culture), within the thought of Byung-Chul Han. This dimension of the Korean's work has not been sufficiently deepened in the analyses that are made of him. This error leads to mistakes such as stating that there is no emancipation proposal in Han or that his (...) work is limited to a pessimistic description of the world. Thus, the investigation that follows the bibliographic-documental research method is divided into three moments; the first exposes the foundations of the philosophy of Zen-chan Buddhism developed by Han; the second delineates the ontology of Hanian falsification and; the third, analyzes the theses on the East within Han's theoretical project. This paper deals with the conceptual and historical-intellectual relationship that links Gilbert Simondon’s philosophy with cybernetics and information theory. For this purpose, it deploys three lines of analysis: the French reception of cybernetics and information theory, and the positioning of Simondon in that conceptual field; the transcendent meaning that Simondon assigns to them, as they express a new technological era of the twentieth century; Simondon’s criticisms of cybernetics and information theory, which tend to dismantle the nineteenth-century remains that affect them (...) from within and to think a new concept of genesis. Habacuc 3 se ha abordado desde distintos puntos de vista. Este artículo hace hincapié en la crítica textual y en su relación con otros pasajes del Antiguo Testamento, así como con textos asirios y ugaríticos. Al compararlo con otras composiciones del mismo estilo, este himno sobresale por su forma y significado. Puede situarse en los primeros años de la Conquista y canta las alabanzas de una gloriosa batalla no identificada, pero histórica, con imágenes borrosas.

El artículo busca caracterizar la noción y práctica de la filosofía de un grupo de profesores colombianos del siglo XX. Se parte de la revisión historiográfica del relato “normalizador” en la historia de la filosofía local. El análisis cualitativo de textos escritos entre 1940 y 1960 propone una lectura ambivalente sobre algunas características del oficio de la filosofía, al exponer las tensiones entre una vocación filosófica y las modestas condiciones del oficio. Otras tensiones mostrarán los dos ejes desde donde aquellos (...) profesores pretendieron hacer filosofía: el técnico y el cultural. En 1950, el relato del proceso normalizador de la filosofía fue reforzado por Francisco Romero desde unos referentes ejemplarizantes, “adánicos”, e incluso épicos. Luego, el relato sobre las décadas comprendidas entre 1940 y 1960 se cristalizó bajo el lente retrospectivo de 1980, pero desde una mirada unilateral de la categoría de “normalización”, enfocada solo en aspectos técnicos y disciplinares de la filosofía. Para recuperar el eje cultural, se perfila la figura del “intelectual” de mediados de siglo XX a partir de lo que Renán Silva ha caracterizado como el “pastor de almas”, como aquel que podía interpretar la cultura popular y dictarle un derrotero. Una segunda entrega, ocupada del análisis de distintos registros textuales de la escritura filosófica de mitad de siglo XX, más centrados en el eje de la interpretación y orientación cultural. In Olivi´s division of the sciences, which can be found in his treatise De perlegendis philosophorum libris, c. 9, there seems to be a twofold place for metaphysics: one as part of the theoretical sciences and another as part of the practical, alongside medicine and ethics. This view is based on a misreading of the manuscripts. For the second appearance of metaphysics one should read “mechanica” instead. Thus, this paper shows that the thesis of an unconventional approach to metaphysics in (...) Olivi cannot be sustained by De perlegendis philosophorum libris. (shrink)

This article highlights two possible unnoticed acrostics in Ovid's Metamorphoses concerning the predictions of Calchas and Helenus.

A central debate in philosophy of action concerns whether agential knowledge, the knowledge agents characteristically have of their own actions, is inferential. While inferentialists like Sarah Paul hold that it is inferential, others like Lucy O’Brien and Kieran Setiya argue that it is not. In this paper, I offer a novel argument for the view that agential knowledge is non-inferential, by posing a dilemma for inferentialists: on the first horn, inferentialism is committed to holding that agents have only alienated knowledge (...) of their own actions; on the second horn, inferentialism is caught in a vicious regress. Neither option is attractive, so inferentialism should be rejected. (shrink)

In this paper I will critically assess a very popular interpretation of Heidegger’s early thought, according to which meaning (Bedeutung) is conceived as ontologically dependent on human existence (Dasein). In order to criticize this subjectivist understanding of meaning, I will offer an interpretation of Heidegger’s analysis of signs in Being and Time (§17). This will reveal two main things: first, that the ubiquity of sign-phenomena is founded on the universality of the structure known as reference (Verweisung); second, that Heidegger’s idea (...) of reference offers a non-substantialist understanding of meaning and its relation to the world. El artículo reflexiona en torno a las nociones de dispositivo (Foucault) y agenciamiento (Deleuze-Guattari), operando un análisis morfológico que destaca convergencias y divergencias conceptuales en el marco de una misma práctica teórica entendida como pragmática de la multiplicidad.

Ofrecemos dos cartas inéditas entre los filósofos Manuel García Morente y Xavier Zubiri. La primera carta, escrita por el pensador giennense, viene a iluminar el itinerario de su conversión religiosa que le llevó a ordenarse sacerdote en la Iglesia católica. Dicho proceso espiritual había empezado a fraguarse el año anterior en París, durante el exilio que ambos pensadores habían compartido en la capital francesa, tras el estallido de la guerra civil española. En la segunda carta, fechada casi dos años y (...) medio después de la anterior, Zubiri dirige al pensador andaluz unas palabras entrañables en respuesta a la invitación recibida de asistir a su primera misa; una carta en la que el filósofo vasco desvela la inquebrantable amistad entre ambos pensadores, intensificada en los últimos años por la fe cristiana. Business organizations in their work environment, aspire to create a high level of performance and low levels of absenteeism and turnover. Organizational commitment is considered a key factor in achieving this objective, however, it can be conditioned by several factors, among which is the psychological contract. The literature has related the organizational commitment with the fulfillment of the psychological contract framing it as one of the explanatory variables. This work aims to investigate research trends on psychological contract and organizational commitment. (...) For this purpose, bibliometric techniques and the software SciMAT have been used. 220 journal articles indexed in Web of Science (WoS) were analyzed. The findings indicate that the theme chosen for this review is valid. Based on the relationship between the two concepts, as the most recurrent themes, issues such as the sense of justice and the consequences of the violation of the psychological contract, normative commitment, HR management or job insecurity are addressed. However, in the last period analyzed (2015–2018), publications related to more sensitive topics to the present time emerge, such as the employability or the impact of these two concepts in the new generations (millennial and generation-Y) or the retention of talent. On the other hand, shortcomings are detected in the research on the ideologically charged psychological contract, the analysis of the organizational context or cultural and demographic factors in relation to both theoretical constructs. The contribution of this work lies in giving visibility to scientific results, which will serve business organizations as instruments for decision making in their labor management and, for the scientific community, as knowledge of the research spaces to explore. This article aims to present a Free Dialogic Logic [FDL] as a general framework for hypothesis generation in the practice of modelling in science. Our proposal is based on the idea that the inferential function that models fulfil during the modelling process (surrogate reasoning) should be carried out without ontological commitments. The starting point to achieve our objective is that the scientific consideration of models without a target is a symptom that, on the one hand, the Applicability of Logic should (...) be considered among the conditions of adequacy that should take into account all modeling process and, on the other, that the inferential apparatus at the base of the surrogate reasoning process must be rid of realistic assumptions that lead to erroneous conclusions. In this sense, we propose as an alternative an ontologically neutral inferential system in the perspective of dialogical pragmatism. (shrink)
