The COVID-19 pandemic has impacted medical care in many ways; previously, a patient would enter a hospital and had an approximate idea of what would happen upon his admission, the physician informed them about it, but in the last two years this scenario has changed. Therefore, our aim was to identify if bioethical principles are present in the physician–patient relationship and the effect of these in the health care provided, through an observational and descriptive study where patients answered the validated (...) ReMePaB questionnaire that measures the presence of bioethical principles in the physician–patient relationship, on the seventh day of their hospital stay and 24 h after discharge, during the period from 1 August to 5 November 2020. In autonomy, an improvement in the score was observed in the second application compared to the first measurement; in the principle of non-vulnerability, the same scenario was observed for the first and second measurements, respectively. In the principles of beneficence, dignity, and justice, no statistically significant differences were observed. Considering the presence or absence of bioethical aspects in health care in this pandemic creates an area of opportunity to know the feelings of the patient during the care received and to maintain what is done well and improve those aspects that can be improved. Historians have thoroughly documented the development of mercury-based silver refining in Spanish America in the late sixteenth century, and its use for over 300 years on an industrial scale unknown in Europe. However, we currently lack any consensus about the significance of this technology in the global history of knowledge. This article critically reassesses the invention and improvement of this refining method with the aim of addressing two interrelated issues. Firstly, how experiential knowledge and practical skills in silver refining were (...) deliberately harnessed to solve a specific technical problem. Secondly, how economic incentives and patronage set the stage for empirical practices and a collaborative culture that facilitated the widespread use of this novel technique. In so doing, this article places silver refining within the theoretical constructs and historiography of useful knowledge, and bridges narratives that have remained largely isolated. (shrink)

This book examines the human ability to participate in moments of joint feeling. It presents an answer to the question concerning the nature of our faculty to share in what might be called episodes of collective affective intentionality. The proposal develops the claim that our capacity to participate in such episodes is grounded in an ability central to our human condition: our capacity to care with one another about certain things. The author provides a phenomenologically adequate account of collective affective (...) intentionality that takes seriously the idea that feelings are at the core of our emotional relation to the world. He details a form of group emotional orientation that relies on the fact that the participating individuals have come to share a number of concerns. Readers will learn that at the heart of a collective affective intentional episode, one does not merely find a set of shared concerns, but also a particular mode of caring. In the end, the argument presented in this monograph makes plausible the idea that the emotions through which humans participate in moments of affective intentional community express our nature. In addition, it shows that the debate on collective affective intentionality also permits us to better understand the relationship between two conflicting philosophical pictures of ourselves: the idea that we are essentially social beings and the claim that we are creatures for whom our personal existence is an issue. Thus, aiming at an elucidation of the nature of our ability to feel together, the book offers a detailed account of what it is to situationally express our human nature by caring about something in a properly joint manner. Maybe you only have 1000 units of some resource, but 10,000 people need the resource or would benefit from it. One question: why do you control the resource? Leave that aside for now. A second question: how should you allocate the resource? If you are a decision-maker in a health system, and if the resource has to do with medicine or public health, we are in the world of the ethics of scarce resource allocation decisions in healthcare. Munthe et al (...) 1 note that the ‘operational norms that guide actual decision making in this area tend to be similar across health systems’ and include principles concerning need, prognosis, equal treatment and cost-effectiveness. Even with just these principles, there are hard questions of how they ought to be specified, operationalised and balanced against each other when they conflict. They do not focus on this. Instead, they identify a concern: paying attention only to these principles in making allocation decisions may lead decision-makers to miss ‘negative dynamics’ that result from their decisions. They aim to rectify this by suggesting a ‘sustainability’ principle that would sit alongside these other ethical principles, serving as a side-constraint that rules out certain allocation choices or as a distinct reason to be weighed in the decision-making calculus. Se trata de un estudio que, desde la perspectiva del teólogo alemán, realiza un somero itinerario por la historia político-espiritual de Europa, subrayando la cesura que constituyó el siglo XX, y que finaliza con algunas propuestas para construir una Europa con futuro. Abstract:There is debate about the ontological status of conventional entities in Abhidharma thought. Buddhist texts often draw a distinction between two different kinds of entities, ultimately real entities (paramārtha-sat) and conventionally real entities (saṃvṛti-sat), but are often unclear about what the distinction entails. The debate about whether past and future dharmas are ultimately real reveals that Sam.ghabhadra and Vasubandhu—two prominent Abhidharma philosophers—fundamentally disagree about whether reality consists in one or many modes of being. Saṃghabhadra's Sarvāstivāda position is best understood as (...) the ontologically pluralist view that a dharma can enjoy three distinct but equally fundamental temporal modes of being. Vasubandhu's position is that reality is univocal, that everything is real in the same sense. Because Saṃghabhadra is a pluralist and Vasubandhu is not, Saṃghabhadra affirms the reality of conventional entities whereas Vasubandhu does not. (shrink)

The law marks a significant difference between violent and non-violent criminal actions. Violent crimes are typically met with more severe punishments and consequences than non-violent crimes. Even in discussions of criminal justice reform, the refrain remains: violent crime is different; those convicted of violent crimes are different; and it is appropriate to respond to violent crime differently. This article argues that the violent/non-violent distinction cannot bear the normative weight placed on it and that we should jettison violence and move to (...) thinking about objectionable harm caused and risked. There are moral constraints on punishment from considerations of proportionality and equality, these are connected to wrongful harm and facts about agent culpability, and there is no consistent relationship between violence and wrongful harm nor between violence and culpability. The article concludes by offering an error-theory concerning our commitment to treating violent crime differently and suggests that morally better categorizations are available. (shrink)

La literatura latinoamericana requiere desarrollar una teoría literaria pertinente que describa su variedad y especificidad. Junto con esto, la crítica al pensamiento moderno occidental debe centrarse en el rescate del acervo cultural latinoamericano, ignorado por la modernidad occidental. Por lo tanto, el objetivo de este artículo ha sido el de develar la estructura dialógica de Yo, el supremo (1985) en contraposición a la perspectiva monológica, inherente a la cultura occidental. A partir de un análisis interpretativo de la teoría filosófica y (...) de la crítica literaria, la tesis central de este artículo elude un “universo unidimensional” para presentar un desplazamiento permanente de textos (voces) que incorpora nuevos significados al lenguaje afectado por la dinámica de la cultura occidental. La obra de Augusto Roa Bastos debe ser interpretada, más allá de sus características representativas, como parte de un proyecto universal y utópico donde la alienación del individuo moderno desparece para dar paso a un conjunto de nuevos significados. Over the last two decades republican thought has attracted a growing interest from political, moral and legal scholars. These contemporary theoretical syntheses of ‘neo-republican’ thought have been closely related to intellectual history and the idea of recovering an overshadowed tradition of political thought. In this vein, a classical set of historical moments and places and specific political practices within those contexts appear to be the main source of what republicanism meant – and what it could mean today.

Buddhist philosophers draw a distinction between two kinds of entities: ultimately real entities and conventionally real entities. Among Abhidharma Buddhist philosophers, who accept the fundamental existence of ultimately real entities, there is a debate over the existential status of conventionally real entities. The most prevalent interpretation of the general Abhidharma position is an anti-realist one: conventionally real entities do not exist. Here, however, I will argue that there is at least one Abhidharma philosopher who is not an anti-realist about conventionally (...) real entities. Saṅghabhadra, a fifth-century CE Indian Buddhist philosopher belonging to the Vaibhāṣika-Sarvāstivāda tradition of Abhidharma Buddhism, offers an account of conventionally real entities that takes them to be real. According to him, conventional entities exist, although in a derivative and degenerate way—a way that is supervenient on and grounded in what is ultimately real. Saṅghabhadra’s view substantiates, in his specific case, Kris McDaniel’s argument that Abhidharma accounts of conventional reality are profitably interpreted as the view that conventional entities exist but enjoy a mode of being that is distinct from the fundamental mode of being enjoyed by ultimately real entities. In what follows, I will argue that the pluralist framework that McDaniel lays out for understanding the mode of being that non-fundamental entities enjoy fits well with and makes the most sense of, the account of conventional entities offered by Saṅghabhadra. El presente estudio se realizó con el objetivo de evaluar el impacto del estrés emocional en la adecuada toma de decisiones y práctica médica oportuna y de calidad de los estudiantes que cursan el quinto año de la carrera en la Facultad de Medicina de la Universidad Nacional Autónoma de México. Se utilizó una lista de valoración para las competencias de la simulación de reanimación cardiopulmonar avanzada, y un Cuestionario de Maslach Burnout Inventory para valorar los sentimientos, actitudes y de (...) desgaste profesional. Los resultados muestran que aquellos que estaban expuestos a mayor cantidad de labores recientes y estrés fueron más propensos de incidir en errores médicos durante la toma de decisiones y su aprendizaje. This study was conducted with the aim of assessing the impact of emotional stress in the appropriate decision-making and quality medical practice of fifth year medical students from the Faculty of Medicine of the National Autonomous University of Mexico. It was used an assessment list for cardiopulmonary resuscitation simulation competence and a Maslach Burnout Inventory Questionnaire was used to assess feelings, attitudes and professional wear and tear. Results show those who were exposed to a greater number of recent tasks and to greater stress were more likely to make medical mistakes while making decisions and learning. (shrink)

The use of artificial intelligence in healthcare contexts is highly controversial for the (bio)ethical conundrums it creates. One of the main problems arising from its implementation is the lack of transparency of machine learning algorithms, which is thought to impede the patient’s autonomous choice regarding their medical decisions. If the patient is unable to clearly understand why and how an AI algorithm reached certain medical decision, their autonomy is being hovered. However, there are alternatives to prevent the negative impact of (...) AI opacity in shared (healthcare professional–patient) decision-making processes, and benefit from the high accuracy of such systems. Despite these ethical issues, this paper advocates for its usage and also defends the positive role that it could have in enhancing patients’ autonomy. I advocate for a system where the implementation of AI is only partial, and humans will remain in control of oversighting algorithm interpretation of medical images and patients’ data. (shrink)

While committed to the view that Buddhist Reductionism offers the best account of the Abhidharma distinction of the two truths, Siderits (2009) argues that Buddhist Reductionism has the surprising consequence of making itself inexpressible. This inexpressibility follows from the semantic insulation between conventional and ultimate discourses that Siderits argues is required in order to preserve classical logic for both types of discourse, avoiding contradiction and bivalence failure. La relación médico-paciente (RMP) es una relación profesional-interpersonal base para la gestión de la salud. Nuestro objetivo fue desarrollar un instrumento que permitiera evaluar la presencia de los principios bioéticos en la atención médica recibida en la consulta externa de una institución hospitalaria. According to the continuity hypothesis of dreaming and contemporary psychodynamic approaches, dreams reflect waking life. The aim of the present study was to explore the relationship between the COVID-19 pandemic and dreaming in adolescents. A cross-sectional survey was conducted in Italy, Romania and Croatia involving 2,105 secondary school students. No substantial differences between countries were found. Thirty-one percent of the participants reported heightened dream recall, 18% noticed an increase in nightmares during the lockdown, and 15% of the provided dreams included (...) pandemic-related content. The results indicate that subjective emotional reactions to lockdown had a significantly higher correlation to dreaming than objective distress. These findings suggest that attention to dreams should be included in preventive programs for adolescents with pandemic-related stress. (shrink)

El presente artículo interpreta la regla propuesta por san Anselmo en el c. 15 del Monologion, siguiendo la distinción aviceniana entre ens y res. Su distinción y coincidencia ayuda a explicar la diferencia entre el ser entendido como ámbito y el ser en sentido real, como “algo”. Se concluye que la “regula Anselmi” establecería los parámetros para una atribución trascendental de las perfecciones de las criaturas a la esencia divina, en la medida en que su perfección intrínseca es tal, que (...) pueden ser predicadas del ser necesario y de los seres posibles. The COVID-19 pandemic and the accompanying safety measures, including confinement, has meant an unprecedented challenge for the world population today. However, it has entailed additional difficulties for specific populations, including children and people with disabilities. Being out of school for months has reduced the learning opportunities for many children, such as those with less academic resources at home or with poorer technological connectivity. For students with disabilities, it has entailed losing the quality of the special attention they often need, in (...) addition to a more limited understanding of the situation. In this context, a case study was conducted in a special education classroom of a secondary education school. This class started implementing Dialogic Literary Gatherings with their special education students before the COVID-19 confinement and continued online during the confinement. Qualitative data was collected after a period of implementation of the gatherings showing positive impacts on the participants. The case study shows that interactive learning environments such as the Dialogic Literary Gatherings can provide quality distance learning for students with disabilities, contributing to overcome some of the barriers that the pandemic context creates for the education of these students. This paper straightforwardly addresses one of the strongest, from an ethical perspective, objections presented to the duty to die, the one concerned with the lack of a normative theory to support it, offered by Seay in his paper Can there be a “duty to die” without a normative theory? The aim of the paper is to provide strong metaethical grounds to support the duty to die without the need of a moral normative theory. First, the definition and main argument for (...) the duty to die will be presented. Second, Seay’s objection will be described and clearly explained. Third, our metaphysical assumptions and a preliminary metaethical discussion will be offered to situate and understand the context. Finally, we will show how the duty to die can be integrated within the metaethical approach previously presented, defending that there is no need of a normative theory to provide good justification and strong ethical grounds for the duty to die, because they will have already been provided by our metaethical argument. How does age matter to moral responsibility and criminal liability? Almost no one thinks that a 3-year old is morally responsible for what she does. No one would think an 8-year old should be held criminally liable for engaging in illegal criminal action—even for something seriously harmful such as intentionally setting fire to a building or badly harming another child. Something else should happen, certainly, but not criminal prosecution and conviction and State punishment. And that’s true even if we might (...) start to think that the 8-year old can be morally responsible, or at least somewhat morally responsible, for what she does. Disagreement might start to enter in as the age increases. What do we think of a 12-year old? A 15-year old? A 17-year old? Gideon Yaffe’s excellent book, The Age of Culpability, is focused on the question of why children—for these purposes, all people under the chronological age of 18—should be given a break, legally speaking, and why this should be done categorically. Yaffe argues that the fact that no one under 18 is eligible to vote is a key part of the explanation. In this paper, I raise two objections to Yaffe’s account. In particular, I raise several questions about the details of Yaffe’s account regarding what it is to “have a say over the law” and the way in which this makes a difference to criminal culpability. Una perspectiva reciente sobre los fundamentos normativos del derecho público ha propuesto concebir las relaciones entre ciudadanía y Estado como una “relación fiduciaria”, usando deberes fiduciarios del ámbito iusprivado para justificar limitaciones jurídicas y morales al poder del Estado. La gobernanza fiduciaria también ha sido señalada como una característica distintiva del republicanismo y la soberanía popular, ya que sitúa a la comunidad política como fideicomitente y beneficiaria de cualquier acto administrativo. En este artículo se revisan algunas concepciones protomodernas del gobierno (...) considerando sus justificaciones explícitamente fiduciarias. Concluye con una interpretación fiduciaria del iusnaturalismo Leveller, especialmente necesario para entender la relación de la gobernanza fiduciaria con la democracia. A recent perspective on the normative foundations of public law has proposed to conceive citizen-state relationships as a “fiduciary relationship”, using private-law fiduciary duties to justify legal and moral constrains on state power. Fiduciary governance has also been pointed as a distinct feature of republicanism and popular sovereignty, since it places the political community as trustor and beneficiary of any administrative act. This paper reviews some early modern conceptions of government considering their explicit fiduciary justifications. It concludes with a fiduciary account of Leveller natural law, especially needed to understand the relationship between fiduciary governance and democracy. (shrink)

What follows is but the attempt to draw the lessons from the mystical and visionary text of Teresa of?vila in order to consider today issues that concern us, questions that are asked of Aesthetics, and not only as theoretical discipline that theorises on the arts and considers the beautiful, but as a reflection on a?sthesis, of sensitivity, of the sensitive edge exposed by a constituent relationship which installs the human in a world. Consideration, then, of the happening, of entering the (...) world, creative experience. This essay seeks to consider the relationship between the image and the body via the visionary discourse of the mystics, because their writings question and lend shape to a large number of formulae of thought that can help us better understand the questions facing us today. Let us imagine that the mystics made of their body a frontier or a support where what by definition has no place could take place. Place: part of space occupied by a body, the boundary of a containing object. This then is what is addressed here, a question of boundaries. nema. (shrink)
