Is property-awareness constituted by representation or not? If it were, merely being aware of the qualities of physical objects would involve being in a representational state. This would have considerable implications for a prominent view of the nature of successful perceptual experiences. According to naïve realism, any such experience—or more specifically its character—is fundamentally a relation of awareness to concrete items in the environment. Naïve realists take their view to be a genuine alternative to representationalism, the view on which the (...) character of such experiences is constituted by representation. But naïve realists must admit qualities or property instances as items of awareness if they are to remain wedded to common sense, and the nature of property-awareness may smuggle constitutive representation into the naïve realist account of character. I argue that whether property-awareness involves representation, and consequently whether naïve realism is distinct from representationalism or not, depends on what qualities are fundamentally. On universalist and nominalist accounts, property-awareness turns out to involve representation. Not so under tropism. (shrink)

Nesse âmbito, além do Patrimônio Material de ruas, praças, igrejas, objetos artísticos e históricos, o discurso e ações dos órgãos oficiais e (...) da comunidade, devem também se pautar pela valorização das produções imateriais da cultura. Esses elementos envolvem os sujeitos e os sons produzidos por eles, seus ofícios, memórias, festas e religiosidade. Nesse sentido, o presente artigo visa analisar os Bens Culturais que compõem o cenário da celebração do Senhor dos Passos e descrever os seus valores histórico, religioso e artístico. A metodologia utilizada foi: pesquisa bibliográfica, documental e de campo. Após as três etapas da pesquisa e observação no local, constatado que a Festa do Senhor dos Passos em São Cristóvão possui elementos patrimoniais conectados que a transforma em um evento vinculado à identidade cultural-religiosa da região. Alguns desses elementos já são tombados nos níveis estadual, nacional e mundial, enquanto que outros, embora não reconhecidos pelos órgãos oficiais de salvaguarda do Patrimônio, são valorizados pela comunidade no que concerne a afetividade, memória, dádiva e pertencimento: Patrimônios de Fé, Religiosidade e Culto em Sergipe. São Cristóvão (Sergipe).The concept of cultural property that belongs to one locality has been going through new paradigms regarding the scope and relevance. In this context, in addition to material assets (streets, squares, churches and historical-artistic objects) the speech and actions of official bodies and the community, should also be guided by the appreciation of intangible productions. Such elements involve the subjects and the sounds produced by them, their crafts, memories, parties and religiosity. In this way, this article aims at analyzing the aspects that make up the scene of the festivities of Senhor dos Passos as a Cultural object and describes its historical, religious and artistic values. The methodology used was the bibliographic, documental and field research. After the three stages of research and on-site observation, it was found that the Festival of Senhor dos Passos in São Cristóvão owns connected heritage elements which turn it into an event linked to the religious-cultural identity of the region. Some of these elements are already safeguarded statewide and at national and global levels, while others, though not recognized by the official bodies of safeguarding of heritage are valued by the local community by affection, memory, donation and belongingness: Heritage of Faith, Religiosity and cult in Sergipe. In the nineteenth century, Karl Marx wondered how it was possible for the exchange of commodities to generate so much wealth for some and so much misery for the others. A similar question now haunts our discussions of financial markets: how can the expanding trade in financial securities create such extraordinary wealth for the financiers while creating increasing vulnerability for the rest of us? Taking a leaf out of Marx’s playbook, I propose in this essay to follow Moneybags to the (...) market and consider what he finds there. In the nineteenth century, Moneybags was able to purchase labor-power at its value while somehow generating more value merely from using it; by the late twentieth century, it appears that Moneybags is similarly able, in all good conscience, to acquire other people’s probability—their ability, that is, to make promises and to be believed—while somehow becoming more credible in the process. The article deals with the official position of the Soviet government in the national policy during 1943-1982 years, analyzes the situation in the linguistic environment in Donetsk region, and identifies the main channels of policy in the language environment, particularly through the school system as a major mechanism in the process. We can conclude that from the beginning of tenure as First Secretary of the Communist Party of Khrushchev and the end of Brezhnev`s era more than half of schools were (...) Russian. This trend was observed among the students also. Difference proportion of pupils who have studied Russian and Ukrainian languages in nearly two decades has changed in favor of the Russian language when in 1959/60 year Russian was taught almost 3.5 times more than Ukrainian , while in 1978/79 year there were 12.8 times more. This shows that in the 1943-1982 period the Soviet government consistently carried out the process of creating a single Soviet people in the territory of the USSR by the Russification of education. Visibly voluntary choice of language of study at the command-administrative methods of the country management made even better results behind the screen democracy. Since such a large state like the Soviet Union sought to unify the system of inter-republic communication through the introduction of Russian language in the process the Russification of Ukrainian SSR carried out more rapidly than in other Soviet republics, and had its own special features. In this article, we examine the political and educational relevance of Hannah Arendt’s account of friendship. Drawing from Arendt’s central works on friendship, we offer a novel interpretation of the concept by connecting the notion with the idea of educational ‘love for the world’, amor mundi. With this interpretation, we seek to demonstrate that the concept of friendship has both direct educational and indirect political significance. Thereby, we distinguish our interpretation from two previous understandings of the educational relevance of the (...) Arendtian notion of friendship—those by (1) Aaron Schutz and Marie G. Sandy, and (2) Morten T. Korsgaard—in which friendship is either assigned a specifically political role (as in (1)) or its significance to education is narrowly understood (as in (2)). We argue our interpretation of friendship offers both a new contribution to the understanding of the relationship between education and politics in the context of Arendt scholarship, and a novel way of thinking about the educational significance of friendship in the context of contemporary democratic politics, especially the prevailing political polarization. I discuss five main approaches to this question, according to which an insult is determined by (i) the semantic properties of the expression used; (ii) the insulter, her intention, or attitudes; (iii) the addressee and her personal standard; (iv) the features of the speech act performed; and (v) the standard of the relevant social group. I endorse the last, objectivist account, according to which an act x counts as (...) an insult if and only if x is assessed as demeaning when addressed at A by the standard of the relevant social group at t. This is reflected in the expansion of patient-reported outcome measures to capture a person's perception of their own health, and (...) the increasing requirement of involving people with lived experience in the co-design of research studies (National Health and Medical Research Council, 2016) and care improvement initiatives. In mental health it has been long understood that observable behavioral phenomena can only partially inform clinical understanding of the experience of the patient living with the condition. However, capturing the patient's subjective experience faithfully remains a challenge.Tourette syndrome (TS) is a complex condition in which there are clearly observable behavioral phenomena (vocal and motor tics, compulsive and socially inappropriate behaviors), but also a broad and varied range of subjective phenomena reported by different individuals. These may include sensory phenomena such as the premonitory sensory urge preceding a tic, compulsions to touch things a certain number of times or do something repeatedly until it feels "just right," or bothersome intrusive thoughts or images. To further complicate the picture most patients with TS have one or more co-occurring conditions such as attention deficit hyperactivity disorder, obsessive-compulsive disorder, and anxiety, which may actually cause a greater burden of dysfunction and distress than the Tourette symptoms.In their paper, Curtis-Wendlandt et al. (2024) challenge the dependence of current psychiatric diagnostic criteria (e.g., the Diagnostic and Statistical Manual of Mental Disorders, 5th edition) on observable tics, and propose a broader and more dimensional approach to nosology which incorporates sensory, cognitive and affective phenomena. [End Page 47] Data from interviews they conducted identified that premonitory phenomena and urge experiences in tic disorders are more complex and diverse than what is currently reflected in the literature and clinical scales. They also interviewed participants who reported "no urges" or "no premonitory sensations." They commented that the literature generally treats reports of urge absences at face value, and does not address the likelihood that such reports may be ambiguous or problematic. Overall, they concluded that their research suggests that premonitory urges in TS are a complex and diverse phenomenon that requires further study. This reflects with our clinical experience in working with TS patients. Although a large proportion of older patients describe sensory-based premonitory urges, descriptions are not homogenous, with many describing other experiences preceding their tics.When evaluating a patient's response to an intervention (either behavioral or pharmacological) clinicians incorporate a range of information. This includes the severity of their tics (number, type, frequency, intensity, and associated impairment), as well as their mood, participation and performance in study, work, and social activities, and overall quality of life. Standard clinical practice would not typically include assessment of some of the subjective experiences which precede tics. If it was accepted that these subjective phenomena are indeed salient to the patient's well-being, then a challenge would be how to consistently and reliably capture these feelings to operationalize a comprehensive patient-centered assessment.The primary evidence-based treatment for tic disorders, comprehensive behavioral intervention for tics (CBIT), involves training to increase the awareness of premonitory urges (Woods et al., 2008). Furthermore, successful 'blocking' of tics during the course of CBIT requires the patient to be aware of premonitory urges. I propose that the fundamental challenge Berkeley left realists is to account for experiences’ ability to present items as mind-independent, consistent with the claim that experiences always present themselves among the items of awareness. By exploring two ways of responding to this challenge, and ruling out the second, I hope to show that realists aiming to secure a role for experiences in grounding our grasp of mind-independence need to adopt a specific view of perceptual experience. The philosopher Jorge J. E. Gracia engages fifteen prominent scholars on race, ethnicity, nationality, and Hispanic/Latino identity in the United States. Their discussion joins two distinct traditions: the philosophy of race begun by African Americans in the nineteenth century, and the search for an understanding of identity initiated by Latin American philosophers in the sixteenth century. Participants include Linda M. Alcoff, K. Anthony Appiah, Richard J. Bernstein, Lawrence Blum, Robert Gooding-Williams, Eduardo Mendieta, and Lucius T. Outlaw Jr., and their dialogue (...) reflects the analytic, Aristotelian, Continental, literary, Marxist, and pragmatic schools of thought. These intellectuals start with the philosophy of Hispanics/Latinos in the United States and then move to the philosophy of African Americans and Anglo Americans in the United States and the philosophy of Latin Americans in Latin America. Gracia and his interlocutors debate the nature of race and ethnicity and their relation to nationality, linguistic rights, matters of identity, and Affirmative Action, binding the concepts of race and ethnicity together in ways that open new paths of inquiry. Gracia's Familial-Historical View of ethnic and Hispanic/Latino identity operates at the center of each of these discussions, providing vivid access to the philosopher's provocative arguments while adding unique depth to issues that each of us struggles to understand. Certain cognitive and philosophical aspects of the concept of conceivability with intended or established diversion from reality are discussed. The “coherence gap problem” arises when certain fragments of the real world are replaced with imaginary situations while most details are ignored. Another issue, “the spectator problem”, concerns the participation of the conceiver himself in the world conceived. Three different examples of conceivability are used to illustrate our points, namely thought experiments in physics, a hypothetical world devoid of consciousness , and (...) virtual reality. A renewed search for legal certainty is a reaction to the preponderance of judge made law, which has been in turn prompted by the democratic deficit of the EU and the impact of Anglo-American law. The problem is that the search is oblivious to both systematic interpretation and the need of re-systematization of law. The paper defines systematic interpretation, relates the definition to standard French and German conceptions, indicates the room for systematic interpretation in Anglo-American laws, and states prima facie (...) reasons for a re-systematization of law as a prerequisite of systematic interpretation. The problem cannot be appreciated outside its proper context. It is a disregard for causation and evaluation. Hence the paper outlines Aristotle’s understanding of causation and evaluation in his presentation of phronesis, reconsiders continental European legal thought in the light of Aristotle’s presentation, and offers policy-oriented jurisprudence as a remedy to the deficit of evaluation and causation in European legal thought. A solution to the problem offers a typology of criteria and clarifies positive and fundamental legal concepts, positive and fundamental criteria of systematization, and the place of criteria in knowledge of law. The usefulness of the criteria is demonstrated by a common approach to the systematization of law and an alternative diagnosis of a defect of systematization diagnosed by an authority in history and philosophy of law rather than legal theory. Karel Kosík (1926-2003) was one of the most remarkable Czech Marxist philosophers of the twentieth century. His reputation as a creative thinker is owed largely to his philosophical 'blockbuster' Dialectics of the Concrete, first published in Czechoslovakia in 1963. In reintroducing Kosík's philosophy to English-speaking readers, we show that Kosík's work is important not only as a leading intellectual document of the Prague Spring, but also as an original theoretical contribution with international impact that sheds light on the meaning of (...) labour and praxis, democracy and economic structure, dialectics and the crises of modernity. This paper makes explicit the basic problem perfect hallucinations pose for perceptual naive realists, more fundamental than the well‐trodden Screening‐off Problem. The deeper problem offers the basis for an overarching classification of the available naive‐ realist‐friendly approaches to perfect hallucinations. In the course of laying out the challenges to the different types of response, the paper makes a case for the superiority of a particular approach to perfect hallucinations, on which they would be understood as a special kind of perceptual (...) anomaly—arising from a secondary mode of perceptual processing. Este trabajo busca presentar el debate alrededor de la materialidad del cuerpo en dos grandes teorías feministas, a saber, las teorías feministas de la diferencia sexual y la teoría feminista alrededor del género. En ese sentido, mi interés es mostrar cómo, desde una distinta aproximación al concepto de cuerpo, se articulan unas diferencias para reivindicar las luchas feministas. Quisiera en particular acercarme a las pensadoras Judith Butler y Rosi Braidotti, que tienen una articulación distinta del sujeto-cuerpo del feminismo y el (...) lugar que este debe ocupar en las transformaciones sociales y políticas. Este trabajo no pretende inclinarse por mostrar las ventajas de una teoría sobre la otra sino más bien establecer sus diferencias. (shrink)

This paper examines the first complete Ukrainian translation of Immanuel Kant’s Critique of the Power of Judgment (2022). I discuss the consistency of the Ukrainian translator’s decisions in rendering Kant’s terminology in Ukrainian and assess the accuracy of the translation of Kant’s extremely complicated and nuanced syntax. Based on this assessment, I concluded that this translation provides a strong argument in favor of the idea that translations of classical texts of such complexity will not meet academic standards without scholarly editing. An example of a recurring terminological mistake is the translation of Kant’s “Schluß” as “conclusion,” whereas it means “inference” or “syllogism.” The most common syntactical mistakes are misinterpretations of pronouns (demonstrative, personal, possessive) in subordinate clauses. I connect the idea of an existential turn in philosophical science, presented by Ilya Kasavin and Vladimir Porus in their recent article, with the problem of rationality and culture crisis, as well as the opposition of profession and vocation in Max Weber’s famous speech on politics. I offer an analysis of the structure of vocation to politics and to science as affects of a special kind. To do this, I draw on Jacques Lacan’s analysis of hysteria. My conclusions are that (...) the structure of a target affect coincides to that of hysteria. This means that scientist tries to show that the truth exists, seeks to force other people to recognize this fact and submit to science as an only acceptable form of worldview. Until this can be done, the scientist gives his relationship to the community the character of service to the highest entity. At the same time, he waits for the inversion of this service, i.e. a transition to power through acknowledgement. It should be noted that scientific research is never limited by the science itself, no matter how dangerous it may be. The existential choice in science is a choice between the pursuit of truth in natural sciences and exact sciences and maintaining the sustainability of culture in social and humanitarian knowledge. The latter, contrary to Weber, is always intertwined with politics. The first is not political, but affective. This allows me to see the definition of the vocation to the science that Kasavin gives in a new way. At the center of the “cognitive-existential mood” in the search for truth, affect dominates, the engine of which is hysteria, and in its basic attitudes truth and the scientist are opposed to the plausible and the profane. How to Do Things with Myths: A Performative Theory of Myths and How We Got There assembles a radically updated collection of the author's oft-cited publications on myth. Together, they tell how theories of myth have changed and led to a novel "performative" theory of myth.

I propose a novel solution to the Sorites Paradox. The account vindicates the tolerance of vague predicates in a way that properly addresses the normativity of vagueness while avoiding sorites contradiction, by treating sorites reasoning as a type of defeasible reasoning. I show how this can be done within the setting of a nonmonotonic deontic logic. Central to the proposal is its deontic interpretation of tolerance. I draw a key distinction between two types of tolerance, based on different deontic notions, (...) and show how the account captures key differences between these types of sorites reasoning. I compare the resulting theory to various existing contextualist proposals and argue that it better accounts for the normative aspects of sorites reasoning. (shrink)

¿Estuvo la cultura de autoría impresa fuera del alcance de las mujeres antes de 1887 en Costa Rica? El propósito principal de este artículo es ofrecer una primera respuesta a dicha pregunta con base en una revisión preliminar de periódicos y revistas que permiten considerar el problema planteado desde una perspectiva más amplia.En breve, el argumento central que se va a desarrollar es que la construcción de esa autoría pasó por tres etapas: en la primera, durante las décadas de 1840 (...) y 1850, tal proceso se basó en la redacción de anuncios comerciales; en la segunda, centrada en los decenios de 1860 y 1870, predominaron los discursos de alumnas y maestras relacionados con actividades de enseñanza; y en la tercera, ubicada a partir de 1885, se dieron dos tendencias paralelas. Por un lado, algunas docentes comenzaron a dar a conocer sus producciones literarias; y por el otro, el Estado, en vísperas de la reforma educativa de 1886, implementó una política para que las educadoras oraran informes de sus actividades escolares y los enviaran a una revista especializada para ser publicados. El texto explora el papel que juegan los argumentos de naturaleza filosófica y religiosa en la razón pública, trayendo a colación el debate acerca del aborto, tema en el que John Rawls pone a prueba su propuesta. La tesis es que en el liberalismo rawlsiano, los argumentos filosóficos y religiosos juegan un papel semi-público, es decir, están referidos básicamente a la razón social, la cual se encuadra en la sociedad civil.

El artículo 270.2 del Código penal español hace responsables a los prestadores de servicios intermediarios cuando existe una facilitación activa y no neutral de un comportamiento infractor en las obras protegidas por copyright. Ello se ha traducido en un mecanismo incierto que fomenta la colaboración acrítica con los titulares del copyright sin ponderar de forma adecuada la creatividad social a través del uso transformativo de la obra. Este artículo propone un análisis de la autoría como signo distintivo con la finalidad (...) de corregir esta incertidumbre normativa mediante una interpretación restrictiva del derecho de uso exclusivo eliminando los usos derivados como fuente generadora de una obligación de actuar, y a la vez, reconociendo la necesidad de un mecanismo de contra-notificación que permita al supuesto infractor una defensa efectiva de sus intereses sin que ello implique la pérdida de la condición de actor neutral.
