Los movimientos #MeToo y #YoSiTeCreo sin dudas son el motor de una transición que se dirige a rectificar los males que sufren las mujeres en términos de violencia sexual. Aunque el contenido de aquello cuya experiencia es compartida colectivamente o que es creído como una decisión colectiva de las mujeres que se sumaron a las consignas refiere a la violencia sexual, ambos movimientos ponen de relieve la existencia de un mal adicional consistente en un déficit de credibilidad que afecta a (...) las mujeres victimizadas. Este fenómeno conceptualizado como injusticia epistémica por la filósofa inglesa Miranda Fricker explica dos aspectos de estos movimientos que han impulsado una de las primeras grandes transiciones del siglo XXI3. En primer lugar, estos movimientos construyeron4 una audiencia antes ausente para receptar y acompañar los testimonios de víctimas de violencia sexual reconociéndolas como agentes capaces de transmitir conocimiento sobre sus propias experiencias. Al mismo tiempo impulsaron una crítica y demanda de reforma de las prácticas institucionales y sociales que se traducen en la ausencia de una audiencia adecuada y en la negación de la capacidad de las víctimas de conocer y testimoniar sus experiencias. En segundo lugar, estas campañas se tradujeron en actos de solidaridad epistémica que se dirigen a corregir o mitigar la injusticia testimonial que afecta a las mujeres en el ámbito de estos delitos. Las herramientas teóricas destinadas a señalar las injusticias que sufren ciertos grupos socialmente oprimidos pueden acabar siendo utilizadas con propósitos completamente opuestos a los iniciales. Modificar el alcance de una herramienta teórica no es necesariamente problemático: la popularización de un concepto abre las puertas a que se utilice estratégicamente para diferentes fines. La tesis que defendemos en este artículo es que algunos personajes públicos cultivan una imagen particular de sí mismos que parece satisfacer los requisitos de la noción de (...) class='Hi'>injusticia testimonial y utilizan esta situación como medio para obtener beneficio político de ella. Más concretamente, estos personajes públicos se benefician de esta condición para generar situaciones de desacuerdos cruzados, que están estrechamente relacionados con el aumento de la polarización. The purpose of this paper is to develop an ontological reading of the ethical and epistemic phenomenon that Miranda Fricker describes as testimonial injustice. In order to do this, we will resort to the ideas put forward by Ian Hacking concerning the relations between social classifications and social kinds. On the one hand, we will deal with the processes that Hacking terms “making up people”, namely, processes in which the articulation of certain classifications make possible to existence of certain (...) types of people. We will argue that episodes of testimonial injustice, that express the effects of stereotypical classifications, can be construed as part of the social processes of making up people because those episodes contribute to fabricate the epistemic attributes, such as credibility, of certain types or kinds of people. On the other hand, in order to conceptualize the ontological setting under which the phenomenon of testimonial injustice becomes recognizable and reproachable, we will draw on Hacking’s idea of “interactive kinds”. We contend that the concept of “interactive kinds” underlines the fundamentally unstable nature of human kinds and that emphasizing this dynamic aspect can illuminate the social conditions that make testimonial injustice ethically blameworthy. In this sense, we will argue that testimonial injustice can become the object of a normative point of view only insofar as the kinds whose existence is made possible by stereotypical classification are already undergoing a process of change. Resumen: Una de las formas más comunes y menos estudiadas de parcialidad judicial subjetiva es la disminución de la credibilidad otorgada a un testigo debido a un prejuicio identitario implícito del agente judicial. En la epistemología social, este fenómeno ha sido estudiado bajo la rúbrica de la injusticia testimonial. En este ensayo mostramos que para determinar la ocurrencia de un caso de injusticia testimonial en el derecho se deben cumplir tres condiciones que son imposibles de verificar (...) empíricamente y que están basadas en presupuestos psicológicos que han sido puestos en duda en años recientes. Sin la posibilidad de verificar estas condiciones, estamos frente a un tipo de parcialidad judicial indetectable. En su lugar, ofrecemos una nueva forma de entender la injusticia testimonial en el derecho como un fenómeno más general que describe una tendencia comportamental prejuiciosa recurrente por parte de un agente judicial. Entendida de este modo, la injusticia testimonial es completamente verificable. -/- Abstract: One of the most common and least studied forms of subjective judicial partiality is the credibility deficit suffered by a witness due to an implicit identity prejudice in a judicial agent. Social epistemologists have studied this form of partiality under the rubric, “testimonial injustice.” In this essay we argue that to verify the occurrence of a singular instance of testimonial injustice in law three facts must be established, none of which can be established with any degree of confidence. Furthermore, all of them are based on psychological suppositions that have been recently discredited. Without the possibility of establishing these facts, we end up with an undetectable form of subjective judicial partiality. In its place, we offer a new way of understanding testimonial injustice in law as a general phenomenon that describes a recurrent pattern of prejudiced behavior in a judicial agent. Under this characterization, testimonial injustice becomes empirically verifiable. (shrink)

El presente artículo interroga la posibilidad de que la justicia, entendida como institución, se transforme al reconocer como injusticias estructurales las injusticias epistémicas relacionadas con el abuso sexual. Para ello analizaré la decisión de la jueza Rosemary Aquilina de invitar a más de 150 sobrevivientes de abuso sexual a dar su testimonio en el juicio a Larry Nassar. Sostengo que este acto de escucha y acompañamiento de las sobrevivientes durante las audiencias reconoce el valor de narrar la experiencia de abuso (...) sexual, muestra el daño de la injusticia epistémica por los prejuicios que interfieren con la credibilidad de las víctimas y las estructuras de poder que silencian los testimonios. En un segundo momento, analizo las audiencias donde hay una participación colectiva de las sobrevivientes como un espacio de acompañamiento que las empodera en tanto sujetos epistémicos y agentes morales. El trabajo utiliza las herramientas conceptuales de la discusión sobre injusticia epistémica para analizar tres contextos de cuidado emocional y la atención a la salud mental, tales como: las redes sociales de apoyo informal, la atención terapéutica y la atención psiquiátrica. El propósito es mostrar el tipo de dinámicas sociales que, en dichos contextos, derivan en una exclusión del testimonio de las personas que recurren a ellas. La tesis central sostiene que entender las diversas dinámicas sociales que propician los (...) distintos tipos de exclusiones, implica desglosar circunstancias sociales de diferente calado, algunas de las cuales se encuentran interrelacionadas, como lo representan la producción de sesgos derivados de diferentes tipos de prejuicios (de identidad o participación), mientras que, otras, responden a la constitución de un exceso de credibilidad otorgado a determinados campos expertos. De esta forma la invitación es a pensar que la restitución de la justicia epistémica en este tipo de atención y cuidado no depende ni de la corrección de una sola instancia social, ni de la mejora de un solo sistema experto. En este artículo se pretende problematizar la noción de injusticia testimonial, mediante una reconstrucción históricofilosófica de algunos usos contemporáneos del testimonio. La literatura sobre el testimonio en el siglo XX no siempre considera la discusión filosófica acerca del significado epistémico del testimonio, pese a que ambos asuntos podrían articularse mejor si el testimonio se comprende desde sus usos históricos recientes, y si la interpretación de los testimonios históricos se sostiene en una concepción adecuada del dispositivo discursivo de la (...) testificación. Se realizó un análisis filosófico del discurso testimonial y una revisión histórica de sus usos en dos contextos testimoniales: los testimonios del Holocausto y la literatura del testimonio latinoamericana. Como resultado de esta reconstrucción históricofilosófica sugerimos ampliar la noción de injusticia testimonial para que, además del desconocimiento o rechazo de la palabra ajena, incorpore el enrarecimiento de la testificación que cabe reconocer en cierto paradigma contemporáneo expresivista de la memoria testimonial.AbstractIn this article we try to problematize the notion of testimonial injustice, through a historical-philosophical reconstruction of some contemporary uses of testimony. The literature on testimony in the twentieth century does not always consider the philosophical discussion of the epistemic meaning of testimony, although both issues could be articulated better if testimony is understood from its recent historical uses, and the interpretation of historic testimony is held on an adequate conception of the discursive device of witnessing. We conducted a philosophical analysis of testimonial discourse and a historical review of its use in two testimonial contexts: Holocaust Testimonies and Latin American literature of testimony. As a result of this historical-philosophical reconstruction, we suggest to expand the notion of testimonial injustice so that, apart from disregard or rejection of the word of others, it incorporates the rarefaction of witnessing, which can be recognized in a certain expressivist contemporary paradigm of testimonial memory. Cada día es más evidente que existen muchas formas sutiles de exclusión y parcialidad que afectan el correcto funcionamiento de los sistemas jurídicos. El concepto de injusticia epistémica, introducido por la filósofa Miranda Fricker, ofrece una herramienta conceptual útil para comprender estas formas de exclusión y parcialidad judicial que a menudo pasan desapercibidas. En este artículo presentamos la teoría original de Fricker y algunas de las aplicaciones del concepto de injusticia epistémica en los procesos jurídicos. En particular, queremos (...) demostrar que la semilla sembrada por Fricker ha generado un floreciente campo de estudio en el cual el concepto se utiliza para analizar muchos fenómenos diferentes en el ámbito jurídico, no siempre siguiendo la caracterización original proporcionada por ella. Esto ha llevado a una distinción entre lo que llamaremos la versión estrecha del concepto, que se acerca a la descripción original de Fricker, y la versión más amplia de injusticia epistémica, que es una noción más controvertida porque existe el riesgo de que se confunda con otros conceptos más conocidos como el sexismo, la discriminación racial, la opresión, el silenciamiento y el gaslighting. Mostraremos que el valor de la versión estrecha es principalmente teórico y que para utilizar el concepto de injusticia epistémica se debe adoptar una comprensión más liberal del mismo. (shrink)

A veces, justificadamente, dejamos de confiar en el testimonio de alguien cuando descubrimos que nos ha mentido en repetidas ocasiones. Pero, ¿cuál es la razón por la que asignamos a alguien menor credibilidad de la que se merece cuando nada justifica esa falta de confianza? Cuando otorgamos a una persona menos credibilidad de la que merece por pertenecer a un determinado grupo social estamos llevando a cabo un acto de injusticia testimonial. ¿Se debe esto a factores individuales (prejuicios (...) explícitos y sesgos implícitos) o estructurales (normas y convenciones sociales, instituciones y condiciones materiales de vida)? Estos dos enfoques difieren tanto en sus versiones sobre las causas de estas injusticias como en las maneras de intervenir para resistirlas. Sin embargo, ambos enfoques pueden integrarse fácilmente. ABSTRACT The focus of this essay is Kant's argument in the Groundwork for the Metaphysics of Morals III that regarding oneself as rational implies regarding oneself as free. After setting out an interpretation of how the argument is meant to go, I argue that Kant fails to show that regarding oneself as free is incompatible with accepting universal causal determinism. However, I suggest that the argument succeeds in showing that regarding oneself as rational is inconsistent with accepting universal causal determinism (...) if one accepts a certain, plausible view of the explanation of events. RESUMEN El ensayo se enfoca en el argumento de Kant en la Fundamentación de la metafísica de las costumbres III según el cual considerarse racional implica verse a uno mismo como libre. Se interpreta la forma en que debe entenderse el argumento y se afirma que Kant no logra demostrar que considerarse libre es incompatible con la aceptación del determinismo casual universal. No obstante, se sugiere que el argumento sí logra demostrar que considerarse a uno mismo como racional es incompatible con la aceptación del determinismo casual universal, si se acepta una cierta versión plausible de la explicación de los eventos. Este trabajo afronta la deriva escéptica de la estética reciente, que ha cuestionado muchas verdades asumidas por la estética moderna, en especial las que hicieron prevalecer el arte sobre el no-arte. La estructura de poder así generada y ahora descubierta se aborda aquí desde el enfoque de las injusticias epistémicas de Fricker, relacionándolas con la conocida como estética de lo cotidiano al haber sido éste desprovisto tradicionalmente de su capacidad hermenéutica y testimonial por no responder al patrón artístico dominante. Testifying subjected to hermeneutical injustice. Sexual harm and discernment Resumen: Junto a la concepción del testimonio como institución social sometida a condiciones y normas, hay en Conocimiento expropiado (Broncano 2020) una segunda forma de concebir la práctica epistémica del testimonio que entra en conflicto con la primera y que parece pasar inadvertida. Esta segunda concepción se manifiesta en el modo en que Broncano delimita el acto de testimoniar y la dependencia epistémica. El objetivo de esta contribución es mostrar el conflicto (...) existente entre ambos modos de concebir el testimonio a partir de la tensión interna que presentan: mientras que la concepción del testimonio como institución social nos permite reconocer algunas formas fundamentales de testimonio (a saber, el testimonio de las víctimas de injusticia hermenéutica), las definiciones del acto de testimoniar y de la dependencia epistémica parecen excluirlas. Lejos de invalidar el análisis de Broncano, la tensión interna, aunque problemática para los casos en los que quien testimonia está sometida a la injusticia hermenéutica es, en primer lugar, necesaria para comprender los casos de injusticia discursiva o injusticia testimonial —y, por lo tanto, no defiendo su rechazo?; y, en segundo lugar, pone de relieve la importancia vital de concebir el testimonio como una institución social. Abstract: Alongside the conception of testimony as a social institution subject to conditions and norms, there arises in Conocimiento expropiado (Broncano 2020) a second way of conceiving the epistemic practice of testimony that conflicts with the first and seems to go unnoticed. This second conception is manifest in the way Broncano delimits the act of testimony and the epistemic dependence. The aim of this contribution is to show the conflict between these two ways of conceiving testimony through the internal tension they present: while the conception of testimony as a social institution allows us to recognize some fundamental forms of testimony (namely, the testimony of victims of hermeneutic injustice), the definitions of the act of testifying and epistemic dependence seem to exclude them. Far from invalidating Broncano’s analysis, the internal tension, although problematic for cases in which the testimonial agent is subject to hermeneutic injustice is, firstly, necessary to understand cases of discursive injustice or testimonial injustice—and, therefore, I do not advocate its rejection?; and, secondly, it highlights the relevance of conceiving testimony as a social institution. Este texto es la traducción del capítulo cuarto de The Routledge Handbook of Epistemic Injustice, editado por Ian James Kidd, José Medina y Gaile Pohlhaus Jr. En él, Miranda Fricker aclara y delimita los conceptos de injusticia hermenéutica y testimonial, proporcionando ejemplos, narrando su genealogía, respondiendo a algunas de las críticas que recibieron estos conceptos, así como estableciendo relaciones de semejanza y contraste con otras concepciones de la justicia y otras ramas de la filosofía.

RESUMEN El artículo responde algunas críticas planteadas por Ignacio Ávila a mi interpretación de la epistemología davidsoniana. Presento argumentos en contra de: a) que sea necesario distinguir entre representaciones epistemológicamente “peligrosas”e “inofensivas”; b) que el empirismo mínimo sea un tipo de realismo directo; c) que mi uso de la expresión “evidencia distal” y el interés por la teoría de la correspondencia sean asuntos ajenos a Davidson. Finalmente, sostengo que la triangulación es un elemento fundamental de la epistemología davidsoniana, pues permite (...) sortear la ansiedad realista manteniéndose en una postura no representacionalista. ABSTRACT In this article, I respond to some of Ignacio Ávila's criticisms of my interpretation of Davidson’s epistemology. I argue against: a) the need to distinguish between epistemologically “dangerous” and “harmless” representations; b) the idea that minimal empiricism is a kind of direct realism; and c) the claim that my usage of the expression “distal evidence” and interest in the theory of correspondence are issues that do not pertain to Davidson. Finally, I claim that triangulation is a key element in Davidsonian epistemology since it allows us to deal with the realist anxiety while maintaining a non-representationalist viewpoint. (shrink)

Los movimientos #MeToo de Hollywood, #YoSiTeCreo de España y #MiraComoNosPonemos de Argentina son el punto de partida de una transición promovida por el movimiento feminista. Esta transición está dirigida a una sociedad justa en la que las mujeres no sean víctimas de violación y acoso que, además, quedan impunes. La perpetración de los males que estos movimientos buscan eliminar ha sido posible hasta ahora, entre otras cosas, dado el déficit de credibilidad que afecta a las mujeres que denuncian tales delitos. (...) En este artículo, me centraré en el caso de la injusticia testimonial y trataré de responder la pregunta sobre qué requiere la transición de una sociedad con altos niveles de injusticia testimonial a una sociedad epistémicamente justa. Para hacerlo, en la Sección 1 trataré de especificar el tipo de mal que implica la injusticia testimonial. En la Sección 2 mostraré que la injusticia testimonial, como una especie de dominación estructural, consiste en una desviación del umbral de la justicia diferente de los dos tipos citados habitualmente. Por lo tanto, la dominación estructural constituye un tipo de injusticia diferente de la desviación del umbral de la justicia debido a la acción incorrecta de un agente o agencia y la desviación debido a factores arbitrarios como la lotería genética. Sin embargo, comparte similitudes con ambos tipos de desviaciones. En la Sección 3 analizaré las particularidades de la justicia de transición epistémica, explorando los puntos de conexión con otros casos de justicia de transición y tratando de especificar el tratamiento que debe recibirse en la transición, las expectativas de las víctimas de esta injusticia, sus beneficiarios y el resto. de la gente. Claims of epistemic credit in social context Resumen: En este ensayo explico la propuesta fundamental de Conocimiento expropiado (Broncano 2020) en el marco agencial y fiabilista que asume el autor. A continuación, me centro en su análisis de las situaciones de injusticia testimonial, contraponiendo los caminos seguidos por Miranda Fricker (enfocado en el prejuicio del intercambio testimonial) y Broncano (enfocado en el desajuste estructural). Tras señalar las deficiencias de cada modelo, apunto una propuesta alternativa: la injusticia (...) testimonial se produce cuando la atribución de credibilidad es efecto de un juicio identitario, ya sea este ajustado o no, con respecto al colectivo al que pertenece la testigo. Abstract: In this essay, I explain the main claim of Conocimiento expropiado (Broncano 2020) against the background of the agential and reliabilist framework that its author assumes. I then focus on his analysis of situations of testimonial injustice, opposing Miranda Fricker’s approach (focused on prejudice in testimonial exchanges) and Broncano’s one (focused on structural imbalances). By pointing out the shortcommings of both models, I skech an alternative proposal: testimonial injustice is produced when the credibility assessment results from an identity judgment, whether it is effectively appropriate regarding the collective or not. Blind, deaf, and mute: the healthcare system regarding conscientious objection to abortion Resumen: A la luz de la obra de Fernando Broncano, Conocimiento expropiado (2020), este trabajo plantea la objeción de conciencia generalizada al aborto como un fenómeno que origina situaciones de injusticia epistémica. El acceso a la información, el disvalor del testimonio de las mujeres y el silencio cómplice, individual e institucional, perpetuador de la ignorancia sistémica son realidades que afectan a un número indeterminado de mujeres que requiere (...) la interrupción de su embarazo. Para hacer frente al daño generado, se plantea cómo las redes y movimientos pro-elección distribuyen información y recursos sobre el aborto fuera del ámbito clínico y se organizan como fuerzas de resistencia epistémica, capaces de crear y compartir conocimiento en un ejercicio de democracia radical, en el sentido expresado por Broncano. Abstract: In accordance with Fernando Broncano’s work, Conocimiento expropiado (2020), this paper considers the widespread conscientious objection to abortion as a phenomenon that creates situations of epistemic injustice. Access to information, devaluation of women’s testimony, as well as individual and institutional complicit silence that perpetuates systemic ignorance, are realities that affect an indeterminate number of women who require the termination of their pregnancies. In order to address the damage generated, we consider how pro-choice networks and movements distribute information and resources on abortion outside the clinical sphere. They also organise themselves as forces of epistemic resistance, capable of creating and sharing knowledge in an exercise of radical democracy, in the sense expressed by Broncano. Se plantea que los currículos universitarios actuales de filosofía se soportan en estructuras curriculares que conllevarían diversas modalidades de injusticias epistémicas, a saber: el anglo-eurocentrismo, el racismo, el sexismo y el humanismo. Con base en esta premisa, la cual se considera inscrita en la trayectoria histórica de los epistemicidios occidentales, se propone la necesidad de decolonización del currículo universitario de filosofía en las universidades colombianas. Se plantea como un proyecto urgente de acción educativa que, de modo inmediato, contribuiría a contrarrestar (...) las diversas modalidades de injusticias epistémicas y, transitivamente, impulsaría la materialización de lo que aquí se denomina justicia curricular. Esto no solo sería provechoso para mejorar y transformar los currículos de filosofía en el nivel de educación superior y el paulatino enriquecimiento epistemológico de la filosofía, sino que también aportaría a un reconocimiento saludable de la pluridiversidad en la universidad. That testimony is one of the principle bases on which many people hold their religious beliefs is hard to dispute. Equally hard to dispute is that our world contains an array of mutually incompatible religious traditions each of which has been transmitted down the centuries chiefly by way of testimony. In light of this latter it is quite natural to think that there is something defective about holding religious beliefs primarily or solely on the basis of testimony from a particular (...) tradition. The present chapter takes up the question of what that defect consists in. I first consider whether religious diversity entails that a religious believer’s testimony-based beliefs are not formed in a suitably epistemically reliable manner even conditional upon the truth of her religion. After casting doubt on this thought I turn to look at the idea that testimony-based beliefs are subject to defeaters in light of awareness of religious diversity, and I suggest that many such beliefs are not obviously so. According to my diagnosis the problem, rather, is that believers who base their religious beliefs just on testimony will be very unlikely to have reflective (that is, second-order) knowledge even if they possess first-order knowledge, and I explain why this is a notable shortcoming. La injusticia epistémica significa desacreditar a alguien en su capacidad de sujeto de conocimiento. En las instituciones psiquiátricas se filtran los sesgos y prejuicios, las injusticias e inequidades del conjunto de la sociedad. Las personas diagnosticadas con problemas de « salud mental» suelen ser estereotipadas negativamente y desacreditadas cognoscitivamente. En este artículo analizamos este tema a través del documental uruguayo Locura al aire (2018), basado en una experiencia radial que surgió en una institución psiquiátrica de Montevideo liderada por un (...) grupo de pacientes ambulatorios y de psicólogos con autonomía de la institución. La invitación a participar en el primer encuentro de «radios locas» en México es la excusa para la realización de este documental donde exploramos las injusticias testimoniales y hermenéuticas y visibilizamos el ineludible lugar del cuerpo y las emociones en la producción de conocimiento. La experiencia de la radio Vilardevoz expresa un modo de contrarrestar y resistir al estigma y la agencia disminuida que suelen experimentar los pacientes psiquiátricos, reivindicando así un espacio epistémico alternativo. En primer lugar, nos detendremos en la injusticia como norma del sistema médico, luego en la radio Vilardevoz como espacio de resistencia epistémica y finalizamos con algunas reflexiones sobre este espacio comunitario. This paper argues for the general proper functionalist view that epistemic warrant consists in the normal functioning of the belief-forming process when the process has forming true beliefs reliably as an etiological function. Such a process is reliable in normal conditions when functioning normally. This paper applies this view to so-called testimony-based beliefs. It argues that when a hearer forms a comprehension-based belief that P (a belief based on taking another to have asserted that P) through the exercise of a (...) reliable competence to comprehend and filter assertive speech acts, then the hearer's belief is prima facie warranted. The paper discusses the psychology of comprehension, the function of assertion, and the evolution of filtering mechanisms, especially coherence checking. (shrink)

Testimony of oppression is testimony that something constitutes or contributes to a form of oppression, such as, for example, “The stranger’s comment was sexist.” Testimony of oppression that is given by members of the relevant oppressed group has the potential to play an important role in fostering a shared understanding of oppression. Yet, it is frequently dismissed out of hand. Against the background of a recent debate on moral testimony, this paper discusses the following question: How should privileged hearers approach (...) testimony of oppression if they aim to do so in an ethically and epistemically sound way? Should they defer or try to understand? Both strategies constitute ways of learning from testimony of oppression. However, they differ in important respects and exclude each other. Because testimony of oppression is often based on personal experience, empathizing with the speaker can play an important role in trying to understand testimony of oppression. While the fact that empathy can change your mind and the advantages of understanding over knowledge support trying to understand as the right approach to testimony of oppression, considerations of the “limits of empathy” and the value of deference support deferring. I argue that, on balance, these contrasting arguments allow for a limited defense of the role of empathy in learning from testimony of oppression. We should try to understand testimony of oppression by empathizing with the speaker, but not treat our ability to understand as a condition on accepting a speaker’s claim. (shrink)

Epistemologists typically assume that the acquisition of knowledge from testimony is not threatened at the stage at which audiences interpret what proposition a speaker has asserted. Attention is instead typically paid to the epistemic status of a belief formed on the basis of testimony that it is assumed has the same content as the speaker’s assertion. Andrew Peet has pioneered an account of how linguistic context sensitivity can threaten the assumption. His account locates the threat in contexts in which an (...) audience’s evidence under-determines which proposition a speaker is asserting. I argue that Peet’s epistemic uncertainty account of the threat is mistaken and I propose an alternative. The alternative locates the threat in contexts that provide factors that give audiences a mistaken psychological certainty or confidence that a speaker has asserted a proposition she has not. Recent work in artificial intelligence has increasingly turned to argumentation as a rich, interdisciplinary area of research that can provide new methods related to evidence and reasoning in the area of law. Douglas Walton provides an introduction to basic concepts, tools and methods in argumentation theory and artificial intelligence as applied to the analysis and evaluation of witness testimony. He shows how witness testimony is by its nature inherently fallible and sometimes subject to disastrous failures. At the same time such (...) testimony can provide evidence that is not only necessary but inherently reasonable for logically guiding legal experts to accept or reject a claim. Walton shows how to overcome the traditional disdain for witness testimony as a type of evidence shown by logical positivists, and the views of trial sceptics who doubt that trial rules deal with witness testimony in a way that yields a rational decision-making process. Can we gain understanding from testifiers who themselves fail to understand? At first glance, this looks counterintuitive. How could a hearer who has no understanding or very poor understanding of a certain subject matter non-accidentally extract items of information relevant to understanding from a speaker’s testimony if the speaker does not understand what she is talking about? This paper shows that, when there are theories or representational devices working as mediators, speakers can intentionally generate understanding in their hearers by engaging (...) in relevant speech acts without understanding the topic of these speech acts themselves. More specifically, I argue that testifiers can intentionally elicit understanding of empirical phenomena in their hearers even if they themselves lack such understanding – granted that they properly understood the epistemic mediators involved. Jennifer Lackey’s case “Creationist Teacher,” in which students acquire knowledge of evolutionary theory from a teacher who does not herself believe the theory, has been discussed widely as a counterexample to so-called transmission theories of testimonial knowledge and justification. The case purports to show that a speaker need not herself have knowledge or justification in order to enable listeners to acquire knowledge or justification from her assertion. The original case has been criticized on the ground that it does not (...) really refute the transmission theory, because there is still somebody in a chain of testifiers—the person from whom the creationist teacher acquired what she testifies—who knows the truth of the testified statements. In this paper, we provide a kind of pattern for generating counterexample cases, one that avoids objections discussed by Peter Graham and others in relation to such cases. (shrink)

What, if anything, is wrong with acquiring moral beliefs on the basis of testimony? Most philosophers think that there is something wrong with it, and most point to a special problem that moral testimony is supposed to create for moral agency. Being a good moral agent involves more than bringing about the right outcomes. It also involves acting with "moral understanding" and one cannot have moral understanding of what one is doing via moral testimony. And so, adherents to this view (...) claim, relying on moral testimony is problematic. Importantly, the problem that afflicts moral testimony, according to this view, is not a problem for testimonial knowledge in general. Indeed, critics of moral testimony acknowledge that a vast amount of our knowledge comes, completely unproblematically, from testimony. Call this the Asymmetry Thesis. We argue that while the diagnosis of what is wrong with moral testimony (when there is something wrong with it) in terms of moral understanding is correct, the lesson many of its adherents draw from it, namely that there is a principled difference between moral an non-moral testimony which renders the first, but not the second, problematic, is not. In other words, we argue that the Asymmetry Thesis is false. (shrink)

En este artículo nos centramos en la consideración de las injusticias epistémicas como emociones público-privadas para enfrentar la injusticia epistémica estructural. Partimos de la propuesta de Judith Shklar, quien critica a la concepción tradicional centrada en la justicia que entiende a las injusticias como una falla del modelo. En esta línea, revisamos la propuesta de Miranda Fricker sobre la injusticia epistémica como injusticia estructural, conceptualización que complejizamos a partir de los aportes de Sally Haslanger. Luego, a partir (...) del planteo de Sarah Ahmed, nos centramos en la dimensión social y a la vez individual de las emociones, entendidas como prácticas sociales y culturales. Desde este abordaje, destacamos el valor epistémico de las emociones socialmente valoradas como negativas, cuyo saber ha sido infravalorado a lo largo de la historia por la epistemología tradicional. En este sentido es que entendemos a la injusticia epistémica como emoción público-privada. Para finalizar, sumamos a este enfoque la propuesta de las estructuras del sentir de Raymond Williams, para profundizar en el análisis de la injusticia epistémica estructural desde esta propuesta entendiendo a las injusticias epistémicas como emociones público-privadas que emergen como sentir epocal. This paper identifies two distinct dimensions of what might be called testimonial strength: first, in the case of testimony from more than one speaker, testimony can be said to be stronger to the extent that a greater proportion of the speakers give identical testimony; second, in both single-speaker and multi-speaker testimony, testimony can be said to the stronger to the extent that each speaker expresses greater conviction in the relevant proposition. These two notions of testimonial strength have received (...) scant attention in the philosophical literature so far, presumably because it has been thought that whatever lessons we learn from thinking about testimony as a binary phenomenon will apply mutatis mutandis to varying strengths of testimony. This paper shows that this will not work for either of the two aforementioned dimensions of testimonial strength, roughly because less testimony can provide more justification in a way that can only be explained by appealing to the (non-binary) strength of the testimony itself. The paper also argues that this result undermines some influential versions of non-reductionism about testimonial justification. (shrink)

To verify the occurrence of a singular instance of testimonial injustice three facts must be established. The first is whether the hearer in fact has an identity prejudice of which she may or may not be aware; the second is whether that prejudice was in fact the cause of the unjustified credibility deficit; and the third is whether there was in fact a credibility deficit in the testimonial exchange. These three elements constitute the facts of the matter of (...) testimonial injustice. In this essay we argue that none of these facts can be established with any degree of confidence, and therefore that testimonial injustice is an undetectable phenomenon in singular instances. Our intention is not to undermine the idea of testimonial injustice, but rather to set limits to what can be justifiably asserted about it. According to our argument, although there are insufficient reasons to identify individual acts of testimonial injustice, it is possible to recognize recurrent patterns of epistemic responses to speakers who belong to specific social groups. General testimonial injustice can thus be characterized as a behavioral tendency of a prejudiced hearer. (shrink)

This chapter explores two kinds of testimonial trust, what we call ‘evidential trust’ and ‘non-evidential trust’ with the aim of asking how testimonial trust could provide epistemic reasons for belief. We argue that neither evidential nor non-evidential trust can play a distinctive role in providing evidential reasons for belief, but we tentatively propose that non-evidential trust can in some circumstances provide a novel kind of epistemic reason for belief, a reason of epistemic facilitation. The chapter begins with an (...) extensive discussion of standard accounts of both kinds of trust and criticises especially the standard accounts of non-evidential trust. A new account of non-evidential trust is offered that avoids a number of difficulties that plague the standard accounts by rejecting what we call ‘attitude-liability assumptions’. (shrink)

Relying on aesthetic testimony seems problematic. For instance, it seems problematic for me to simply believe or assert that The Velvet Underground's debut album The Velvet Underground and Nico (1964) is amazing solely because you have told me so, even though I know you to be an honest and competent music critic. But why? After all, there do not seem to be similar reservations regarding testimony from many other domains. In this paper, I will argue that relying on aesthetic testimony (...) seems problematic because we are attached to an ideal of aesthetic authenticity and feel that living up to this ideal is anathema to simply relying on aesthetic testimony. Nos complace presentar este número especial de la Revista Las Torres de Lucca, dedicado íntegramente a la investigación sobre injusticia epistémica. El proyecto de esta publicación se gestó entre 2017 y 2018, en conversaciones entre Cristina Bernabéu e Isabel Gamero; a las que luego se sumaron Alba Moreno y Llanos Navarro. Los directores de Las Torres de Lucca, Diego Fernández Peychaux y Juan Antonio Fernández Manzano, aceptaron la propuesta con interés. Estamos muy agradecidas a ambos por ello, así como (...) por el acompañamiento que nos han hecho durante todo el proceso, desde la publicación de la convocatoria hasta la conclusión del número que ahora presentamos. La motivación que subyace a este trabajo es el interés en la noción de injusticia epistémica, en la que encontramos una poderosa herramienta para visibilizar qué voces tienen más presencia en los distintos contextos sociales situados en los que participamos y qué prácticas habría que aplicar para lograr una distribución más justa de capacidades, tan básicas y cruciales, como las de dar testimonio y comunicar las propias experiencias. El debate sobre injusticia epistémica ha crecido significativamente a raíz de la publicación del libro de Miranda Fricker Epistemic Injustice. Desde entonces, la discusión se ha desarrollado sobre todo en el contexto de la epistemología social feminista y antirracista, aunque ha tenido otras ramificaciones. Este número en particular reúne una serie de trabajos que aplican la noción de injusticia epistémica, tal y como fue propuesta por Fricker, a ámbitos diversos de discusión, que incluyen el análisis jurídico, el análisis del discurso y la estrategia políticos o el desarrollo de formas de resistencia epistémica, y que abordan problemas como la atribución errónea de género ─conocida como misgendering por su voz inglesa─ y el fenómeno del silenciamiento. Nos satisface comprobar que el debate es tan rico en sus ramificaciones y aplicaciones, así como haber podido reunir una muestra de esta riqueza. (shrink)

Epistemologists of testimony have focused almost exclusively on the epistemic dynamics of simple testimony. We do sometimes testify by ways of simple, single sentence assertions. But much of our testimony is narratively structured. I argue that narrative testimony gives rise to a form of epistemic dependence that is far richer and more far reaching than the epistemic dependence characteristic of simple testimony.

Why is there a felt asymmetry between cases in which agents defer to testifiers for certain moral beliefs, and cases in which agents defer on many other matters? One explanation influential in the literature is that having understanding of a proposition is both in tension with acquiring belief in the proposition by deferring to another's testimony and distinctively important when it comes to moral propositions, as compared with what we might think of as many ‘garden variety’ facts. My project in (...) this paper is to offer a new and more defensible version of this explanation. This will involve re-conceiving understanding as a richer state than it is commonly thought to be, requiring affective and motivational engagement with reasons as well as cognitive facility. I also offer a new explanation of the tension between understanding and deference to testimony. (shrink)

It is commonly claimed that reliance upon moral testimony is problematic in a way not common to reliance upon non-moral testimony. This chapter provides a new explanation of what the problem consists in—one that enjoys advantages over the most widely accepted explanation in the extant literature. The main theses of the chapter are as follows: that many forms of normative deference beyond the moral are problematic, that there is a common explanation of the problem with all of these forms of (...) deference—an explanation that is based on the connection between the relevant judgments and desire-like attitudes, and that this explanation is compatible with moral realism. Speakers offer testimony. They also hedge. This essay offers an account of how hedging makes a difference to testimony. Two components of testimony are considered: how testimony warrants a hearer's attitude, and how testimony changes a speaker's responsibilities. Starting with a norm-based approach to testimony where hearer's beliefs are prima facie warranted because of social norms and speakers acquire responsibility from these same norms, I argue that hedging alters both components simultaneously. It changes which attitudes a hearer is prima facie (...) warranted in forming in response to testimony, and reduces how much responsibility a speaker undertakes in testifying. A consequence of this account is that speakers who hedge for strategic purposes deprive their hearers of warrant for stronger doxastic attitudes. (shrink)

Aesthetic testimony is testimony about aesthetic properties. For example, in aone straightforward case, one person might tell another that something is beautiful. Philosophical discussion about aesthetic testimony centers on the question of whether there are any important differences between aesthetic testimony and testimony about non-aesthetic descriptive matters. In particular, the focus is often on the respective epistemic credentials of aesthetic and non-aesthetic testimony relative to firsthand judgments in the respective domains. Most are inclined to think that in some way and (...) to some degree we typically treat aesthetic testimony as being epistemically inferior to testimony about non-aesthetic matters. Assuming an asymmetry in the way we typically treat aesthetic and non-aesthetic testimony, the philosophical debate then asks a number of questions. Is aesthetic testimony actually epistemically inferior? If so, in what ways, and what explains its inferiority? If not, why do our ordinary ways of thinking, talking, and engaging with aesthetic testimony treat it as being inferior? In this chapter, I consider various ways in which experimental philosophy can contribute to these debates. Drawing on extant work and some new empirical studies, this chapter provides an overview of what experimental philosophy has told us so far, and summarizes the implications for philosophical debate. Scientific Testimony concerns the roles of scientific testimony in science and society. The book develops a positive alternative to a tradition famously expressed by the slogan of the Royal Society Nullius in verba ("Take nobody's word for it"). This book argues that intra-scientific testimony—i.e., testimony between collaborating scientists—is not in conflict with the spirit of science or an add-on to scientific practice. On the contrary, intra-scientific testimony is a vital part of science. This is illustrated by articulating epistemic norms of (...) intra-scientific testimony and arguing that they are vital to scientific methodology on a par with other scientific norms governing scientific observation and data analysis. -/- The book also provides an account of public scientific testimony—i.e., scientific testimony to the lay population. This is done by integrating philosophical resources with empirical research on the science of science communication. For example, various misconceptions about science and folk epistemological biases are diagnosed as factors that contribute to science skepticism. This diagnosis provides the basis for developing novel norms for science communication that are sensitive to the psychological and social obstacles to laypersons' uptake of it. Finally, the volume discusses how public scientific testimony is best embedded in society and argues that it is critical for societies that pursue the ideals of deliberative democracy. Scientific Testimony draws on philosophy of science, social epistemology, and empirical research to provide a wide-ranging account of the roles of scientific testimony within scientific practice and within the wider society.
