We contribute to the empirical debate on whether we understand and predict mental states by using simulation (simulation theory) or by relying on a folk psychological theory (theory theory). To decide between these two fundamental positions, it has been argued that failure to predict other people's choices would be challenging evidence against the simulation view. We test the specific claim that people prefer the rightmost position in choosing among equally valued objects, and whether or not this position bias can be (...) correctly predicted. A series of experiments shows that the bias appears only in a specific spatial arrangement and that it can be correctly predicted given adequate imaginative input. In concert with other recent findings on the correct prediction of choices these findings do actually strengthen, rather than challenge, the simulation account on the prediction of mental states. This article supports H. L. A. Hart's “any reasons” thesis (defended consistently from the first edition of The Concept of Law in 1961 to the Postscript to the second edition of 1994) that legal officials may accept law for any reasons, including non‐moral reasons. I develop a conception of non‐moral aesthetic ideals of official conduct which may provide legal officials with reasons to accept and apply even morally iniquitous law. I use this conception in order to rebut Gerald Postema's and (...) Joseph Raz's criticisms of Hart's view, and suggest that my revisions offer reasons for renewed confidence in Hart's account of law's normativity. (shrink)

Abstract:We aim in this paper to explore several related challenges to contemporary analytical legal theorists who accept as theoretically foundational the state-based view of legality and legal system advanced by H.L.A. Hart. We contend that this approach contains internal explanatory problems which limit the view’s capacity to account for novel prima facie legal phenomena outside the typical experience of the law-state. We supplement the analytical approach by advancing the rudiments of what we call an ‘inter-institutional theory of legality,’ a theory (...) of legality derived from a morally-neutral, descriptive-explanatory picture of legal system qua system of legal institutions. Our theory additionally enables us to account for the novel prima facie legal phenomena we identify, and to conclude that while prior analytical legal theorists’ approaches to legality and legal system were historically right to depart from the example of the municipal legal system, that example and departure point are no longer most salient, so explanation of the legality within the state is no longer sufficient as a general explanation of legality.Resumen:En este artículo los autores se proponen explorar diversos retos que enfrentan los teóricos analíticos del derecho contemporáneos, los cuales han aceptado que una perspectiva estatista del sistema jurídico y de la legalidad —introducida por H. L. A. Hart— es fundamental como punto de partida en la teoría. Los autores sostienen que este enfoque contiene problemas explicativos internos que limitan su capacidad para explicar fenómenos jurídicos prima facie novedosos que no se ajustan a la experiencia paradigmática de un derecho-estado. Los autores reformulan el enfoque analítico mediante la introducción de las bases de lo que deno minan una “teoría de la legalidad interinstitucional”, esto es, una teoría de la legalidad derivada de una noción moralmente neutral, descriptiva y explicativa del sistema jurídico como un sistema de instituciones jurídicas. Esta teoría permite, además, explicar los fenómenos jurídicos prima facie novedosos que identifican los autores; y concluir que si bien los enfoques anteriores hacia el sistema jurídico y la legalidad de los teóricos analíticos estuvieron históricamente en lo correcto al tomar como punto de partida el ejemplo de un sistema jurídico municipal, ese ejemplo y punto de partida han dejado de ser relevantes, dicho ejemplo y punto de partida no resulta suficiente, por lo que la explicación de la legalidad dentro de los confines del Estado no es suficiente para una explicación general de la legalidad. Although he himself is not fond of jubilees and although he lik es to play the decimal system of numb ers do wn as contingent, this is nev ertheless a suitable o ccasion to re ect on the professional work of one of the rare distinguished contemp orary scientists who attach equal imp ortance to exp erimen tal and theoretical and conceptual lines of researc h. Hans Primas' in terests ha (...) ve covered an enormous range: metho ds and instruments for n uclear magnetic resonance, theoretical c hemistry , C - and W -algebraic formulations of quantum mechanics, the measurement problem and its various implications, holism and realism in quantum theory , theory reduction, the w ork and p ersonality of Wolfgang Pauli, as well as Jungian psychology . In man y of these elds he provided imp ortan t and original fo o d for though t, in some cases going far b eyond the ev eryda y business in the scientic world. As is the case with other scien tists who are conceptually innov ativ e, Hans Primas is read more than he is quoted. His in uence is due to his writings. Even with the current ood of publications, he still p erforms the miracle of ha ving scientists eagerly a waiting his next publication. His external life, by wa y of contrast, is not very sp ectacular. With the exception of a brief p erio d as a guest professor at Washington Univ ersity at St. Louis, he has never b een a wa y from Zuric h for an y length of time. He has nev er b een a warded an y prizes, nev er organized a congress, nev er done any organizational work in a scientic so ciety . In their landmark 2010 paper, “The weirdest people in the world?”, Henrich, Heine, and Norenzayan outlined a serious methodological problem for the psychological and behavioural sciences. Most of the studies produced in the field use people from Western, Educated, Industrialised, Rich and Democratic (WEIRD) societies, yet inferences are often drawn to the species as a whole. In drawing such inferences, researchers implicitly assume that either there is little variation across human populations, or that WEIRD populations are generally representative of the (...) species. Yet neither of these assumptions is justified. In many psychological and behavioural domains, cultural variation begets cognitive variation, and WEIRD samples are recurrently shown to be outliers. In the years since the article was published, attention has focused on the implications this has for research on extant human populations. Here we extend those implications to the study of ancient _H. sapiens_, their hominin forebears, and cousin lineages. We assess a range of characteristic arguments and key studies in the cognitive archaeology literature, identifying issues stemming from the problem of sample diversity. We then look at how worrying the problem is, and consider some conditions under which inferences to ancient populations via cognitive models might be provisionally justified. (shrink)

It is generally accepted that H. Friedman’s gap condition is closely related to iterated collapsing functions from ordinal analysis. But what precisely is the connection? We offer the following answer: In a previous paper we have shown that the gap condition arises from an iterative construction on transformations of partial orders. Here we show that the parallel construction for linear orders yields familiar collapsing functions. The iteration step in the linear case is an instance of a general construction that we (...) call ‘Bachmann–Howard derivative’. In the present paper, we focus on the unary case, i.e., on the gap condition for sequences rather than trees and, correspondingly, on addition-free ordinal notation systems. This is partly for convenience, but it also allows us to clarify a phenomenon that is specific to the unary setting: As shown by van der Meeren, Rathjen and Weiermann, the gap condition on sequences admits two linearizations with rather different properties. We will see that these correspond to different recursive constructions of sequences. (shrink)

Myers' offer of cooperation as a medicine for ailing moral theories is welcomed as potentially helpful, even if his handling of it is diagnosed as implicitly one-sided consequentialist. His search for an ethically “substantive way of engaging with others” is shown as not coherent with his remarks on the tasks cooperation as an ethical concept has to fulfil. Instead, it is proposed that the concept be disentangled from the micro- problems Myers' wants it to solve, and that it be read (...) more freely, from the perspective of Rawls' conception of cooperation. We prove that for any k≥3 each element of the h-quasiorder of finite k-labeled forests is definable in the ordinary first order language and, respectively, each element of the h-quasiorder of countable k-labeled forests is definable in the language Lω1ω, in both cases provided that the minimal non-smallest elements are allowed as parameters. As corollaries, we characterize the automorphism groups of both structures and show that the structure of finite k-forests is atomic. Similar results hold true for two other relevant (...) structures: the h-quasiorder of finite k-labeled trees and of finite k-labeled trees with a fixed label of the root element. (shrink)

Leist worries that by tying the ideal of cooperation to the aim of promoting the good I exhibit a bias towards consequentialism, and that this in turn leads me to downsize the role to be played by the ideal of cooperation within moral theory. I maintain that no bias is exhibited towards consequentialism but acknowledge that realism is being favoured over constructivism. I further argue that the role assigned to the ideal of cooperation is as large as realism permits.
