Clinical Ethics Consultation (CEC) has grown significantly in the last decade, and efforts are being made to professionalize the practice. The American Society for Bioethics and Humanities (ASBH) has been instrumental in this process, having published the _Code of Ethics and Professional Responsibilities for Healthcare Ethics Consultants_ and founded and endorsed the creation of the _Healthcare Ethics Consultant Certified (HCEC) Certification Commission._ The ASBH also published “core competencies” for healthcare ethics consultants and has delineated a clear identity and role of (...) such consultants distinct from that other healthcare professionals. In addition, more enter the field armed with advanced degrees (MA and PhD) or certification in clinical ethics consultation. While some have questioned the trend toward professionalization, the momentum is clearly in its favor. This paper explores three questions: Does the professionalization of healthcare ethics consultation expose those engaged in the field to the types of liability claims faced by professionals in other fields? What specific liabilities could affect a healthcare ethics consultant? And finally, what should healthcare ethics consultants do to protect themselves against liability claims? We conclude that while the risk of liability remains low, those engaged in the field should accept that risk just as part of their status as professionals and, like those in allied professions, seek appropriate protection in the form of liability insurance. El Holocausto ha sido en Chile al igual que en el resto del continente, una de las formas más tradicionales de enfrentar la temática de los DDHH; en la educación, así como en las políticas de memoria, hablar de violación a los DDHH implica hacer una referencia a lo ocurrido en la Europa de 1940. Esto, desde la perspectiva de la educación formal ha posibilitado, en el caso de Chile, que se hable de DDHH sin que, necesariamente, se pase por (...) nuestra propia historia reciente. Esta situación, posiblemente se deba a que el curriculum escolar fue hasta 2016 un proyecto conservador. Ese año, el Ministerio de Educación impulsó la Ley de Formación Ciudadana que puso en discusión ¿Qué y cómo enseñamos DDHH? lo que posibilitó la revisión de la enseñanza del Holocausto como único referente, posicionando los contenidos de “Dictadura”, “Violaciones a los DDHH”, “Memoria” y “ciudadanía”. El presente artículo ofrece, en primer lugar, una caracterización de la noción marxiana de ideología, implícita y explícitamente desarrollada a partir de una concepción materialista de la historia en La ideología alemana, todo ello desde la perspectiva de la filosofía de la historia. Para ello, en segundo lugar, se comparan los proyectos de filosofía de la historia en Hegel y Marx, tomando como criterio de contrastación la caracterización de filosofías sustantivas de la historia ofrecida por autores como Carl Hempel y (...) Arthur Danto. La conclusión principal a la que se arriba con dicho análisis es, en tercer término, que las críticas de Danto y Hempel a la filosofía sustantiva de la historia no afectan al planteamiento filosófico-histórico marxiano, pues este no tiene como sujeto de la historia al despliegue de la Idea sino a la acción de individuos humanos que actúan en el mundo para satisfacer sus necesidades, realizarse y desarrollar sus instituciones. Global health conditions are marked by inequities due mostly to poverty and lack of access to healthcare services. In a Pandemic setting, Mayan Communities in the Quintana Roo State in Mexico are a good example of how these disparities are exacerbated. First, they may have difficulty in adhering to directives to stay home from work because of the nature of their job, and the necessity to work, their living conditions are marked by crowding and sometimes lack of basic sanitation. Other (...) susceptibilities generally considered are the underlying host factors and medical conditions that may increase the risk of disease or of complications of disease. In general, our native communities experience a high degree of socio-economic marginalization and are at disproportionate risk in public health emergencies, becoming even more vulnerable during this global pandemic, owing to factors such as their lack of access to effective monitoring and early-warning systems, and adequate health and social services. Moral distress is defined as the inability to act according to one’s own core values. During the COVID-19 pandemic, moral distress in medical personnel has gained attention, related to the impact of pandemic-associated factors, such as the uncertainty of treatment options for the virus and the accelerated pace of deaths. Measures to provide aid and mitigate the long-term pandemic effect on providers are starting to be designed. Yet, little has been said about the moral distress experienced by patients and the (...) relational and additive effect on provider moral distress. Pandemic-associated factors affecting moral distress in patients include the constraining effects of isolation on spiritual and religious traditions as well as the intentional separation of patients from their families. This paper will explore the idea that patients are suffering their own moral distress and further how this impacts the intensity of moral distress experienced by the providers—nurses and physicians. The paucity of research in this area with the implications on patient’s distress, decision making, and distress experienced by providers compels further investigation and analysis. (shrink)

Las exigencias del diálogo entre la fe y la cultura actual han obligado a plantearse seriamente la tarea de "inculturación" del cristianismo, una misión necesaria aunque compleja y delicada. Tras definir los términos principales del tema, se exponen los criterios a seguir y los equilibrios necesarios para su adecuada realización. A continuación se describe el objeto principal de este estudio: la inculturación de la catequesis. En primer lugar, los agentes o personas responsables de la inculturación (la comunidad cristiana, los diferentes (...) servicios o ministerios, el papel de los catequistas), los aspectos o lugares particularmente implicados (pequeñas comunidades cristianas, catequesis locales, catequesis populares, etc.). El estudio termina destacando algunos de los posibles riesgos y dificultades que la tarea de inculturar la catequesis debería intentar superar. (shrink)

El Tomus es un documento de reconocido valor doctrinal. La respuesta del Patriarca se ubica después de la Fórmula de Unión y antes del concilio de Calcedonia. En este trabajo se explora su posible influencia en la decisión que siguió. Para esto, compara su contenido con algunos documentos precedentes y con el concilio del año 451. Asimismo, examina el vocabulario técnico que emplea, buscando su grado de coincidencia con los significados anteriores y posteriores de los mismos términos. Luego confronta sus (...) afirmaciones cristológicas con las que se encuentra en los mismos documentos antes mencionados. Finalmente, resume las consecuencias salvíficas que Proclo destaca con motivo de la economía de la encarnación. (shrink)

Este artículo tiene como objetivo principal analizar la relevancia que tiene el discurso mítico en la novela Changó, el gran putas (1983) del escritor colombiano Manuel Zapata Olivella. Se busca dar cuenta que este discurso está presente en la obra en tres niveles que, a pesar de ser distintos, se complementan y entrelazan constantemente. El primero de ellos es el discurso mítico como filosofía. Para la comprensión de este nivel se dará cuenta de la cosmovisión Muntú y religión yoruba que (...) se presenta en la narración. El segundo nivel es el mito como relato, donde se profundiza en la historia de la maldición de Changó que se desarrolla en la novela. En el tercer nivel, es el mito como motor de acción, y en él se analiza la relevancia que tienen ciertos personajes dentro de la trama en relación con el devenir material y político de los pueblos afrodescendientes. Todo ello para comprobar que el discurso mítico no cumple una función meramente narrativa ni contemplativa de un origen o de un pasado lejano, sino que constituye una herramienta de reivindicación cultural y política para los pueblos afrodescendientes en América. This paper presents a revision of the way in which Jürgen Habermas returns to the critical tradition of Marxism regarding the topic of ideology. After the characterization of Habermasian thinking regarding the progress of instrumental rationality it confronts the debate between Habermas and Niklas Luhmann within German Social Theory. Finally, the third section focuses on showing the differences regarding the conception of the place of law in society, based on the theoretical frameworks of Habermas and Luhmann.

El artículo presenta y comenta las catequesis de Benedicto XVI en las audiencias públicas de los miércoles. A lo largo de los años los temas tratados son: los salmos y cánticos litúrgicos de laudes y vísperas; la Iglesia, su naturaleza e identidad; los Padres de la Iglesia; San Pablo (en el Año Paulino, 2008). En 2009, Benedicto XVI lanza una serie dedicada al Año Sacerdotal. En los últimos años de pontificado (2009-2011), presenta figuras de la historia de la Iglesia en (...) la Edad Media en los siglos XII y XIII, y a continuación personalidades femeninas de la historia eclesial de la Edad Media, y Moderna. Una última nueva serie está dedicada a los Doctores de la Iglesia. Estas catequesis dirigidas a todos los fieles constituyen un significativo momento de formación. (shrink)

Los últimos diez años –prácticamente la década a caballo del año 2000– han sido muy fecundos en la reflexión y en el magisterio eclesial a propósito especialmente de la evangelización, la iniciación cristiana y la catequesis. Muchos documentos, publicaciones y experiencias quieren relanzar la acción evangelizadora y catequética por nuevos derroteros.

The study examines the perception that students have of an establishment in the commune of Osorno, about the formation processes and the interpersonal relationships that exist in their school development. The sample is made up of 157 high school students. To achieve the purposes, a survey-type instrument is designed and validated, containing alternatives. The results show that the students consider that their learning process has been positive. They report that the tasks are excessive and the subjects difficult, but they indicate (...) that their teachers know how to explain the same content differently, they are patient, they motivate them to learn. They report that in school they learn and that teachers propose interesting topics in the classes. (shrink)

The biopsychosocial model is characterized by the systematic consideration of biological, psychological, and social factors and their complex interactions in understanding health, illness, and health care delivery. This model opposes the biomedical model, which is the foundation of most current clinical practice. In the biomedical model, quest for evidence based medicine, the patient is reduced to molecules, genes, organelles, systems, diseases, etc. This reduction has brought great advances in medicine, but it lacks a holistic view of the person. To solve (...) the problem, we propose an early team based approach where the primary care physician leads a group of people that can help her/him address the psychosocial issues while she/he attends to the biomedical issues. This article addresses one case where the clinical ethicist facilitating a team based biopsychosocial model for the care of a patient worked as a bridge between the primary team, the critical care team, and the psychosocial team to advance the argument that good communication among the groups can lead to a true biopsychosocial model where the collaboration of the social worker, psychologist, chaplain, ethicist and the different medical teams can improve the overall patient experience. La nueva enfermedad del coronavirus de 2019 (Covid-19), producida por el coronavirus del Síndrome Respiratorio Agudo Severo 2 (SARS-CoV-2), es una pandemia que está creando una creciente crisis sanitaria mundial, dada su novedad, su alcance y sus inicialmente limitadas opciones de tratamiento eficaz. En efecto, se sabe poco acerca de las intervenciones no farmacéuticas óptimas para evitar la morbilidad y mortalidad causadas por él, y también se conoce poco sobre la rentabilidad y aspectos éticos de dichas intervenciones. Por lo tanto, (...) éste es el primer análisis ético y de rentabilidad de las medidas de contención del Covid-19 que se conoce (así como de las medidas de cuarentena de la población para cualquier pandemia en particular), con el fin de ayudar a los sistemas de salud y a los gobiernos a garantizar la atención clínica más rentable que pueda proporcionarse equitativamente al mayor número posible de pacientes, durante esta pandemia y en las futuras crisis mundiales que sean similares. Este análisis utilizó la metodología adoptada por los Centros para el Control y la Prevención de Enfermedades (CDC), cifras comúnmente aceptadas como entradas, y los supuestos mínimos tanto extremos como del mundo real para proporcionar los resultados más sólidos y confiables posibles. El análisis de costos indicó que en los escenarios extremos, o en el mejor de los casos para las medidas de contención del Covid-19 durante la cuarentena de la población, hay una relación de costo-efectividad de $154.86 millones de dólares gastados por cada muerte evitada, y un costo neto de $1.92 billones a nivel mundial. En el mundo real, esta intervención tiene una proporción de 2,520 millones de dólares gastados por cada muerte evitada y un costo neto de 1,99 billones de dólares. La ética del contrato social personalista, tal y como se articula en el popular sistema ético de derechos y deberes de las Naciones Unidas, pone de manifiesto la especial preocupación por el hecho de que estos confinamientos pueden derivar en injusticias poco éticas perpetuadas por los Estados, de manera que socavan las vidas y las libertades individuales, al tiempo que afectan de manera des- proporcionada a las comunidades de menores ingresos, especialmente a las minorías raciales. Este estudio sugiere, por tanto, que la práctica prevalente de la cuarentena entre la población, en comparación con las precauciones de tipo estándar y las intervenciones más específicas, puede proporcionar un beneficio neto inadecuado por su costo financiero y ético. En un momento de escasez mundial, que pone a prueba la capacidad de los sistemas sanitarios para detectar y atender adecuadamente a los pacientes con Covid-19, especialmente en los países en desarrollo y en las comunidades desatendidas, este estudio respalda que se dediquen menos recursos a intervenciones con una relación costo- beneficio poco clara, y más recursos a intervenciones más asequibles, éticas y equitativas, con mayores pruebas de sus beneficios netos para salvar vidas. The United Nations Educational, Scientific and Cultural Organisation’s Declaration on Bioethics and Human Rights refers to the importance of cultural diversity and pluralism in ethical discourse and care of humanity. The aim of this meta-narrative review is to identify indigenous ethical values pertaining to the Ojibway, Xhosa, and Mayan cultures from peer-reviewed sources and cultural review, and to ascertain if there are shared commonalities. Three main themes were identified, namely illness, healing, and health care choices. Illness was described with a (...) more complex and dynamic picture than from the western view, as illness is not considered to be one dimensional. Healing needs to take place on various levels in order to restore a state of equilibrium between the different spheres. Health care choices were also considered from a multi-level perspective. In all three of the indigenous cultures explored, good decision-making is seen to have occurred when choices are informed by commitments to one’s moral and ethical responsibilities towards the community, nature, and the spirit world. Tuberculosis en América Latina y el Caribe: reflexiones desde la bioética Tuberculose na América Latina e no Caribe: reflexões da bioética The objective of this article is to analyze the conditions of access to health services by people with tuberculosis in Latin America and the Caribbean, reflecting on the public health aspects involved from a bioethical perspective. A literature review of the context of tuberculosis in LAC based on epidemiological data was performed. The results were analyzed from its relationship with (...) the social determinants of health and the ethical principles that guide medical practice. Tuberculosis is a pressing public health problem in the region because of its family, social, economic and health impact. It mainly affects vulnerable individuals and populations. Health services violate ethical principles. Tuberculosis is a serious ethics and public health problem in the region that causes death, disability and increased poverty. It is imperative to ensure the right to health services and to understand the individual and public health consequences of non-adherence to treatment. It is important that national tuberculosis control strategies include principles of dignity and non-discrimination of the sick, changes in the social determinants of the disease, and respect for the ethnicity, language culture and identity of patients. En este trabajo se hace un análisis hermenéutico de la obra Constitución Social de Honduras de Ramón Rosa con el fin de revelar rasgos de la identidad hondureña que subyacen en pensadores del siglo XIX en el contexto de la Reforma Liberal. Luego de introducir datos básicos del autor, de la obra y la época histórica de su redacción, se presenta y justifica el uso de un instrumento hermenéutico para analizar dicho texto. Este instrumento divide el análisis en tres ejes (...) temáticos: antropológicos, morales y políticos; posteriormente, aplicando categorías de análisis adecuadas al fenómeno de la nacionalidad en clave de modernidad, se interpretan los contenidos del texto desde los tres ejes temáticos mencionados, para extraer rasgos identitarios desde una postura filosófica. Es así como este artículo se presenta como un primer acercamiento a la conformación de la identidad hondureña a partir de un análisis hermenéutico. (shrink)

Justice Sonia Sotomayor was vilified for arguing that one's social identity can contribute positively to judgment or public reason. This paper considers and expands on Sotomayor's arguments, showing that identity is relevant to snap judgments and to sensation transference that affects how speakers are assessed. It further develops a hermeneutic account of identity that can make sense of its epistemic relevance without foreclosing individual variation.

This chapter examines the lost legacy of John Stuart-Glennie (1841-1910), a contributor to the founding of sociology and a major theorist, whose work was known in his lifetime but disappeared after his death. Stuart-Glennie was praised by philosopher John Stuart Mill, was a friend of and influence upon playwright George Bernard Shaw, and was an active contributor to the fledgling Sociological Society in London in the first decade of the twentieth century. Stuart-Glennie’s most significant idea in hindsight was his theory (...) of what he termed in 1873, “the moral revolution,” delineating the revolutionary changes across different civilizations in the period 2,500 years ago, roughly centered around 500-600 BCE. This is the era currently known as “the axial age,” after Karl Jaspers coined that term in 1949. Stuart-Glennie’s theory of the moral revolution is framed within a three-stage view of history, the first of which involved an outlook he characterized as “panzooinism,” and sometimes as “naturianism.” This theory of aboriginal and early civilizational outlooks is also notable and worthy of consideration in contemporary context, and as a contribution to “the new animism.” The chapter concludes by considering whether the moral revolution/axial age, whose effects have continued for the past 2500 years, is sustainable in the age of the unsustainable Anthropocene. The revolutionary outbreak in a variety of civilizations centered around 600 B.C.E., a period in which the great world religions as well as philosophy emerged, from Hebrew scriptures and the teachings of Buddha to the works of Greek and Chinese philosophers, has been named the Axial Age by Karl Jaspers. Yet 75 years earlier, in 1873, unknown to Jaspers and still unknown to the world, John Stuart Stuart-Glennie elaborated a fully developed and more nuanced theory of what he termed The (...) Moral Revolution to characterize the period. This book also brings to light the previously undiscussed ideas of D. H. Lawrence on the phenomenon from 20 years before Jaspers, the seldom mentioned contributions of Lewis Mumford, and proposes a new context for understanding the phenomenon. Halton rewrites the history of this fascinating theory and opens new ways of conceiving the meaning of The Moral Revolution for today. (shrink)

In 1873, 75 years before Karl Jaspers published his theory of the Axial Age in 1949, unknown to Jaspers and to contemporary scholars today, Scottish folklorist John Stuart Stuart-Glennie elaborated the first fully developed and nuanced theory of what he termed “the Moral Revolution” to characterize the historical shift emerging roughly around 600 BCE in a variety of civilizations, most notably ancient China, India, Judaism, and Greece, as part of a broader critical philosophy of history. He continued to write on (...) the idea over decades in books and articles and also presented his ideas to the fledgling Sociological Society of London in 1905, which were published the following year in the volume Sociological Papers, Volume 2. This article discusses Stuart-Glennie’s ideas on the moral revolution in the context of his philosophy of history, including what he termed “panzooinism”; ideas with implications for contemporary debates in theory, comparative history, and sociology of religion. It shows why he should be acknowledged as the originator of the theory now known as the axial age, and also now be included as a significant sociologist in the movement toward the establishment of sociology. The rise and legacy of world religions out of that period centered roughly around 500-600 BCE, what John Stuart-Glennie termed in 1873 the moral revolution, and Karl Jaspers later, in 1949, called the axial age, has been marked by heightened ideas of transcendence. Yet ironically, the world itself, in the literal sense of the actual earth, took on a diminished role as a central element of religious sensibility in the world religions, particularly in the Abrahamic religions. Given the issue today (...) of ecological unsustainability, including massive die-offs of wildlife and ever-increasing global human population and consumption, the legacy of those world religions face the question I consider here: Can religion transcend the earth in the long run? With the Axial Age/Moral Revolution, comes the possibility of transcendence of the world per se. The moral revolution/Axial Age represented significant changes in civilization, to be sure, but it can also be taken, as I do, as a second phase in the radical shift to anthropocentric mind already begun with the advent of agriculturally based civilization. The axial ideal of transcendence connects to a larger ideal, manifest not only in the legacies of the world religions but in contemporary science and technology, of a philosophy of escape from the earth. I show how ideas of axial transcendence, celebrated by scholars such as Jaspers and Bellah, nevertheless involve an unacknowledged tragic cost, the forgetting of the earth and its lessons and limits as central to what I have termed elsewhere, “sustainable wisdom.” . Thus far most of the scholarship on the axial age has followed Karl Jaspers’ denial that nature could be a significant source and continuing influence in the historical development of human consciousness. Yet more than a half century before Jaspers, the originator of the first nuanced theory of what Jaspers termed the axial age, John Stuart-Glennie, mapped out a contrasting philosophy of history that allowed a central role to nature in historical human development. This essay concerns issues related to my (...) book, From the Axial Age to the Moral Revolution, and begins with a discussion of how I came to uncover the forgotten work of John Stuart-Glennie. Although Jaspers and Stuart-Glennie each drew similar conclusions regarding many of the facts of the moral revolution respectively the Axial Age, there are significant differences in their philosophies of history, concerning, for example the problem, whether history can be regarded deterministically or as an open whole, and whether nature can be a source of profound spiritual significance and even transcendence or whether that realm is limited to historical consciousness. I also briefly discuss two other overlooked contributors, namely D. H. Lawrence, who wrote on the phenomena twenty years before Jaspers, and Lewis Mumford, who is one of the first writers to draw from Jaspers' work. I then respond to four diverse scholarly essays on my book, delineating in the process my own philosophy of history as a progress in precision, paradoxically counteracted by a regressive contraction of mind. In its January 20th, 2010 decision in Citizens United vs. Federal Election Commission, the United States Supreme Court ruled that certain restrictions on independent expenditures by corporations for political advocacy violate the First Amendment of the Constitution, which provides that “Congress shall make no law […] abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” Justice Kennedy, writing for the 5-4 majority, (...) held that “[b]y suppressing the speech of manifold corporations, both for-profit and non-profit, the Government prevents their voices and view-points from reaching the public and advising voters on which person or entities are hostile to their interests” (Citizens United vs. Federal Election Commission 558 U.S. 38-9 (2010); emphasis added). Much of the language of the opinion, and some of its reasoning, as this passage illustrates, presupposes that corporations are agents capable of speech, and that it is (at least in part) in the light of this that limitations on political advocacy by corporations are prohibited by the Constitution. -/- While there are other strands in the argument, they are interwoven with the conception of the corporation as agent and speaker, with its voice and its viewpoints. The dissenters on the court objected on precisely this point (among others). Justice Stevens wrote sarcastically in his dissent, joined by Justices Ginsburg, Breyer, and Sotomayor, that “[u]nder the majority’s view, I suppose it may be a First Amendment problem that corporations are not permitted to vote, given that voting is, among other things, a form of speech” (558 U.S. 33 (2010)). Justice Sotomayor suggested in oral argument that the Court’s century-old practice of treating corporations as persons rests on a conceptual mistake. -/- My concern in this essay is not with the question whether the restrictions violate the Constitution. There are many issues that bear on this which will be outside the scope of my discussion. My concern is with the proper conceptual framework for understanding the agency of corporations and corporate speech, and the role that conceptions of these play in the background of the majority’s reasoning. The issue is legal, but it also has philosophical, conceptual and semantic aspects. It will be the latter aspects, and their potential to shed light on legal reasoning, that are my main focus. An adequate framework requires saying what properly speaking the corporation is, how agency is expressed through the corporation, whose agency it is, centrally whether the corporation is an agent or person in its own right, and in what sense it can be said to be capable of speech. I draw on recent work in collective action theory, particularly with respect to the semantics of collective action sentences (Ludwig 2007) and the analysis of the proxy agency in collective action (Ludwig 2014), to show (i) that corporations are neither genuine agents nor (therefore) capable of engaging in genuine speech, (ii) that consequently the First Amendment does not apply to corporations per se, and (iii) that a better understanding of the mechanisms of corporate agency casts doubt on more indirect arguments for extending the First Amendment to “corporate speech” as well.
