In the rabbinic literature from the land of Israel the poor are depicted not as passive recipients of gifts and support, but as independent agents who are responsible for their own behaviour. Communal care for the needy was expected to go beyond their basic needs for food, clothing and shelter; the physical safety of the poor and the value of their time as well as their dignity and self-worth were also included in the scope of charity. In this monograph, Yael (...) Wilfand offers a comprehensive and contextual analysis of major rabbinic texts on poverty and charity composed during the first five centuries of the Common Era in the land of Israel, principally the Mishnah, the Tosefta, the Palestinian Talmud and midrashim. She shows that, for the rabbis, the poor were not necessarily considered outsiders; indeed, some students and rabbis in Palestine may have personally experienced poverty. Wilfand claims that such socio-economic diversity contributed to the thinking of these rabbis, who rarely saw poverty as a result of transgression (in contrast to the Babylonian Talmud). This book presents a number of contrasting viewpoints held by Palestinian rabbis over such questions as: Must communal administrators ensure applicants' eligibility for alms? Should the newly indigent from wealthy families receive exceptional levels of support? Might neighbouring gentiles qualify for economic assistance from Jewish communal sources? By examining Palestinian rabbinic sources within the contexts both of the hegemonic Greco-Roman (later, Christian) milieu and of the biblical heritage, this volume offers an absorbing account of some ancient approaches to timeless social challenges. Transitional Justice (TJ) focuses on the processes of dealing with the legacy of large-scale past abuses (in the aftermath of traumatic experiences such as war or authoritarianism) with the aim of fostering domestic justice and creating the basis for a sustainable peace. TJ however also entails the problem of how a torn society may be able to become a self-determining member of a just international order. This paper presents a minimal conception of TJ, which departs from Rawls' conception of normative (...) stability of the international order, which suggests disentangling the two goals of fostering democracy within torn societies and TJ itself. The scope of TJ is therefore limited to enabling these societies to create minimal internal conditions for joining a just international order on equal footing. This paper makes an original contribution to two different debates, namely normative research on TJ, and post-Rawlsian literature in general. First, it provides a new direction for normative theorizing about TJ which takes both its domestic and international dimensions seriously into consideration. Second, it extends Rawls' political liberal outlook to an area where it is not usually understood to apply. (shrink)

Throughout history the image of the non-Jew in Judaism has profoundly influenced the way in which Jews interact with non-Jews. It has also shaped the understanding that Jews have of their own identity, as it determines just what distinguishes them from the non-Jews around them. A crucial element in this is the concept of Noahide law, understood by the ancient rabbis and subsequent Jewish thinkers as incumbent upon all humankind, unlike the full 613 divine commandments of the Torah, which are (...) incumbent on Jews alone. The approach adopted in this now classic study is to consider the history of the idea of Noahide law, and to show how the concept is relevant to practical discussions of the halakhah pertaining to non-Jews and to relations between Jews and non-Jews. The seven chapters that make up the first part of the study examine each of the Noahide laws in turn, with a view to showing their halakhic development in the rabbinic sources, in the codes, and in the responsa literature. The discussion draws primarily on classical texts by traditional commentators as they attempt to deal with living issues from the rabbinic world as equally vital concerns in their own time. This chapter examines the methodologies, new approaches, and challenges in the use of rabbinic literature to study the history of Judaism in late antiquity. At a time when bioethical issues are at the top of public and political agendas, there is a renewed interest in representations of the embryo in various religious traditions. One of the major traditions that have contributed to Western representations of the embryo is the Jewish tradition. This tradition poses some difficulties that may deter scholars, but also presents some invaluable advantages. These derive from two components, the search for limits and narrativity, both of which are directly connected with the (...) manner in which Jewish tradition was constructed in Antiquity. The article accomplishes three goals: • To introduce some central elements in ancient Rabbinic literature on the subject of the embryo and its representation; • To present this body of literature as clearly as possible, noting some of the difficulties encountered by scholars who engage in its study; • To explain how the literature’s textuality came about, examining the particular sociopolitical circumstances of Judaism at that time, including the reasons for the delay in the production of scientific texts, transmitted as such, as compared to other philosophical or religious traditions. The claim is that these circumstances engendered a tradition peculiarly relevant for the study and teaching of medical ethics today. (shrink)

Challenging earlier cognitivist approaches, recent theories of embodied cognition argue that the human mind and its functions are best understood as intimately bound up with the human body and its physiological dimensions. Some scholars have suggested that such theories, in departing from some core assumptions of the Western philosophical tradition, display significant similarities to certain non-Western traditions of thought, such as Buddhism. This essay extends such parallels to the Jewish tradition and argues that, in particular, classical rabbinic thought presents a (...) profoundly nondualistic account of the body–soul relation in its connection to cognition, action, and embodiment. Classical rabbinic texts therefore model the possibility of engaging with ‘Western’ conceptions such as God and the soul, while doing so in a manner that resonates strongly with many aspects of contemporary scientific theories. Thus, beyond their value as historical documents, insight into the texts and concepts of classical rabbinic Judaism can contribute to the further development of new theories of intellect and cognition. Abstract:This study explores the relationship between beauty and intellect, often represented as diametrical opposites, in Chinese and Jewish texts, particularly with reference to Confucian and rabbinic texts. Four discourses concerning the nexus of beauty and intellect are presented: antagonistic, complementary, authentic, and epistemic. In both traditions, although more so in Confucianism, intellect is sometimes elided with moral virtue, adding another element to the discussion. The comparison of this theme in distant traditions seeks to highlight their shared resistance to a single (...) interpretation or a consistent outlook: while Confucian texts tend to embrace a complementary discourse, along the lines of a physiognomic tradition, competing views can be detected. Likewise, the rabbinic tradition inherits the biblical view that "beauty is vain" but still manifests some cases of a complementary discourse. (shrink)

This essay explores classical rabbinic literature's understanding of the prohibition of bloodshed alongside its understanding that "the image of God" corresponds to the physically embodied individual. This conception generates radical implications so that, apart from the narrow instance of a direct aggressor with intent to kill or rape, it is never legitimate to cause the death of any person, even in pursuit of a supposed "greater good." While notions of war and execution are retained in principle, the requirement of direct (...) divine sanction for such actions neutralizes them in practice, removing them from the domain of human judgment and justification. This chapter aims to define to state of investigation of research into rabbinic literature. It describes the most important approaches in research on the basis of which rabbinic literature has been and is being studied. These include the traditional halakhic approach, the exploitative-apologetic approach, and the thematic approach. This chapter concludes that the questioning of the redactional identity of the individual works of rabbinic literature inevitably also disavows the research approach to the work at the level of the final redaction.

Do ubiquitous modes of thought (types of analysis, types of argumentation) pervade the entire corpus of the Rabbinic writings of late antiquity and impart coherence to those diverse documents? Here are the results of a systematic probe of representative Halakhic and Aggadic documents in search of the answer to that question. The result is limited but one-sided: the answer is yes, they do. The inquiry proves urgent, because the bases for supposing the Rabbinic documents coalesce have diminished, and the differences (...) between and among the respective documents have made their mark. The book asks whether, however diverse, all of the documents conform to a single, determinate program of [1] analysis and [2] argumentation. Do they raise in common a set of questions that are ubiquitous, and do they pursue a uniform inquiry, whatever the data subject to study? Further, does a single protocol of argumentation dictate the means by which analytical propositions are advanced and tested? If they do, then Rabbinic Judaism finds coherence in shared intellectual traits. These, then, would serve to define the foundations for the construction of all components into the Rabbinic system and structure. (shrink)

De allí que quepa preguntarse cuál es el propósito de dialogar con una otredad imaginaria. Se examinan las construcciones identitarias de los dos primeros personajes gentiles de los que hasta ahora se tiene noticia: el de la Disputatio christiani cumgentili de Gilberto Crispino y el de la (...) Disputatio inter christianum et gentilem del Pseudo-Anselmo. A partir de estas construcciones, se discutirá la función que cada gentil desempeña en su respectivo diálogo, con el objetivo de establecer qué relación mantienen estas identidades dialogantes con la intentio operis. ABSTRACT In the 11th century, the dialogical literature that emerged in the context of Latin Christianity included, among its repertoire of interlocutors, one that was always fictional: the Gentile. Thus, the question arises as to the purpose of entering into dialogue with an imaginary other. The article examines the constructions of identity of the first two known Gentile characters: that of Gilberto Crispino's Disputatio christiani cum gentili and that of Pseudo-Anselm's Disputatio inter christianum et gentilem. On the basis of these constructions, we discuss the role played by each Gentile in his respective dialogue, in order to establish the relationship between these participating identities and the intentio operis. John Rawls's influential theory of justice and public reason has often been thought to exclude religion from politics, out of fear of its illiberal and destabilizing potentials. It has therefore been criticized by defenders of religion for marginalizing and alienating the wealth of religious sensibilities, voices, and demands now present in contemporary liberal societies. In this anthology, established scholars of Rawls and the philosophy of religion reexamine and rearticulate the central tenets of Rawls's theory to show they in fact offer (...) sophisticated resources for accommodating and responding to religions in liberal political life. The chapters reassert the subtlety, openness, and flexibility of his sense of liberal "respect" and "consensus," revealing their inclusive implications for religious citizens. They also explore the means he proposes for accommodating nonliberal religions in liberal politics, developing his conception of "public reason" into a novel account of the possibilities for rational engagement between liberal and religious ideas. And they reevaluate Rawls's liberalism from the "transcendent" perspectives of religions themselves, critically considering its normative and political value, as well as its own "religious" character. _Rawls and Religion_ makes a unique and important contribution to contemporary debates over liberalism and its response to the proliferation of religions in contemporary political life. Writing about secession is not an easy task for a political philosopher. Yet, writing about secession in India raises further practical and theoretical problems. The incredible task of professor Chandhoke’s book, Contested Secessions, is thus to provide a restatement of a liberal theory of secession, understood as a remedial right theory, which is still compatible with situations of contested secessions, such as those occurring in post-colonial societies like India. This paper focuses on two distinct yet related aspects of Chandhoke’s theory: (...) her distinctive version of remedial right theory, and her emphasis on a form of comprehensive pluralist liberalism. I argue that this approach might result in inconsistency due to the conflicting demands of these two approaches. If we take seriously Chandhoke’s political claim in favour of the legitimacy of what she calls “formal” democracy, further clarifications are needed with respect to the account of pluralism she proposes. In this paper, I examine whether Wenar's Bloody Oil ( 2016) succeeds in providing a theory able to accommodate the statist commitment to peoples’ sovereignty without dismissing the cosmopolitan concern regarding a just global market. Contextualising Blood Oil within the broader debate on global justice and resource ownership, I focus on some specific aspects of Wenar’s Clean Trade scheme and explain why it comes to quite radical conclusions. Yet, if these conclusions are taken seriously, Clean Trade seems too demanding from (...) the point of view of a statist account of justice. For cosmopolitans, too, the lack of normative justification for any alleged national resource sovereignty might weaken this position, especially for those who might oppose arguments to justify different forms of resource ownership. I will therefore discuss two problems with Wenar’s theory. First, I will show that, in spite of its statist premises, Wenar’s radical conclusions hardly pass the test of anti-paternalism. Is the Clean Trade scheme able to accommodate the demand of pluralism emerging in the Society of Peoples? Second, I focus on an issue that is neglected in Wenar’s book and which refers directly to the normative basis of resources ownership. I argue that this is a crucial issue, especially in contexts where the traditional idea of national sovereignty is contested, which often occurs in resource-cursed societies. (shrink)

The author applies the fields of gender studies, psychoanalysis, and literature to Talmudic texts. In opposition to the perception of Judaism as a legal system, he argues that the Talmud demands inner spiritual effort, to which the trait of humility and the refinement of the ego are central. This leads to the question of the attitude to the Other, in general, and especially to women. The author shows that the Talmud places the woman (who represents humility and good-heartedness in the (...) This research note presents data concerning the community engagement activities of 2,096 Swiss companies as reported by a single company respondent in an online survey. Switzerland affords an interesting opportunity to compare engagement activities in a single country with multiple culture systems across companies varying in size from large to small and medium enterprises. Study results show that 78% of the surveyed firms pursue some community engagement activities. While engagement is mostly practiced in traditional forms, more active forms are not (...) uncommon. The main motivating factor is a concern for the communities in which the firms operate. Engagement activities are mostly employed independent of financial considerations and are conducted flexibly to serve personal interests of the firms’ decision makers. Swiss firms’ reported environmental assessment activities show no specific patterning. Perceiving engagement to be on the rise globally and in Switzerland is associated with a greater likelihood to be involved. Accordingly, knowing other engagement pursuing firms increases the individual firm engagement probability. The German speaking part of Switzerland is more active in engagement than the French and Italian speaking parts. Bigger companies pursue engagement activities more intensively and strategically than do SMEs. (shrink)

It begins by noting the challenges which the 'return' of religions to liberal democracies poses to the liberal commitment to respect citizens’ freedom and equality. Then, with particular reference to Rawls' theory of liberal politics, it situates the papers in relation to three different senses of liberal ‘respect’ that are challenged by contemporary religions – one understood in terms of the justification of political (...) power, another as tolerance of diversity, and the third in terms of freedom from interference. Approaches to the “Indian Issue” which fail to go beyond the mere charting of evolutions in legal norms or the articulation between neoliberalism and multiculturalism do not allow us to take the full measure of indigenous policies, in terms of the goal set for the enlargement of the spaces for public interpellation and the reconfiguration of ideas and practices pertaining to citizenship. Starting from the Argentine experience, the aim of this article is to examine the question of the sedimentation of (...) neoliberal procedures, in a context marked by the will to re-appropriate national and popular sovereignty over territories and resources. The Indian question thus poses both the problem of the model of development that has been adopted and the question of the characterizing of the pleb (the category of the popular, or of those most underprivileged) as a part of the populus, that is, as part of the people of the nation, and therefore of the demos, understood as the space open to those who can legitimately give form and content to populus and who can put words on the world.
