This article argues that we can understand Jean Epstein's theory of photogénie as an instance of technics. Starting from a reading of Epstein's final fictional film Le Tempestaire, we can see that Epstein collapses the distinction between human and technological. This insight leads to a discussion of Epstein's theory of photogénie more generally, and one that highlights the term's relationship to temporality. This temporal dimension recalls Bernard Stiegler's discussion of technics in Technics and Time. As the series evolves, Stiegler increasingly (...) foregrounds cinema as technics, and the essay ends with a discussion of the ways that Epstein's understanding of photogénie can press on Stiegler's claims. Vacillating and mixed emotional experiences are often difficult to explore and understand because they confront the limits of our language's ability to capture private experiences in extreme or abnormal circumstances. In this paper, we build upon remarks by Wittgenstein (1953) to present a conceptual-discursive perspective based on naturalistic examples of individuals vacillating between pride and other emotions. This perspective is used to show how relevant emotion theories contain conceptual errors of the sort identified by Wittgenstein. The “assembled reminders” of shifts (...) between pride and other emotions are presented in contrast to analyses that focus on people's identification of causes of emotions, an approach which leads to theoretical speculation about underlying appraisal set changes or discussion of the empirical justification of cognitive ontology. We bypass a direct confrontation on these issues by examining how people's talk about the content of vacillating and mixed emotional experiences (i.e., aspect shifts) augments a shared “emotionology” with creative expressions and poetic comparisons. This last point is illustrated by the emotional instability experienced by individuals with Borderline Personality Disorder (BPD). Support for the conceptual-discursive perspective is provided by the success of a particular therapeutic approach, the Conversational Model, in ameliorating the developmental disruption of BPD by encouraging participation in empathic conversations. We conclude that a conceptual-discursive perspective undermines the cognitive appraisal “picture” of vacillating emotions and adds to our understanding. (shrink)

This article seeks to analyze the conditions in which group-based pride is rationally appropriate. We first distinguish between the shape and size of an emotion. For the appropriate shape of group-based pride, we suggest two criteria: the distinction between group-based pride and group-based hubris, and between we-mode and I-mode sociality. While group-based hubris is inappropriate irrespective of its mode due to the arrogant, contemptuous, and other-derogating character of this emotion, group-based pride in the we-mode is appropriate in terms of shape (...) if it is felt over an achievement to which the group members collectively committed themselves. For the same reason, members of I-mode groups can feel appropriately proud of the achievement of their group if they have collectively contributed to it. Instead, group-based pride by mere private identification with a successful group can be rationally appropriate if it manifests the person’s reduced-agency ideal and is also part of a coherent pattern of rationally interconnected emotions focused on the same ideal. Moreover, we suggest that pride in the success of one’s family member or a close friend is typically felt over the rise of social status that one group member’s success grants to the group. However, social status cannot be valued for its own sake as this undermines the values upon which social status is founded. Instead, direct or indirect causal contribution to the success of one’s child, friend, or student can warrant group-based pride, which may be justified on the basis of shared values without causal contribution as well. Finally, regarding the size of group-based pride, members of we-mode groups are warranted to experience and express more intense pride than members of I-mode groups. Moreover, the proper intensity of this emotion depends on the particular other to whom the expression is directed. Finally, criteria of appropriate size don’t apply to shared group-based pride as sharing increases the intensity of emotion by default. (shrink)

In his anthology of socio-political essays, Evolution and Human Life, Oka Asajirō, early twentieth century Japan’s foremost advocate of evolutionism, developed a biological vision of the nation-state as super-organism that reflected the concerns and aims of German-inspired Meiji statism and anticipated aspects of radical ultra-nationalism. Drawing on non-Darwinian doctrines, Oka attempted to realize such a fused or organic state by enhancing social instincts that would bind the minzoku and state into a single living entity. Though mobilization during the Russo-Japanese War (...) seemed to evince this super-organism, the increasingly contentious and complex society that emerged in the war’s aftermath caused Oka to turn first to Lamarckism and eventually to orthogenesis in the hopes of preserving the instincts needed for a viable nation-state. It is especially in the state interventionist measures that Oka finally came to endorse in order to forestall orthogenetically-driven degeneration that the technocratic proclivities of his statist orientation become most apparent. The article concludes by suggesting that Oka’s emphasis on degeneration, autarkic expansion, and, most especially, totalitarian submersion of individuals into the statist collectivity indicates a complex relationship between his evolutionism and fascist ideology, what recent scholarship has dubbed radical Shinto ultra-nationalism. ArgumentContrary to common portrayals of social Darwinism as a transference of laissez-faire values, the widely read evolutionism of Japan's foremost Darwinist of the early twentieth-century, Oka Asajirō (1868–1944), reflects a statist outlook that regards capitalism as the beginning of the nation's degeneration. The evolutionary theory of orthogenesis that Oka employed in his 1910 essay, “The Future of Humankind,” links him to a pre-Darwinian idealist tradition that depicted the state as an organism that develops through life-cycle stages. For Oka, laissez-faire capitalism (...) marked the moment when the state began to decline toward extinction due to the orthogenetic overdevelopment of hitherto subordinate individual egos. Because conservative bureaucrat-intellectuals had been drawing upon this same organicist-developmental tradition since the 1880s in an attempt to forestall the social ills of industrialism, Oka's call for statist measures, including eugenics, to lessen and delay the atomizing, enervating, and corrupting influence of capitalism articulated the political vision of officialdom. Statist evolutionism, not social Darwinism, might be the term that best describes Oka's approach. (shrink)

In doing so, he reveals the value for psychologists in adopting a philosophical method of conceptual investigation to work through and become more reflexive about prominent theories, methods, therapies and practices in their respective, multiple fields and thereby create a resource for future theoretical, empirical and applied psychologists. Last year marked the 20th anniversary of the Foreign Corrupt Practices Act (FCPA) of 1977. The FCPA is the first and only statute prohibiting bribery and other corrupt business practices by U.S. citizens and companies conducting business overseas. This paper provides an overview of the FCPA during the two decades of its existence. More specifically, the objectives of this paper are four-fold. First, the paper provides background information about the FCPA of 1977 and subsequent amendments in 1988. Second, the paper (...) discusses the enforcement of the FCPA since its passage by examining the number of cases prosecuted under the FCPA and the respective penalties imposed. Third, the paper discusses the economic impact of the FCPA by addressing whether the FCPA places U.S. firms at a competitive disadvantage. Fourth, the paper provides public policy recommendations to expand the reach and scope of the FCPA. It covers efforts to criminalize bribery through multilateral organizations, such as the Organization for Economic Cooperation and Development (OECD), the World Trade Organization (WTO), and the Organization of American States (OAS). It also covers bilateral arrangements and efforts by non-governmental organizations such as Transparency International. (shrink)

Based on responses from 1078 human resource (HR) professionals, this study concludes that there is not an ethical crisis in the work place. Seven of 37 situations were rated as serious problems by more than 25% of the respondents. HR reported that their organizations are serious about uncovering and disciplining ethical misconduct, top management has a commitment to ethical business conduct, personal principles are not compromised to conform to company expectations, and performance pressures do not lead to unethical conduct.
