Das Husserlbild der Gegenwart ist noch weitgehend gepragt von den erkenntnistheoretischen "Logischen Untersuchungen", durch die Husserl in weitem MaBe als Begriinder einer neuen objektiven Logik gilt. Mitunter wird er sogar als einseitig orien tierter Rationalist und Aufklarer des 20. J ahrhunderts, als der "Cartesius unserer Tage" 1 angesehen. Dieses Bild Husserls kann wohl jederzeit durch seine Veroffent lichungen gerechtfertigt werden. Dennoch ist es einseitig und recht vordergriindig, da dabei voll und ganz iibersehen wird, daB auch der Bereich des Emotionalen flir (...) HusserI ein entscheiden gut wie nichts des Interessengebiet darstellt, wovon bislang so veroffentlicht worden ist. Wohl werden in seinen Schriften gclegentlich Fragen der Wertlehre, der Asthetik und Ethik angeschnitten 2, aber eine eingehende Auseinandersetzung mit derartigen Fragen liegt in keinem der veroffentlichten Werke vor. In Wirklichkeit aber war ihm die Begriindung einer echten wissenschaftlichen Ethik immer ein ernstes philosophisches An liegen. Franz Rosenzweig's philosophical writings from his years of study (1906-1914) are now published for the first time. The publication of his historical and art-historical works is planned. In the first part of the two - volume publication we find his seminar work on the main subjects of the Kantian philosophy, which he gave to his academic teachers Alois Riehl at the Friedrich Wilhelm University of Berlin (1907/1908) and the professors Jonas Cohn and Hans Rickert at the University of (...) Freiburg (1908) / 1910). They provide an insightful insight into the development of his philosophical thinking and testify to the intensive study of Kant, which was later to be found in the system of Rosenzweig's "Star of Redemption" (1920). "The three verbs, which form the star, namely, the question of the possibilities 'to perceive the All', 'to experience the miracle,' to 'ask the kingdom,' is what the temporality of the thematized in it appears, In a certain analogy to the three epigrams, which, with their respective 'objects' indicated by infinitives, set aside the field of philosophizing in Kant: 'to know', 'to do', 'to hope.' Barry Smith has written a book about an important topic in philosophy and its recent history, concerning the legacy of Franz Brentano. “The Legacy of Franz Brentano” is also its subtitle, a subtitle much more revealing of its contents than its title: Austrian Philosophy. That title makes one expect either a general picture of philosophy in Austria, past and/or present, or an account of what Rudolf Haller has called Austrian Philosophy, a term that refers to its golden age, (...) to a tradition whose main characteristics are, according to Haller, empiricism, proximity to science, and a concern with language. Smith includes these properties in his characterization of the legacy of Brentano, and adds quite appropriately for that legacy “a concern with ontological structure” and “an overriding interest in the relation of macro-phenomena ... to ... micro-phenomena which underlie or are associated with them”. Smith is quite aware that this addition does not hold for the tradition of Austrian philosophy, since he opposes it to a German tradition, and delineates the former “by means of a list beginning with Bolzano, Mach and Meinong, and ending with Wittgenstein, Neurath, and Popper”. What emerges in Fischer’s phenomenological aesthetics is clearly the view that empathy is absolutely crucial not only to the apprehension of the aesthetic object, but also to the enjoyment of it. While this position certainly has merits, I have argued that in some ways his phenomenological description leaves something to be desired. This was particularly seen in his claim that empathy can never be described as an intuitive presentation of feeling. Perhaps another criticism which can be added here is (...) be found in a consideration of abstract works of art. In the case of these it would seem that empathy plays a much smaller role than it does in the apprehension of other aesthetic objects, especially works of art of other kinds. This is not to say that empathy could play no role at all in the apprehension of abstract works of art, for we may keep in mind that Fischer formulates the notion of mechanical empathy whereby one empathetically grasps power and other phenomena which are analogues of the will. It remains to be seen in the further development of a phenomenological aesthetics whether the notion of empathy can be applied in any other way in such cases. (shrink)

This is a selection of essays on moral responsibility that represent the major components of John Martin Fischer's overall approach to freedom of the will and moral responsibility. The collection exhibits the overall structure of Fischer's view and shows how the various elements fit together to form a comprehensive framework for analyzing free will and moral responsibility. The topics include deliberation and practical reasoning, freedom of the will, freedom of action, various notions of control, and moral accountability. The (...) essays seek to provide a foundation for our practices of holding each other (and ourselves) morally and legally accountable for our behavior. A crucial move is the distinction between two kinds of control. According to Fischer, "regulative control" involves freedom to choose and do otherwise ("alternative possibilities"), whereas "guidance control" does not. Fischer contends that guidance control is all the freedom we need to be morally responsible agents. Further, he contends that such control is fully compatible with causal determinism. Additionally, Fischer argues that we do not need genuine access to alternative possibilities in order for there to be a legitimate point to practical reasoning. Fischer's overall framework contains an argument for the contention that guidance control, and not regulative control, is associated with moral responsibility, a sketch of a comprehensive theory of moral responsibility (that ties together responsibility for actions, omissions, consequences, and character), and an account of the value of moral responsibility. On this account, the value of exhibiting freedom (of the relevant sort) and thus being morally responsible for one's behavior is a species of the value of artistic self-expression. (shrink)

Stanley Cavell's work is distinctive not only in its importance to philosophy but also for its remarkable interdisciplinary range. Cavell is read avidly by students of film, photography, painting, and music, but especially by students of literature, for whom Cavell offers major readings of Thoreau, Emerson, Shakespeare, and others. In this first book-length study of Cavell's writings, Michael Fischer examines Cavell's relevance to the controversies surrounding poststructuralist literary theory, particularly works by Jacques Derrida, J. Hillis Miller, Paul de Man, (...) and Stanley Fish. Throughout his study, Fischer focuses on skepticism, a central concern of Cavell's multifaceted work. Cavell, following J. L. Austin and Wittgenstein, does not refute the radical epistemological questioning of Descartes, Hume, and others, but rather characterizes skepticism as a significant human possibility or temptation. As presented by Fischer, Cavell's accounts of both external-world and other-minds skepticism share significant affinities with deconstruction, a connection overlooked by contemporary literary theorists. Fischer follows Cavell's lead in examining how different genres address the problems raised by skepticism and goes on to show how Cavell draws on American and English romanticism in fashioning a response to it. He concludes by analyzing Cavell's remarks about current critical theory, focusing on Cavell's uneasiness with some of the conclusions reached by its practitioners. Fischer shows that Cavell's insights, grounded in powerful analyses of Descartes, Hume, and Wittgenstein, permit a fresh view of Derrida, Miller, de Man, and Fish. The result is not only a revealing characterization of deconstruction but a much-needed and insightful introduction to Cavell's rich but difficult oeuvre. (shrink)

Brain functions are stochastic processes without intentionality whereas mind emerges from brain functions as a Hegelian “change from quantity”, that is, on the order of 1012 profusely interconnected neurons, “into a new quality”: the collective phenomenon of the brain's self-experience. This self-referential and self-observing quality we have in mind is capable of (recursively) observing its self-observations, i.e., interpreting change that is meaningful in relation to itself. The notion of self-interpretation embodies the idea of a “hermeneutic circle”, that is, (in interpretation (...) theory) the treatment of the whole in relation to its parts. (shrink)

In solving judgment aggregation problems, groups often face constraints. Many decision problems can be modelled in terms the acceptance or rejection of certain propositions in a language, and constraints as propositions that the decisions should be consistent with. For example, court judgments in breach-of-contract cases should be consistent with the constraint that action and obligation are necessary and sufficient for liability; judgments on how to rank several options in an order of preference with the constraint of transitivity; and judgments on (...) budget items with budgetary constraints. Often more or less demanding constraints on decisions are imaginable. For instance, in preference ranking problems, the transitivity constraint is often contrasted with the weaker acyclicity constraint. In this paper, we make constraints explicit in judgment aggregation by relativizing the rationality conditions of consistency and deductive closure to a constraint set, whose variation yields more or less strong notions of rationality. We review several general results on judgment aggregation in light of such constraints. (shrink)

What role, if any, should Confucianism play in the politics of our time? In some of my previous works, I claimed that modern liberal states are not permitted to promote Confucian values on the basis of their intrinsic merits. Yet, drawing insights from Joseph Chan’s moderate state perfectionism and John Rawls’s wide view of public political culture, I proposed the “wide view of moderate perfectionism.” According to this view, in public political discussion, citizens should be allowed to deliberate whether and (...) how Confucianism, among other reasonable moral doctrines, can make positive contributions to their social and political thinking and public policymaking, provided that certain conditions are met. This view has been criticized by some scholars, in particular Zhuoyao Li. Li argues that the practice of the wide view of moderate perfectionism would inevitably harm civility. In this article, I clarify and develop the wide view and respond to Li’s criticisms. (shrink)
