Les normes au sens le plus large sont issues des interactions entre les individus et sont interprétées au sein de ces interactions, même si la complexité des interactions tient aussi à l'intervention des institutions et des Etats. Il s'agit de partir du micronormatif pour aller vers le macronormatif (notamment les lois et les traités) et non l'inverse, de manière à rendre compte de phénomènes comme la responsabilité sociale des entreprises, le droit souple et la prise en compte de l'éthique pour (...) prendre des décisions (au plan national et international, en matière environnementale et médicale, etc.). Le constat de départ est qu'une masse colossale de normes de toute origine s'applique à des individus, personnes physiques ou morales, qui à leur tour participent de l'élaboration de normes. L'inflation et la diversification des normes engendrent notamment une crise du droit (en quête d'identité), mais aussi une crise des institutions et des professions judiciaires. Une façon de rendre compte de ces crises consiste à établir une sorte de cartographie des interactionnismes au regard des normes. Emergent ainsi des interactionnismes philosophiques, sociologiques, anthropologiques, psychologiques, éthiques ou juridiques. Les différents interactionnismes peuvent apparaître critiquables au regard des normes (notamment en raison de leur caractère descriptif et non institutionnel) et il serait fort utile de dégager des voies alternatives. L'introduction met en place cette problématique (E Picavet et E Jeuland). Après une recherche théorique et pratique menée par des juristes (E Jeuland et L Champain), un sociologue des professions (F Champy) nous permet de penser l'évolution des professions judiciaires entre statut et adaptation. Une philosophe spécialisée dans l'interactionnisme (C Bonicco) ainsi qu'une psychanalyste (H Tessier) s'interrogent sur les normes implicites, non dites et les rapports de domination sous-jacents aux interactions. Un philosophe spécialisé dans la justice climatique et le nucléaire ouvre un nouveau champ de réflexion particulièrement nécessaire aujourd'hui en incluant la nature au sein des interactions humaines (F P Piguet). Deux ingénieurs nous présentent une approche des interactionnismes et de l'innovation technologique (J F Omhover et C Bouchard) qui n'est pas sans lien avec la nature et le droit. Un anthropologue estime que le droit tel qu'il est connu depuis deux ou trois siècles dans une version très étatique est en plein bouleversement et revient à des formes microjuridiques (Etienne le Roy). Un juriste essaie enfin de faire la synthèse des articulations entre les normes et les interactions (J Moret-Bailly). Il en ressort une présentation transdisciplinaire des différents versants du problème de la relation entre les normes et les individus. (shrink)

Constitué d'analyses et de réflexions sur les méthodes pratiquées aujourd'hui dans l'écriture de l'histoire de la philosophie, cet ouvrage vise à rendre compte de la différence des pratiques existant selon les traditions et à interroger l'existence d'une démarche historique spécifique au domaine de la philosophie. L'enjeu fondamental est donc de savoir s'il existe une historiographie propre à la philosophie. Les interrogations portent en particulier sur les questions des critères d'exactitude, de vérification, de crédibilité qui permettraient de distinguer et de décider (...) entre les interprétations. Si le travail de l'interprétation est infini, toujours à refaire, reprendre et corriger, cela n'implique nullement l'abandon des exigences qui fondent la pertinence historique. In this article, I discuss Gerbert Faure’s Vrije wil, moraal en het geslaagde leven (Free Will, Morality, and the Well-lived Life). I summarize and elucidate Faure’s argument. My criticisms are directed primarily at the first chapter of the book, in which Faure develops what he regards as a Strawsonian account of free will and moral responsibility. Faure denies that we have free will; I argue that Strawsonians should not deny this. Faure argues that, although we do not have free (...) will, it is often justified to hold others responsible, because we owe it to the victim(s) of a wrong to hold the perpetrator responsible; it is our moral duty. I argue that we only have a moral duty to hold perpetrators responsible if they are morally responsible. I also comment on the way in which Faure presents Strawson’s distinction between theory and practice. (shrink)

My apology for reverting to this subject is a recent article by Mr. W. C. F. Walters in the April number of the Classical Quarterly for 1910 on the signatures in the Vatican Codex . Mr. Walters does not seem to have been aware that this manuscript, though not of direct value in the constitution of the text of Livy, is one whose interest from a palaeographical point of view has long been recognized. A number of articles have been written (...) concerning it, most of which deal with the signatures, the subject of Mr. Walters' paper, more fully and more accurately than he has done. Beyond giving the signatures, two of them incorrectly, Walters does nothing more than to conclude that there were eight scribes, who copied 42 quaternions. But a great deal more than this is known about the scribes and the manuscript. In fact, thanks to the ingenious combinations of Chatelain and Traube in piecing together the hints suggested by the signatures, more is known about this particular manuscript and the circumstances under which it was made than is the case with any other manuscript of a classical author of so early a date. It may therefore be worth while to summarize the known data concerning the manuscript, with a brief account of how they were worked out, referring the reader for the details to the articles mentioned in the footnotes. The main difficulty utilitarians have faced is the problem of reconciling the dictates of utility with what seem clearly to be moral duties, but based on considerations of Justice. John Stuart Mill addressed this problem in his essay,Utilitarianism,and the result has not served to silence the critics of utilitarianism on this score. In part, this is due to the fact that Mill's position in the chapter on Justice is not entirely clear, nor is it entirely convincing where it is clear. (...) Still, I do not think Mill's views on Justice have been given their due. In this essay, I shall try to show that Mill anticipated recently defended principles that rely on appeal to a notion of fairness or fair play, and that these can be given a utilitarian foundation. The preceding paper described how all-pervasive was the influence that Paracelsus designated ‘astral’. In what sense, then, is it true that he placed restrictions, on astrological powers? The restriction applies to the more limited and usual sense of astrology, referring to the control of events on earth by the stars in the sky. Paracelsus was not prepared to hand over our fates entirely to a distant autocracy of the stars quite beyond our control.

This article explores the relationship between utility and justice in the ancient Epicurean tradition, and as it developed in the seventeenth and eighteenth centuries following the revival of Epicureanism in the writings of Pierre Gassendi. It focuses on the significance of various allusions to a line from Horace, 'utilitas, justi prope mater et aequi' , which appeared in writings of Hugo Grotius, David Hume, and Jeremy Bentham, and was used to give utility a prominence in modern thought that it had (...) not hitherto received. The article attempts to provide the context for Hume's belief in the Enquiry concerning the Principles of Morals that the foundation of justice was utility and for Bentham placing utility at the foundation of his system.
