This article describes and proposes the “environmental subsidiarity principle” as a guiding ethical value in forestry governance. Different trends in environmental management such as local participation, decentralization or global governance have emerged in the last two decades at the global, national and local level. This article suggests that the conscious or unconscious application of subsidiarity has been the ruling principle that has allocated the level at which tasks have been assigned to different agents. Based on this (...) hypothesis this paper describes the principle of subsidiarity and its application to environmental policies within forest governance and proposes the “environmental subsidiarity” principle as a critical conceptual tool for sustainable resource management. The paper explains as an example how “environmental subsidiarity” is the key principle that can link payment for ecosystem services (PES) with environmental public policies and applies this principle with all its political consequences to reducing emissions from deforestation and forest degradation, and enhancing forest carbon stocks in developing countries (REDD+) architecture. It concludes by showing how the adoption of “environmental subsidiarity” as a ethical principle could help to maximize benefits to all stakeholders involved in PES schemes such as REDD+. (shrink)

Ethical reasoning of all types is anthropocentric, in that it is addressed to agents, but anthropocentric starting points vary in the preference they accord the human species. Realist claims about environmental values, utilitarian reasoning and rights-based reasoning all have difficulties in according ethical concern to certain all aspects of natural world. Obligation-based reasoning can provide quite strong if incomplete reasons to protect the natural world, including individual non-human animals. Contemporary architecture is increasingly grounded in science and mathematics. Architectural discourse has shifted radically from the sometimes disorienting Derridean deconstruction, to engaging scientific terms such as fractals, chaos, complexity, nonlinearity, and evolving systems. That's where the architectural action is -- at least for cutting-edge architects and thinkers -- and every practicing architect and student needs to become conversant with these terms and know what they mean. Unfortunately, the vast majority of architecture faculty are unprepared to explain them to students, not (...) having had a scientific education themselves. Here is an architecture book by an architect/scientist, just in time to help architects in the new millennium. Alexander discusses many of the scientific terms arising in cutting-edge architecture, and explains them to those who don't have scientific training or advanced mathematical knowledge. We find discussions of the evolution of forms; the importance of process in design; iteration; genetic algorithms; sequences of transformations; different levels of scale (i.e. fractals); etc. They are explained here by an architect who is also a scientist, because he wants to change the way architects think and build. Alexander is not merely popularizing other scientists' results and making them accessible to architects: he is in fact presenting new and original scientific work that ties many of these concepts together in a way that will be useful to architects. Recent discussion on Corporate Social Responsibility (CSR) mainly focuses on two aspects of CSR: from a technical perspective, CSR aims to improve ethical standards in the organizational decision-making process, and should guarantee that management practices are in accordance with commonly accepted standards of behavior. From a political perspective, CSR describes corporate engagement with ecological and social issues that extend beyond the firm's economic activities. The latter perspective in particular leaves unclear whether such corporate contributions to solve environmental and societal (...) problems should be seen as voluntary additional services or whether corporations bear specific duties in this field.Based on the tenet of subsidiarity derived from Catholic thought, this article emphasizes that the common interpretation of CSR should be extended by a third perspective that addresses corporations as intermediate actors bearing specific subsidiary co-responsibilities in society. The theoretical overview of Ukrainian scientist's papers related administrative concepts of ecological and economic development was made. The essence of state regulation of ecological and economic development was formulated. The principles of state regulation of ecological and economic development were described and its objectives in terms of relevance to national conditions were determined. Principles of state regulation of ecological and economic development were separated into three groups. The first group are fundamental principles of state regulation: integrity, consistency, commitment, flexibility, consistency, (...) scientific, transparent. The second group are principles of efficiency regulation of ecological and economic development: objectivity, sustainability, effectiveness, predictability, motivation, responsibility, innovation. The third group are principles reflecting the need to consolidate efforts to regulate the environmental and economic development: subsidiarity, refund damages the environment, environmental orientation, integration. The main objectives of state regulation of environmental and economic development in terms of relevance to Ukrainian conditions were identified. In 2007, then Australian Prime Minister Howard said of the Murray-Darling Basin’s rivers that action was required to end the ‘The tyranny of incrementalism and the lowest common denominator’ governance to prevent ‘economic and environmental decline’. This paper explores the management of these rivers as an epicentre for three key debates for the future of Australia. Information on biodiversity, analyses of the socio-ecological system, and climate change projections are presented to illustrate the disjunction between trends in environmental health (...) and the institutions established to manage the Basin sustainably. Three key debates are considered: conflict over the allocation of water between irrigated agriculture versus a range of other ecosystem services as the latest manifestation of the debate between adherents of the pioneering myth versus advocates of limits to growth in Australia; cyclical crises as a driver of reactive policy reform and the prospects of the 2008 Water Act forming the basis of proactive, adaptive management of emerging threats and opportunities; and subsidiarity in governance of the environment and natural resources in the Australian federation. Implementation of the 2012 Basin Plan as promised by the Federal Government ‘in full and on time’ is a key sustainability test for Australia. Despite Australian claims of exceptionalism, the Murray-Darling Basin experience mirrors the challenges faced in managing rivers sustainably and across governance scales in federations around the world. Empirical evidence of our changing climate is frequently interpreted through the lens of either optimism or pessimism. In tandem with this, ethical responses can oscillate from myopic ‘business as usual’ to misanthropic ‘lifeboat ethics’. In this paper I argue that these are inadequate and unworthy positions from which to begin in Christian ethics. The question of sharing the burdens of climate-change mitigation and adaptation is the crucial task facing the world community. The development of the burden-sharing rules—sector based as well (...) as country based—since the Kyoto agreement will be evaluated from the perspective of three theological ethical principles: justice, solidarity and subsidiarity. Lastly I suggest that creation serves as a ground for developing shared perspectives in the ethics of environmental questions in the context of intercultural and interfaith dialogue. (shrink)

This reflection builds on a triple agenda: challenges, warnings, and guidance. The challenge agenda deals with upcoming scientific and biotechnological developments, adjustments to work and study, sustainable development reorientation, and changes in businesses and (...) entertainment companies. These challenges could be summarized as development paradigm shifts. The warning agenda includes the management of wild species, mistrust in political leaders, unsupportive and criminal human behavior, information overabundance, the emulation of pharmaceutical industries, and the determining factors of the culture of death. These warnings could be condensed in the importance of promoting the culture of life. The guidance agenda comprises a series of principles such as the human person’s dignity, the common good, the preferential option for the poor, the universal allocation of goods, solidarity, subsidiarity, and the care for our common home. This guidance points to a fundamental and existential environmental transformation. This argument does not mark Sniegocki’s text as particularly (...) original. However, the dialogue that he constructs between Catholic social teaching (CST) and three schools of thought on development, which he describes as “neoconservative,” “radical,” and “grassroots” views, provides a compelling argument for new directions for both CST and economic globalization.Sniegocki’s book begins with three chapters that provide an overview of development theory (beginning with calls for “modernization” of the “Third World” beginning in the 1950s), examine failures of this theory in practice, and discuss the growth of CST concerning development. While these chapters provide important groundwork for understanding the context of Sniegocki’s argument, the heart of the argument comes in the fourth chapter, where he places CST in dialogue with neoconservative and radical approaches to development (represented, respectively, by Michael Novak [End Page 209] and Mary Hobgood). Neoconservatism is clearly incompatible with CST, as any denial of structural inequality or whole-hearted embrace of capitalism— even “democratic capitalism”—would be. However, radical approaches maintain that CST does not sever itself completely from the economic liberalism that underlies neoconservatism. As a result, even when CST recognizes the pitfalls of capitalism and the realities of structural injustice, it still often resorts to liberal assumptions. Radicals maintain that if CST were more consistent, it would more adamantly call for social struggle resulting in “democratic socialism.”Sniegocki finds resources for CST in radicalism but also introduces a third perspective from grassroots critics of development, exemplified by Vandana Shiva. These critics question whether “development equals Westernization via industrialization” (242, quoting Herb Addo), as maintained by both neoconservatives and radicals; they instead call for revitalization of local economies and traditional cultures. Sniegocki concludes that this vision could enhance CST in several ways: resolving the tension in CST between modernization and respect for local cultures, improving its framework for understanding ecological issues, encouraging recognition of grassroots action and social struggle for change, and attending to the role of women in economic and social processes. In the two concluding chapters, Sniegocki proposes that radical and grassroots perspectives together provide a basis for critiquing neoconservatism and improving CST.At least two issues deserve more attention in Sniegocki’s text. First, the principle of subsidiarity, “which asserts that issues should be dealt with at the most decentralized level appropriate to the issue at hand” (121), would seem to offer a strong grounding in CST for many grassroots arguments, yet Sniegocki gives this principle little attention. Second, Sniegocki criticizes the decision-making practices within many international development organizations, such as the International Monetary Fund (IMF), the World Bank (WB), and the World Trade Organization (WTO), for suppressing democratic participation. In many ways, this critique could also be leveled against the Roman Catholic hierarchy. Could deficiencies of CST concerning development be an outgrowth of the decision-making practices of the hierarchy, just as problems with IMF, WB, and WTO policies are an outgrowth of their decision-making practices? Sniegocki seems to recognize this possibility in a single sentence: “The resurgence within the Catholic Church in recent years of more top-down, centralized, and secretive ecclesiastical practices, while the church at the same time recommends to the broader world the importance of grassroots participation, dialogue, and human rights, makes ongoing attention to these issues especially urgent” (331). The philosophical origins of the principle of subsidiarity must be understood historically. This chapter argues that the critical point for the emergence of the principle lay in Thomas Aquinas’s theological interpretation of Aristotle’s political philosophy and his application of it to the institutional pluralism of medieval Europe. From Aristotle, Aquinas developed the idea that human societies naturally progress from families, through villages to entire city-states, but he recognised that what Aristotle said of city-states could be applied not only to (...) cities but even more emphatically to political communities on the scale of provinces, kingdoms and empires. Moreover, for Aquinas, the civil order was not the only ‘perfect community’ in Aristotle’s sense: there was also the church in all of its many grades and jurisdictions, alongside the many different religious orders and fraternities of medieval Europe, some of them also organised into their own graded hierarchies. Reflecting on the complexity of the society surrounding him, Aquinas acknowledged the many and various purposes for which various associations and forms of human community exist and are formed, giving rise to a whole host of familial, geographical, professional, mercantile, scholarly and other specialised societies. All of these groups and groupings, from the smallest to the largest, have their place and their proper function, according to Aquinas, and each should to be allowed to make its unique and special contribution as a means to integral human fulfillment, without undue interference from any others, including the state. The Fourth Industrial Revolution based on digitalization, the development of AI, robotics, big data, and increasing automation is dredging up older debates on the end of human work. This article contributes to this debate arguing that these changing circumstances represent an opportunity to advance a renewed consideration of human work. By emphasizing its most distinctively human dimensions, including gratuitousness, relationality, and meaningfulness, we propose the articulation of a social model that recognizes relational goods as a specific contribution of human work (...) in an attempt to overcome the state and the market's monopoly of public life built around the dichotomy between the private and the public. Such a social model is based on the concept of circular subsidiarity, which represents a departure from traditional notions of subsidiarity by promoting a dynamic and reciprocal interplay between three essential societal spheres: the state, the market, and organized civil society, all of which have their role to fulfill by providing security, efficiency, and relational goods. Ultimately, this article suggests that circular subsidiarity can lead to a more inclusive and equitable social model by acknowledging how relational goods not only humanize civil society but also sustain the functioning of both the market and the state. Every country must allocate final decision-making authority over different issues/subjects within its boundaries. Historically, many scholars working on this topic implicitly assumed that identifying the features providing entities with justified claims for authority and the entities possessing those features would also identify which groups should have which powers (or vice versa). However, many candidate allocative principles select multiple entities as candidates for some sub-state authority and yet fail to explain which powers each should possess. Further work must explain which groups (...) should possess which powers when and what to do when two groups can make equally-valid authority claims using the same principle. Subsidiarity, the principle under which authority should presumptively belong to the entity representing those ‘most affected’ by its exercise and capable of addressing underlying problems, is one of the few principles focused on identifying which groups should have which powers. Unfortunately, subsidiarity alone does not provide guidance on many issues/subjects. Useful subsidiarity-related guidance relies on balancing underlying justificatory interests, which do the real allocative work. Another allocative principle remains necessary. A deflationary account of subsidiarity’s allocative potential nonetheless provides insights into how to articulate a new principle and accounts of subsidiarity that can fulfill other moral roles. But it excludes any general policy or aim of assuming the control or managerial direction of lower groups. Its deepest rationale is the intrinsic desirability of (...) self-direction, a good that is to be favored and respected even at the expense of some efficiency in the pursuit of other goods. Though arising out of Aristotelean moral and political theory, it denies or strongly disambiguates a cardinal principle of Aristotelean political theory. Is it a democratic commonwealth, and can it be? Is there sufficiently a demos or ‘people’ for democracy to be possible? If not democratic, what is it? Monarchy, (...) oligarchy, or democracy, or a ‘mixed constitution’? Argued: there is a mixed constitution containing a reasonable element of democratic rule. The value of democracy is then explored in terms of individualistic versus holistic evaluation and instrumental versus intrinsic value. Subsidiarity can be considered in a similar light, suggestively in terms of forms of democracy appropriate to different levels of self-government. It has always been the fate of centrally important concepts in public debate to be used promiscuously. ‘Democracy’, for instance, has long been assigned multiple contested meanings; its meaning is univocal only in the minds of passionate advocates of a single political project seeking to monopolize usage of the term, whether Liberals or Leninists. Theorists tend to worry about this conceptual promiscuity more than practitioners, who, firing off loaded concepts in the heat of political battle, are impatient of reminders that, (...) perhaps, this or that concept is not being consistently used as originally intended. “No matter,” says the busy practitioner, “it is doing the job I currently intend.” This reply is often justified: scholarly intrusions into public debate are sometimes appropriately dubbed ‘academic’ . However, when rhetorical skirmishes cease and a concept gets to be embedded in public policy or legislation, clarity is indispensable.This, of course, summarizes the recent career of the concept of ‘subsidiarity’, which has been nominated as possibly ‘the most contentious abstract noun to have entered European politics since 1789’ . Advocates of both centralization and decentralization currently invoke it with the same firmness of conviction. Its inclusion in the Maastricht Treaty, far from having generated clear guidelines on how to determine the proper balance between European and national competences, has only served to highlight the competing interpretations which it can, apparently, bear. ‘Subsidiarity’ is suffering from a ‘clarity deficit’ which needs remedying. My aim in what follows is to contribute to that process of clarification and to suggest ways in which the concept might be critically developed.First, I attempt to retrieve the original meaning of subsidiarity and exhibit its intrinsic relationships to related concepts of community and the common good. I seek to show that subsidiarity is only one aspect of a broader theory, rooted in Catholic social thought, of the proper relationship between persons and communities. Subsidiarity takes its meaning from an elaborate social theory which is personalist, pluralist and communitarian. Charges of vacuity against subsidiarity are only to be expected when the concept is treated in isolation from this background theory. Second, I identify and attempt to remedy certain deficiencies of the concept by critically elaborating what I take to be its central intent. In a brief conclusion, I indicate the need to bring the concept into dialogue with alternative models of the person-community relationship. (shrink)

The paper starts with a case study of a medium-sized company in which a strong and successful change in the organisational form and job design took place. A bureaucratic organisation with highly-specialised jobs was converted into a new organisation in which employees became much more autonomous in managing their own work. This not only entailed new techniques and managerial systems but also a new anthropological vision. Bureaucratic rules were reduced, but not eliminated completely, and management became less authoritarian. Employees could (...) therefore apply greater entrepreneurial spirit, developing their talents in pursuit of the company’s common goals. It is argued that this new organisational form is ethically superior to the old, and reflects the basic requirements of the principle of subsidiarity. The ethical principle of subsidiarity holds that a larger and higher-ranking body should not exercise functions which could be efficiently carried out by a smaller and lesser body; rather the former should support the latter by aiding it in the coordination of its activities with those of the greater community. While the principle has usually been applied in a political context, this paper explores the principle as a moral base for organisational forms within business organisations. Finally, the principle of subsidiarity is analysed in the context of business organisations and proposed as an ethical guideline for organisational forms. This would help to mitigate the effects of those bureaucracies in which individuals, with their dignity, freedom, diversity and capacity for undertaking business activities with entrepreneurial spirit, are often not fully appreciated. Subsidiarity is a key term in the development of the European Union. The word itself was unknown in the English language until recently when it was first used and immediately became a key concept in the European political discussion. Since then, everyone is using it according to their own interpretation and purpose. From the extreme left to the extreme right, from the Euro-sceptics to the Euro-enthusiasts, the term is used to justify contradictory points of view.Is it because its meaning (...) is so vague that anyone can use it at will? Is it because this concept, which seems at first hand to be so clear, does not mean anything and is useless in rethinking the renewal of social organization? The European purpose in introducing the subsidiarity principle was to give a place to intermediary communities, but the whole ambiguity of the concept is related to the comprehension of what is called a community. This in its turn is related to the view one has of what a human being is, and of the importance of his relationship with others for the constitution of his identity.If a community is part of the human identity, this has a deep influence on the understanding of what a community is, and the consequences of the principle of subsidiarity point towards much more than a mere principle of political federalism. The recent global increase in environmental regulation does not necessarily signal improvement in firms’ ecological imprints. Like many markets, the Arab world is struggling to implement environmental compliance measures among local firms. For Arab countries, the reliance solely on formal policies to improve local firms’ ecological footprints may be risky given the evident institutional challenges to enforce environmental regulations, specially post the Arab Spring. Drawing from the literature highlighting the merits of combining formal and informal controls to (...) ensure successful implementation of a strategy, we argue that the emphasis for regulation must be accompanied by an emphasis for developing environmental ethics of individuals, who are the expected implementers of any environmental policy. In that light, we propose that the Eco-Islam phenomenon can serve as an influential and effective foundation for building organizational cultures with stronger environmental ethics among local small and medium enterprises. We explain the underlying maxims of Eco-Islam then conduct qualitative research among experts preaching or practicing the concept to gain better insights into the potential of leveraging it in Muslim-majority Arab countries. Finally, we conclude with insightful implications for local SMEs in the region. (shrink)

The right to ‘domestic remedies’, which ideally connects ‘subsidiarity’ and ‘embeddedness’ of the ECHR in the legal systems of member States, is deemed to play a crucial role for the Strasbourg machinery survival as well as for an effective protection of human rights, especially in the field of the ‘reasonable-time’ requirement. In this respect the Italian case seems an excellent test. Once a compensatory remedy was introduced in the Italian legal system by Law No. 80 of 2001 (the ‘Pinto (...) Act’), it soon appeared that such a remedy could be considered ‘effective’ in so far as it was implemented in accordance with the ECtHR’s jurisprudence. Therefore a legal tool for the interaction between ECtHR and Italian courts had to be found. Nevertheless, the results of this interaction might suggest that the domestic remedy has neither increased the protection of the reasonable-time requirement in Italy nor is it the final solution to the ECtHR’s overload. Subsidiarity is often implicitly conceived as an organizational model or a Weberian ideal type. The purpose of this paper is to show that, in contrast, subsidiarity is a principle in the sense of the tradition originating from Thomas Aquinas. Considered as an ideal type, subsidiarity may be perceived as impossible to apply because of its ideal status, abstracted from the circumstances. Here, we will demonstrate the consequences of the fact that subsidiarity is one of the common (...) principles of practical moral reasoning of particular prudence. Because it is a principle, subsidiarity does not have a visualizable substance or prescribe an organizational model, unlike the ideal type. It thus avoids the indiscriminate application of organizational models to contexts that are not appropriate, and in the context of tension between external consultants and managers, it rehabilitates the prudence of leaders who know the circumstances of their organization. Environmental ethicists have been arguing for decades that swift action to protect our natural environment is morally paramount, and that our concern for the environment should go beyond its importance for human welfare. It might be thought that the widespread acceptance of moral anti-realism would undermine the aims of environmental ethicists. One reason is that recent empirical studies purport to show that moral realists are more likely to act on the basis of their ethical convictions than anti-realists. In (...) addition, it is sometimes argued that only moral realists can countenance the claim that nature is intrinsically valuable. Against this, we argue that the acceptance of moral anti-realism is no threat to the environmentalist cause. We argue, further, that the acceptance of moral realism is potentially an obstacle to delivering on a third core environmental ethicist demand: namely, that successful action on climate change and environmental destruction requires us to change some of our commonly-held ethical views and to achieve a workable consensus. This article closely examines the way in which Thomas Aquinas understood the relationship between the various forms of human community. The article focuses on Aquinas's theory of law and politics and, in particular, on his use of political categories, such as city, province and empire, together with the associated concepts of kingdom and nation, as well as various social groupings, such as household, clan and village, alongside of the distinctly ecclesiastical categories of parish, diocese and universal church. The analysis of (...) these categories is used in the article to help explain Aquinas's role in the development of theories about subsidiarity, federalism and mixed constitutionalism. In the first place, it is argued that a close inquiry into Aquinas's discussion of the many and various forms of human community sheds light on the origins and development of the idea of subsidiarity within Catholic social teaching. Second, while Aquinas certainly did not advance a theory of federalism as that idea is presently understood, it is argued that recovering what Aquinas had to say about the categories of human community helps us to understand the origin and later development of federal ideas. Finally, it is argued that far from endorsing a system of absolute monarchy as is sometimes alleged, when understood in this way, Aquinas supported a particular kind of mixed constitution in which monarchy is tempered by a variety of constitutional constraints founded upon a conception of the body politic as itself constructed out of a plurality of smaller, intermediate corporations and communities of a political, ecclesiastical and social character.
