Si l'idée du suicide représente un important sas de liberté pour l'existant, la pensée tragique ne prône pourtant pas le passage à l'acte, celui-ci constituant, au fond, une tentative de neutralisation de la mort, plutôt qu'un véritable affrontement de notre finitude. Elle ne s'inscrit pas, non plus, dans la perspective de la foi religieuse, y discernant, quelle que puisse être la profondeur de son inspiration, une façon d'éluder l'impact de notre mortalité intime et la dureté de notre présence au monde. Five years ago, an article co-written by two of us (Joly and Simard) presented an emerging trend to disclose certain individual genetic results to research participants. Since then, both technologies and research practices have evolved significantly. Given this rapid evolution, our goal is to provide updated and thorough guidance on this issue. Our paper begins by identifying the ethical principles that support the return of results: justice, beneficence, and respect for persons. Then, it presents the results of an analysis of (...) international norms on the return of results, covering both general and individual research results. It reveals existing divergence and consensus on these topics within the international community. With the goal of promoting greater harmonization, we conclude by proposing a flexible framework for the return of individual research results. (shrink)

At the time, ethical norms and scholarly publications on the return of results often did not distinguish between the return of research results in general and the return of unexpected results. Both technologies and research practices have evolved significantly. Today whole genome and exome sequencing are increasingly affordable and frequently used in genetic (...) research. Because these techniques produce a vast amount of interpretable and non-interpretable data about an individual, the issue of how to manage information generated by such technologies needs to be considered. However, the development of international ethical guidelines has not kept up with the rapid pace of technological progress. Indeed developments in genomic biobanking also challenge the duty to disclose research results. (shrink)

We study a class of representation mechanisms, based on reports made by a random subset of agents, called representatives, in a collective choice problem with quasi-linear utilities. We do not assume the existence of a common prior probability describing the distribution of preference types. In addition, there is no benevolent planner. Decisions will be carried out by an individual who cannot be assumed impartial, a self-interested executive. These assumptions impose new constraints on Mechanism Design. A robust mechanism is defined as (...) maximizing expected welfare under a vague prior probability distribution, and over a set of mechanisms which is at the same time immune from opportunistic manipulations by the executive, and compatible with truthful revelation of preferences by representatives. In this paper, we provide an analysis about the relationship between expert and pragmatic categories used to name and categorize social space, from the point of view of the social hierarchies that structure it. Taking the case of Chile, and applying an experimental simulation methodology, we seek to contribute to the epistemological debate about the representations that individuals elaborate about social space, from a cognitive and interactionist perspective of everyday life. We analyse in particular the scope of the concept of (...) social class as an element of expert description of social reality, but also as a categorization used by ordinary subjects. We argue that although classifications used by ordinary people to describe members of society are not consistent with the most common academic class schemes, they nevertheless share the same logic and ranking system, adding evaluative and normative elements to the cognitive distinction, in the social construction of reality. En este artículo, presentamos un análisis acerca de la relación entre categorías expertas y categorías pragmáticas usadas para nombrar y categorizar el espacio social, desde el punto de vista de las jerarquías sociales que lo estructuran. Tomando el caso de Chile y aplicando una metodología experimental de simulación, aportamos al debate epistemológico acerca de las representaciones que los sujetos sociales elaboran acerca del espacio social, desde una perspectiva cognitiva e interaccionista situada en la vida cotidiana de las personas. Analizamos en especial el alcance del concepto de clase social en cuanto elemento de descripción experta de la realidad social, contrastándolo con la categorización de la misma de parte de sujetos comunes y corrientes. Postulamos que si bien las clasificaciones que ocupan las personas comunes y corrientes para describir a los integrantes de la sociedad no se condicen con las clasificaciones académicas más comunes, comparten sin embargo las mismas lógicas clasificatorias de jerarquización y ordenamiento, agregándose a la distinción cognitiva elementos normativos que aportan a la construcción social de la realidad. L’association Alter Natives a voulu mobiliser autour des enjeux de la restitution d’objets africains des personnes peu enclines à fréquenter les musées qui les conservent. L’expérience se nomme Zone de contact/Objets d’ailleurs. Il s’agit pour des jeunes franciliens d’entrer dans les réserves des musées, de choisir certains objets d’origine non européenne, d’enquêter sur leur biographie pour savoir d’où ils viennent et d’être en mesure d’expliquer leur parcours au reste de la population. Dans ce projet de long terme, ancré sur des (...) territoires divers, la restitution des objets mal acquis n’est donc pas le mobile principal. Ces actions permettent de tester des outils pour établir un autre type de rapport aux savoirs et développer une relation directe avec les populations dont sont issues ces objets, dans leurs pays d’origine, d’Afrique essentiellement. As a graduate student, years before I met David Lieberman, I had read _ The Province of Legislation Determined. _ I was immediately taken by the breath of his knowledge and the lack of affectation of his style. These qualities struck me again when I met him in person at several ISUS conferences, including the one he hosted so wonderfully in UC Berkeley in 2008. Generosity is a rare quality in academia. David’s friendship and the interest he displayed in the (...) work of others gave me confidence, as I know it did for many younger scholars. From the seminal distinction he introduced between the ‘historical Bentham’ and the ‘authenticity Bentham’ to his stimulating re-reading of Bentham’s later constitutional theory, his articles were always illuminating and challenging. This is the first volume of a two-volume project whose aim is to publish all the known Middle English manuscript translations of the French Somme le mi, a thirteenth-century manual of religious instruction offering teaching on the Decalogue, the seven deadly sins and their remedies, compiled by the Dominican friar Laurent of Orleans. The project extends and deepens our knowledge of the influence of this popular French text, known today only from the versions entitled The Ayen bite of Inwit and (...) The Book of Vices and Virtues, published in 1866 and 1942, respectively. This volume presents the versions extant in BL MSS Royal 18. A. x and Add. 37677; the second will cover the versions in Cambridge, Corpus Christi College, MS 494, Oxford, Bodleian Library, MS Ashmole 1286, and Oxford, Bodleian Library, MS e Musaeo 23. The texts of both volumes have been prepared with the help of the recently-published edition of the French text, a circumstance from which the earlier English editions were unable to benefit. It is likely that the versions edited here for the first time will make a considerable contribution to our understanding of the processes of textual transmission and to that of translation itself in English literary circles of the fifteenth century. En este artículo, sobre la base de evidencia empírica cualitativa acerca de las clases medias en Chile, analizamos el enfoque pesimista de Richard Sennett sobre el futuro de lo público. Mediante nuestra investigación reciente, proponemos tres claves interpretativas – la intermitencia del paso de lo público a lo privado, las tensiones que se generan entre ambos y finalmente la demanda por autenticidad como forma de apelar a lo público – para entender la articulación entre los espacios públicos y privados en (...) la vida cotidiana. Si bien encontramos evidencia para respaldar las ideas de Sennett sobre la predominancia de lo privado por sobre lo público, vemos que la historia reciente de Chile también ha obligado a los individuos y las familias a hacerse cargo de lo público, desde lo privado. Demenageries, Thinking (of) Animals after Derrida is a collection of essays on animality following Jacques Derrida's work. The Western philosophical tradition separated animals from men by excluding the former from everything that was considered “proper to man”: laughing, suffering, mourning, and above all, thinking. The “animal” has traditionally been considered the absolute Other of humans. This radical otherness has served as the rationale for the domination, exploitation and slaughter of animals. What Derrida called “la pensée de l'animal” (which means both (...) thinking concerning the animal and “animal thinking”) may help us understand differently such apparently human features as language, thought and writing. It may also help us think anew about such highly philosophical concerns as differences, otherness, the end(s) of history and the world at large. Thanks to the ethical and epistemological crisis of Western humanism, “animality” has become an almost fashionable topic. However,Demenageries is the first collection to take Derrida's thinking on animal thinking as a starting point, a way of reflecting not only on animals but starting from them, in order to address a variety of issues from a vast range of theoretical perspectives: philosophy, literature, cultural theory, anthropology, ethics, politics, religion, feminism, postcolonialism and, of course, posthumanism. Paying more attention to the rhetorical side of argumentation raises epistemological questions. In this article I argue that rhetoric has to be an integral part of argumentative models if such models are to be considered rational. In other words, I claim that rhetoric is a necessary condition for argumentation studies. I am aware that this view may appear provocative. I hope to show that it is not the case, if we consider rationality to be a concept that encompasses more than (...) just a strictly logical way of thinking. Indeed, I would like to defend a humanistic conception of rationality as the background for a theory of rhetoric in order to underscore the specific rationality of the humanist frame of thinking for a .. Sponges are important but often‐neglected organisms. The absence of classical animal traits (nerves, digestive tract, and muscles) makes sponges challenging for non‐specialists to work with and has delayed getting high quality genomic data compared to other invertebrates. Yet analyses of sponge genomes and transcriptomes currently available have radically changed our understanding of animal evolution. Sponges are of prime evolutionary importance as one of the best candidates to form the sister group of all other animals, and genomic data are essential to (...) understand the mechanisms that control animal evolution and diversity. Here we review the most significant outcomes of current genomic and transcriptomic analyses of sponges, and discuss limitations and future directions of sponge transcriptomic and genomic studies. Un spectre hante l'Université française : celui de la déconstruction. Créé par Jacques Derrida à la fin des années 1960, ce concept est devenu, dans l'esprit des réactionnaires de tout poil, le mot-valise désignant tout ce qu'ils haïssent dans la pensée, lorsque celle-ci cherche à émanciper davantage qu'à ordonner. Dégénérescence de la culture, mépris pour les grandes œuvres, délire interprétatif, amphigouri linguistique, danger politique, confusion sexuelle, licence morale : à en croire les ennemis de la déconstruction, tout ce qui va' (...) mal dans le monde lui est imputable. Que signifie la fixation frénétique d'une frange d'intellectuels sur tout ce qui peut ressembler à une pensée différente, inventive et fondamentalement démocratique? Formal approaches that aim at representing human reasoning should be evaluated based on how humans actually reason. One way of doing so is to investigate whether psychological findings of human reasoning patterns are represented in the theoretical model. The computational logic approach discussed here is the so-called weak completion semantics which is based on the three-valued ᴌukasiewicz logic. We explain how this approach adequately models Byrne’s suppression task, a psychological study where the experimental results show that participants’ conclusions systematically deviate (...) from the classical logically correct answers. As weak completion semantics is a novel technique in the field of computational logic, it is important to examine how it corresponds to other already established non-monotonic approaches. For this purpose we investigate the relation of weak completion with respect to completion and three-valued stable model semantics. In particular, we show that well-founded semantics, a widely accepted approach in the field of non-monotonic reasoning, corresponds to weak completion semantics for a specific class of modified programs. Ένας αρχαϊκός θησαυρός στο ιερό του Απόλλωνα (Θησαυρός 5): αρχιτεκτονική μελέτη Στο άρθρο αυτό παρουσιάζεται η αρχιτεκτονική μελέτη ενός από τα αρχαιότερα κτίρια του ιερού του Απόλλωνα στη Δήλο, του Θησαυρού 5. Ο θησαυρός βρίσκεται στα βόρεια του ιερού του Απόλλωνα και είναι το δυτικότερο από τα πέντε μνημεία που οικοδομήθηκαν γύρω από τον Πώρινο ναό. Η μελέτη ξεκινά με την παρουσίαση των κτιρίων αυτών, που θεωρούνται ως οίκοι. Το δεύτερο κεφάλαιο είναι αφιερωμένο στο αρχαιότερο από τα κτίρια αυτά, το (...) Θησαυρό 5 αναφέρονται επίσης οι προηγούμενες μελέτες για το μνημείο αυτό. Εξετάζεται ιδιαιτέρως και απορρίπτεται, η υπόθεση του R. Vallois για την ύπαρξη μιας κλασικής φάσης του Θησαυρού 5. Στο τρίτο κεφάλαιο προτείνεται η αποκατάσταση της αρχικής φάσης του δωρικού αυτού κτιρίου, το οποίο χρονολογείται γύρω στο 550 π. Χ. με βάση την τεχνική κατασκευής των θεμελίων και το στυλ του κίονά του. Το ζήτημα της ταύτισης του κτιρίου και τα κριτήρια χρονολόγησης εκτίθενται στο τελευταίο κεφάλαιο. Στο πρώτο από τα δύο παραρτήματα παρουσιάζονται οι επτά λίθοι που ο R. Vallois είχε προτείνει να αποδοθούν στην κλασική φάση του μνημείου. (shrink)

In this paper, it is argued that the classical rhetorical framework undergoes a transformation because of an important change in Western thought. Following this hypothesis, I analyze a rhetorical notion of “dissuasion” as a rhetorical technique of creating a “general disposition to inaction” in addition to a classical rhetorical notion of “dissuasion” that aims at “refraining from an action”.

According to Perelman (Rhétoriques, Presses Universitaires de Bruxelles, 1989: 80), a pseudo-argument is an argument that is supposed to be convincing from a given audience viewpoint, while it is not from another audience viewpoint. Such a claim raises the traditional problem of the boundaries between the well known “convince versus persuade” dichotomy. This paper aims at investigating it from a contemporary rhetorical and argumentative perspective which will take into account the fictional dimension of persuasion. Inventeur du néologisme « déontologie », le philosophe anglais Jeremy Bentham lui donnait pour but de fixer ce qui doit être sous l'égide du principe de l'utilité, de concilier les intérêts privés et les intérêts publics. Emmanuelle de Champs explore la branche politique de la déontologie benthamienne, l'art du législateur, celui du droit constitutionnel, et la dimension morale de l'utilitarisme, qu'elle juge centrale dans le système philosophique benthamien. Elle montre que la théorie du langage et de la connaissance est (...) une véritable condition de possibilité de la réflexion politique: il s'agit de forger les outils nécessaires à l'élaboration d'une morale de l'action publique. Loin d'être le produit d'une conversion tardive à la démocratie, la réflexion constitutionnelle habite l'œuvre de Bentham dès le début des années 1770. Au cours des années, elle se nourrit des Révolutions américaine et française, de la montée des revendications radicales en Grande-Bretagne, puis des révolutions libérales du sud de l'Europe et d'Amérique latine au début du XIXe siècle. Etudiée dans son contexte, la déontologie politique benthamienne s'inscrit dans un dialogue avec Montesquieu et Blackstone, Burke et Paine, Mill et Macaulay. This study examines to what extent perceived corporate social responsibility reduces employee cynicism, and whether trust plays a mediating role in the relationship between CSR and employee cynicism. Three distinct contributions beyond the existing literature are offered. First, the relationship between perceived CSR and employee cynicism is explored in greater detail than has previously been the case. Second, trust in the company leaders is positioned as a mediator of the relationship between CSR and employee cynicism. Third, we disaggregate the measure (...) of CSR and explore the links between this and with employee cynicism. Our findings illustrate that the four distinct dimensions of CSR of Carroll are indirectly linked to employee cynicism via organizational trust. In general terms, our findings will help company leaders to understand employees’ counterproductive reactions to an organization, the importance of CSR for internal stakeholders, and the need to engage in trust recovery. In Hippias Minor, Plato does not merely condemn Homer as a reference in ethical matters. He opposes two uses of poetry when it comes to referring to and giving meaning to it: poetry as a source of knowledge admitted and frozen by tradition, ethically normative, and poetry as a source of philosophical questions, conducive to ethical reflection. The debate shows that Socrates’ view of Homer, as well as his Homeric point of view, allow us to ask good and often paradoxical (...) questions about the link between truth, falsity, knowledge and calculation, which are essential for those who want to build solid ethics.
