Midway through How to Do Things With Words, J.L. Austin’s announces a “fresh start” in his efforts to characterize the ways in which speech is action, and introduces a new conceptual framework from the one he has been using up to that point. Against a common reading that portrays this move as simply abandoning the framework so far developed, Marina Sbisà contends that the text takes the argumentative form of a proof by contradiction, such that the initial framework plays an (...) instrumental role as part of a proof in favour of the subsequent one. Despite agreeing with Sbisà’s broad instrumentalist approach, we argue that her regimentation of Austin’s narrative into a proof by contradiction ultimately fails - both as a proof and as an interpretation of Austin. Instead, we suggest that a better way of interpreting the peculiar structure of How to Do Things With Words is as a pedagogical exercise whose point is to bring a concealed alternative into view in a manner that also explains its initial concealment, and that this approach provides richer resources for supporting Sbisà’s own conventionalist understanding of illocution than that afforded by reading the text as a proof by contradiction. This article criticizes the recent “aretaic-turn” in legal theory. Within Criminal law theory, the main concern of aretaic theorists is culpability, and their main source of inspiration is Aristotle’s virtue ethics. Too focused on Aristotle’s virtue ethics, however, aretaic theorists fail to consider Aristotle’s views on culpability proper. Aristotle himself did not turn to virtue ethics when he discussed culpability; and thus I suggest that Aristotle himself would have rejected the contemporary aretaic turn. Still, I believe that Aristotle’s work on (...) culpability is important insofar as it laid the foundations of subsequent theories of culpability in most of the non-English-speaking West. Through Aristotle, then, I seek to show the relevance of rich and venerable legal and philosophical traditions for the advancement of our understating of some thorny problems of contemporary criminal law. During the last decade, one source of debate in argumentation theory has been the notion that there are different modes of arguing that need to be distinguished when analyzing and evaluating arguments. Visual argument is often cited as a paradigm example. This paper discusses the ways in which it and modes of arguing that invoke non-verbal sounds, smells, tactile sensations, music and other non-verbal entities may be defined and conceptualized. Though some attempts to construct a ‘multimodal’ theory of argument are (...) criticized, it advocates for an argumentation theory that makes room for visual arguing and for other non-verbal modes that have not been explored in depth. In the process, the paper provides a method for identifying the structure of multimodal arguments and argues that adding modes to our theoretical tool box is an important step toward a comprehensive account of argument. Informal logic is an attempt to develop a logic that can assess and analyze the arguments that occur in natural language discourse. Discussions in the field may address instances of scientific, legal, and other technical forms of reasoning, but the overriding aim has been a comprehensive account of argument that can explain and evaluate the arguments found in discussion, debate and disagreement as they manifest themselves in daily life — in social and political commentary; in news reports and editorials in (...) the mass media ; in advertising and corporate and governmental communications; and in personal exchange. Living well was the best revenge for Leo Stein, the art critic who took to heart Samuel Johnson’s dictum, “Clear your mind of cant.” Leo shared with his sister, Gertrude Stein, the Paris apartment that became a meeting place for the famous. Reflected in Appreciation: Painting, Poetry and Prose are their early years as American expatriates as well as their later estrangement. The present paper elaborates a deductivist account of natural language argu-ment in the context of pragma-dialectics. It reviews earlier debates, criticizes some standard misconceptions in the literature, and argues that the identification and analysis of deductive argument schemes can be the basis of a compelling theory of argumentative discourse.

In the pioneering article and two papers, written jointly with McKinsey, Tarski developed the so-called algebraic and topological frameworks for the Intuitionistic Logic and the Lewis modal system. In this paper, we present an outline of modern systems with a topological tinge. We consider topological interpretation of basic systems GL and G of the provability logic in terms of the Cantor derivative and the Hausdorff residue.

On Tyranny is Leo Strauss’s classic reading of Xenophon’s dialogue Hiero, or Tyrannicus, in which the tyrant Hiero and the poet Simonides discuss the advantages and disadvantages of exercising tyranny. Included are a translation of the dialogue from its original Greek, a critique of Strauss’s commentary by the French philosopher Alexandre Kojève, and the complete correspondence between the two. This revised and expanded edition introduces important corrections throughout and expands Strauss’s restatement of his position in light of Kojève’s commentary to (...) bring it into conformity with the text as it was originally published in France. The appeal of the moral principle according to which we should treat like cases alike is so great that it verges on the axiomatic, or on the platitudinous. Recently, however, the principle has been challenged in deeply interesting ways. These ways are interesting because they do not invite skepticism about morality at large, but about the specific claim that what is good (or bad) for an agent in a given situation must be good (or bad) for any other similarly situated (...) agent. I here assess the post-challenge viability of the principle. In a sense, the principle survives, but this is neither an unqualified victory nor an inspiring result. The examination of these matters contains an important (and under-investigated) lesson about the nature of moral experience. (shrink)

This essay offers a critique of Larry Temkin’s seminal new book, Rethinking the Good, at the heart of which is the highly counterintuitive claim that all things considered judgments are not transitive. I evaluate Temkin’s claims through the lens of social choice theory, pursue some of its larger implications and applications, and conclude with a very general worry having to do with the intimate connection between transitivity and logical consistency, namely whether, if Temkin is right, this would not bring all (...) moral reasoning to an abrupt halt. During the last decades the physico-chemical conception of self-organization of chemical systems has been created. The chemical systems in natural-historical processes do not have any creator: they rise up from irreversible processes by self-organization. The issue of self-organization in physics has led to a new interpretation of the laws of nature. As Ilya Prigogine has shown, they do not express certainties but possibilities and describe a world that must be understood in a historical way. In the new philosophical understanding of (...) nature priority is not ascribed to any single type or level of entity, but to historical processes, to processes of endless generation and change. At the confluence between Modern Olympism and Confucian teachings—nowadays embodied and expressed in East Asian Confucianisms—there are meaningful overlaps, significant challenges, and opportunities. This paper examines these. Despite radically different origins and apparently incommensurate tenets, we should not assume that the underlying ideals of Modern Olympism and East Asian Confucianisms cannot benefit mutually. It is precisely when considering their putative weak points, such as Modern Olympism's soft metaphysics or vague ethics or Confucianism's bias against physical activity or gender, that we (...) find educational opportunities that make contributions to a universal humanistic sport education. A set X of nonnegative integers is computably enumerable (c.e.), also called recursively enumerable (r.e.), if there is a computable method to list its elements. Let ε denote the structure of the computably enumerable sets under inclusion, $\varepsilon = (\{W_e\}_{e\in \omega}, \subseteq)$ . We previously exhibited a first order ε-definable property Q(X) such that Q(X) guarantees that X is not Turing complete (i.e., does not code complete information about c.e. sets). Here we show first that Q(X) implies that X has (...) a certain "slowness" property whereby the elements must enter X slowly (under a certain precise complexity measure of speed of computation) even though X may have high information content. Second we prove that every X with this slowness property is computable in some member of any nontrivial orbit, namely for any noncomputable A ∈ ε there exists B in the orbit of A such that X ≤ T B under relative Turing computability (≤ T ). We produce B using the Δ 0 3 -automorphism method we introduced earlier. (shrink)

In “Image, Evidence, Argument,” Ian Dove defends an intriguing ‘middle ground’ between those who argue that there are “visual arguments” and skeptics who argue that there are not. I discuss one of Dove’s key examples, proposing a different analysis of it, arguing that there are problems with the “verbal repackaging” of the argument he suggests.

We argue that Hilary Putnam's pragmatism provides an epistemological perspective which can help us understand--and can positively inform--the development of informal logic.

We present some results on algebraic and modal analysis of polynomial distortions of the standard provability predicate in Peano Arithmetic PA, and investigate three provability-like modal systems related to the Gödel–Löb modal system GL. We also present a short review of relational and topological semantics for these systems, and describe the dual category of algebraic models of our main modal system.
